It's best for each of you to write your own brief letter, date it,and sign it.

Here's how I wrote it. Let me know what you guys think. Thanks

Dear Sir or Madam:

We, (Petitioner's name) and (Beneficiary's name), do hereby state that we are legally able and willing to marry each other, and we intend to do so within 90 days of (Beneficiary)'s arrival into the US using the K-1 visa. (Little summary on the relationship)

Yours truly,

I personally don't see the purpose to putting it on only one letter instead of two... but if you are going to do it that way, I would make the small adjustments that I bolded in the quote above there. Just a suggestion good.gif

K-1 Fiance(e) Visa Process & ProceduresG325A employment history question
I would go 'for' listing them separately. Even if you do you'll still only have 3 lines to fill, so you won't have to add an attachment.
On mine, I had to add an attachment because I needed ONE MORE LINE just to say I was unemployed in April of 2004.... argh. mad.gif
lol

Either way, there's not much more I can add at this point, other than good luck! And hang in there. We JUST mailed our I-129F package off TODAY, so the waiting now begins.... sigh.

K-1 Fiance(e) Visa Process & ProceduresSkip K1, enter on a tourist visa and Marry?
Good luck, whatever you decide. I had similar questions when I was still trying to understand the process. It can be confusing because some of the things seem like gray areas, and people DO seem to get through the cracks all the time. However, I do strongly recommend you go the legal route. You should be able to visit each other in the mean time, which is very helpful... It's a pain in the @$$, but it will give you peace of mind, and you won't run the risk of deportation or being banned, like people have said can happen. Think of yourself a year or so from now, when you and your future spouse will be together regardless of what route you take. Would you prefer to know that you have done things the legal way, or would you want to feel like you somewhat cheated and scammed the system and worried constantly over getting caught? Just a thought.

K-1 Fiance(e) Visa Process & ProceduresG325
I have a question on the G-385A as well and figured I'd tack it on here. It's more like something I wanted to point out.

In the example below the employment for last five years there is "Show below last occupation abroad if not shown above. (Include all information requested above.)"
In the example, the occupations are indeed NOT shown above, as it's an example/explanation of how to fill out that part if you need an attachment. My occupations are not listed on the form either because I've had enough jobs that I need to attach a separate sheet to list my employment history. So, should I put the information for just my last (current) job there, since that IS what it's requesting? I did anyways, because that's what it's asking for, but the example could lead to some confusion since it's left blank. Just wanted to bring that to someone's attention if it hadn't been already smile.gif I did do a search, but didn't come up with that one, probably because it only applies to people like me that need a separate sheet. lol

Which is another thing actually... should I put ALL my employment history on the separate sheet, or should I use the first 4 lines to write the recent employers, and then the last line to say 'see attached for further employment history', or something and then do only the older ones on the separate sheet. If that makes sense. Which would be better? Right now I only wrote 'please see attached for employment history' there and then put ALL the employers listed in a chart on a separate sheet. Just want to make sure that would be ok.

Please let me know if I should put this on 'site related discussion'.

Do be very careful about your non-legal ceremony. I would not include any photos or information about this ceremony...especially if you have plenty of on-going proof already. Wear no rings and do not speak about each other as 'husband/wife'. Although some people do this with no problems, we have had lots of horror stories here on VJ when couples have tried this as well.

What about engagement ring?

thats fine, if it has a huge diamond on it then don't include it because it will look like a wedding ring.... try to keep things as simple as possible,

I am not sure what you mean. Unless I've messed up, my engagement ring that I've purchased for my fiancee was a little over 1kt. I thought the engagement ring is the one with the bigger diamond?!?!

Unless I am mistaken, wedding ring/band usually are less expensive than the engagement ring?!?! If wearing a diamond engagement ring is a no no, then I better tell my fiancee before the interview.

Thanks in advance!

I agree...I always thought the engagement ring was the one with the big diamond, and the wedding rings are simpler... It may depend on certain traditions/cultures though.. who knows. I'd maybe just specify that it is an engagement ring if they ask.

K-1 Fiance(e) Visa Process & ProceduresVisiting your fiance during the immigration process
I am a Canadian, visiting my US fiance as we speak, so that in itself should tell you that we CAN do it. I had no problems crossing the border, but just in case I DID bring with me a letter from my employer, which they didn't need. I didn't have a lease or anything, given my living situation, so I'm glad they didn't ask for one. They did ask me who I was visiting, where I was going, for how long, where I worked, what I was bringing with me and so on... I was lucky, and all things considered, it was smooth, but it very well could be hard. Just be prepared, honest, stay calm and it will be fine.

