Canadadual canadian citizenship for my husband and i

Your information is false you do not have to renounce your Canadian citizenship.

Like Pocheros said, you make an oath at the US ceremony, but it does nothing to your Canadian citizenship. You maintain both.

Bogart - Once you hit the three year anniversary of being a permanent resident, your husband can apply for US citizenship. Once he becomes a citizen, your Dad will no longer be legally obligated anymore. Like others have mentioned you'll first need to remove conditions on the 2 year greencard, which should happen 90 days before the 2 year greencard expires. In your case, it will be beneficial for your husband to become a citizen so that your Dad is cleared.

I think some posters have misunderstood hikergirl- she simply explained how one would lose canadian citizenship (by renouncing it at an embassy), which is something that you could do if you WANTED to. She didn't say you HAVE to. Her information is correct.

Please read posts carefully.

Canadadual canadian citizenship for my husband and i

This issue is confusing to me too. Once a person is eligible to become a U.S. citizen - can they become a US Citizen (removing all sponsorship obligations) AND not renounce Canadian Citizenship - thereby becoming Dual Citizen?

I have been struggling with this very concept. And I've had lots of people ask me if I can go the Dual Citizenship Route. Someone seriously please CLARIFY

Thanks,

Georgia

Yes, that is how it happens. When you are eligible (3 years GC holder) you simply apply for American citizenship. You do not have to do anything else if/when you become an American citizen- you are AUTOMATICALLY a dual. You do not have to inform Canada or anything, your Canadian citizenship is not in danger. Many, many people are dual Canadians/Americans (such as Alanis Morissette and Celine Dione.)

Where people get confused is in the oath ceremoney you swear that your allegiance is to the US and and only the US or something like that but they CANNOT force you to renounce your citizenship, are you are free to become an American citizen so long as you meet the 3 year GC requirements.

There are a few countries that don't allow dual citizenship, like Japan, but the US is not one of them.

CanadaHELP..approved for K1 today son has US Dad not approved
Yes you have access to it. You get an envelope, and then outside the envelope, free for you to use, is your passport with your visa glued inside. Do not open up the envelope.

I would check out the Ottawa embassy website or perhaps try e-mailing or calling them to ask what happens if you don't get your passport back in time- if some other photo ID is acceptable. No idea if they're fast/slow or good to replying to people, as I've never dealt with them before.

Sorry your son wasn't approved at Montreal. Hope they sort it out next Thursday :/

CanadaGreen Card filling from Canada VS US?
I think he'd have to prove he could support everyone who will be living in the household. It goes by the number of people living in a domicile. So it would be him, you, your wife, your child, and whoever else lives with your uncle (if he has a wife or children, for example). However the poverty guidelines are quite low- I'll locate them in a second.

Here are the poverty guidelines: http://www.westcentr... GUIDELINES.pdf Note that you need to meet 125% of them, not 100%. Fortunately it lists 100% and 125%.

For 4 people at 125% it's $27,948 unless you live in Hawaii or Alaska.

Edit: Actually that's from 2011. 2012 probably hasn't changed much though: http://aspe.hhs.gov/...12poverty.shtml It's a little higher than last year.

CanadaWaiting for P3 to be sent out
If someone has told you at some point that Packet 3's been logged I'd go on ahead. DOS operators are not consistent. I called about my packet 4 three time in an hour, first two answers were ambiguous and the last answers said it was logged so I went ahead and booked my interview. Didn't have any problems.
pocherosFemaleCanada2012-04-25 17:58:00
CanadaWaiting for P3 to be sent out
You don't have to physically receive Packet 3 in the mail before you send it out. Call DOS and ask if Packet 3's been logged. If yes then go ahead and send it in. "In Transit" probably means it's going to get sent out or it's in the mail so it's probably time you sent Packet 3 in.

It's not uncommon for Montreal VJers to never receive Packet 3 or Packet 4 from Montreal, or to receive them very late. For whatever reason, Montreal falls off the ball sometimes.

CanadaForm 134
According to this example form, you say "N/A (K1 visa process for permanent residence.)"

The example form is here: http://www.visajourn.../Form-I-134.pdf

More example forms are here: http://www.visajourn...ontent/examples

I forget what my husband put on our I-134.

Edit: What you wrote is fine. The interviewers are human and understand that what your husband meant :)

CanadaForm 134
1. Pay stubs are good. Bring a few of the most recent ones maybe one for each month prior to that up to 12 months or so. Make sure to bring photocopies.
2. You should bring the last 3 years tax transcripts (you can order them from the IRS for free) OR tax returns. Tax returns include the actual tax form + the W2. Ensure that if you bring tax returns to photocopy them (including the W2) because they will want to keep the copies.
3. Bank account statements don't really mean anything. It's better to get a letter from the bank stating how long you fiance has maintained an account with them, how much has been deposited, etc. Montreal kept this letter at my interview so they must've thought it was worth looking at.
4. The letter does not have to be notarized, though it should be done on company letterhead and be signed by an appropriate superior. This letter is good evidence because it shows your husband has employment. Montreal kept my hub's employment letter as well.

