It shouldn't really take a month... most get there in around a week... Did it come from VSC or CSC?
Do you know for sure it left? And NVC says it has nothing? If it's been a month you should follow it up - don't wait! If none of them have answers where it is you may want to get a congressman involved or something???

Check the guides, follow the instructions, down-load it and do it yourself. You do however need the bar-coded cover page to send along with it proving you have paid.

Many people on VJ have sent them at the same time if they have all the documents for both packets and you have the barcoded cover page that is printed after you have paid the 2 fees. I would have but I sent my packet from Canada (as I was still waiting on a police check) and my husband sent the AOS from the US. It's up to you. Lots of people sent them together and no one I know had any issues at all (and they saved on the courier)!

One of my police checks got lost and I had to wait for it too. From what I was told it will make no difference wether you send it now or wait as if you send it incomplete you will surely get a RFE. THen your case just sits there incomplete. It does not get you any further ahead, you don't get an ealier date or anything and you may also:
1) have to pay to send 2 sperate courier evelopes instead of 1
2) have more chance of them losing something
I was told to wait and send it as a complete package so that is what I did.

I think you've got the $ right from what I have read - but since we don;t have kids, maybe someone else can double check. I think with the police reports it will depend on the ages of the kids.

Don't forget there will be the cost of the medicals also, which will vary.

The AVR gave me some wierd message and it said there had been a letter sent out to us regarding what we were missing. Turned out the thing we were "missing" was the entire DS-230!! Like you - we had been waiting for one of my police checks. We had not even sent the DS-230 yet so we thought maybe it was to do with the I-864. Seems like this may be the same in your case. The only way to really know is call back until you get an operator who can explain it! The AVR is usually a day or two behind and sometimes makes things sound worse than they are!

Thanks very mich for your reply and the links. good.gif We're starting to piece everything together and understand all the steps. I have read that the UK recvently changed the validilty dates to 6 months and the others should be within the year so I think we will hold off just a bit before we send for these. It's still good to understand the process though. It'll be so nice when the process is over (or at least when we will be able to be together)! This forum has been the best information I have found anywhere!

Hi all,

We were just wondering if anyone who has already done their police clearance can help us. Since we've heard international police checks can take so long we are trying ot get a head start on the process. The problem is we have not been able to find the exact requirements. Each country has different forms some with finger prints, some without etc... I need one from UK, Australia, NZ and Canada. Does anyone who has already completed this have any details they can share? Does the packet you recieve give more information? We don't want to wait until then... we'd love to start now if we can. Any info would be greatly appreiciated.

K-3 Spouse Visa Process & ProceduresTourist Visa while filing for I-130
I have 2 questions:

Background:
I'm Canadian and my husband is American. We are planning to start the K-3 process in April so I can gain permanent residency there. I realize that while the I-129F paperwork is processing it will be very difficult for me to visit the US on a tourist visa. So we came up with a plan.

I would like to enter the US on a tourist visa just before we submit any K-3 paperwork. As soon as I arrive we will then submit the I-130. That way I can be with my hubby 6 months during all this processing. Obviously after my tourist Visa runs out I will have to spend the rest of the time back in Canada until I actually get my K-3 interview.

Question #1) Does this sound like a bad idea?

If we do this, question 14 on the I-130 does ask for the I-94 Record, but i've never received one of these before when entering the US. The I-94 instructions even say "This form must be completed by all persons except U.S.Citizens, returning resident aliens, aliens with immigrant visas, and Canadian Citizens visiting or in transit."

Question #2) Assuming I'm in the US on tourist visa when we send off the I-130, how should I answer the "Arrival/Departure Record (I-94)" question on the I-130 form?

We were just wondernig what other people have submitted as evidence and how it turned out. None of these really apply to us as we still live in seperate countries - it seems we can only provide 5 and 6. How much detail needs to be put into this at this stage? Should we send lots of photos, plane tickets, emails, etc at this point? I thought that was more for the interview? What do they consider "other relevant documentation"? Any help from those that have already submitted would be great!

