Not just because ur moving to the USA. You still have to have enough qualifying hours in Canada, and the amount u get is based on how much you made, etc! As a K1, you can't collect EI until ur legally able to work in the USA. Not sure what the maximum time is, back in 2005 it was arounf 38 weeks I think, but I believe it has been increased?????????


Thanks, that helps :) I work exactly 38 hours a week, but at least I know that if I'm going to try and collect EI I don't have to worry about it right at this instant.

OKay, this is probably a big NOOB question, but I was unaware of it until looking at this thread...

Am I correct in understanding that you qualify for EI just because you're relocating to another country? My interview is really soon and I haven't even looked into any of this stuff. I just had no idea this was an option.

How long does the EI last for?

My 2 yr resident card and EAD are going to expire in a few months, and I have no idea what forms to use. If everything is included in one price....any direction would be greatly appreciated.

Still nothing from Montreal, no response to email, and still not being processed. We're at the point that if it's not here by tomorrow, we'll have no choice but to cancel my fiance's trip up. We're now at 9 business days gone, 10 if you count the interview day too. Anyone recently get their passport that can tell me what their wait was like? I know there was trouble in the summer, but I thought that had changed recently.

All I know is I need it for this weekend, or my fiance's flight up to Buffalo and truck rental and drive up to get me might be in vain. We can't afford to send him home to come up later for me, and he needs to be at work the day after we planned to be back. We can't drive all night cause I can only drive motorcycles not trucks, so it's all on him once we go. I'd hate to have to have him go back, and then be stuck trying to make money to follow him somehow.... Calling Dos tomorrow...

Thanks Brooksie, I called today just in case and the guy on the phone said exactly the same thing, just fax my EAD as soon as I get it and not to worry about it. He also said that I don't need to send in any cards until I get the EAD.

Yes, You are ready and willing and capable to work!! <img src="style_emoticons/<#EMO_DIR#>/wink.gif" style="vertical-align:middle" emoid=";)" border="0" alt="wink.gif" /> They want to make sure you are work authorized and as a K-1 you are work authorized.. just can't be hired by an employer without a stamp - SO it's a catch 22 and basically on paper you ARE work authorized and thus elligible for EI...

There is so much information in this thread, and I can't even get into the old one at all to find out all the how to part of it, but I put no on my application because I knew I wasn't allowed to work.

But if it's true that I am able to work, just not allowed to without the stamp on the SSN, should I have put yes? I just got my NOA for my AOS, so I know I need to send that in, but now I'm really worried that I have made a huge mistake, as I'm at the point now that I'll be expecting to start getting cards to fill in too, and don't know what to put.

So, I've been going through many, many threads about importing your vehicle and would just love some clarification, please. I just always need to make sure I got this all right! (This stuff makes my head hurt!)

I understand that you do require a compliance letter. I have already established that I can get that done quickly and without a charge. Interestingly enough, I've also been told it is valid for 30 days from Kia.

In the compliance letter, if it states that my car conforms to US standards... except the daytime running lights... do I need to get them disconnected or not? I'm concerned with the nhtsa.gov site says:

"If the manufacturer?s letter states that the vehicle complies with all applicable FMVSS except for those pertaining to the speedometer or headlights, the vehicle can still be imported as a conforming motor vehicle under Box 2B, provided the importer furnishes Customs with an invoice from a franchised dealer or repair facility authorized by the vehicle?s original manufacturer showing that the affected components have been replaced with U.S.-model parts."

The way I read that, if the daytime running lights are mentioned in the letter, I have to get them fixed. But, from what I've read on here, many VJers haven't had to do so. Any advice?

I want to be prepared when I cross the border, so aside from the compliance letter, is there some other paperwork I can have prepared as well? (The HS-7 Declaration form?) Also, do they need any EPA documentation or is this more for manufacturers and registered importers? I think I read a really old thread about needing to get a car tested. I have 2006 Kia.

I wrote an email to the Florida Department of Saftey of Motor Vehicles regarding the registration. I have to say, they wrote me back within 12 hours and were pretty informative:

"Thank you for your recent inquiry. The Declaration of Domicile must be filed with the Clerk of the Court’s Office. Once the Declaration has been filed, your residency has been established.

In order to title and register a motor vehicle in Florida you will need proof of ownership (the Canadian Certificate of Title). If the proof of ownership is in a language other than English it requires a written English translation, signed by a translator, before a notary public. The translator must also state on the translation that he/she has knowledge of the two languages OR is fluent in the two languages; translates documents as a normal course of business and that his/her translation of the document is accurate. The person translating the document must be someone who has no previous or current ownership interest in the motor vehicle/mobile home. Form HSMV 82040, which can be found on the department's website http://www.flhsmv.gov/html/forms.html, must be accurately completed, including section 8 by a DMV Compliance Examiner/Inspector. (Out-of-country VIN verifications are checked thru NICB. If results are returned showing a lienholder on record, the VIN verification will not be completed until an original letter on letterhead stationery, from the lienholder giving permission to have the motor vehicle titled in Florida is received.)