Just to clarify what some others have said... as you probably know, Canadians do not need a visitor's visa to come into the US. But we can not stay for longer than 6 months, and can NOT work while we are here (that includes remotely to a Canadian job from the US).

K-1 Fiance(e) Visa Process & ProceduresPassport Control Number?
QUOTE (Destructo Bill @ Feb 18 2009, 12:15 PM) <{POST_SNAPBACK}>
Yep. In a Canadian passport the "Book Number" appears on the third page in the top right hand corner.

Nice username, i'm Denver bound as well good.gif

And by 'top' right, do you mean if you are looking at the passport with your photo facing you? Because if you hold the passport the way the cover is displayed (so it flips left/right like a book instead of top flip), then it's bottom right, vertically... hahah But yeah, it's the number that is right by the bar code, on the Canadian passport. Correct??

K-1 Fiance(e) Visa Process & ProceduresHi! Questions about the initial petition for K-1 visa (I have done my research)
I would double check the instructions regarding the passport photos. From what I recall the ones included with the I129F have to be taken within 30 days. The only way you can really prove that is with an original photo with the stored stamped date on the back. Since you'll have to mail original forms anyways, you might as well go ahead and mail passport photos as well, to be safe. Also, be careful about getting all your pass port photos all at once in the beginning too. Some embassies and medical appointments may require the passport photos to be taken within 3-6 months from what I'm aware of (and yes, this process will take longer than that).

K-1 Fiance(e) Visa Process & ProceduresK-1 estimated timelines
QUOTE (jkminney @ Sep 27 2009, 09:07 PM) <{POST_SNAPBACK}>
I'm reading posts where people are referring to their "estimated timeline". Where are they finding these estimated timelines at? I've seen Igor's overall list that shows how many people have pending applications, I see where people post how far along they've come. But if there is somewhere that gives me an estimated date as to when the NOA2 would come I would LOVE to know where that is! I know everyone is excited about the possibilty of those petitions being processed fairly quickly so without getting too excited I would appreciate knowing where to find it!

Thanks!

You can also click your own timeline... on yours you'll see "Based on timeline data, your I129f may be adjudicated between December 25, 2009 and January 9, 2010*. "

Which is likely to change, but there ya go.

90+ days to be scheduled an interview seems to be the norm right now.

Hey thank you for your reply...one more question :
Can we choose the interview date or does the Consulate decide on that ?

The Consulate decides. We have no say.
And yes, right now it's taking 3+ months to get an interview. As for waiting to send Packet 3, I am not sure, but I'd have a look at your NOA2 expiry as a guide. I have heard that they will extend it automatically, but I wouldn't push my luck. lol Most people try to send it right away.
You can visit after sending packet 3, but as with any other visit, make sure you have sufficient ties to Canada (mortgage, lease, letter from employer, return ticket, etc).

K-1 Fiance(e) Visa Process & ProceduresPhysically putting the package together?
Don't hole punch it. Use LARGE paperclips that go around the whole package, or butterfly clips, like so:
Posted Image

That's probably good enough. They'll take it apart when they get it anyway. We didn't use ACCO Fasteners (I wasn't familiar with them either until I Googled it) and ours was fine. :)

If you label each section as well, that is usually helpful, along with the cover letter to let them know what's included.

Good news from China and my girls today. They got a late September court date (so fast for China!) for the inheritance that the other family is fighting. It's ####### they are fighting my girls for the house and money they are clearly bestowed... those moneygrubbers.
mad.gif mad.gif mad.gif oooooooooooooooo makes me so mad that they are trying to cheat a 12 year old girl (my fiancee's -- and soon to be my-- daughter) out of the house and money her father left her in his will! And that we have to pay so much money for lawyers and things just to get my little girl what is rightfully hers. oooooooooooooooooooo mad.gif mad.gif mad.gif
SENT OFF MORE MONEY TODAY.
Everything will be fine just hang in there, and give them your support. I know how this can be so painful emotionally and financially. I am going through the same process just getting this freakin divorce decree. It turns out that I have to go to India in person and that is the only way I will get it asap. I maybe leaving this weekend and coming back Wednesday. It's urgent I get this document, and SO NOT looking forward to facing my past. It's not financially suitable now, but I have to do this. Anyways, I thought I would share something with you.