The USCIS now requires that when filing an I-130 for a spouse that you include evidence of a bonifide marriage. They list examples of acceptable evidence as:
1. Documentation showing joint ownership or property; or
2. A lease showing joint tenancy of a common residence; or
3. Documentation showing co-mingling of financialresources; or
4. Birth certificate(s) of child(ren) born to you, thepetitioner, and your spouse together; or
5. Affidavits sworn to or affirmed by third parties havingpersonal knowledge of the bona fides of the maritalrelationship (Each affidavit must contain the full nameand address, date and place of birth of the person makingthe affidavit, his or her relationship to the petitioner ofbeneficiary, if any, and complete information and details explaining how the person acquired his or herknowledge of your marriage); or
6. Any other relevant documentation to establish that thereis an ongoing marital union

Well, my husband spoke to them yesterday and the kind lady on the other end said that she could see that the site was down at the time and that she thought that meant they were updating it. Obviously not!

My theory is that if the site does not give an exact date then we can't complain that we are outside processing timelines any more. That way they do not have to take any responsibility what dates they are on and just continue as they please! I feel bad for the poor people who have to deal with all of our complaints though, as it's not their fault no one is processing applications! I would HATE to work there!

Please, please, please VSC - let's keep 'em coming!

Our Senetor's office has been checking into our case for us and he just got a response back from VSC today. They told him we were approved 2 days ago! So I think that would make us the 20th! Our online stuff has not been updated yet either, nor did we get any emails! But if it is true I am going to be so so happy! Nothing has shown up regarding our case via email or when we checked online or by phone - the only way we have found out that we have an approval was because we had a Senator's office checking into it and they told us today that we were approved "a couple days ago" so I am hoping we will soon recieve a hard copy in the mail with a NOA2 dating the 21st!

If he enters on a K-1 Visa you have marry within 90 days of his entry.
If you want to get married in the US (then he leaves) or in any other country, you woudl then get the marriage certificate etc and file for a K-3 or a CR-1. Your best place to start is to read over the different types of Visas in the Guides section. All of the visas will take some time! The choice is yours. Once you understand your options, you can post and the many helpful people here will be able to help!

I agree. Make your medical appointment today and find out when you can expect the results - after you know this you really only have 2 options:
1) go Monday without medical results and tell they you were confused and see if they will believe you
2) reschedule the interview for a date after you will have the results from the medical

Either way they will know you were not organized (or you lied). There is no getting around this at this point. Loads of people send the checklist back before they have had the medical so that they are further ahead in the queue for an interview BUT you should have followed up and had one in the meantime. You could be together soon if you get on with this process - but as sooooo many people have already said - you need to DEAL WITH THIS NOW. No point in freaking out!!

Thanks to everyone for your answers. I figured it only made sense that 1 was required but thought I would check what others have done anyway. Sometimes you just need to confirm you aren't going crazy!

Just to let anyone else know who needs to get one - I had one done last year in Toronto for $25 and it covered the RCMP check for all of Canada. It came to me about a week later in the mail. Simple.

I have to get one now for immigration, and where I live now (a small police detachment 2 hrs north of Toronto) said they too do it for $25 and it can be done while I wait. If they were busy they might have to mail it to me.

Just depends on the police station I guess...

I have a Canadian police check from the police services where I live and it says right on it that a search of the C.P.I.C. National Criminal Records Repositiry maintained by the RCMP was done and my name and birthdayte etc. This is Canada wide - so why does the Dept of States website say we need one from police authorities of each localitly we have lived in? I lived more than 6 months in one place when I went to university, more than 6 at current address and more than 6 at another address. Do I really require 3 when the one I have covers all of Canada???? Wierd!

