Hon, I'm so sorry to hear about the crazy stuff you're having to put up with right now. I think it's great that Sam is going to work overtime to try to help you, but I don't believe that if he can't help financially that your visa shouldn't still go through. What does the government expect us to do if someone gets laid off and we fall below the poverty line anyway, say, I'm sorry, but I never would have been allowed over here with your finances so low, so I'm going home now? I also think that at your age, it's obvious that you're at the bottom of your earning potential, and things won't always be so dire. Best to let you be together so that you can make a proper go of it. As to the expedite, I'm not sure that you'll have proper evidence for them to grant it, for the reasons stated above.

I'm mostly concerned with your health and well-being though, you said that you're tired all the time and not eating, that your having to rest etc... Have you been to a clinic to be tested? Better to know ahead of time if you have some kind of communicable disease like Tuberculosis and start treatment before your medical exam, you wouldn't want to be denied for something like that, not that they would necessarily deny you either... I'm wondering as well about shelters, soup kitchens, even youth hostels, there must be somewhere more affordable for you. Do they have charity groups or welfare available to you?

Also, you said that your mom and grandmother stole your money from you, and are asking for more? Is this extortion? Or do they feel that you owe them for food and shelter and took by force your money? I'd be worried about them continuing to take from you as it gets closer to interview time, as you will need that money for your medical, police check and the interview itself. Can Sam cover all those things online? I'd look into it, as well as having him pay for any rent or bills he's said he's gonna pay for online. If you don't have any cash in person, no one can steal it, right?

If you look at my timeline in my signature, you will see that we originally sent our petition in January. It got lost somehow and after months of calling to see where it was, we just resent it, not seeing the expiry dates on the forms. Look again at the date of our NOA1 and notice that it is more than a month after we refiled, (also more than a month after they cashed the cheque)

We received a call a few days after sending in the petition, telling us that our forms were expired, and that I also needed a newer passport photo, remember, my original one was for January, not for March. So we scrambled to get this form together and a new passport photo, I paid through the teeth to send it to my fiance ASAP, and he as well to send it to Texas. What a mess. Ignoring the January mishap, had we sent everything in without it being expired, I would have gotten my NOA1 in the end of March. March filers are starting to receive their NOA2s on the site already, and we are listed now as a May filer, though my March buddies still consider me one of their own.

my thoughts to you? Either fill out the form and fedex that sucker to arrive before it expires, or wait until after it expires and download a new form and send that one. You never know what they consider to be needed at any stage of the game for certain, as my fiance was also asked for us to send in some things that are normally not even needed until packet 3, and the interview. Also, apparently the USCIS NEVER phones you according to this site, though having had a phone call from them, and confirmed it when we called them back over the few days following, we know that's not true all the time either.

Hahahaha! I plan on keeping my petition after the process is over (the copy anyway, lol) so if you plan on doing the same, don't forget that stuff is in there and one day let your kids read it!! I remember reading love letters that my dad sent to my mom when he was working in Tennessee, she didn't edit the steamy ones out. Now THAT was an eye opener!

Don't be embarrassed about the officers reading them, if they're really really interesting, they will remember you a little more is all before they pass you on to the next desk! They are all professionals, and likely need to sign some kind of nondisclosure or privacy act statement for their job, so none of it should ever come back to haunt you, but as to if your relationship is bonafide?? They might not ask for proof of relationship status, fearing what they MIGHT get back from you as proof!!! :rofl:

When you do withdraw, make it clear in your letter that you are emigrating to Brazil, and no longer need to pursue a visa option for her in the US, just in case you change your mind and decide to reopen/repetition the case. I agree with the above poster that it would be great to have the visa in hand just in case, but it's only good for 6 months, and if you don't plan on using it, then it's better to cancel the request, saving the money for the interview and your time.

I hope the visa process in Brazil is easy for you, and that you breeze through it! Maybe the 84 days is a sign of things to come!

We sent our package in January, and it was lost by the USCIS somehow. We resent our package in March and got a phone call asking us to redo it with new forms and new dates as our forms had expired. It took more than a month to log us into the system, even though we had the new packet info to them with 2 days of the request. It might make your journey a little longer if they get the package and have updated the forms on the site since you sent them. I'd keep an eye on it, and if it changes before you get NOA1, then print it and be ready to send it, if they ask for it.

A lot of things were not done by the book with our case, so I don't want to say it's going to be that way every time, but in our case, it delayed us just over a month in processing time.

I'm sorry that it's going like this for you, but she's pretty young still, and it's good to know now rather than later if it's not going to work out. My fiance's son accessed his savings account over the last few days and cleared it out. While we are hoping to recover the stolen funds, my fiance is concerned that if he can't, the US government will not accept his income alone as enough proof that he can support me and my son. He makes well above the poverty line, and I'm sure it's a moot point, but I'm wondering what we can do to beef it up a little. He has no investments or assets otherwise (wife got all in the divorce)

I could transfer money from my savings into his account, if it's deemed important, and I know that my house can also be counted towards this as well. Should we prepare to include everything we can?

No worries as far as your case being lost.. but unfortunately there is a logjam between USCIS and NVC right now. I don't think there has been a single July NOA2 from California USCIS get an NVC case number yet.. Getting close though! There have been a couple of June 30th. You will hopefully get through by the end of next week.

