:crying: i had the same concern. we sent our rfe response 6 days already but still on the website it says request for evidence...oh why oh why


In our case the website didn't change either and we didn't get an email or text like we did when the NOA1 and RFE were issued. The NOA2 simply arrived in the mail. I checked again last night and it still shows 'evidence being reviewed'. Perhaps they don't rush to update that site once the decision is made and the noa2 is sent? Strange and frustrating I know.

USCIS received our RFE response May 27th but we haven't heard back yet. Just wondering if it's actually a full 60 days before we hear again? I am trying to plan my return flight to Vancouver - thinking I should be safe to go back the first week in September but need to change my current ticket ASAP. How long did it take you to get your NOA2 after they received your RFE info?

We sent an RFE response June 14th and received the NOA2 in the mail today (June 24th)! From what I've read here it seems to only be a few weeks in most cases. It probably varies depending on what information they are looking for? My understanding is that they review it as soon as they have the info.

I need some advise. Here is my situation. I filed for bankruptcy about 3 years ago, because I had alot of medical bills (some pre-existing conditions)everything was discharged, and now I have 2 1/2 jobs now, sent copies of all 3 of my W2's and also letters from my jobs telling how long I have been employed, but my fiance was denied because they said tbat I filed bankruptcy and they cannot see how I can afford to travel to see him as often as I have. I don't have any children and made close to 50,000 last year. Has anyone been denied for filing bankruptcy, and if so what did you have to do


Sounds like they are questioning the relationship based on what they think is your inability to afford to visit him. I would think if it was financial they would just ask for a co-sponsor? I haven't read anything about bankruptcy being a reason to deny. :(

If you look up the information about the medical exam on the website you will find that the xray will not be required if you are pregnant.


Taken from the Montreal Consulate explanation of what the medical will consist of and what exceptions there are.. it states in part..

SPECIAL MEDICAL CONDITIONS
If you are pregnant and do not wish to have the x-ray, a temporary exemption of the chest x-ray will be granted. To be granted the exemption, you must provide written certification of your pregnancy signed by your personal physician or obstetrician.

Hi VJ'ers!
Hypothetical question for you all.
If I were to be pregnant at the time of my medical exam and I opted to have the xrays deferred, what exactly does that mean? I mean, I get that the xrays wouldn't be done at the time of the exam, but what happens next?
Would my K1 application be put on hold until after the babe arrives and the xrays are done, or would I continue with the interview and POE as planned and then get xrays done after the babe arrives and we're in the US?
I'm not entirely sure of what the implications of deferring the xray would be, so any help or insight would be very much appreciated.

When I submitted my DS160 Online, I printed a copy before submitting it. I don't understand why, but the entire section on education is missing from my printed copy, no blanks or anything, just missing. I had filled it all out on the online application. Now I don't know whether they received that section or whether it matters. We have been waiting about a month for our packet 4.
Should I just wait to hear from them? Did anyone else have this experience? Also, I was told later that I should have courriered the DS160 confirmation, so I just did that separately. I thought I only had to bring the confirmation to the interview and not mail it. Did everyone mail in the confirmation? Thanks.


Yes I did as well as the copy I printed. I made a copy of it for myself and to take to the interview. I've also heard that some people have had problems printing it so if you didn't send it and they don't ask for it in advance, just take with you. The important thing to send was the confirmation page.

I got mine at my local Regional Police office. It is a Canada wide (CEPIC) search and they did it while I waited. If they are busy they may say come back in a couple of days to pick it up. The cost was $40.00 if I remember correctly.

Just to let you know... I had my interview on the 21st and received an email last night that the package had been picked up in Montreal yesterday. At 8:00 this morning I received a call from DHL that it is here ready to be picked up. Exactly one week since the interview as they said it would be.

I hope you have received yours by now too tolowyn and t.rah.. If not I would try to follow up to see when it was sent.

if you have had the same doctor since birth your doctor should have adequate records...but if not, you may want to contact the public health dept for your immunization records. judging from your picture, you are younger and the public health dept should have all you records on file (computer). if you have a new doctor they may not know (some doctors in the past did not transfer records appropriately) what vaccinations you have had or not had....in this case I'd ask for a titers test on all vaccinations.....as it turned out I was not immunized for rubella and after my medical in TO, I had to get it.....even though my doctor said I was up to date on all immunization.

word of caution....we are approaching flu season....and if your hoping for an interview prior to spring/summer, you will want to put that on your list of things to do.

Forms were filled out wrong, I was given totally wrong info a number of times, and he has never apologized once for any of it.

Just wanted to add this in case it helps anyone.

I basically got ripped off by an 'immigration consultant'. They took my money and said they'd take care of everything.

HA!

