IR-1 / CR-1 Spouse Visa Process & Proceduresfiling for K3 but switching to CR-1 question
QUOTE (robbyrob @ Mar 9 2009, 10:33 PM) <{POST_SNAPBACK}>
I129F doesn't make a full stop at NVC and is forwarded to the embassy. It doesn't even get a case #.

Your K-3 DOES stop at NVC and IS assigned a case number before it is sent to your embassy. The embassy (as said above) will be sending you the Packet 3. If you chose to ignore it htat is fine. Some people prefer to follow it along even though they have no intention of getting the K-3. They schedule a K-3 interview and once the CR-1 completes at NVC and is sent to the embassy - sometimes you can swap the already scheduled K-3 interview slot into a CR-1 interview so you avoid having to wait again for another to be scheduled. This all depends on timing and the embassy. It has worked for some and not for others.

No news on our interview....the operator told me last night to call back around the third week of March as they ONLY schedule interviews the first two weeks (at least we got that clarified now!) So I'll be calling back & crossing my fingers to get an April interview! If not...at least May isn't THAT far away right? smile.gif

The last few people through MTL have been 100+ days. Cases completed in Jan are now getting dates around the end of April... judging by that unfort I think we will be looking at end of May Moosker! crying.gif

IR-1 / CR-1 Spouse Visa Process & Procedureseveryone CALL NVC ,DONT WAIT FOR SECOND WEEK OF MARCH
It's exciting - but I think some people are jumping the gun here. Once the cases are complete normally NVC makes you wait until the 1st and 2nd weeks of the month when they will schedule all the interviews for the month after. They tell you to call at eh start of the 3rd week and they will have the dates for you.

Right now the people getting interviews have still gone through the whole NVC process and have a COMPLETED CASE. The only difference is instead of waiting to hear during/after the first 2 weeks of March they are getting the news early. You still have to go through everything and complete your case at NVC!

Congrats to all those getting April interview dates - at least the wait is not so hard knowing there is a date assigned!!

IR-1 / CR-1 Spouse Visa Process & ProceduresHow did you receive your NOA2?
Our Senator told us it had been approved. He got involved after 7 1/2 months and when they got back to him they told him they approved it 2 days before they returned his call. Coincidence??? We never had a single touch or anything!

IR-1 / CR-1 Spouse Visa Process & ProceduresQuestion about NVC
When your case completes both files should be sent to NVC. The I-129F only stays there long enough to get an case number assigned and then it is sent to the embassy who take care of the K-3 stuff (sending out hte next packet, you send requested list and forms back to them and they schedule the K-3 interview). CR-1 cases also go to NVC and are given a case number. Mine took about 3 days but I hear now it is taking longer and coudl even be a 2-3 weeks. After the sace number, follow the Wiki Shortcuts to speed your case through NVC. Even when you case is completed, the file will stay at NVC until NVC assigns the CR-1 interview. Only then the case is physically transfered to your embassy. Hope that helps.

Tomorrow I'm going to try to switch my K3 interview for the CR1.

Congrats! You might want to wait until your cr1 file reaches consulate before you ask them to switch your k3 into cr1 because most consulate cancels k3 in favor of cr1, but that's just my sugesstion. I am personally planning to wait untill my cr1 reache consulate.

That's right! It's better to wait a couple days. I'm so anxious I can barely think clearly! LOL

If you are trying to make the switch aren't you supposed to call NVC asap once your CR-1 completes and tell them to send your case to the embassy right away and give them the date (by March 24th) and after you do that you can call the embassy and tell them it's been sent already and to switch the date? That is what I read somewhere...

It seems the USCIS webiste is sort of a CYA. They report that April 1 is the latest case they are working on but likely processing at June.

I filed in August, but there are people who filed after me who are getting approved and I am still waiting. So I guess it really depends!

Good luck on your journey

The USCIS website updates their website when they feel like it, and their charts are usually outdated and "cover all the bases" so that we can't call them and complain... from what I can tell they don't seem to follow chronological orders anyhow...

VJ takes the info from dates we've entered to generate a timeline which can only be as reliable as we are at filling stuff in... so take each with a grain of salt.... I know it's frustrating!

One way I tried to keep tabs on what was happening was checking here: Igor's List You can use the filters to generate what you want...

Good luck in your journey!

IR-1 / CR-1 Spouse Visa Process & ProceduresVSC transfers to CSC in January 2008, Please post here
I'm not trying to be funny - but how can people with NOA1's in November 2008 be close to approval already? There were many people transfered to CSC at the end of 2008 who do not have NOA2's not to mention the rest of the people still stuck at VSC. If you guys get approvals before all these other couples (assuming everyone is under normal circumstances) I would really really like to hear from the service centers as to what method they use in approvals. Good luck to you and I hope your process is painless. Keep us up to date!! This could be interesting!

IR-1 / CR-1 Spouse Visa Process & ProceduresOffically 6 months what should I do???
We waited almost 8 months. Right before we were approved we contacted our Senator's office and within a week we were approved. Nothing was updated, no notices, no anything and they did not get back to him either. When he did finally hear from NVC, he was told they had already approved us. I called NVC and sure enough we had been approved the previous week as soon as he had contacted them. I am sure this was not coincidence!! As much as you are getting discouraged I think you should try it! Our contact at the Senator’s office called us every Friday with updates even after NOA2 - he was great!