Thanks Starlight95. Will you get to see your SO in India? I feel like I am living in a soap opera. Today that family actually told my girl's lawyer that they might try to get custody of my girl's daughter! That's how crazy they are. They have seen her for like 5 hours in her entire life but they want to get custody from the mother who has raised her by herself for 11 of her 12 years!!!! Obviously they know they are not going to win this court battle and they will try anything to get the little girl's money and house. mad.gif Now my ex-wife is taking me to court for 5 years of FUTURE child support because she asserts that I may never come back from China and wants my passport restricted!!!! wacko.gif My girls and I laughed together today about all these crazy people we got involved with in the past.

#######?!?! That's ridiculous.. I encountered a crazy ex situation, which was bad, but not THAT bad. I hope this all blows over. People can be so selfish and cruel...

My consulate is in a transition to some new online forms, so I couldn't get a heads up on a few things... I got some stuff, but a lot of the forms I couldn't do ahead of time... also due to being out of the country for a month.

I was hoping to mail the packet 3 back today, but I have NO money to mail stuff, until I go to the bank and exchange a bit of cash I have from my trip into Canadian currency... work sucked so much today I didn't get to get out to the bank and post office before it all closed, so now I have to wait until tomorrow. It's frustrating... I just want to know when my stupid interview will be!

So, on that note, it was nice to see a bit of good news from other people on the thread. Congrats Starlight and endoftheroad!

Ash - Good luck with that. Are you at the embassy where you can fax your stuff in?

Ian's filling out his forms tomorrow. There's a lot to do and bizarre questions along the way. I like the 156, where it asks for a "Spouse's name (even if you are divorced)" I wonder who wrote that question.

How was Neverland, btw?

Allie - Hang in there! Maybe we should form (or join) a book club! smile.gif I've been thinking about taking a class... cake decorating or creative writing. Something.

End of the Road - At least I'm not the only one with nightmares. This is a rough process, and it's even worse in China, I'll bet, because it has to be secretive, and she has no ability to leave to visit you. How are your plans going to visit them?

I wonder how attaya's trip is going....

Thanks Lisa... I can't fax things in to my embassy unfortunately. sad.gif Which means $$$ I don't have right now to mail it! Oh well. These forms are a little weird. One of them looks similar to the g-325a... seems redundant!
Neverland was kinda neat to go to. We weren't able to go inside, but there were still some people outside the gates, and people were dropping off flowers and balloons, and posters. Someone sang happy birthday while we were there. LOL They had two large 4'x8' panels that people could sign and leave messages.

I wish I could take some classes! I miss learning. lol

I'm also wondering how attaya is doing. Tuesday is the big day, right??

According to my roommate I received my Packet 3 today... unfortunately I can't do anything about it until I get back on Saturday, then it's the long weekend, so I won't be able to send it out until next Tuesday... a bit frustrating, since it's basically sitting in limbo out of my grasp for a week... but I know I shouldn't complain. I REALLY shouldn't complain since I'm able to visit my fiance right now (though it's a financial hardship on us as well)... It came earlier than I expected (hence the timing of this trip.. I really wasn't expecting much progress until September)... so it's still going ok. I just wish I could send it back right away... I have everything they need now! Oh well. I'm just anxious to find out when I can have my interview. I'm still hoping for November.

I haven't touched base with the April group in a bit.. I think mostly because my own visa progress is at a stand still until I return to Canada next week and wait for my Packet 3. good morning-

hope everyone is well. I am already fed up with the dr. in Dakar. Lamine called him this morning, and he said to call back at noon. Lamine called at noon, and he was out till three. Lamine called at three, and the doctor was out until 3:30. Finally, at 3:30 Lamine got a hold of the dr, and he said that he would call Lamine tonight. He said the same thing yesterday. Every time he talks to Lamine he asks if he's scheduled the interview yet. Lamine tells him no, and the doctor says, "oh, ok. well, good then." We're not supposed to schedule the interview until we have finished the medical, but I feel like if we don't schedule the interview, he'll just wait forever. I know it's ridiculous, but I'm on the verge of tears. I want to see him again! So, tomorrow, if we haven't heard from the doctor, we're calling the embassy to schedule the interview. Then the doctor will HAVE to finish Lamine's paperwork prior to that date-just like a k-3. Hopefully, though, we'll hear back from him in a couple hours. Not holding my breath, though.

Sorry, guys. I know I have absolutely no right to be feeling frustrated, I was just so caught up in the process moving quickly, that this road-block is wreaking havoc on my nerves.