If your fiance has any assets (like in a 401K or something) you can also bring some kind of statement or printout showing how much he's contributed to them.

No, it doesn't need to be notarized. Just make sure your fiance signs it- it won't be valid if he doesn't.

CanadaCan the consulate change their mind once the visa has been approved

There was no problem with my I134 as my co-sponsor had more than significant funds$$$ to sponsor. This was topic was posted more out of interest than anything else. The CO only asked me 2 questions during my interview. Maybe because my fiancee and I have been together for almost 5 years and see each other almost every weekend. She was actually very nice and I found the interview very easy.

I love the comment about the paperwork following me around until citizenship and then going to the warehouse..that was funny.

You're fine. Technically anything could happen at any point of the stage but it's very, very, very, unlikely. The consular officers often do not ask many questions of Canadians because Canada is a low fraud country. My interviewer just glanced through my paperwork then asked a few questions and that was it.

The interview is really underwhelming... makes you wonder why you spent the past 6-8 months worrying! :P

Dang! I can't believe 3 hours was "cutting it close"! I'm POEing there tomorrow - flight is at 3:15 and I was thinking of showing up at 1pm...might have to rethink that plan, haha.

If it's in the middle of the day it's probably best to show up a lot earlier. This is one flight you don't to miss! :P

I POE'd at pearson at 6am and it took about 20 minutes. Immigration at pearson opens at 5:30am, I believe. If your flight is later in the day I suggest you give yourself a big window. 4 hrs sounds good.

CanadaNOA2 Letter of Approval(I-129F)Looks like what?
Oops, I didn't realize that the OP was from Vancouver. Disregard my advice about checking out the K1 for Montreal thread. Vancouver asks for different forms than Montreal.
pocherosFemaleCanada2012-04-10 14:36:00
CanadaNOA2 Letter of Approval(I-129F)Looks like what?
It'll look like NOA1, just with something different written on it. Don't lose it becayse you need it to adjust status. After USCIS approves your case it makes a short stop at NVC and after NVC goes to Montreal. When it's approved at Montreal they will send out packet 3 which is a letter telling you to fill out some forms and mail them back. When they approve packet 3 they send out packet 4 which is a letter telling you to book an interview. However Montreal is known for dropping the ball and failing to send out pkt3 and pkt4 so a couple weeks after your petition is sent to NVC you should start calling department of state to inquire about your case, specifically asking if pkt3 has been "logged." As soon as it's logged you can mail off pkt3, you don't have to physically receive it in the mail, just know that you've been approved. Check out the K1 guide pinned at the top of the forums for more help with pkt3, and be sure to read the newer posts in it as some things were updated.

CanadaQuick question about when to book wedding stuff..

Wow, how did your process go so quickly? Looks like the whole process took 6 months! Lucky you! Did you do anything special?

The poster in question is from the Philipines where (presumably) it's not nearly as backlogged as Montreal tends to be. Montreal is notorious for being slow, however it is possible to get a K1 visa in 6-7 months from Montreal if you're well prepared (no RFEs at any point in the stage), USCIS approves your petition quickly, you call Department of State for updates on your packet 3/packet 4 instead of waiting for them to arrive in the mail, and you are very lucky with scheduling an interview (i.e. you get your packet 4 when interview slots are open). Don't count on it being that fast, however- 7-10ish months is more common. If you live in western Canada and apply for a K1 you go to Vancouver instead, which is lightning fast.

You can always just sign the papers when you enter the US and then throw your celebration a few months later. This is what I'm doing- I got married in September and we're planning on having our real wedding sometime at the end of the year. It would've been sooner except hubby got laid off :S

Just some pre-emptive information: the fingerprint check is NOT REQUIRED unless you have a criminal background. Otherwise a name and date of birth search in the CPIC or national records repository is fine.

Just in case someone just got their police check done and they were nervous about not getting fingerprints. :P

Canadabring cell phone to the interview
Nope. The most people have gotten away with is sometimes a security guard will hold on to electronic car keys for you but you can't even count on that. A cell phone will get you turned away.

Here is a link from the official montreal consulate website about what you can't bring inside: http://tinyurl.com/7oxaf22

CanadaGot Interview date... how to project timing now?
I wouldn't formally give notice until you physically have your visa and have inspected it- sometimes people's names are mispelled or someone else's visa is glued in their passport. The consular officers are human and make mistakes :( Personally I let my boss know what was up when I first started the process and when my interview got close I told him my resignation would be conditional. I worked a casual job at a coffee shop with a cool boss so it wasn't a problem.

Hugglebuggles: that's hilarious. I worked at Tim Horton's once and they acted like that job was supposed to be your whole life.

