I noticed that too! We've already got the 134 done and ready for the interview. I think I'll get my fiance to do the 864 as well and take both.

As Kimbear mentioned they still listed some things that K1s don't need to do. 99% chance doing the 864 now is a waste of time... You do that for adjustment of status. I mean, it's specifically for people who are getting green cards.

Wow, it looks nice! I thought it was the USCIS website at first. It's nice that they specify the x-ray is not required unless there's tuberculosis, and that they also specify translations are needed.

But the odd thing is under "fiance visas" they ask for the 864 instead of the 134. http://montreal.usco...-checklist.html

They also tell you what order to put things in. That's nice :)

CanadaDHL Pick up

I wonder if the cause of any delay in this process has to do with who's desk your paperwork ended up on. If they get sick, run over by a train, go on holiday for a week or two or off to a training seminar in Washington DC for a week or two.. if for any reason, they don't go in to work then your paperwork just sits there until they finally get back from wherever/whatever they were doing.

It could happen....

Yeah, I've heard that the length of time can vary between individual consular officers.

CanadaPolice Certificate
This depends on where you live in Canada and whether or not you have a criminal record. The time it takes can vary from 5 minutes to a few weeks. Here is some information on the police certificate: http://www.visajourn...a#Police_Checks

I live in Ontario and just went to my local police station and asked for a CPIC certificate. They redirected me to another police station where they do the checks and it only took me 5 minutes to get mine and $50. The police check is good for one year so you probably want to get it around NOA2/packet 3.

CanadaIs K1 an Immigrant or Nonimmigrant Visa?
Immigrant visa. This is how I know- you deal with the IV unit (immigrant visa) in Montreal. When I sent my packet 3 it was addressed to them.

It is "technically" not an immigrant visa but for all intents and purposes, treat it like an immigrant visa. On the day of the interview they will ask for immigrant only visa applicants to get in the elevator- that includes K1s. At POE you will tell them you're immigrating. Et cetera. :)

CanadaGetting a little confused, need help.
It is legal alien allowed to work. Your SSN will say "valid for work with DHS authorization" DHS meaning your work permit/EAD.

I had the same situation. Instead of going back and forth with paperwork. We decided to apply for the EAD then get the SSN. My wife is not going to work anytime soon. So we can wait a few months. You can get many things done before getting your SSN.

I do not recommend waiting. Your SSN will be necessary for health insurance, for opening a bank account, for all sorts of things. It is extremely useful to have. Additionally, the SSN must be applied for within 76 days of your POE (the expiration date on your I-94 minus two weeks.) If you miss the deadline then you have to wait until you get your EAD or green card. DO NOT WAIT!

Copy and pasted from one of my old posts, some SSN tips:

1. Print off this memo http://www.k1k3.com/stuff/SSNMemo.pdf and bring it with you in case they try to deny her a SSN. As long as her I-94 is valid she is entitled to an SSN, but sometimes the SSA officers don't know that.
2. Check off "legal alien allowed to work," keeping in mind that she is actually only allowed to work when she has an EAD or her green card.
3. The SSN is delivered through certified mail, so if her name is not registered with the mailbox yet make so include "Care of <husband's name>" or something along those lines, else they'll return it.
4. It is advisable to wait about 10 days after your fiancee's entry into the US before applying for a SSN since she needs to be updated in the system. However, in my case I waited 14 days and when I applied I still wasn't in the system. This is okay but if you go ahead with the application at that point be aware that it may take a little while for them to get the SSN to your wife because they have to send a request to USCIS to verify her. In my case it took 4 weeks until my SSN appeared in the mail.
5. Make sure to apply within 76 days of her POE!
6. If you're going to put your wife on a health insurance plan you might have to do it within a certain period of time of your marriage (most often 30 days) and she may also need an SSN in order to do it. You'll want to double check on that to make sure you're not too late :) In my case I received the SSN one day too late an wasn't able to go on health insurance right away :bonk:

CanadaFINALLY - moving to the US!
Regarding HST credits I would notify the CRA ASAP because they tend to do the paperwork for the tax credits ahead of time. You must contact the international CRA office at 1-800-267-5177 and have your SIN number ready. The international office just moved to Ottawa so expect eastern standard time business hours (British Columbia is 3 hours behind, I believe.) You just tell them you're changing your permanent residency as of your date of POE and that after that date you aren't eligible for the tax credits. And of course change you address with them too.