*hugs* I think you do have a right to feel frustrated! You've done everything on your end to do this right, and now you're stuck waiting for the doctor! That doctor is being very unsympathetic to the importance of this stage in the process. Does he not realize that essentially HIS meaningless delays are delaying when you and Lamine will be together again? Heartless! I hope he comes to his senses, and does what he needs to do. Was it the doctor that said you're not supposed to schedule the interview until the medical is done? If it's just a matter of paperwork, I'm sure he can get it done asap. I'd go ahead and schedule the interview too if that's the only thing you're waiting for! Good luck attaya... you're SO close!!! smile.gif

Tracking DHL is a crapshoot... one couple were following a package that left the day after the NVC said it was sent (none left that day) and the P3 arrived before that package ever got to the consulate! But, it is something to do while playing the waiting game. The date of NVC out is the date they tell you it left because that is the date of record.

Thanks.
DHL is frustrating because there's no way to tell specifically that it was mine, I can only assume. It does say that it was signed for today in Montreal though, with the name of the person who signed. I called Montreal to check, and their menu specifically said that they won't tell you if they received it or not, and basically we just have to wait for Packet 3. Figures. I'm not even in Canada for another 2 weeks, so I'm sure that will delay it a bit, if there's a packet 3 sitting waiting for me. I wish I had been put in AP and not the rest of you guys who have... My fiance hasn't even started gathering his financial support information yet, so I'm sure I'll end up having to wait on him for that. But hey, they estimate a 5-7 month wait for an interview, so what's the hurry.

Sorry guys I'm not on here much right now... but hope everyone who is delayed gets moving quickly!

Apparently NVC sent our case to Montreal on the 17th (so they say), and I checked the DHL which said it actually shipped yesterday, the 18th, and there was a package received today in Montreal, which I'll assume is ours. However, Montreal is a really busy consulate, so I still think I'm at a bit of a stand still, because they're taking a LONG time to schedule interviews, so I'll still be surprised if I get one before November/December to be honest. I'm still worried I won't get there before January sad.gif

For my timeline, should I put the 17th, or the 18th as the date it left NVC? I don't see anyone else to Montreal in the last couple days

I don't know why they bother asking about the vaccines if we don't really need to get them anyway right now... lol I just figure might as well get them out of the way, and I can't see them being cheaper in the US, for sure. I got the free ones, and was updated on all the others already... just trying to figure out this chicken pox thing. Who would've thought that I would actually wish I had the chicken pox.. lol I never did.

Attaya, I hope it all went well!! smile.gif Hopefully all the shots won't leave much bruising or anything. lol

Soooo, I hope, seeing most of everyone's timelines, the NVC takes a couple days to send away...except Lisa and Ian...so maybe this WEEK will be when they send our stuff to London.....i'm crossing my fingers!

Yeah, I'm wondering when I should call them again to check on it. We last called on Friday, to confirm the address change, and they hadn't sent it then. I was thinking I'd give them a break today and not call. laughing.gif

I'm with Rhiann and Jauque... I've looked up all the information myself. I'm the beneficiary, and I need to know what I need to do, and like to get things out of the way when I can before the pile up too much. lol I've already got my police cert and my long form birth cert ready to go, and I've updated most of my vaccines already (including getting my cat's vaccines updated!! laughing.gif). I just need to get the bloodwork done to see if I need the chicken pox one (which is annoying, because I have to pay for it if I do.. argh). Thankfully, I'm too old for Gardasil. lol If the situation had been that my petitioner fiancé was the one looking up the info himself, I'm not sure he would've told me all those details laughing.gif But he knows me, and knows I need to know, so I'd like to think he would have. He's knowledgeable about the process as well, and some of that is his own research, and some of that is mine.

Allie, I said it before, but I'll say again: yay!!! lol biggrin.gif

ashen-It's really ok. I wish I could be there, but I know I'll see them all soon. We're keeping it a secret from his family, though, and Lamine's just going to bring me home from the airport and wait to see the expresions on their faces smile.gif The only person we're telling is his uncle (as head of the household) and I know he can keep a secret. They all think I'm coming around November. Surprise.....

endoftheroad-how are your girls today?

Lisa-hope this week is the week you make it out of NVC!

Allie-hope you hear something from NVC soon.

SS-are you mailing off your RFE response tomorrow?

Hope everyone else sees lots of progress this week too!

haha awww.. that sounds like a great surprise!!!

At the risk of sounding redundant, I just wanted to add that we also did not send dated photos either. I hate photos with the date stamped on them. lol We did a similar thing to endoftheroad, and had them attached to a page with a caption by each one explaining when and where the photo was taken.

