1.i know that iranian citizens dont have to have their police certificate with them when they go for the interview,BUT every person i have talked to who applied with a lawyer told me their lawyer advised them to take it with them,just in case.now i called and checked,every police certificate issued in iran,expires within a month,if they somehow ask for it in the embassy will having an expired version be an issue?considering i have to go to turkey a couple of days earlier than my interview to get medical and all,i wont have access to get a new one

2.is it safe to say since my country has no relations with the states,the NVC stage for us will be a very quick pit stop?

3.im trying to estimate how long after i post my packett3 ill get informed about our interview date.for turkey the average is 5 months prior to the date,is estimating by the average timing like that accurate?

4.my fiance is active military,and he most likely WONT get deployed while waiting on our interview date.if we call the embassy and tell em that he might get deployed ( yes yes thats a lie but we all know how hard waiting on the last stages is ) would they check his platoon and all to see if he is telling the truth?

5.some say you can find packette 3s online,is that true?if so can someone link me the packette 3 for the US embassy in ankara

1. I do know there are a couple of countries that are not required to produce police certificates. I do not know if Iran is one of them. there is a website that lists them and how long they're valid for but I cannot recall where to find it. Maybe someone else can post the link if they can't find it. I would try to bring one if at all possible. Getting a 221 g (document request) instead of an approval really sucks.

2. No, it's not safe to say that at all. for all we know it could take them 5 months to even get to you in the stack. I really don't know how they do what they do at the NVC but I don't think they organize by country. It kind of seems to be luck of the draw.

3. Nope, i wouldn't estimate by averages. especially if it's not the embassy you will be going to. Every embassy is very different and even teh same embassy can vary greatly. At Montreal they seemed to schedule interviews every 6 months. that would mean that some people would wait 6 months and some people would wait a week.

4. Yes they will check to see if he is actually being deployed. During our process Kevin was potentially going to be deployed and when i mentioned it to the embassy they said they wouldnt' do anything without written orders or letters from his CO. If that does happen, then you can request an expedite. To be honest, I was much happier waiting longer than to have him deploy.

What is a police clearance? Do they require this for UK fiances?


A police clearance is basically a background check for the beneficiary from the country they currently live in, or have lived in previously for a period of a year or longer. I believe I'm right on that time frame. If anybody knows if its shorter or different for particular countries feel free to chime in.

For example, I am from Canada and lived most of my life there but spent 1.5 years in Japan. The police certificates I needed were from Canada and Japan. I was able to go to my local police station for the canadian one. The one from Japan required me to go to the Japanese Consulate nearest to me to request one.

Every country is different and obtaining the police certificate will be different for everyone. If you aren't sure then you can take a look at the Visa reciprocity table on the DoS web page found here

yup. but the petitioner does have to send the affidavit of support and an updated letter of intent. I asked my fiance to send a copy of our lease that had my name on it but they didnt' end up asking for it at the interview. I figured it was evidence of relationship and domicile. I'm probably missing stuff here but the lists they have under the K1 guides are very detailed.

I would definitly work on getting the paperwork that most people get tripped up on at the interviews. Divorce paperwork, child custody, police clearances, affidavit of support documents, and sometimes proof of domicile. Although I think proof of domicile is more necessary if you were filing a IR1 or CR1.

Given my own personal experience. I would suggest getting police certificates in order, particularly if you lived out of the country for greater than the allowed time frames (6mths to 1yr or greater I seem to recall).

I also filed for a K1, hoping to go back to school at some point. Since I have no immediate plans to do so, (i haven't applied to a college) I checked 'no' to that box. I think they are looking more for people who already have applied or been accepted to colleges and aren't going to wait for their greencard or authorization. I don't think it will come back to haunt you if your fiance plans to wait a year or two.

I would definitly have them send things to your parents address. It is far better to have them safeguard the paperwork that will be sent than to have it lost in the mail. Plus, you will probably like hearing when you get the NOA's faster than you would if they were sent to Argentina. I would have them keep the originals and send you copies. You do not want to lose the NOA2 because you will need it later for AOS.

the copies are just for you to keep in case something gets misfiled or lost in the mail. We actually signed both the original and the copy instead of having a photocopied signature.