My husband was able to add me to his policy without paying anything but when we were looking into it we found out (on day 29) that for a spouse to be added for free, it had to be done within 30 days of our marriage! All they needed was a copy of the marriage certificate. They did not require a SSN or care that I was still a resident of Canada. He was able to select when to "activate" coverage for me and we had no need to do it then. We started it this January (and have to pay a bit more now that I am active on his plan) but it's very reasonable.

I am sure if it will benifit the ratings the shows producers will already have lawyers workign on details if getting some guy to move to Canada. Maybe they will have mostly Canadians??? Perhaps all the US contestants will be screened to see that they are "suitable" to immigrate? Traditionally the contestant who gets the final rose is the one that moves (I don't watch it either - put with all the hype this season you can't avoid it!) If this year's Bachelor was smart he would have picked Jillian anyway. I am sure they would have expedited her case!

If you are awaiting a CR-1 interview your physical case remains at NVC until after the interview is assigned to you and then it is sent. K-3's are only at NVC long enough to get a case # and then are sent to MTL right away.

Just wanted to share my experience because I know we had a few threads a while back regarding this topic and people were unsure or wanting to know if Canada was one of the embassy's that allowed the applicant to "swap" interviews. Other people from ohter countries have done it while some say have said their embassy did not allow it. We continued to follow our K-3 along just in case the swap was possible and the timing was right.

Last week I was assigned a CR-1 interview for May 20th. On Monday of this week I was assigned a K-3 Interview for April 15th. I am visiting my husband in the US right now and will be heading home at the beginning of May. I decided it was silly to change all my plans since I am currently here in the US, BUT I sent an email to the MTL embassy just to clarify whether it would have been an option. The email I recieved said generally the cases stay at NVC only have to arrive at MTL towards the end of the month before the interviews and so sometimes they wait and send the bunch together. (i.e. all of May interview cases will arrive at MTL by the end of April). That does not mean some might not get there before... just that there is no guarentee. The email suggested it's better (I think easier for them) if I keep the May interview date. So really I think Canada would do it but only if your case gets there in time. I am not interested in persuing this option, but if I contacted NVC they most likely could get it to MTL on time.

Hope that helps anyone thinking of doing the same thing.

I also emailed MTL but they answered my question and seemed to totally ignore the fact they sent me someone else's letter!

I have gone through numerous times before we were engaged and never had any issues. I had a full time job then and a lease on an apt but I never had any proof. I was always going on climbing trips so they never did ask me any of the extra questions about who I was meeting. (My husband and I both climb). Even when we were engaged I never was questioned enough to have to say the word "fiance" which starts the red flags! I was always lucky to be with people in a car or travelling to meet my fiance somewhere to climb so it never came out. I would of course told them the truth had they asked me.

Since we got married, I have been pulled into secondary and questioned. They try to intimidate me but I have all my paperwork with me and a spreadsheet of every visit back and forth that my boyfriend/fiancé/now husband have made with dates because they always ask me these questions - details about length of visits and when where my last few visits. It is frustrating but I always allowed extra time knowing that they would want me to go to secondary and I never took it personally. They are just doing their job.

My husband has been pulled into secondary as well when he has come to visit because the Canadians want to know he is leaving too and not going to remain in Canada. He now takes proof that we have done all the immigration paperwork for me to go the other way and they hassle him less.

The most recent crossing for me was by car. It seems when I travel alone in an airport they always ask more questions plus they make you fill out the address where you will be staying and therefore ask the story about how you know people or whose address it is - since you can't lie you have to say "my in-laws" or "my husband" and that is when things get complicated. When I crossed in a car they did not ask me anything about relatives or ties. I was coming again to go on a climbing trip and the lady was more interested in what type of climbing and whether it was safe and whether we were any good. Of course, it seems easier to enter with other people than when you travel alone!

My friend visits her husband all the time and has her mom drive her to Buffalo to fly. They have never asked her anything other than have you done any paperwork yet? They did not want to see anything.

So I would say it's WAY easier to cross at a LAND BORDER in a car than an AIRPORT, but that is just my experience.
