I got through ok, with only my return ticket. I consider myself lucky though. Boy was I sweating when questioned about my trip to see Tim! (And would you believe he wore a "swine flu" mask?? Talk about intimidating, when all I could see was his eyes!) The officer tried to trip me up by asking the same questions two or three times, but I answered truthfully with the same answers each time. One thing he kept asking was why there was such a long gap between our visits. Not that it was any of his business, but for awhile neither one of us could afford to travel, and of course that's what I told him. He asked me why I was visiting NOW, and I told him "because now I can afford to." lol

Hi all. This site is so helpful and informative, that I think I'll stay. Reading all the posts for the past few days, well it's almost like reading a good book you just can't put down, ya know? LOL

I met Tim for the first time in Sept. 2006. He's in Oklahoma, I'm in Canada. In 2007, he came up for my sister's wedding. We had planned for me to return home with him to spend 6 months getting to know each other better.

Let me first admit that at the time I was TOTALLY UNINFORMED about what to expect at the border. Since then, I made sure I did my homework. Your mouths will probably drop open as you read this... I had had no job, no home or other property...I was living with my mother, I had no return ticket because we planned to DRIVE back to Canada before the 6 months were up. RED FLAGS ALL OVER THE PLACE!! So Tim got through fine (he was ahead of me in a second lineup), and I got hauled over to what I believe you call "secondary." Grilled and grilled for about 20 minutes...then "We can't let you enter the U.S." I couldn't even cry, I was so stunned. All that planning...all the anticipation. It felt like the floor dropped out from under me. If I hadn't been leaning on the counter, I think I would have fallen down. In comes Tim, back through the entry door looking for me, because there was a bus waiting for us. He finds out they won't let me go, and LOUDLY said "I'm not going home without you." Then he started to cry. A nice female border cop talked calmly to him and explained the reasons why I couldn't go through. She directed him to talk to a third officer, while I was still being questioned by the first one. Then we were both allowed to talk to my officer. We did our best to explain that we only wanted to spend 6 months together to get to know each other well enough to decide if he would indeed file a fiancee petition. We told them I had NO intention of staying this time. I guess this officer had a heart, and eventually agreed to let me enter for only 30 days, and attached something to my passport that I had to have stamped when I returned home. Of course I did as I was told...returned within 30 days, and had the attachment stamped. (The attachment was kept, by the way. I have no idea where it went after that.)

So........here's my dilema now. First, I know I'm probably flagged in their system, so something will come up the next time I try to cross, which hopefully will be in April or May. I WILL have a return ticket next time...I now have a job (1 yr.)...my boss will happily give me a one month leave of absence with a note saying I have a job to return to (with an expected date of return).

BUT, as for my place of residence, I am still living at mom's (an apartment that she rents), and the past two winters I've stayed 6 months at a time at my cousin's house while he vacations in Florida. I don't pay rent to him, nor do I pay rent to my mom. Mom has never wanted help with the rent, although I contribute to the groceries and phone bill. So I have no receipts at all from these two places where I live.

I just don't know how to explain this at the border. I sure don't want a repeat performance of my last visit. Any ideas for me?

Oh, and in case anyone's wondering if we caught our bus that day at the border, we DIDN'T. But...that nice lady officer actually had been listening in on our conversation with the other officers, and when she realized I was finally allowed to cross, she talked to ANOTHER bus driver who agreed to take us FREE OF CHARGE to our destination. There ARE good people in this world after all! We had to sit on the step inside the door of the bus, but the trip was only about 15 minutes. And after we told the driver our story, would you believe he asked us if we'd mind him saying a prayer for us to have success in the future? "Not at all, sir. And thankyou very much!"

Your address should be listed at the top and type your name only as you are the one who is writing the letter and sign.

Maybe I misunderstood the OP. I took the question to mean "how many copies of each photo" do they need. ONE of each. If you want to send 10, 20, 11, 23, or 100 photos, it is fine, you only need ONE of each.

FWIW I sent ONE photo of us together for the petition, I had about 200-300 for the interview and they only looked at four. I took the others home with the visa approval



I think you were on the right track but I disagree with the response.. I think 3 copies of each photo are needed.. 1 for original submission of 129F sent to USCIS , One for duplicate sent to beneficiary and 1 for duplicate kept by Petitioner... I know that many say to have 1 extra copy of the packet in case something happens or it is needed later, but I feel 2 are needed as something could happen the backup if mailed to beneficiary... as we see in many cases USCIS can and does lose packets.. so the petitioner needs an extra ready to go if that happens...