You may be able to ask your bank to not take direct deposits from the CRA- but then that would be a pain when you get your tax return, as you'll want to maintain a Canadian bank account as banks in the USA tend to be finicky with Canadian cheques and the CRA will not direct deposit into an American bank account, I believe.

Congrats on the receipt of your visa and your upcoming POE! It is very exciting indeed.

No, Canadian public health insurance is only available to permanent residents of Canada, regardless of their citizenship. If he moves to the USA on a visa he ceases to be a permanent resident, and it takes 3-6 months to re-establish permanent residency if he moves back.

Thanks for your help, as always.
I was freaking out about getting ALL these papers twice.
Why do they say that on the form, thou? I dont get it!!

What do you mean by they "getting hard on me" ? My fiance came to Canada 4 times. I live in Toronto, thank God we have lots of proof.
Again, thanks for your detailed reply.

I will have lots of questions!

I just mean that they may be more likely to request evidence of a relationship from you, but you have nothing to worry about if you come prepared. I don't imagine Brazil is a high fraud country or anything. You'll be good to go
pocherosFemaleCanada2012-02-15 00:21:00
CanadaFrom 156 K
The DS-156 is a bit confusing- you DO NOT attach any of these documents to packet 3. Instead, you bring them with you on the day of the interview. Packet 3 simply consists of the forms, two 2"x2" photos, and a photocopy of the biographic info page on your passport. That's all you'll be mailing back.

Evidence of engagement is a letter of intent signed by the USC within 30 days of the interview. Don't worry if you haven't bought each other rings or made wedding plans yet.

Evidence of support will be the I-134 filled out by your fiance, the USC. They will need tax returns or tax transcripts showing that they meet 125% of the poverty guidelines. If they do not meet the requirement (it's something really low for two people, like $18,000 annual income I think) they will need a co-sponsor.

Since your country of nationality is Brazil I suggest you bring evidence of an ongoing relationship to the interview. It's usually not requested in Montreal but they might be harder on you than usual.

CanadaFlu shot question

Well, we're doing a CR-1, so we won't go through AOS, just removal of conditions in two years. I don't know if that makes a difference.

Oh, sorry, I forgot to check what visa you are  I don't know if that makes a difference either. I just heard that immunity with MMR fades and it's been going around so it's a good idea to get a booster...
pocherosFemaleCanada2012-02-13 13:50:00
CanadaFlu shot question

My husband just got out of his medical, and we were pretty sure that he was going to need another MMR shot because his vaccine record only shows that he had one (and we had read this thread). But the nurse said he was fine...I hope that wasn't a mistake. He went for the Tdap a couple weeks ago, and they gave him the flu vaccine today at the medical exam.

I think the medical exam doesn't require the MMR but USCIS wants to see it once you do AOS. It's a little convoluted. If he hasn't had a second booster he should get one. My family doctor gave it to me for free and she said that she can guarantee they will want me to have a booster shot.

CanadaSome random questions about Vancouver interview for K-1

ewww yeah that would of been a question I was going to ask before I was POE'n.. how early I should show up for my flight. I'm happy it went smoothly though!

$350 for the interview? I thought it was $100 for some reason so I that's why I was confused when I was looking on the consulate page. Is there a way for my US fiance to book and pay for it? All these extra expenses keep adding up!

When packet 4 has been logged (after you send back packet 3 you simply call DOS to find out) you register on this website http://usvisa-info.c...country_welcome where you will book an appointment. You can give your fiance your login details if you want them to book the appointment for you. You also can pay the fee online with a credit card, so if your fiance has one you just need his credit card number and info.

