there is a big difference between sole physical custody and sole legal custody here in the U.S. Getting sole physical custody of a child is fairly common. Getting sole legal custody is very rare. It's a little hard to get it through a judge (but I had other issues such as my former spouse's history of violence and criminal convictions to support the action), but perhaps you should consult both an immigration and a family law attorney and see what your options are.

I know you are dealing with Canadian law here, so things might be different. I am just trying to provide you with some alternatives you may want to explore. Is your husband planning on adopting your daughter?



It's not joint custody....I have sole custody. He has access with reasonable notice. My future hubby would like to adopt her but will discuss it with her first.

mad.gif That jerk of an ex just called me and said he wouldn't approve the move. He claims he never gets to see her - well d'uh...he lives in BC and she is in ON. As well, he spent 3 months here in 2005 and saw her all of 3 times. All because she didn't call him. He expects her to make all the contact for visits, calls, email, online chats.... unsure.gif

Now what? I certainly don't want to waste time and money in court. Has anyone been able to take their child(ren) to the USA with just their court order that gives them sole custody?

I noticed on Jeremy and Kristy's review about taking her daughter to the USA.

Here is my scenario - I have sole custody of my daughter. However, my order states that her dad can see her anytime, giving my reasonable notice. In the past 10 years, since our split, I'm guessing he has seen her for a total of 4 weeks to maybe 6 weeks. He is very sporadic with phone calls or end chatting with her online.

I've spoke to him and he is aware of my plans to move to Chicago and get married. Kelsie is not 100% thrilled about the move cause of friends, etc. So she will remain here until she graduates from grade 8. She thought she would be smart and approached her dad about buying a house here and her living with him. He told her she could live with him any time, but in BC. That, of course, was not the response she was hoping to receive.

He has left no forwarding address for her to contact him. So I have no way of reaching him to ask him for a letter supporting this move? Will my court order suffice?

You definitely lucked out with the Uhaul. I don't see myself as being that fortunate. Unpacked - wow. Until we move to a bigger place, I know my stuff will not all be unpacked but put into a storage cubicle. Then again, could have a bigger place before I even move.... crying.gif but I hope not.

You'll be able to take some time now and relax somewhat till the next round of paperwork starts.

Wow...what a terrible person to have to deal with. He obviously didn't want to perform your wedding the way you wanted but how he believed it should be done. Go after him for a refund! He didn't give you what you wanted.

Once I get to Chicago, Larry and I will be married at the courthouse. However, we will have a church wedding here in my home town performed by my minister. I've already given her ideas and told her to run with them cause we trust her to give us something special.

Only moisturizer I use is Pond's Cold Cream for my face. I've lived in Northern Ontario all my life and we can hit some pretty cold temps in mid-winter. All I know is that Pond's does it for me.

For my lips, I use Vaseline. Works great!!

It's supposed to be sequential but interviews have taken a month to come and in other cases, almost a year. MTL has been speeding up as of late so this looks like a rather fortuitous time to be waiting for the interview. That you will get an interview is inevitable, that's all anyone can say with any certainty (aside from death and taxes). laughing.gif
Just a reminder, conscious thought avails us not..... laughing.gif

I feel very badly for you right now. Even though we don't truly know each other, I wish I was close enough to give you a hug. It won't fix anything but it might just be the thing you need.

In my situation, I'll be moving my daughter who is 13 into a home with 2 boys, 16 and 24. We spent a month living with them to see how everyone reacted to each other. It went well but for the 16 yo being a pest, which I remember my brothers being the same. It's not the same scenario as you are currently in, but I do concern myself with how things will work out in the long run.

I hope that everything works out for you and your hubby finding a place of your own. I would dislike having to see you start this process again.

I'll keep you all in my prayers that God will help you to find a solution that fits everyone.

Hey, I was there Monday morning too. I arrived about 7:20 but they had the doors closed so I had to wait for someone to let me in. There where already people there when I was asked to join the waiting room. Were you the guy in the red hat?

I didn't see Dr. Seiden, I saw a female doctor. She was really nice and we had some things in common.
But I did catch some of the drama that you were mentioning.

My medical went well other than I had a minor surgery and a mammogram recently and they wanted copies of the results, so I now have spent the last two days calling and faxing the other doctors offices to forward them to Dr. Seiden.

After going threw the medical, I think that for some reason the Doctors in the Philippines must really grill people about drug and alcohol abuse and mental illness since I found that those questions were really short and sweet.

I was in a blue t-shirt. There were 2 other ladies with me besides my daughter. We sat directly in front of the windows and when I was in the waiting room, I sat on the grey covered area where the toys were. I was on my way by 8:20 am.

We are closer to being together as I am now waiting for the interview date.

Larry and I have been chatting online, telephone and with cards for the past 2 years. We've met 3 times and have thoroughly enjoyed our time together. I believe our relationship is stronger for that time. We became good friends and our relationship grew from there. Neither of us were truly looking but still found that special love.

I can't wait till we can be together. I have my fingers crossed it will happen soon.

Montreal takes a lot longer cause they are the only consulate to do the interviews for CR1/??? applications too. I certainly wish they would find a way to speed things up for the K-1 ppl.

Another thing I hope for is that it really doesn't take 4 - 6 months to get my interview. I miss my sweetie...