Now that I've read everyone's replies, I'm tending to agree with Scott. What's a couple extra bucks for the security of knowing there's backups in case they're needed?

I found and downloaded the form.

Do I check:

"Marriage Certificate" (file size) - contains basic information such as names, date and place of marriage OR

"Certified Copy of Statement of Marriage" (long form) - contains all information registered on the statement of marriage including signatures.

I know I need one of those, but I'm not sure what the difference is, except for the fees. Has anyone applied for this before?

Oooops, yes of course the question is on I-129F! :blush: Too many forms and photocopies spread across the table right now. :blink:

In the description on question 18, I have now changed it to "We met online and have since visited each other several times." We will attach the "How We Met" letter, dated and signed by the petitioner. We do have photocopies of boarding passes, passport stamps etc. as supporting evidence, all of which we will include with the application.

I do realize, as my fiance is the petitioner, that this is HIS petition to USCIS. However, we and I worked on the forms together during our Christmas visit, because I'm the one who has been doing the research here on VJ, and he's afraid of screwing something up. I took what we had done home with me to add finishing touches and my own photocopies of evidence. But I will be sending everything back to him so he can check it, sign where required, add his OWN supporting evidence, and then mail the whole thing off.

I am the beneficiary, preparing the forms to send to my fiance, who will add what he needs to, sign everything, then send off the application.

I just now noticed (after printing out forms) that my entire description of "how we met" did not fit. It starts out "We met online...blah blah.." which I know in itself should be sufficient, even if the last part of my description ends in mid sentence. I do however have the entire description printed on a separate piece of paper.

1. Is it NECESSARY to reprint the form and leave that section blank, except for "see supplement.."?...then attach the supplement? (Yes, I can reprint, but I need to go use someone else's printer, which is an inconvenience at the moment.) Or...

2. Can I leave the form as is, and write across that section "see supplement" ...then attach the supplement?

3. If we attach the supplement "How We Met", does it need to be signed and dated by both of us, or just the petitioner?

There is no standard divorce decree in the US. Each state can use whatever format they choose, and some states even vary depending on which court in the state granted the divorce. I think it just needs to be obvious to the USCIS adjudicator that the document is an order from a court dissolving the marriage, and that it be stamped to show that it's a certified copy from the court.


Yes, that is what I've told him. I wonder if he'll be able to get that certified copy at the court house or if he'd have to send away to "Vital Statistics" or wherever to get it. Could take weeks..."sigh." :unsure:

I was not issued the document I needed for my divorce as part of my divorce proceedings. I had documents that said it was final, but they did not contain the words "Absolute Decree" on the top...and I got an RFE.

I had previously gone to the courthouse and asked if the papers I had represented all the documents for the divorce, a clerk told me I had all the papers I would get.

Turned out I did not ask the right question.

After I got the RFE for this single document I went back to the courthouse and said that USCIS requires it say "Absolute Decree".

The clerk said "oh..in that case you need to specifically request that document for immigration purposes "

I got the RFE in the mail around 2:00 pm....had the needed document by 3:00pm..back to VSC in two days...and approval 14 days later, which it seems is the minimum they are allowed to turn an RFE around, as they stated as such in the letter, and it turned out to be the case.

We had two 'touchs' shortly after they reveived response to RFE and I suspect they actually processed everything at that time and just waited the 14 days to send.

Anyways...just be sure it says "Absolute Decree" or you will be assured of an RFE..it looked like a standard reply...so I bet this is a very common reason for RFE!!

My fiance (USC) thought he had a certified copy of his divorce decree, but it turns out that what he obtained from the court house is just pages from the court order. Can someone give me a description of what his divorce decree will look like, so I can tell him? Even a picture of one would be helpful. :thumbs: I've explained to him that it needs to have an official seal, and a date that the divorce became effective.

I am the beneficiary. I've been married twice before. I'm using my second married name now. Where it asks for "other names used" I put my maiden name and my first married name.

The instructions for the I-129F state:

D. If either you or your fiancé(e) were married before, give copies of documents showing that each prior marriage was legally terminated.

So all I got were copies of both divorce certificates, but no marriage certificates. :blink:

Am I to understand that I need to provide marriage certificates as well??