My initial package was sent to the wrong filing location, by the consultant. There's a two month delay.
Some information on my forms was filled out wrong, by them. Totally their fault. If I wasn't so worried and triple and 5 times checking everything it would have went out with false info. They did not apologize for this.
Emails from them have been in very rude tones. Basically calling me an idiot for asking some of the questions.
They said I'd be back in the USA in 6 months. That was 14 months ago.

Anyways, please, unless you have a problem with the english language and can not find a good translator, do everything yourself!!! It will save you a lot of money and hardship.

I never stayed longer than 6 months at one time. I just didn't know then that you aren't supposed to do it more than once a year I guess. You know how it is waiting for your interview, thinking of everything that could go wrong ;)

I'm holding onto the fact the customs officer specifically told me he was not putting a ban on my passport, just a one time entry denial, until I could provide proof that I wasn't trying to illegally immigrate.

So here's the deal...

I met my fiancé a little over 5 years ago here in Canada where I live. We began talking on the phone and whatever. I went to visit him in the USA for a week or so. Went back a few months later for another week or so, did this I dunno maybe 3-4 times. We decided it would be nice to spend more than a week together so I quit my job and went to the USA for 6 months as a visitor without a visa. After the first 6 months I went home for a week and (unknowing it wasn't allowed) returned for another 6 months, went home for a week, came back for 6 months, went home for a week, back for 6 months. Anyways I did that for almost 4 years. I was not working and was never questioned at the border about this and was never told I wasn't allowed to do this. So a little over a year ago I came home for a few weeks and when I tried to go back the customs officer informed me I hadn't be following the rules and that he didn't think it was a good idea to let me back into the USA. He told me he was not banning me from entering the USA, but only denying my entry for that day. I was free to request entry after that whenever I wanted. He suggested that I needed to either show proof of my ties to Canada by providing work information or a lease or something like that. He also said we (my boyfriend and I) think about getting married.
Fast forward a year, we are now engaged and my K1 interview is next week (march 22). I just found out today from reading this forum that apparently if you were in the USA for longer than you should have been your visa is automatically denied because you would have been banned from the USA whenever the last time you went over the border was. I'm really freaking out about this because if I do fall under that category I will be facing a ten year ban.

Anyways anyone been in the situation? Any advice? Thanks!

I did have some paperwork that 'they' claim to have mailed to both myself and my fiancé never show up, at either location. So if it's not there soon maybe try calling to make sure it's not been lost in the mail.

Most consulates if not all will automatically renew the petition. Mine ran out Dec 22/11. I emailed the consulate here in Canada because like you I hadn't gotten an interview date at that point. They emailed back within a couple days saying they automatically renew petitions with no action on your part. You should be fine but you could find out how to contact your consulate and ask them directly just to make sure.

Just wondering if anyone has had experience with travelling on a monthly basis? I travel monthly to see my fiance now. I am *always* asked where I'm going, why, how do I know him, do I *actuually* know him in person, what do I do for work, and what proof do they have that I'm returning?
I'm a government empolyee so I guess that gives me some kind of credit in their eyes. Can I expect the process to be much different once we are married and file for the I-130?
I guess one plus is there's consistant proof for the past 3 years that I return when I say I will, but for me it would be heart breaking to be turned away for something as dumb as pushing my luck too often :)

also...i read the guidlines and tips and flowcharts and i got the impression that he sends in the first package, but then Montreal would send me stuff to fill out as well? all the same stuff??? seems kinda redundant, is that why it's adviced to make 2 identical packages?
i have a feeling that if i actually went there monday, wed and came home that i would be banned for a year or more, with no way back in during that time, true?

Okay I am new here but have done A LOT of research on this topic of marrying my American man and I am getting more and more confused!
I am from Ontario Canada. He lives in Arizona. If I go there Monday, which I am, and we get married, what happens or what has to happen when I come home in two weeks??
I know about the K-1 visa and to be honest that sounds like the fastest way for Canadians to be with their loved ones BUT what would happen if we didn't wait??
Also, is it true that when you file a K-1 visa you can still visit the U.S. while the application is in process??

How old is your daughter? The older she is the easier it will be to get a judge to let you go. It'll just show that he hadn't show any interest and now that you are planning to leave the country he just wants to make your life miserable. You will really need to consult a lawyer though as the single name on the birth certificate might make things different. You may not need his permission at all. I do know in my case I required either HIS written permission or I was going to have to take him to court and convince a judge to give me permission.

If he only just met her two months ago then I suggest you go get permission from a judge. You need either his permission OR a judge's. I personally had it written in our final court documents that the children and I were free to move to the USA. You'll also need proof of sole custody. I assume his not being named on the birth certificate would give you that but you might wanna consult a family lawyer.

There is no separate form or fee but you must make sure she is named on the I129-F that you'd fill out for her mother. Later once they are in the USA and you marry you would file them both separately to adjust their status.

doesn't really need to be the actual origianl, but a certified copy, and this is for the petitioner, beneficiary birth certificate is needed at a later stage.