A March VSC filer with NOA2 of July 18 got their NVC case number today.

If the other parent is "unknown" (as they will consider it if not listed on birth certificate) you will have to find out from your passport office how to get a passport. It is likely that as the only listed parent, you will be the only one to sign for him.

You will need a passport for him, so you will need his father's signature to apply for it. You may also need permission allowing you to take him out of the country, unless his birth father is deceased, then you will need a copy of his death certificate.

You will need a medical examination for him, they generally cost less for children but you will likely have a lot of vaccines to update him with, given that he is so young and likely hasn't completed many of the yet. He will need to be listed on the I-129f petition, and you will need to apply for a visa for him as well, and pay the fee for his application, though the I-129f you only pay the one fee for both of you. You can seek an exemption for him at the interview, though I'm not sure what the criteria is in them granting it. I'd bring him with you, and your fiance too, it will go a long way to an approval to see him holding your son, even if it technically isn't required that the fiance be there, brownie points do add up!

Check everyone's timelines for more info... mine is a little messed up, ignore the filed in January and filed in March, as we didn't even get an NOA1 until May, but from there, you can see that the suggested 4-6 months is a little off, us being at 7 months. Now go back to when we actually filed... not so good then... Mind you, we got really really lucky with our interiew date, others that were "approved" at the USCIS portion before me are still waiting...


All you really need to know at this point in the game is patience. It will be your saving grace... In the meantime, read the threads and find out a what point you can ditch the lawyer and do the rest on your own. Might as well save some money...

1 - Do we need to use CAPS while filling out the forms... I-129F and G-325a? We run out of room on some, so by using lower case, it all fits. (It says use CAPS for last name on the I-129F form, so I'm just paranoid.

Hello everyone,

According to the example form on this site for the I-129F, in section 10 where it asks about how citizenship was acquired... the example states that if you check Birth in the US, you don't have to fill out the space below asking for the certificate number. It says that this space is filled out only if the box "Naturalization" was checked. Can any of you that have filled out it out confirm that you also left this space blank if you checked "Birth in the US."

We just want to be sure...

Hey Guys,

Reading through another thread, I've come to realize that your social security numbers sticks with you for life. I worked in the USA about 5 years ago under the Q-1 visa, and was obviously issued a SSN.

When doing the paperwork for the I-129F there is a spot under the fiancée information, that asks for the SNN, if any. Sure enough, I put "None" and now realize that the number is still valid even though that visa has expired and I've been home in Canada for the past 4 years. I can't remember why exactly, but I was truly under the impression that the SSN from before was no longer valid.

So, now I am a little concerned that the info on the I-129F is not accurate. I am assuming that the best route is to call USCIS customer service tomorrow to tell them about this. Any suggestions?

problem is that I live in a border town and have been in and out of the US endless times in my 37 years.

#30 on the questionaire. Asks if you have ever been issued a US visa? When? Where? What Type?

I was going through my old (expired) passport, and came across a few stamps in it that have B-2 written on
them. (Do I put those B-2's in this spot)?
*They are old visits, over the years to an (ex) american boyfriend. I was rejected just before we
broke up. For at the time I was visiting him off and on for 10 months (coming back in forth to canada in between)
But they rejected me for my lack of ties to Canada. (I was unemployed, no proof of residence, and bills etc..)
This was back in Dec 2008. Now I really hope this past rejection does not affect our future.

Sorry for all the questions...I am trying to figure this all out. And everyone is so knowledgable on this site!!

I read that has a Canadian I can stay in the US up to 6 months. I just want to know if instead of meeting someone from my ambasy in Canada I could meet someone in America instead?

No, you have to go to an embassy in Canada. Either Vancouver or Montreal (depends on where in Canada you live in)for example I live in Ontario so I will have to go to Montreal.
And yes you can "visit" the USA for 6 months in a calendar year.

They all know us and we rarly get a hard time (again very lucky).

First off thank you for your service to the country. As a spouse of a Marine, I hear people tell that to my husband all the time and i appreciate any opportunity to say it to other members of the military.

You personally don't need to be in the states for any of the process. You can stay in russia for as long as they;ll let you. Even through the interview process and flying back to the states with your fiancee if the time frames work out. There is some papers that uscis will send to the address you put on the paperwork. Namely the NOA1 and NOA2. It is good to have the NOA2 to give your fiancee a copy to bring to her interview, but it's not always necessary. I didn't have mine and wasn't asked for it. Others have been. You can probably get around this if you can get someone to pick up your mail and send you a copy. I would have them keep the original because it would suck if it were lost in the mail.

Before you go. Take a look at the documents your fiancee will need to bring to her interview. That way you can hand deliver them. I can't remember them all but I know my fiance had to get a copy of his birth certificate. You can find the list here on visajourney.

We chose the K1 because we thought it would be faster. We also wanted some time together in person before to plan the wedding and to be reunited after our wait.

I can't say that it was faster but I think it was. We didn't end up having any time prior though but we were happy to be married right away. To be honest, We've been married almost 2 months and I really wouldn't want to be anywhere other than with my husband right now.

We didn't keep boarding passes either. I did print out the itineraries from our trips and included them with the passport stamps. That and photos were pretty much the majority of our evidence that we sent.

Of course I brought a tonne of additional evidence to the interview.