And nope, it's $350. Immigration ain't cheap. Be prepared for another $200-$300 fee for the medical (it varies depending on where you go and I don't know much Working Medical in Vancouver is.) Then after you arrive in the states you have to adjust your status to get your green card and that's $1070. That's not including your moving and marriage costs. Try to save as much money as possible! :)

CanadaSome random questions about Vancouver interview for K-1

Hey all,

Right now I've got my medical scheduled and just waiting on my fiance to do his evidence of support paperwork before I fax off Packet 3. So the interview for me is coming up soonish.

My random questions:

1. on http://www.visajourn...ndex.php/Canada it says to bring an Expressport mailer - what is that about? I mostly hear peeps going on about DHL shipping.

That link has outdated information. You do not being an expresspost mailer anymore- Vancouver will use DHL to mail it back to you. You have to register for DHL service on the usvisa website before your interview so they mail it back to the right place.

2. Is there a fee I need to bring payment for to the interview (similar to the medical)? I tried looking through the consulate site but got confused.

There is a $350 dollar fee for the interview. You either pay the fee online on the usvisa website when you schedule your interview. The Vancouver consulate also probably has an option to pay for in in person, in which case it must be in USD cash. http://usvisa-info.c...payment_options

3. Not being able to bring electronics - I'm one of those spazzy people that need something to do. So no cellphones, ipods, ebook readers, correct? Do I even need to bring something like a book or knitting? what kind of waiting times is there for the interview?

No cell phones, kindles, ebooks, none of that- they will turn you away. If you have a morning appointment and you get there on time you probably will not have that much time to fiddle with something to entertain yourself anyways. I wouldn't bring knitting because the knitting needles might look dangerous (think airport security.) But a small paperback book should be fine if you must have something.

4. I can keep my electronics at my worksite, which is not far from the consulate - but I have one of those key fob things you scan to enter an electronic door for work - are those okay to take on me to the interview?

My experience is with the Montreal consulate but there's mixed reactions to it. Sometime security will hold on to the keys for you and then you collect them after the interview, sometimes they don't care.

Canadainterview scheduling (MTL)

I feel like I'm coming down the home stretch! DOS said today that P4 has been sent out. There's nothing on the Montreal web site about P4 (like there was for P3), so I feel like I'm flying blind a bit. So, to be clear, I do Not have to wait to actually receive anything, correct? I can just go ahead and schedule my interview now?

Also, can anyone who has recently booked an appointment explain the difference between the K1 Visa option and the "Ready to Schedule" option? I thought previously that the difference was one was for pre-paying and the other for paying at the interview, but I've heard that you can *only* prepay now... so, does it matter which I choose?

(Not that it matters too much... there are no appointments available just now anyway, but I'd like to feel confident in what I'm doing.)

Thanks for any advice/pointers you can share.

As far as I know ready to schedule is what you said it is- just skipping the pre payment. If you're paying online just choose the K1 option.

Why are people saying you can't pay at the appointment now? I'm not saying that's wrong, I'm just curious and it seems odd to me, and I haven't seen anything to indicate as such. But, perhaps Montreal got tired of handling cash. :/

CanadaPolice Certificate
Just FYI, Montreal does not require fingerprints unless you have a criminal history. Since the OP is Ontario it's probably much faster (and cheaper) to get it done at the local police station instead of the commissionaries. I know some Ontarions have been charged as little as $30 (mine cost $45 in Mississauga) not to mention you can usually pick up the police check on the same day or the next business day... You just have to specify you that you only need a CPIC search or they might get confused and try to do fingerprints when it's unnecessary.

It's faster and easier to get a police check from your local police station than the RCMP. Tell them you need a country wide name check or a CPIC check and if that station doesn't do it they'll direct you to one that does. I had mine done at the 22 division in Mississauga for $45 and it was ready in five minutes. They needed addresses from where I lived in the last 5 years and ID.

