Do you know if all winnipeg applications get sent to Vancouver? Or is it based on which area you're going to be living in the states?


All K1 applications in eastern Canada go to Montreal, all K1 application in western Canada go to Vancouver. It's based on where you live in Canada. Unfortunately, you will have to travel to Vancouver.

How about contacting the Montreal consulate directly and ask them - the case officer is the only one in a position to tell you. I have contacted Montreal many times when I was not sure how to proceed, and they always helped.
I don't think it has anything to do with where you were born. Clear your mind from suspicions. I can only imagine that they are conducting the usual investigations in your home country to satisfy any discrepancies.
You have mentioned that "Once the interview was done, he handed me a welcome letter and told me I should get my visa within 4 to 5 days" - did they keep your passport for visa ?
As far as involving congressman, senators etc. are concerned, I wouldn't even bother going that way.....


As previous VJers have noted, it most likely has to do with where the OP was born. It wasn't that long ago when another VJer had to wait in AP for a long time even though they were born in Canada- simply because their parents were born in Egypt. And involving a congressman of senator is better than doing nothing and certainly not inappropriate after this length of time.

CanadaNOA2/Packet 3 questions

1) assuming you're just worried about your interview date being after the NOA2 expiry date, you don't have to do anything; it's automatically extended. So long as you don't wait a whole year or something before moving forward with your case, you should be fine.

4) you do not attach those documents. The birth certificate, police certificate, etc. you bring to the interview with you. Packet 3 just includes the listed forms, 2 american style passport photos, and a photocopy of the biographic info page of your passport.

 

I'm not sure about your other questions, hopefully someone else more knowledgeable than me can help you with that. Overstays are a big no-no though (which is generally 180+ days) :/

I may be wrong but from what I understand they basically "kill" the K3 partway through and it becomes either a CR1/IR1 or a K1. CR1/IR1s have interviews assigned to them and K1s schedule their own interviews, either way it takes about 4 months or so from NVC to the day of the interview. Doubt you'll receive your interview sooner because of the visa type. The reason it takes so long is because Montreal is a busy consulate.

Montreal is tough about evidence of domicile. Most likely they will want to see at least a lease and maybe evidence that he has a job in the US. You're aware that evidence of a domicile is only required when the USC is living outside of the US right? Sorry if it's a silly question, just though I'd ask since sometimes VJers think they need it when they don't.

In addition ... I have one question. In my packet 3 submission I gave them 2 copies of the DS156 (with pictures attached) and one copy of the DS-156K. It's on the list of documents that I have to bring with me along with Birth Certificate, police cert, medical exam ... etc ...

Since I sent those in my packet 3 submission, do I have to bring them again with me on the interview day ??? Or was this just a list of everything required in total ... and if I have sent it in I don't need to bring it again ?

Just want to make sure I get this right. I had 6 passport photos taken but if I need 3 for the medical, and I've sent 2 in already I won't have another 2 to put on the new copies of the DS-156 if indeed I need to bring them again.

2 passport-style photographs? Photocopy of your passport bio page? (Plus your passport of course) Letter of intent from your fiance signed within 30 days?

You can find what you need to bring on the official Montreal consulate website- that's where you should check first.

PLEASE note that there is an error on that page and the website says to bring an I-864. This is NOT applicable for K1s; you bring the I-134 instead. They copy-pasted the checklist for immigrant visas onto the checklist for K1 visas (K1 is technically not an immigrant visa). K1s have emailed Montreal before asking about this and were told to bring the I-134. This only causes confusion now because they recently changed their website and haven't fixed the error yet. So don't panic when you see I-864 on that list.

Likewise evidence of domicile does not apply if your fiance lives in the US currently, nor do marriage or divorce certificates or custody documents unless you were previously married or you're bringing children to the USA. Nor do military or court records unless they apply to you.

Make sure you have the original and a copy of the supporting documents you want to submit during your interview.

To prevent unnecessary delays during your interview, please arrange your documents in the following order:

Valid Passport and photocopy of the biographic page.
Ticket with your number (will be given at the Consulate).
Medical Examination in a sealed envelope (X-ray is not required, unless there is TB).
2 color passport-size pictures (5 cm X 5 cm or 2 inch X 2 inch).
Form DS-230 (175KB PDF), part I, or Confirmation Page of the electronic form DS-260.
2 copies of form DS-156 completed online and printed with barcode.
Form DS-156K (PDF 292K) (do not sign).
Confirmation page of the electronic form DS-160.
Statement of intent to marry from the U.S. petitioner (signed within last 30 days).

I lived in Brampton, they redirected me to 22 Division in Mississauga. I just got the one that was labeled as valid for immigration. It cost me $45 for one and $5 for each copy after that and took less than 5 minutes.

You don't HAVE to bring extra copies of P3 to the interview- it's just handy to do so in case they lost a form. It's also handy to keep extra copies for yourself because some of the information is repeated when you fill out AOS.

If you have the DS-230 you don't need the DS-260.

You do not send the police certificate, birth certificate etc. with package 3- you only send what you listed.

