That is so great. It's been 3 months since I saw my baby girl and I'm so ready for another visit. I think if I don't have a job by Easter, I may drive up then and surprise her. USCIS sends a RFE with no information attached. This was at the end of Feb. I've since rec'd a 2nd RFE with the added documentation and am in the process of completing a 2nd medical to appease them. sad.gif Good thing I located a CS that has a reasonable rate.

It was wonderful. Too short, of course. We made more memories for me to draw from when I get to feeling blue and missing her. I spent part of the first 4 hours of our trip home crying cause I left her behind again. When I talked with her on Sunday, she said she had shed some tears too but also told me that I didn't have to leave either. My sister and her hubby will be bringing her here after school is out in June. Who knows, I may just take another trip up to see her before then.

Hi Zyggy

First let me say, thank you. This is a great thread.

Now, here's my dilema. My US hubby went ahead and filed his taxes. He filed jointly without having any of my information and he couldn't figure out how to enter Canada, so he input CA - which is California, right. He used Turbo Tax.

How do I fix this? I've been here since June 30/08. We went to Canada for 8 days at Christmas. I did come for a visit in March of 2008 and was here for 13 full days. I received income from my former work place in Canada until July 4 (they were paying out my vacation time) and then collected EI.

Any advice / help would be greatly appreciated.

Been so long since I received any $$ from EI, that I thought I'd drop by and get some clarification from those of you who have been here before.

I've got my fingers crossed that I'll get my EAD by the end of November. Does my EI claim kick in from the date on the EAD and run for the balance of the 36 weeks I was approved for? (So, I've gone through 12 weeks and would get the balance of 24 weeks from my EAD issuance date.) That is of course, until I start working.

I filed on July 6....they approved my claim on September 11....they mailed me a check here for the first 5 weeks they owed me which I received last Tuesday.....I got another check along with cards on Monday.

It's tough. On top of all that, come Monday, my claim will be closed until I receive my EAD.

This is enough to drive a sane person crazier.....lol

She also told me that she was going to put a "disqualified note" on my file to take effect on September 29 as my I-94 expires on the 27th of September. Your employer HAS TO have the ROE to you in 5 days, that's law (I worked at an employment centre so we had to know these things). Generally, a ROE must be issued within five (5) calendar days of the interruption of earnings or the date the employer becomes aware of the interruption.
You can apply online for EI as well as fill in your "cards" online: http://www.servicecanada.gc.ca/
When EI gets your application, they will automatically send you cards in the mail (takes sometimes 2 weeks to receive them) and a "PIN" number. You can easily change your PIN by calling the toll free number (if the one they issued does not work). Getting cards does not mean you have been approved to receive EI - I got cards & thought that I was eligible until the website said the usual "we are processing your request, we hope to have a decision by Aug 14, 2008"...blah, blah, blah...I got a call today saying that I wasn't eligible...I was hoping that someone inexperienced would approve my app. Anyways, once to create a profile thru Service Canada, no need to mail anything, do it all online.

ROE - Record of Employment.

He can apply any time. All he needs is a copy of his K-1 and I-94 to submit along with his ROE. His employer may have submitted it electronically.

I got 2 sets of cards tooo. The first for 2 weeks and the second was for 1 week. Now when I check online they tell me I have another set to complete and submit on August 8. I haven't received them in the mail as yet, but I'm sure they'll arrive soon.

Ok... here's an up-date.

I checked online this morning and found the following information.

"We have received new information about your claim. We have not yet made a decision but will (basically) try to have a decision made by August 27, 2008 or the following day."

Start date of Claim - July 6, 2008
Benefit Type - Regular
Earnings - $$$
Fed Tax - 25%
Allowable Earning - $$$
Weeks of Entitlement - 34
End date of Claim - July 4, 2009

For the week of July 20 - 26, we processed your claim and a payment of $0 has been processed.

I think EI should still approve you for a claim right away since they're just looking for the I-94 itself. They don't care if has the employment authorized stamp on there or not. Of course none of us have heard of an unauthorized stamp before either.

Depending on how gruff you can get over this, personally I'd go back to the walk in office in Chicago. See if you can speak to somebody else. The person you got obviously doesn't know bupkis. How in the heck is a K-1 suppose to apply for a post marriage EAD before crossing the border? That person must be mistaking the 2 year EAD card with the 90 day temporary work stamp.

Whatever you do, keep mailing those cards in.


I think I will call the POE and see what the procedure is for K-1 Visa's. I know that Ontarkie crossed at the same one as I did and she never received that stamp.

I will keep mailing in the cards and hopefull we'll be filing our AOS mid August. I just get the feeling that I'm going to be raked over the coals with mine.

Maybe I should set up an Infopass appointment. See if I can get any farther that way with this stupid thing.

Well...here is where I'm at with all this #######. Yesterday, I got 3 weeks of EI cards in the mail kicking.gif

Today we went to the USCIS walk-in office in Chicago. The supervisor.... whistling.gif ....indicated that there must have been something on my file for the BPO to stamp my I-94 Employment Unauthorized. When I mentioned to her that other K-1 Visa folks have not got that stamp, she firmly said they have nothing to do with your file. She also said that in order not to get that stamp, people must have applied for their EAD.

So now, I have to send my I-94 in with the questionnarie I received on Monday. It still has the dreadful stamp on it. I'll send in the documents from SSN to show that we are actually authorized to work. I'm afraid that dumb stamp is going to see the end of my EI cards. crying.gif

I will. I applied for my SSN this morning. The lady that assisted me at the office was quite confused over the stamp and said that it should have been stamped "Employment Authorized", if anything. I received a letter from EI today when I got home from the SS office. It's more of a questionnaire. They are asking if I have a working visa issued by the Government of the US authorizing me to accept employment here. If yes, they want the visa number and a photocopy of the front and back fo the document. That would be my I-94, wouldn't it?

I believe you should make a copy of your ROE (for yourself) and still send the original ROE (although I'm not sure). Mine wasn't electronic.

Wait for the request in regards to the I-94 stamp. The 203.500 paper probably wouldn't be bad for submitting along with it. Did they put the unauthorized thing on the front or back of the I-94?


It's in red right under the Admitted and just above my last name.

Folks, when I crossed the border at Sault Ste Marie, they stamped my I-94 Employment Unauthorized. Is this going to affect my EI? They had a checklist and this was the second thing on that list. First thing was to cancel my K-1 Visa.

Holy heck, how do they expect ppl to survive?

• Copies of the passport and green card of (cardholder name).
• Three sworn affidavits by U.S. citizen friends, attesting to our relationship and marriage.
• Copies of our 2008 - 2010 joint US tax returns.
• Letter from my company of the designation of my (USC - Hubby) life insurance to (spouse, GC holder's name).
• Copies of lease agreements for 2008 - 2010.
• Copies of our bank statement showing a joint account.

I just received the letter for my biometrics last week. Hope this helps.....