We didn't have any passport stamps to show travel, because they're not generally required for short visits between US/Canada, so we had hotel receipts, itineraries, and boarding passes instead. It may have helped that we had actually MET each other and started our relationship within the last 2 years as well (for example our story of how we met was within the last 2 years, but a story isn't 'proof'... it just supported the relationship I guess)... I think we even had a pic of us outside of Red Lobster, with a dated copy of the receipt beside it. laughing.gif At least we were thinking of doing that... I can't remember if he actually sent it in that way, but that's an idea.

And, attaya, I'm sorry you had to miss Lamine's sister's wedding. rose.gif That's really cute that they all called you though. lol Were they able to take any pics that you could see?

It sounds like the beneficiaries are calling NVC, as either the petitioner or beneficiary can, to change the beneficiaries address so that when the consulate receives the package from NVC, package 3 from the consulate will be sent to the correct address of the beneficiary.

Don't know if that is correct, but if only a US citizen is allowed to submit a petition for entry to the US, it seems like only that person should be able to make changes to it. Otherwise the chances for fraud are elevated. I don't want anyone making a change to my petition but me, a US citizen.

Your best bet is to call NVC about an address change for the beneficiary, to catch the petition before it heads to the consulate so that you can ensure that the beneficiary will actually receive Packet 3 if they have moved. At least at NVC you get to speak to a live person, most consulates do not have that option.

I understand what you are saying, but NVC has allowed the petitioner OR the beneficiary to call about the status of your case. They were very friendly with me and I was the beneficiary, and they usually asked a few questions to confirm who was calling, sometimes not though, and just ask for the WAC # .

sigh... rolleyes.gif Yes... this is exactly the case. as minnew pointed out. The BENEFICIARY, me, calling to change MY OWN address, on MY OWN case, which is certainly not fraudulent in any way. I'm not a random foreigner trying to change the petitioner's address (which I can understand would be inappropriate, but as said, that is NOT the situation). I AM changing MY address asap with them to make sure that I receive the Packet 3 at the right place, because I moved a few streets away, in the same city, mere DAYS before we got the NOA2, and it's too important a document to allow to be lost in the mail. I will call them, yet again, today to try to change my address again.

Attaya, I am sending good vibes for the safe arrival of Lamine!! And that he can get his medical quickly. So many loose ends to tie up for this! Good luck to all of us!

Speaking of updates, NVC received our case yesterday! hurrah!!! I have my new case #, which I believe I can use for booking my medical, and they said I can just email them to change my address!!! kicking.gif

The NVC can change your address over the phone. They did that with Ian's address. It takes them 2 weeks to get to their email.

I was talking with them on the phone when they told me to do it via email. ?

When I initially called the NVC, the call was for the purpose of finding out if Ian's address change that I put through to USCIS was made. After asking what the address should be, and I read it to them, they said, "No, it hasn't." I said, "Well, how do I go about changing the address?" And she said, "I can do that for you over the phone". I read it off, she input the change.

Before that, I had sent an email asking the same question. It was July 23rd. I got a response back via email 2 weeks later saying, "yes, the address change was done".

I suppose it can be done either way. I would guess NVC and the embassies all use the same database.

hmmm that's strange.. cause I was just calling to ask if they had our case yet, then told them I want to change my address, and asked how I could do it. She actually told me they CAN'T just do it on the phone. Sounds like a conflict of information within the same system. Shocking! laughing.gif I have to call back anyways to find out when they actually send our stuff to Montreal, so I guess I'll ask someone else about the address change again. I sent off an email today, so maybe they can cross reference (doubtful, but who knows). I wonder if it made a difference that I was the beneficiary calling, and not the petitioner? I dunno. Quite frustrating though, because once it gets to the consulate, I don't want to run the risk of them sending something to my old address if NVC can't get their act together and update it. ranting33va.gif

... The only thing I worry about is his birth certificate... they made him older than he actually is...

Gee, no birth cert problems in China (see the Beijing Olympics Chinese woman's gymnastic team controversey wacko.gif ) laughing.gif

We don't have a birth cert problem but our girl entered school after homeschooling with mom and they screwed up her school age. So she is two years ahead of my son who is the same age. We completely expect that she will be placed into her age group year in the US school, same grade as my son. (both will be "our's" soon) Just funny how this stuff gets mangled.

You're comment just made me laugh and calm down. Thank-you smile.gif I needed someone to say something like that. It's just so bizarre to me that you can just march into an office and say that you are however old you want to be.

My sister in law had the same sort of thing when she was a school aged girl. From what I recall of the story, she was small for her age, so her parents said she was 2 years younger than she really is. laughing.gif I think she has some of her ID in one year, and some in another!