They very rarely ask for the USCs birth certificate from K1s. They used to a couple years ago but it doesn't seem like standard procedure anymore. I'm on my phone so I can't see your consulate but I'm assuming it's Montreal. The photocopy alone is fine. Make sure to photocopy yours as well.

CanadaVaccines.. ugh
This thread is helpful, and it addresses Working Medical in Vancouver: http://www.visajourn...-shot-question/ MMR is discussed in detail. Your age group may have different requirements for vaccines. One lady is a nurse (I think?) and says you can do two live virus vaccines at a time so it seems kind of odd you can't get varicella + MMR if necessary.

It's certainly best to take care of MMR sooner than later since it saves you some hassle down the road (paying for an MMR in the US, possibility of it causing trouble at the medical, and getting proof of your second MMR for AOS.) It's also good to boost your immunity to rubella in case you get pregnant.

The MMR is more important with AOS than the medical for the interview. Just make sure you get your second MMR before AOS. Varicella, however, they do care about *right away*.

Elsinha: it seems like some shipping companies say you don't need the I-94 but it's an error on their part. I'm on my phone right now but later I can link you a thread where someone was told the same thing and later they found out they needed the I-94. The visa alone is not proof you've entered the USA. You can always pay for the postage ahead of time and ask them to hold on to your boxes until you fax them a copy of your I-94. Customs will do whatever they want so I say better safe than sorry. By the way I'd keep a couple photocopies of your I-94 around anyways since it's an important document (proof of your legal status in the USA combined with your visa and marriage certificate.)

Also, the most effective way to pack clothing is by rolling it. When you roll clothes tightly it minimizes the amount of air in them, whereas folded clothes are much more bulky because they arent compact. If you own clothes that aren't delicate and don't need to be hung or folded, rolling is the most efficient way to pack a ton of clothes in a small space. I used elastics to hold the clothes in tight rolls but be careful that they don't leave weird white marks on them. I also shoved socks and small items inside shoes and boots.

Obviously, my luggage consisted of 99% clothing... And I still have more at home. also FYI immigration at Toronto Pearson opens at 5:30am (last time I checked) so don't get there before then, BUT if you're not arriving first thing in the morning make sure to leave plenty of time to POE since pearson in unpredictable and all.

CanadaEAD approved online can I work now?
It was not my intention to gain employment, I work in the medical field, and had filled in at the resort, cleaning rooms, helping in the restaurant, folding laundry, even watching in the waterpark. We had a really big tornado here and they were extremely short staffed, so while the postions should have been filled by a paid position, they had way more guests than expected and way less staff than normal. I did not take a job away from anyone, and as they are still extremely short staffed, I know I would be hired if I wanted to work while I looked for something in my field. I really hope that they consider it me just helping out, cause that is just what I was doing. The other wives there often do it as well, for special occasions, like decorating for New Year's, which I also helped with. They don't get paid either.

CanadaEAD approved online can I work now?
I had no idea that unpaid work was illegal, I only thought paid work was. In any case, the postions I have been working at, are not any of the ones that I would likely be hired to do, and this kind of work isn't even in my field, so I guess I'll just have to look for work elsewhere. I really did not intend to break a law. It's so boring not working, why can't we volunteer at least?? Man this really sucks, we did everything else the legal way, I'm really upset now. I'll have to let them know I can't help them anymore, and really hope I don't get in any trouble, or get them into any.
Stuart and TheaFemaleCanada2012-04-08 11:27:00
CanadaEAD approved online can I work now?
I checked the USCIS website today, and they approved my EAD, and said it will be up to 30 days before I get the card. However, my husband runs a resort waterpark here in Branson, and they have been so short staffed that I have been volunteering there, and know that I could be payed for it, as soon as I'm legal.

Do I have to wait for the card, or can they hire me now? I know I need to wait for the card for my EI, but I have already worked over 80 hours free for this place since December, and don't want to do any more if I can get paid for them. I have filled in for so many positions there short notice that I think I can have my pick of any job I want, and they ask me constantly when I can start work.

CanadaWhat's For Dinner - Part Deux
I don't know why that posted twice... anyway here's what we had on friday. Yum!

I bought a pork loin which is too big for the two of us so i cut it into more reasonable sizes and it'll be used for 3 meals i think. This time I marinated it in white wine, olive oil, garlic and rosemary. Closer to dinner time, I chopped up a couple of potatoes, a sweet potato, a couple of carrots, a shallot and some more garlic. I tossed that with some olive oil, thyme, salt and pepper. I put that in a casserole dish, put a couple pats of butter on it, and covered it in tin foil. It went into a 400 degree oven for about 30 minutes, until teh veggies were about half done. Then I took it out of the oven and put the marinated pork on top as well as about half of the marinade. That was baked for another 20-30 minutes until the meat was cooked.

It was so delicious... and easily adaptable to smaller or larger amounts.