Most people mail their package 3 with xpresspost because it's fast, has a tracking number and it's cheap. You do not have to use loomis/DHL- it's just free if you do.

5. Sending Packet 3
How you send P3 is up to you. It can be done for free via DHL, but many have found it faster to just use an xpresspost mailer from Canada Post and eat the cost themselves. If you are sending it via xpresspost, it goes to the following address:

Make sure to again write your MTL case # on the mailer itself.
(You could also just send it regular mail, but it?s usually better for peace of mind to get a tracking number, which means XPpesspost.)

I have a quick question related to renewing Canadian passports- if you renew your passport while in the US do you still need a guarantor? The website says you do not need to resubmit guarantor information with the simplified form, but then the simplified form asks for references- I assume the references are not guarantors though. Do the references need to be Canadian?

Just to echo what others have said- lawyers are useless for Canadian K1s and IR1/CR1s 99% of the time. Sorry your lawyer gave you bad advice. sad.png I would recommend ditching the lawyer and doing research here on visajourney. Your lawyer doesn't seem to know what's going on as all east coast K1s and all CR1/IR1s go through montreal and you're also not supposed to schedule an interview until the montreal logs your packet 4, which is usually somewhere around 4-8 weeks after NVC receives your case...

And yeah, you don't need evidence of domicile. Like ralyse, I included a cover letter that had my name, case number, and contact information on it.

We weren't actively spying on each other so much as we had a jolt of morbid curiosity and found nothing. We had a good laugh about it. We both did it just on a whim and didn't look very long and then felt really stupid afterwards, lol. And we do trust each other... we've been through a lot of ####### together and came out stronger for it. And we've had previous relationships where people betrayed us, so I understand how potent our fears can be sometimes. But it's not a component of our relationship. Our relationship is plenty "good" with plenty communication and trust. And I highly doubt it's a cover up because his profile is almost completely empty but more importantly, he's never cheated on anyone, including me, and I just don't see him doing it.

 

We don't have rings and didn't have a wedding- it's not our style tongue.png

You can divorce and file to remove the condition on your own based on a bona fide marriage.  You would get a 10 years green card.

 

 

But to show that it's a bona fide marriage, wouldn't we still have to be married when I file for ROC, and show evidence from throughout those two years (up to the present) that we had a bona fide marriage? I'm just a little confused, I appreciate the help. Is there really a ROC option for a divorced previous K1 holder? I don't see anything about it in the VJ guides...

I'm massively embarassed to post this... but I think my husband might be cheating on me. I am not completely sure yet- I still have to confront him about it. I will spare you the details about proof etc. And really, I think it just might be a series of coincidences, BUT you never know... So... I will find out tonight.

 

I moved here on a K1 in 2011, got my 2 year conditional green card in January 2013. ROC is still awhile away. If we were to separate would there be any options for me to stay here? I'm assuming not, and that I would have to go back to Canada... I'm not saying we wouldn't want to work it out, but IF he is cheating and IF we don't work it out... what options are there for me?

When I had my interview in August 2011 the guard told all immigrant visas to get in the elevator (and I think that included K1s- at least, that's when I got on the elevator, and I don't think I was the only K1 :whistle:)

today was Rue St. Catherine's downtown Montreal. Apparently it has a great Santa Claus parade for anyone that will be here come closer to Christmas. As to shopping, it had a lot of great shops to go into, nothing too far different than Toronto. I particularly enjoyed the Betsey Johnson store, just because it was so much fun! I did not spend any money, though was sorely tempted by a faux fur scarf in a le Château there....

Hope everyone else here is having fun!

We're also right around the corner from Place des Arts, and they have a light show going on, so tonight we went to go check out the giant spotlights that you can manipulate and point into various angles of the sky. It was so much fun, we'll be doing it again I think!

Two more days to check things out then on to the consulate!

Goodness, I'm the only one posting in here!

Today was a nice day, we went up to Mount Royal, walked all the way up Parc Avenue and wound our way up the mountainside till we got the the steps. Someone said there are 286 of them to the top. It's definitely worth the view, really pretty, and we stayed and got a ton of great photos. The park is really nice and with all the trees changing colours right now, it was a great sightseeing day. I would recommend this as a must do here too!

Chinatown!!!

We went to Old Montreal today, it was nice, and ate at les 3 Brasseurs. (I had Maxi Poutine, which is poutine like normal, but the fries are dipped in beer batter first, really yummy!) My son had the Royal Sauerkraut (sausage, ham, pork shank, potatoes and sauerkraut) and we tried their beer too, very nice. It was fun running around in Old Montreal, definitely worth a look, the cobblestone streets are worth it alone just to see them.

But what I really liked today was Chinatown! I will even be going there again! There is a guy there named Johnny Chin that makes Dragon's Beard candy. This is rarely available anywhere outside of Hong Kong. It's chinese cotton candy with sesame seeds peanuts and some other sugar too. (can't remember what) It's 75cents a piece, or 4$ for a box of 6. We each took a piece on the way to Old Montreal, but came back for a box of it when we were on our way back to the hotel. I then looked it up and realizing how rare it is, I will make sure to go back before we leave to get somemore to take home. He's open 7 days a week. (also his bubble tea is really nice too) China town has a lot of really neat buildings to look at as well, all with a Chinese flavour to them, but old..