CanadaDS 156 online.... part 2
The first time you tried to complete the form you used a computer other than your laptop, right? Why don't you just download internet explorer to the computer that's compatible with your printer? Here's the link: http://windows.micro...er/downloads/ie

Also make sure all your drivers are up to date, and all your Windows Updates are up to date. I use Windows 7 and initially it was very finicky about my printer as well, but then I checked Windows Updates and there was one that I specifically needed to install in order to use my printer.

You could also trying filling it out at a public library. If you mail off packet 3 without the 156 they will send you an RFE- I wouldn't risk it.

Wonder why so many people have issues with the DS 156- it worked in firefox for me just fine! Hmm.

CanadaI-134 or 1-864? Need info for packet 3
It appears you now submit DS 230 part one with packet 3 and bring DS 230 part two to the interview? I think the reason they specify that is because you sign DS 230 part two at the interview in front of an officer (don't sign it beforehand.) I filled out both parts (but didn't sign) and sent them along with packet 3. I suspect that's still the correct procedure, maybe people were the DS 230 and then mailing it off so that's why they specify that. I brought extra copies of all the forms from packet 3 on the day of my interview just in case anyways.

Edit: upon reading the website Montreal only wants part I of the DS 230 with packet 3. The interview checklist includes DS 230 part II, so you bring that with you on the day of your interview.

That thread needs to be updated. There is a new website for Montreal, the one posted there is the old one that 'cannot be found'. That is why there is so much confusion with things. Montreal now requires the I-864 instead of the I-134 for K1.....They are finally catching up with the rest of the world.

I did update it. Read the very last post in the thread, it has the new links and direct quotes from the new website.

CanadaSchool Shooting discussion gets my son in trouble??
I hope you didn't misunderstand me, my child does not have Autism, he does not have PDD, he's normal mentally as far as that's concerned, but does have a learning disability, very similar to dyslexia, he can't translate from his head to written language. As to being unpredictable, I understand that there are children in his class that could be like that, but he was being treated the same as if he was in any classroom, it's just the way they think of things that differs from how I, and several others (Canadian perspective mostly) think compared to the American paranoid view of life. It's really sad that they had to go through what they went through to get there, but I guess the same could be said after the Dunblane massacre in England creating the handgun ban in the UK, I'm sure there are many that think that was overboard, but they're doing what they can to ensure it won't happen again. I don't think the methodology is really preventative in any way, but they can pat themselves on their back and say they did all they could to prevent something, even when it's unlikely to happen statistically in any given instance. I believe there still continues to be a gun problem there regardless of the ban...

I would hate for a child moving there to be questioned and labelled a threat because they ask questions about the ban, and why it was there, and saying that it can still happen even with the ban, for that is the world my son lives in now. Thank goodness they haven't started in on 911, as he will have a ton of inappropriate questions (from the American perspective I'm sure) and I fully expect another phone call...

CanadaSchool Shooting discussion gets my son in trouble??
The version of the story that I heard was the teacher's version, I had to ask my son about it AFTER I had been told the teacher's version, so no, it's not a matter of him telling me a different story.

Warlord's response to this was exactly the school's response to this, that they have a duty to the other children out there, and any red flag needs to be taken seriously because IF there was ever to be a problem and they were asked, did you have any red flags, and there were and they didn't act on them, they would/could be liable. It's a completely different culture.

As to the special class he's in, the one here, I don't think is the same as the one in Canada at all. He's in with the kids with serious PDD, Autism and other disablities. In Canada, he was in a second chance class that was to prevent kids that were slipping through the cracks from getting lost along the way. He does have a learning disability and is on an IEP, it's mostly written communication that is the big thing for him, it keeps him from working to his potential because the act of getting his message out on paper is so hard for him, he just doesn't bother getting his message out at all. He also has an anxiety disorder, and the inability to filter and self censor, so yeah, it's going to be hard for him here... Hopefully they can find a way to integrate him with the general school population without putting him at risk for failure and quitting, he's too smart to fail at school.

