CanadaWhat About DUIs?
File sharing isn't as common with other countries like it is between Canada and hte US, so the odds of another country scanning your passport and seeing any existing charges is not likely. Canada and the US have full police file sharing so as soon as they scan your ID at the border, or enter your name into the computer, they'll see your history.

However, I did read maybe last year that the UK will be entering into our file sharing, so soon if you have a criminal conviction you won't be able to travel to the UK either. Which could possibly fan out to the entire EU, I dunno how their immigration and borders work.

The US has been known to ban Canadians from entering the country if they had a minor charge for marijuana possession 20+ years ago. People here at VJ over the years have even had visas denied because they admitted to inhaling during high school or college. Why? Because the US views people who use drugs as (except in the case of anyone running for president of course!) undesirables. Even if it was several decades ago, and you have no criminal record. Just admitting that you've used even once could make you inadmissable!

CanadaWhat About DUIs?
Because the conviction was less than 5 years ago, he is definitely inadmissable to Canada. AFTER 5 years has passed since his license was RE-instanted, he may need to apply for rehabiliation, or he may be deemed rehabilitated.

For information on the rehabilitation forms and process see http://geo.internati...missible-en.asp

It'll be about a year to process the CR1 visa for you. Go have a look in the CR1 forum for detailed info, and/or read the guides above.

Having both processes going at the same time is not advisable, but it is do-able. IF the US side finds out about it however, they'll just cancel your petitions/applications for US PR.

The Canadian process isn't nearly as long in most cases (DeadPoolX here recently completed his in about 6 months).

Yes, you can get US citizenship once you're eligible. No, you do not have to give up your Canadian citizenship.

CanadaHaving a baby in the USA on K1
Even with insurance in the US, it'll still cost more to have the baby here than it would in Canada. Plus, while you're on Canadian maternity leave, you can move to the US on your K1 and still collect EI benefits.

No, the baby would not need a visa, they would need to register his/her birth abroad at the US consulate, and it would have US citizenship.

sheesh, it takes my credit union about 5 days to post any transactions to my account! Its bloody rediculous really. Back home I could go make a POS purchase, get home and check my online statement and it would already be there. Even if it was a Sunday!

CanadaCanadian Bank Accounts
I used to bank with ScotiaBank and I don't remember any fees. I could even use BoA machines in the US without service charges. I had a daily limit on my debit card, but as previously mentioned, that's for your own safety in case someone gets hold of your number. I also have a daily limit on my State Employees credit union debit card here in the US. And montly fees tongue.gif

Canadian banking is far ahead of US banking as well IMO. Pretty much entirely paperless, unless you're a luddite without a debit card. Which I'm guessing there's not many of in Canada anymore, considering most retailers and grocers will no longer accept cheques. Cheques are so silly, and make people wait longer in line at the grocers tongue.gif I'm not even sure you deposit or withdraw from your account unless you have a bank card in Canada.

the credit union here just got card readers at the tellers but no one will use them. Not even the tellers. wacko.gif

There are also example forms here that you can have a look at to make sure you are completing yours correctly.

CanadaFiancée's moving to Canada! Help!
1. If I'm in Montreal and she's in Atlanta, and we're getting married in Atlanta, where do I get my marriage license? Canada or Atlanta?

You apply for the license in the city/county in which youre to be married. In your case, Atlanta.

2. We're waiting on her Rehabilitation from the Canadian gov't (8-year-old DUI) -- she sent in the form in early July, and we're hoping she can come up and visit in November (with marriage and move next March). Does that sound reasonable? Would the border folks really turn away my SPOUSE at the border for an 8-year-old DUI?

My husband was turned away for a 20+ year old juvenile charge. So yeah, she can be turned away for an 8 year old DUI, which in Canada is a severe offence.

3. I know that she can ship her goods up here without paying duty, but what's the cheapest method? We're paring down her stuff before the move, but we're basically talking about 1000 books, some kitchen stuff, clothes etc. Probably about as much stuff as would fit in a large well-packed pick-up.

If she's driving up, she can bring it herself, once she has her PR (not before). Or she can send it UPS or FedEx or USPS.

There don't seem to be any "moving to Canada!" forums that are as comprehensive as VJ, but if you can recommend any resources, I'd be grateful! http://roadtocanada.com is very comprehensive and is the Canada equivalent of VJ.

