renewing passport from the US

The tricky part is finding a photographer in the US who will do Canadian passport photos. Most refuse to do them anymore, though Sears Portrait Studios will still do them, mine cost $16 last week. Will mail it off today, and hopefully they won't be rejected.

I'm more of a NASCAR girl, but my husband watches hockey now all the time. He didn't even know Carolina had a team until he started dating me tongue.gif Had never even watched a hockey game before then either, now I'm a hockey widow wacko.gif wink.gif

I usually only watch a game when the 'Canes are playing the Leafs. I wouldn't mind going to see a game, but we live 4 hours+ from Raleigh, so we'd have to make a weekend of it, and board the dogs, which then makes it a very expensive weekend!

Actually, the I-130 is the petition that the US citizen must submit to be approved to sponsor their foreign spouse. The visa application comes after the petition approval, and there are a few Department of State forms required for that.

For the K3, the USC has to submit both the I-130 and an I-129F petition, which will lead to a K3 visa application. Or skip the K3 altogether, just submit the I-130 alone, and go for the CR1 visa application.

My vote would be for the CR1, even with the travel to Montreal, it works out cheaper.

My ex spent all his and my money on cocaine and beer. I left him, but for some stupid reason believed him when he said he'd take care of the house and mortgage (we couldn't sell it because the market took a dip and we wouldn't have made back what we paid for it). He rented it out to his "friend", but he never paid the bills, and the bank foreclosed. I figured he'd have been putting the rent money right in the bank, which he told me he was. I should have checked up on him, but I didn't.

I seriously wanted to murder him when I was served with the legal papers from the bank. I really did.

Live and learn.

I was talking to James about this last night, and he said there is no way that I could know what he's doing all day long while I'm at work. He said he could just get in his truck and drive up the mountain, hack someone to death, and still be home for supper. And I would never know a thing.

Of course, he's too lazy to do that, but he *could*. wink.gif

What works for some people doesn't work for others. If she was able to rack up $40k in debt in a year (that's all?!) on shopping for shoes and jewelry, she's got more than just a communication problem with her husband. Shopping can be just as much an addiction as gambling, alcohol or cocaine. And just as destructive.

Hate to say it, but I think it is quite possible for the same sort of thing to happen to any one of us, no matter how open and honest you think your relationship is, there are always parts of your spouse's life you're not going to know about.

Hell, I've known people who refused to aknowledge that their spouse smoked cigarettes! And you CANNOT hide that smell on your clothes no matter what you do! It is just not possible. But they come home "oh, we stopped at the bar for a couple beers after work" or "I went to Bobby's place to pick up some tools...boy he sure can smoke a lot in half an hour! whew!"

It happens.

I used to work with a guy who used to work with Bernardo, when he was raping women in the Scarborough area. When the composite sketch was first published on all the Toronto news papers, everyone where he worked said "hey, that looks just like Paul!" but no one called him in. Not a single soul. And then they all felt like ###### when he ended up raping 18 (or more) women and then murdering 3 teen agers.

I don't think anyone would like to think that their spouse or friend or co-worker would be capable of murder, but honestly, I think everyone is capable. It's just most of us would never act upon it because we understand the boundries. Some people just don't understand, (mental disconnect that they don't understand right & wrong, which are few I think) or they just don't care (total psychopath). Like Bernardo and Homolka and this guy.

And then there's Dexter.

Canadadumb question
Once your I-94 has expired, and if you have not yet filed your AOS application, if you are stopped at any ID check and asked to prove immigrant status, you could be detained and/or deported. It has happened recently when someone else on a K1 didn't have the money right away to file AOS.

If you can beg borrow or steal the money, get it done as soon as humanly possible. The US is not a kind place to be lately if you are "undocumented".

Correct. He cannot legally work in the US, even for a foreign company, until he has EAD.

Unfortunately, the law has not kept up with technology. So while it is technologically possible, it is not legally advisable.

K1 is work authorized, but only if he gets the stamp at POE I think. And only for the 90 days. So the quicker you get married and file AOS/EAD the better.

So the laws haven't kept up with technology, that's nothing new. However, under the CURRENT law, and the border officials current interpretation of it (which really is what counts), it is not legal for someone without work authorization to work for anyone while on US soil.

A person could decide to take the chance, or could decide to not to. Its completely up to the individual. But if it could in the end render one deportabnle and/or ineligible for a US visa or green card in the future, I personally would not take the chance.

I was told on more than one ocasion by US CBP and Immigration officials that if you are physically on US soil and workig, you must have US work authorization, no matter who is paying you or in what currency or from what country.

Whenever I went to Montreal (which was fairly often for work) I always took the shuttle. And if it wasn't there when I first stepped out the curb, it was there in a few minutes. They run back and forth pretty often.

I'll say again, ask over at www.roadtocanada.com There are folks there MUCH more experienced with the intricacies of Canadian Immigration and visitor records. Most of them have gone thru it already. Canuck Abroad is for Canadians travelling elsehwhere in the world, and Visa Journey is for people immigrating to the US, not Canada.

And yet people who have entered the US with intent to immigrate, have been denied AOS and sent packing. Even if they had a bonafide relationship, and even though their lawyer told them it was ok to do so. What the lawyer failed to mention (and I've yet to hear of even a single lawyer say this to a prospective client) is that if they enter the US on a visitor status, and their AOS is denied, they have NO avenue of appeal. None. They are immediately under deportation proceedings, and they have to leave the country. And in quite a lot of cases, their "bonafide" marriage ends in divorce, because the USC spouse can't/doesn't want to move to their spouse's home country.

THAT's why we tell people here who ask why they should do it the long legal way. It's up to them to choose which way they'll end up going of course, but they really need to know what the consequences are of trying to circumvent the laws. It's not the "thought police". It's ICE.

Unfortunately, if you gave up your job and abode before you left Canada, and entered the US with intent to get married and stay, your best option is to actually return to Canada and wait out the processing of the K3 or CR1. If you were to stay and adjust status, based on whta you've said here, your AOS could be denied and you'd be deported. If AOS from tourist status is denied, you have NO basis for appeal, and then you're stuck in Canada, not even able to visit the US, and then you'd have to start the Canadian process for your husband to move to Canada.

See the guides above for K3 and CR1, pick which one is best for you (CR1 is the superior and cheaper visa to get, however, you will have to travel to Montreal for the interview in about a year's time. Worth the trip IMO.)

For any vaccinations that you have already received and for any reason do not have record of, you don't need to have the shot again. Just have your regular family doctor draw blood and run titre tests for immunity. Safer and should be covered by your provincial healthcare.

I listed the trips for the last year or so, and then put "and several other trips over my lifetime ranging in length from one day to 3 weeks" or some such.

They're used to that with the Canadians, given that 90% of the population lives within 2 hours drive of the border. But you should at least detail the most recent trips.

As others have said, unfortunately you can't move the majority of your stuff before you get your K1. Not only woudl it trigger you to be searched and denied entry, but before you get your visa, it is not duty free. AFTER you get your visa, you can move all of your personal belongings duty and tax free, but in order to not be charged duties, you must show evidence of legal entry. Which would be your valid K1.