I did go down there with the mama bear mentality, but I tell you that there was no talking to them about them overreacting, because to them, it's the right reaction. In Canada, it would not be the reaction, and in fact, if they were concerned, they would call the kid down to the office to talk, call in the parents, or send the kid to the itinerant office to talk to the child and youth worker. Here, they just make sure that they search the kid to prevent violence. They say it's because they want to prevent other kids from getting hurt, but really, they're protecting their bottom line in case they get found liable after the fact. Because, like was mentioned in here, someone with ill intent certainly isn't the kid that just moved to town from a country with strict gun laws, no access to guns and hearing about a school shooting for the first time and getting worried about it, it's the kid that keeps quiet about it all and plans... Hell, the kids that did the Columbine thing planned it for more than a year, it took them that long to just save the money for the explosives.

What I did get across to them is that they now have a barrier in front of my son to his successful education, he feels betrayed by his teacher, and scared to talk to them at school. He already hates school and now has one more reason to not want to go, and to hate the US. I told them that for him, it's most important to have him feel safe enough to tell them things he worries about, and not let it just sit in his head, and mistrust them. So, we have a lot of work ahead of us. We do have another IEP meeting on Tuesday, and they plan to retest him here so they get a better understanding of him, which is a good thing.

Hopefully they don't decide he's a psychopathic killer somewhere along the line, as he was also talking about nukes last night... (maybe they should search him for radioactivity while they're at it.)

CanadaSchool Shooting discussion gets my son in trouble??
My son is 12 years old, and takes the bus to school with a lot of different aged kids. In Canada he was in a specialized class and didn't interact with the whole school population, and here, it's the same thing, so yeah, I'd say he's a little bit sheltered in some ways. The kids on the bus were talking about Columbine, and he had never heard of it. Why would he? (the other day he asked me what AIDS was, so we were going there next)

Well, he asked in class where Columbine was, and how far away it was, and when did it happen and how many kids got shot. Then he asked if it had ever happened at his school, and when they said no, he asked if it could. They said no, and he said, I think it could.

So, they go apeshlt crazy and decide he's threatening the school, he has to report to the office every morning to be searched for guns.

HE'S TWELVE!!!

I am going to the school tomorrow to EXPLAIN to them, that while THEIR perspective may be that anyone who TALKS about history is planning to repeat it, OUR perspective is that if it's scary, and new to you, you ask questions until you feel safe about it. So, a little kid comes home CRYING, and is in trouble over this???

Any ideas on what to do?

CanadaRye
Okay, I'm a rye and ginger girl, and brought my Danfield's Reserve with me when I crossed over. I'm busy trying out the offerings available to me here, and was wondering if anyone has any reviews they'd like to pass along?

Danfield's is a dry rye, very oaky/woody with the right mix of spice, I don't like my drink too sweet.

I've also been known to drink Alberta Premium which is a bit more citric but still yum.

I used to drink a Canadian Club 15 year, that is now discontinued, it was all of the above but with a little toasted caramel added in.

I'm not a fan of the new CC, nor can I stand Canadian Mist, (though I hear that it has a premium version that might be worth trying if I can find it) and the Crown Royal LE is not available anywhere nearby according to their website, and according to the store shelves I've seen.

I did pick up a Black Velvet yesterday, it's nice, but not as spicy as I like my rye to be. It was a little like a sherry, and fragrant with floral notes, closer to the Seagram's Seven that my husband drinks, but thank god, not as sweet as that.

I'm wondering about American Ryes, and what I should be looking for to try, I've seen Sazerac and Templeton on the shelf, and was wondering from any Canadian rye drinkers what their thoughts were on them?

Oh, yeah, Dad's planning a trip down here in the summer, and he's going to have to bring me some Danfield's!

CanadaEI while waiting for Green card?
Wow, Flames, you answered this for me on CanucksAbroad just yesterday! Funny how topics seem to come up. I looked over the links you sent me, and the only way I can see around the wait, is if you are lucky enough to find a POE officer to give you a stamp for your EAD right away... does that ever happen?