Nope, it was illegal in Ontario for several generations for stores to be open on Sundays (except stores in tourist areas and gas stations and a few other exceptions), but then a Toronto store owner who was just outside the "tourist area" who refused to close, helped to get the law overturned and now everything can be open on Sundays, as long as employees are not "forced" to work if they don't want to.

I don't get it. North Carolina is kinda far from the Gulf Coast, why is it included in the warning? Makes no sense. Gustav seems to be headed in the completely opposite direction.

Hanna on the other hand seems to be headed straight for us, but she's not very big, and may not even get to hurricane strength. We might get some rain, but I doubt it would be anything much to worry about.

I have a bunch of those mutant flags. They usually come out of hiding when we go to Canadian events here in NC. I think I've given them all away though, I can't find my last one sad.gif

I have the Made in Canada logo on my back right shoulder. I've had it for longer than I've known my husband though. I've thought about getting something to symbolise both countries, but not flags, I was thinking more the bald eagle and a beaver. With the beaver on top of course. wink.gif

CanadaMedical insurance
Depends on your US spouse's current plan if you can get on it right away. Some insurance companies wont let you if you don't have a SSN.

Travel insurance like Blue Cross may not work because you're not just travelling as a tourist, you're actually staying indefinitely. There are insurance companies however in the US for new immigrants. Just Google "immigrant insurance in the US" and you should be able to find something. But first have your fiance check with their insurance company to find out if you can get insured immediately after marriage.

CanadaWorking in Canada after getting CR-1
You'll have to file taxes in both Canada and the US anyhow, because you're married to an American, doesn't matter if you're living there yet or not.

Once you have your CR1, you can travel back and forth. When you're coming back to the US, you're "coming home from a business trip". When you're going to Canada, doesn't really matter, you're Canadian, they have to let you in wink.gif

Canadait's official we're moving back
If your husband lives in Canada, then he will no longer have work authorization in the US, his current employer would have to sponsor him for a TN or something. Even with the 10 year green card, if he takes up permanent residence in another country, his status in the US becomes void.

He really might want to check with his company's HR and/or legal department about a work permit.

haha Yeah. It's just like my mum has really sore muscles and joints and Aleve is the only thing that she says works for her. So I am constantly bringing bottles from the US to Canada for her. I also used to know many girls on my sports teams who had migraines and needed Excedrin. They'd be hopping to the US all the time for it.

What's wrong with the Excedrin in Canada? huh.gif

Lots of stuff I used to get off the shelf in Canada I can't get here. Like muscle relaxants, and sleep aids that don't contain antihistamines. Plus, there's always 222s for headaches and stuff.

CanadaCanada doesn't have my medication...
In order to get a drug into Canadian market, the Canadian gov't office that oversees it has to do their own testing and whatever to determine if it actually is what it says it is, and does what it says it does. They don't just take the US's word for it. wink.gif

Heck, for the longest time you couldn't even get toothpaste with peroxide in it, because Health Canada determined that it really had no whitening affect as claimed, so it wasn't allowed. No idea if they eventually passed it or not.

Canadamoving to US
But CANADA does not recognize that verbal renunciation made to US authorities. In order to OFFICIALLY renounce your Canadian citizenship, you have to go to Ottawa, kneel at the foot of the the Governor General and the Prime Minister, then hop around on one foot three times and say the magic words. And do some paperwork or sumthin.

As far as Canada is concerned, once a Canadian always a Canadian. No matter how many other citizenships you collect.

Are you a Canadian citizen, or Canadian LPR?

If you're already on disability, you can continue your Canadian disability payments from the federal government no matter where you're living AFAIK. Talk to them before your immigration interview and work out how the payments will be continued.

As for getting on your wife's insurance in the US, it really depends on the plan she's got, no one here can answer your questions, only the plan adminstrator could. She'll have to talk to them to find out if you're eligible, and how much the premiums would be.

CanadaEvidence of Legal Admission
Canadians are not required to have a visa to enter the US, so we're not generally given exit/entry forms. USCIS adjudicators know this, if one of them has specifically requested it, they're on crack tongue.gif If ou rec'd a form letter, its just a form letter that everyone gets, and probably even a verbal reminder that you were not required to have an entry record would suffice.

Or you could print off the form from the website (DoS I think) that says Canadians don't get I-94s when they enter.