Don't lose hope!

IR-1 / CR-1 Spouse Visa Process & ProceduresAm i allowed to go to the USA to visit my husband??
I am from Canada and we normally get 90 days unpon arrival. If you need a tourist visa to enter normally it may be much harder (maybe impossible for you). I can say that as a Canadian I was able to visist my US husband although it is up to the immigration officer at the POE. They will likely take you to secondary questioning and explain that as a pending immigrant you cannot be a tourist too. So technically the cannot let you in because you do not fall into a catagory of visa while your immigrant visa is pending.

To put it simply - it is possiible depending on what country you are from but you will need proof you intend on returning such as:

-proof of job that you are going back to - letter from employer etc.
-lease, deed to a property or something that shows you have ties to your home country and are returning
-dependants in your country help - proof of children, parents someone you hav eto look after helps
-all applicaiton papers filed eg. i-129F or I-130 to show you are following the rules
-proof of return flight
-proof of funds and or spouses funds
-list of all past visits showing how much time you have spent in the US compared to your home country (this helps show you have gone on visits in past and always returned - if you have already been there a long time they will probably deny you entry if you try again)
-any other commitments that you can prove you have in home country will also help

They may still deny you even if you have all of this - I was unemployed, I own nothing, and I have no dependants but had all my paperwork with me and could explain everything so they let me in for a visit although they gave me 30 days instead of 90 Canadians normally get. They basically want to be sure you are spending more of your time at home and not in the USA before you are approved - and eliminate the risk of those that may try and stay in the USA.

There is no clear answer to your question - because like everything else - it's all up to them on the day!

I was assigned a May CR-1 interview last week, but on Monday I recieved notice I have a K-3 interview April 15th!! Well if I wasn't already here in the US visiting I would contacted NVC and got my case to the embassy in time to use the April date for my CR-1! I emailed the embassy and they said it was possible although there was no guarentee when the CR-1 case will arrive at the embassy. The protocal is that the May cases are only "required" to arrive at MTL by the end of April. She gave me not spcifics about my case. I am sure I could have pressed for this if I wanted the April interview but I just cancelled that date and am happy to stick to my original travel plans for my May date. Just wanted to share my story to let those if you wondering if it's worth following the K-3 know depending on timing you may be able to swap and save a bit of waiting for your interview!

Quick question - we have a cover letter for the DS3230 from when we paid the fee and we received an RFE for the DS3230 because we havent sent it in and wont for a while since we dont have police certificates. So when we do have the certificates which cover letter do I use? Thanks in advance.

I sent the bar coded cover (which proves you paid and tells you where to send it) as well as a typed letter listing the case details, our names and info as well as a bullet form list of what documents I had included. The template for this can be found in the Wiki Guides. Is this what you mean?

The DS230 you fill out both parts but only sign part 1 correct?

I'm a bit confused on 'appoinment post' - how do you know if your consulate is an appointment post?

For most countries for the CR-1 you do parts 1 and 2 of the DS-230 but ONLY sign part 1 as mentioned.
If you are also following the K-3 process at the same time, you will be asked to send Part 1 of the DS-230 with your checklist and other requested forms. This is considered a Packet 3 for K-3.

Are you sure that they have reviewed the DS-230. Many have been getting RFE's re the DS-230. In fact, we got one saying there was info missing and when I spoke to the operator she told me that the DS-230 was missing. We had not even sent it yet!!! If there is a long space between sending the I-864 and DS-230 this is often generated. On the other hand, if you know FOR SURE it's after reviewing the DS-230 the operator should be able to tell you something about what is missing. What I don't understand is if the operator said they are still reviewing your DS-230, how can there already be a RFE?? Maybe try calling another operator and see if you get any more details? Good luck!

Did you only mail 2008?
i am wndering cause we didn't send 3 years we only are sending 2007 & 2008

As mentioned in a few other threads, there are some REQUIRED things to submit and some OPTIONAL things. I would at least do the minimum. The extra tax years, letter from employer, pay stubs etc are not asked for, but additional to help prove the case. It depends on your situation and if it's a I-864 or a I-864EZ or I-864A - but I would send as much proof as you have. It can't hurt!!

The one thing some people have said was that they were given an RFE for the 2008 info because they had not filed their taxes yet and where only submitting the W2. It seems like it's better to submit a 1040 for the same year (and a 1099 if applicable).

We sent in 2005, 2006 & 2007 because these were all complete sets of docs. We have not filed 2008 yet and did not want to wait until that time to send our I-864 package. Since taxes are not officially due yet, 2008 cannot be a "requirement" yet as many people do not have them.

Hope that helps some...

Finally!!! I got the UK police report in the mail today! YEAY! I sent everything off and NVC should have it all tomorrow! (OBX, would you mind updating the speadsheet please!) Hopefully they won't come up with any reasons for a RFE! Glad to see how much everyone has moved along!