I'm in Montreal now, and we're planning on checking out Old Montreal tomorrow. (Sunday looks like a better weather day, but I wasn't sure about what's open and not on Sunday's here)

Last night we went to Bistro Cafe e Cucina at 350 Sherbrooke west, it was really yummy! Very good service. I had Linguine with baby clams, my mom had 3meat lasagne and my son had mussels and frites. It was really good!

We're planning on looking at the museum at McGill, RedPath I think it's called. It has free admission! Also there's the largest underground city here, so we have to check that out too!

I'll keep posting reviews on here as we go places, but don't expect a whole lot of restaurant reviews, we have a kitchenette and plan to make a lot of our own meals!

Cananner I'd totally love to meet up for coffee... latte actually if you can recommend a good barrista in the rue St Denis area? I'll be there from the 20th to the 27th, and while I'm not going alone, there WILL be time in there to meet a VJ friend. (or more if we can make it a group event??)

Thanks for putting up this list, it's got some excellent ideas, esp about the Wed night museum freebies! I'll definitely check those out.

Anyone have any suggestions for shopping? I particularly want to look for a faux fur stole to wear with my dress, and a fascinator and birdcage veil. Any good bridal supply shops? or anything like?

Don't forget to bring a copy of your NOA2 with the confirmation DS160 page to the interview. It says this right on the DS 160 confirmation page that the NOA 2 is to accompany the 160...sorry don't want to stress you out but don't want you to be missing something on your interview day that could have been avoided thus making the consulate issue an RFE.

I have misplaced my copy of DS156?? I have the kids and their barcodes..what do i do? If i re-do it will it mess everything up?? HELP

Does it come up that I am a K1 applicant when they type in my name or license or b.cert no. ?? I've been over several times since we've applied (I'm a border city girl .. FI is from Utah .. but I visit Michigan often for concerts and what not) .. and they've never mentioned anything about my K1 visa.

CanadaWhat Are You Reading?
I just finished reading Twilight last week or so. I wanted to see what they hype was all about, and my sister kept pestering me that I "just had to read it!". I found it rather....not as interesting as I thought it would be, considering the hype. I mean really! They sparkle!? sheesh wacko.gif that's just not right. I'm glad I did not pay full price for it.

Before that I read Revolutionary Road. It wasn't bad really, and I could totally relate to the suburban doledrums!

I am also reading The Watchmen graphic novel. If you like comic book style novels, I would recommend this one. I saw the movie before I read the book, so there are some differences, but the opening scene and naration of the movie, are almost exact panel to panel from the novel. And Dr. Manhatten is wearing a speedo in the novel, not so in the movie. wink.gif

Books that changed my life:

The Lord of the Rings trilogy, I've read it more than 20 times I think, though not since the movies were released for some reason. Which is weird. I should pull those out again this summer. How it changed my life: I was a fan before the movies were announced (obviously), but then when the movies were announced, I found this website forum for fans, and that's where I met my husband. We own the site now.

Celtic Myth & Magic, Edain McCoy. My first introduction to Celtic paganism. There are a few historic inaccuracies in this book (common in Llewellyn publishing unfortunately), but it led me to search the history section of religion, rather than sticking to the "new age" section of book stores.

A History of God: The 4000 Year Quest of Judaism, Christianity and Islam, by Karen Armstrong. Whilst reading this book, I finally "got it" why I just did not fit into the Christian mould, and I actually had an epiphany. I need to re-read this one, and see about reading her other books.

Good Calories, Bad Calories, by Gary Taubes. Another "aha" book for me. Makes complete sense.

Stories I enjoyed reading, that did not necessarily "change my life" but I still highly recommend:

The Tales of Kolmar series, by my dear friend Elizabeth Kerner. Wonderful beautiful lady, and a great fantasy writer. I just wish she'd hurry up with the next series! She's been promising it for a couple of years now! sheesh! Her heroin Lanen is an inspiration, and the Dragons in this series are quite different than from other fantasy dragon stories.

Wicked, and Son of a Witch by Gregory Maguire. I loved loved loved Wicked, and naturally followed up with Son of a Witch, which was not quite as riveting, but still a sit until I was numb page turner! When I was younger I loved reading The Wizard of Oz, and I still have my book from way back. The stage musical of Wicked is very enjoyable as well, I wish I could go see it again and take hubby. I've been trying to convince him that a trip to NYC or London is in order. wink.gif

Harry Potter series: except Half Blood Prince I think. It felt a lot like she had her daughter write it for her tongue.gif

I'll think of some more later. We have so many books, this could go on forever!

It's a good idea to bring copies with you to the interview. Montreal is supposed to have the original packet 3 you sent in but you never know if something will get lost. I just printed off two copies of packet 3 when I filled it out and kept one. They didn't need the extra copies at my interview, though. It's just a precaution.