That being said, I don't think I was asked for any part of the I129f packet at my interview. Many people don't bring any of it. It is just for insurance I think.

I think you need to step back a bit and think about who will be opening it. Try not to vary too much from what they request because if you were receiving it and had to wade through 70 pages of texts to get to the actual forms that might be frustrating.

I wouldn't worry about attaching every page together into one packet because they will just take it apart. We just made sure that the forms couldn't get mixed up by stapling them. for example I stapled the i129f together. I also stapled the g 325a with my photo, which i did put in a ziploc bag and had attached to a blank paper. They don't want the photo adhered to anything since there has to be writing on the back. Then I just put it in order of what was listed on VJ and mailed it in an envelope.

Extra documentation won't affect the decision but it might frustrate the person who is getting the packet. I suggest not putting something in unless they ask for it. It will just make the packet more confusing to the person getting it.

I had to attach a separate page for my G-325a for the employment and where i've lived, since i've lived in different countries and had many different jobs. It did not affect our petition. Are you the petitioner or beneficiary? If you are the petitioner you just have to be sure you meet the minimum income requirements or have a sponsor and you should be all good. I think that is more important in the interview phase but I can't recall since it wasn't an issue for us. That also applies to the criminal record part too. I don't believe the petitioners record would affect the application, only the beneficiaries.

Basically they only care about the USC's money and the petitioners criminal history. haha.

Also, at the application submission they only require proof of having met, proof of the relationship is for the interview part. So focus on sending the passport pages, flight itineraries, airline ticket stubs, and photos. We felt that anything more than 5 - 10 pictures would be overkill. We did put in a few emails, and phone records but only a couple of pages, they don't want to read a novel. And make sure there isn't anything too personal in them either.

I wonder if you would run into problems while crossing back and forth across the border? Can US Customs even tell when they swipe your passport that you are in the visa application process? Can your visa process get banned?


I would take a look in the IR1 CR1 threads to see how lucky other people were on the visiting/ working in the US while waiting for their case to be finished.

Yes, I'm pretty sure customs can tell when they swipe your passport. Depending on how you cross. I've never been swiped while driving across. but they swipe every time at airports etc...

Hi Moyo,

It sounds to me that you might need to file the I 130. If you file a K1, it might not be finished in time for the wedding. Also, you will not be able to work in the US until after you file for AOS and EAD. I just filed and it's already been a month with no word on either of those. Every case seems to be different though with some taking a few weeks and some taking a few months. You will have to wait to file the I 130 until after the wedding. If you do file the K1 and it isn't finished by the time you plan to get married, I believe you can go and get married, as long as they let you across the border. However, it will render the K 1 petition void and you will have to leave the states and file for the I130.

I have heard of people crossing the border successfully after having applied for either option. Although it seems that it is often at the discretion of the US customs agent, how they feel that day and how much documentation you have about your ties to Canada, your job requirements and possibly a letter from your employer stating you are travelling for work and expected to return to Canada.

Do you know if your employer has an immigration lawyer they consult with? A friend of mine had a similar situation and she worked for the film industry. They had a lawyer that handled any cross border questions or problems.

Montreal Takes forever. I don't know about any changes. But our case was finished at the VSC in less than a month and got to montreal in a very short amount of time, I think about 2 months. it then took 5-6 months to get an interview. Check out the Canada forums for current info on montreal times to interview.

Does it say anywhere on the envelope not to open it? I'm not sure how it works when they mail it to you but the ones that are picked up at canadian police stations are generally open.

Generally the documents that were supposed to stay sealed were taped and said 'do not open' on them.

To be safe, I wouldn't open it. Bring it sealed to the interview.

Maybe somebody who's had it mailed to them knows more.

You can go to the embassy of the country from whom the police certificate is needed. they will generally give translated copies but you might still need to get them translated.

check The state.gov `reciprocity by country` page. It will tell you how to get it, generally how long it takes and what you need to do. There are some countries where the police certificates are unavailable. Its possible Indonesia is one of them.