The completed form, proof of ownership, proof of Florida insurance and title and license plate fees may be taken to a tag agency your area, for processing. The title fee is $85.25 or $87.25, if a lien is being recorded on the Florida title. License plate fees are based on the weight of the vehicle, therefore, we cannot provide you with this fee. Please use form HSMV 83140, License Plate Rate Chart to figure the fees needed for the issuance of a Florida license plate. The $225 Initial Registration Fee will be due. This form can also be found on the website mentioned above.

Six percent Florida sales or use tax and local discretionary sales surtax is required to be paid before a certificate of title and license plate can be issued by the department. The amount upon which the tax is applied is the larger of: 1) 80 percent of the loan value. 2) The fair market value on date of entry. 3) The outstanding lien on the motor vehicle at the time of entry into this state. No credit is allowed for any sales or use tax paid to a foreign country. We hope this information will assist you. "

Thank you trailmix! I appreciate the info as I'm trying really hard to figure how much money I'll need to get my car all set up. (This stuff never ends, does it?!)

As for the registration timeframe... the 10-day thing is definitely not gonna happen as I am unable to get my Florida DL until after we are married, and after we get the NOA1 for the AOS. (As per the e-mail reply I received from the DMV.) I'm assuming that you can't register your car in the state unless you have a DL for the state, so that helps to squash the 10-day requirement. I'm assuming that you had no issues going to register 2-months in...?

Visa in hand! 7 business days from interview, standing in front of DHL now, waiting for my taxi. I'll note that once I got the waybill, I kept my eye on it. It got to the Waterloo location at 7am. I never did get the email saying it was ready for pickup, but I called and confirmed with the DHL 800 number that it was fine to go get it. My fiance will be here in a couple hours, going to POE tonight at the Bluewater Bridge!

After months of reading this thread, I am absurdly happy to be able to answer the poll finally, lol. :D

THAT IS AWESOME!!!!!!!!!!!!! Enjoy your LIFE in the USA :)

Hi from Utah everyone!
S and P, approved status is pretty much printed, this is what the lady told me and by that evening I had the DHL email. Can't believe its taken them this long for yours!

My poe at port huron was super smooth! Got to the boarder around 2pm, honestly waited longer in line going over the bridge and getting to the booth than the actual processing of the visa in the.building. had a trailer full of stuff and they never even wanted me to open it, truck imported with no problems. Travelled 3900 kms in less than 48 hrs.

Only crappy part was Matt and I.had Sunday together then he had to head six hours away for work for ten days. He will be back Wednesday. We are going to get our marriage license Thursday and getting married Friday. So excited to see him in five days and get married on Canada day. Hehehe pretty great choice of date on my part I have to say!

Got the email last night that DHL picked up my visa.....Got the phone call from DHL this morning at 8am saying it was in Dartmouth NS and ready for pick up. My morning was too busy so at 1pm I had a road trip to Dartmouth to pick up my visa.....Visa sitting beside me at the table here. What a great feeling! I want to thanks all the people of VJ that helped us get this far :-) So it was a week and a day from my interview to have visa in hand. Not too bad at all! :dance:

You don't actually have to travel anywhere to get it. That was my misconception, too. I thought I had to travel 2 hours to London, ON to get it. But, as it turns out, you can have your passport re-routed to your house for $16. It was a bit of an annoyance for me, because they messed it up the first time they attempted delivery, but the 2nd day, I got it no problems.

All you do is go onto the website that you schedule your appt at, and then send an email to csc@dhl.delivers.ca (or something like that, you'll have to check it online to be sure)... anyway, and send them the list of info they ask for. It's all on the site where you schedule your interview. I know my instructions are really vague, but I swear, it's all outlined really well online. I had it delivered to my place, for $16! So much more convenient!

Oh, and you'll get instructions on the back of your "congrats" letter at the consulate. No 4 hour trip for you :)

Yes, and I suppose it's handier knowing that there's one less thing we have to bring to the interview... but times tend to vary so much! DHL wouldn't even have to be involved if they could find a way to get approved visas back to the petitioners the same day, no?



That would be an awesome thing if they could!!! For I am sure I am not the only one that has to travel almost 4 hrs one way to get their passports back after the interview. :(

OK, so apparently, my ROE in finally on its way to my house. However, I doubt that it says "relocation for marriage" as I had no idea I even qualified for EI until last week (well after my last day of work .. which was the end of april). will this be a problem ?? will a US marriage certificate perhaps be good enough ??

My husband and I jointly submitted our I-751 (with our slew of supporting documentation) to remove the conditions of my conditional green card. My conditional green card expires at the end of August 2009. The California Service center received our submission this morning smile.gif However, according to the USCIS website, I-751 processing times are on average 6 months! Now I don't want to panic yet, but if I don't get my new green card by the end of August, and my other one expires, I will not be a legal permanent resident. Am I missing something here?? I have job and a plane ticket to Canada this October, and without a green card, well .... you know where I'm going...

Last week we received my I-797C, Notice of Action. It's the letter that extends my condition green card for one year. So is it safe to say that we won't need to send in more evidence?? We just been assuming that we'd have to, but this letter has be hoping otherwise. Was our evidence sufficient then?