I had a really hard time waiting and waiting for my visa. It always seems to take longer than you think. At first I was checking online every day for any info on uscis, both online and calling them, and watching what other people were getting here on Visajourney. then one day i realised I had to stop before my brain exploded. I limited myself to checking once a week, and i mostly stuck to it.

then I got in touch with my long lost hobbies. I knitted a blanket! (well half of one). I attempted to build a website. etc.

My S.O and I did talk every day and i think that got me through it most of all.

And I do agree that people asking only made it worse. Just when i wouldn't be thinking about it somebody would ask again. Eventually i had to tell people that they would know without asking because i would be jumping up and down in joy and shouting at the top of my lungs.

Purplesky, in theory, your idea is perfect, but since the honeymoon was booked for two days after the wedding, and I'd need my fiance present in the US for the wedding, we wouldn't be able to fly him out of Canada to DR. And there's no way to push anything back with the wedding: we'd lose everything we've spent. * sigh * I do agree, it's not worth risking anything, especially when you're getting conflicting advice from people who should be telling you the same thing. Also, too much of what goes on with a person crossing and the BP is up to the officer's discretion. You never know.

The way I am looking at this now is that at least we will be able to get legally married at our wedding, which we didn't think was going to happen.

Just as a quick run-down to answer everyone's questions:
Kennym, yes I do know we have to get married here. Our wedding is in NH.
Inky, the honeymoon is after the wedding. Our wedding is September 3, we had booked the honeymoon for Sept 5.

Long story short - Because of all of the hangups we were having with processing time (US being busy), we accepted the fact back in April (after getting a letter from the Consulate in Montreal saying it'd be another 4-6 months before my fiance's interview) that we would probably not be able to get legally married at our wedding, so it'd be a pomp-and-circumstance party. We would just have to wait until after he got the visa to have a legal, officiated ceremony.


The plans was
-Fiance drives to MA
- "Wedding"
- Leave for DR
- Fly back to Boston
- Fiance drives home, grabs his stuff
- Fiance enters on K-1
- Get married

After finding out the visa is *affixed* to your passport, I accepted all of this as impossible, and honestly, I still don't know if trust that he will be able to enter the US after the DR trip without a problem. Booking the honeymoon was a mistake, however, we thought we were clear on all of the terms. One of the most frustrating things about this whole process is that you can get contradictory information even from official sources.


It looks to me like something does have to be cancelled. I guess just pick whichever is less expensive.
You can get married as planned and cancel the honeymoon in the dominican ... or...
you can meet in the dominican and see if you can switch the wedding to after.

There have been people who have had mock weddings and then legally married. But it is a bit risky at the border.

Maybe try to see if either option can be moved and go from there.

It is pretty frustrating when you make plans and they have to change. We had booked our wedding and had to move it when I didn't get my visa on time. Luckily it didn't end up costing much and I think worked out better. Good luck

No, we do want to be together as soon as possible, it's just that we spent a lot of money booking a honeymoon, so I was hoping we could hold off on the visa until we returned from DR, at which point we'd go back, grab his belongings and move him in with me. :) <3

He called the Highgate Springs, VT, border office, and the official border officer reassured him it was completely ok, and that he was able to enter the country without using it, based on the B1 visa (? I think that's what it was called). He also emailed the US Consulate in Montreal about it. I'm just not sure what happens when we enter DR and they see it. I don't know how it works when you go into other countries, tbh. I've never used my passport for anything other than Canada.

And Hendea, yes -- that's what we want to do: enter on the K-1 after the trip, but the flight is out of Boston.


Just to make sure we have this right:

-your fiance will fly to boston

-You will then fly to DR (beautiful place for a honeymoon btw)

-You'll fly back to the USA and activate the K1

-Then you'll get married

Sounds like a solid plan. I have heard of people going across the border without activating the K1. As long as the CBP agent knows this then you should be fine. I might not mention it to the CBP agent that it was your honeymoon trip. Maybe make it your reunion trip as honeymoon definitely sounds like you already got married which would invalidate the K1.

are you in eastern or western canada? there are only two embassys that process K1 fiance visas so if you are on teh west coast you are in luck because vancouver is a fast consulate.

If you are in ontario or east of that you will be interviewing at montreal which adds a few months to the process.

If you are planning on getting married before filing then you will be interviewing at montreal no matter what.

This could be a factor in your decision so keep it in mind.

Fiance and I got engaged Xmas Night. Just looking at starting paperwork ASAP and looking over everything Im completely nauseous. He is in PA I am in Ontario..

Couple ?s and Im sure they are on here somewhere but Im feeling so overwhelmed right now..lol I dont know whether i want to throw up or cry..

3. I have 2 small munchkins that will be coming with me..Is there extra paperwork? I see the spot on the K1 to list them but is there more paperwork? or is that at a later date? haha Im assuming theres more fees somewhere for them?? Do they require medicals as well? interviews?
4. After we start the paperwork am i still free to travel between the border like normal or?? Looking at going to visit in March..Do I tell them we are engaged or just?? help

Thanks all for your advice. Michele and Mags are right, the issue is that I won't have a confirmed job when I return because it will probably be agency work. My mother lives 300 miles away and so I won't have had chance to sign up for work until I return in September.
Michele, I did think everything made sense too! There is no way I could afford to go through this process had I not been given the opportunity to return to live with my Mum for a while. Anyway, I think I can handle the questions, I was just concerned about not having appropriate documentation to back the words up. But, I do have copies of the K1 application we're about to send in and can get the letters you suggested to confirm I still have ties to the UK.
I just wonder why US immigration would assume that anyone would apply for the K1 then mess it all up by staying in the US for an illegitimate length of time.

Seeing the number of people who have been let in for 90 day visits is reassuring. My husband and I are still going to the US for 15 days later this month, but I have to move back to the US in August to start law school and his application probably won't be done until December/January. We're going to try and see if he can come with me for the first two months that I'm in school, because I have no holidays in those months and won't be able to go visit him at all. I have a week off in November and two weeks off in December, though, so it'll be easier for me to go to Canada then. I've been really nervous about him being allowed in (especially since this will be barely a week after we get back from our 15 day vacation), but we're really prepared in terms of documents and letters and proof that he'll return and we think we know how best to answer questions at the border, so I'm hoping we'll be okay. Reading everyone's experiences getting in for long periods of time has helped calm me down :)

My husband and I (I'm the USC and also a Canadian PR) live in Canada. We've gone into the US together once since his application was sent to Montreal. The immigration guy at the border (Pearson Airport in TO) asked where we were going (NYC to visit my brother) and how long we were staying (4 days). He scanned our passports and looked a little annoyed and asked us when we were last in the US (beginning of April). He asked us what our jobs were. My husband said that he's an audio technician and I said that I'm a legal transcriptionist. He stamped our boarding passes and sent us on our way. His very stern attitude scared me, but my husband took it all in stride. He didn't ask to see any proof of anything and didn't actually ask us if we had a visa application in process. Just in case, though, we had with us:
-A letter from my husband's employer stating when he was due back at work
-A copy of the lease on our apartment

We're going to visit again next month and I'm a little more worried because we'll be there longer and we'll be in different places. We're starting off visiting my grandparents outside of Boston, then going to a wedding in Boston a few days later, then going to Colorado for a vacation for 10 days, then driving from Colorado to TX, staying in TX for two days, then flying back to Toronto. I have thought and thought and thought and I have no idea what I'm going to say when the immigration officer asks us where we're going. But we'll have the same evidence as before, including an invitation to the wedding we're going to. I tend to get really nervous about this kind of thing, so I've thought through every question they could possibly ask us and I've got answers all mapped out in my head. I figure since we're travelling together and returning to Canada together, that will help us get Steve across the border.

I don't have a letter from my employer for a variety of reasons. Does that seem like something I would need, or do you guys think that just a letter from my husband's employer would suffice?