Agreed. In many consulates, the USC spouse being present at the interview is very very important, and in some cases, absolutely mandatory. Canada, thanks be to G-d, is not one of these. The USC being present at an interview in Canada is a lovely thing for both petitioner and beneficiary, but is, ultimately, a luxury. In Canada, very fortunately, you get to decide whether you can afford it or not.

We are almost ready to file the K-1 petition. Tim is the U.S. petitioner. He's never had a checking account, so he recently opened one so he can write a check to send with the application. He can get counter checks while he's waiting for delivery of custom made ones with his name on them. Is it ok to send just a counter check where he would write his name on it instead of it being printed on there? He doesn't want to send in the application if it'll be sent back. I've told him I doubt it matters whose name is on the check or who signs it, as long as USCIS gets their fee. Input from anyone would be appreciated.

I folded my entire petition into a large stylized paper airplane, and then tossed it in the general direction of the eastern seaboard. Apparently my aim was good, or a I just make one hell of a paper airplane.

Of course, I included tabs for the sake of organization.

It hasn't speeded up the processing time, but I hope to get a star next to my name for creativity.

Since I don't know for certain when my interview date is, it's going to be difficult to decide what my return date will be when I book my flight. Does anyone have any experience with crossing the border to visit a spouse and perhaps having an open date for their return? I imagine the border officers might frown on something like that. I'm hoping they'll even let me cross so soon after my last visit. But I'm wondering if they will take into consideration the fact that my last visit was cut short by a family emergency.

Of course I'd cross with a copy of NOA2 and other related paperwork, and a letter from my boss stating a back to work date.

I just KNOW I'll be spending another winter in Canada, and away from Tim...waiting for that darned interview...but I suppose all of us here have lots of experience with waiting, huh? :unsure:

We got our NOA2 on June 10. My interview will be in Montreal. Tim hasn't called yet to see if the application has reached NVC. I'm just wondering what are the chances it's already in Montreal? I've heard that I can contact Montreal by email to see if it's there. There was a case number with the NOA2 letter that Tim received, starting with "MTL." Would that be the number I need when emailing Montreal? Anybody got that email address by the way?

I was visiting Tim for the summer but had to return a few weeks ago for my sister's funeral. I'd like to resume my visit to the States if my interview isn't coming up too soon. No sense going down there then have to turn around and come back for the interview. What kind of a wait am I looking at if the application is sitting in Montreal?

I'm K-1, just filling out the DS-230 and have a few questions:

Question 2. "Other names used"...Does that mean other names EVER used(maiden and married)? or just names used presently?

Question 9. Marital Status..."Including my present marriage, I have been married X times"...I am divorced twice, and obviously not married now. Do I just put married 2 times? Just wanna be sure.

Question 12: "Present Occupation"...just title? or do they want a name and location of work?

Question 20: "Places lived"...If I'm not sure of a month, can I put "?"/1975 or just 1975?

Question 23: "Educational Institutions Attended"...I did a search on VJ and it seems it's ok to put just high school and higher education. Am I correct?

Question 25: "Dates of all previous visits to U.S."...Are they most concerned about my visits to my fiance, or even all the many cross border shopping trips I've made over the years? It would be impossible to get dates for shopping. Besides, I didn't have a passport back then when I shopped, therefore no record of entry.

And for the "Type of Visa" for individual visits...would I just put "visitor"? or "B-2" as a couple of my passport stamps indicate? I know they're the same thing...just wondered which one is best.

And since there is obviously not enough space regarding places lived and employment history, I have put "see attachment: DS-230 Supplement for Jane Doe places lived" and "DS-230 Supplement for Jane Doe employment last 10 years." Is this sufficient?

I've just finished filling out the DS-230. On the form I put the last few dates I visited the U.S. Then in an attached "Supplement to DS-230 - Visits to the U.S." I explained that there were several other cross border day trips for shopping, for which I had not kept any records. I also stated that to the best of my knowledge those were the only other visits other than those listed directly on the form.

I believe others here on VJ have done the same thing, since the form does not allow enough space for some people to include ALL of their visits. Perhaps others can tell you their experiences with that, since I haven't actually sent in my form yet and I'd be interested to know as well.

K-1 Fiance(e) Visa Process & ProceduresDS-160 and DS-156
I haven't filled out the DS-156 or DS-160 yet as required by the instructions from Montreal Embassy. I've heard that there may be trouble uploading photos. I don't have a scanner to scan a passport type photo. Are photos really necessary, or are we allowed to just bring them to the interview? I think I read on here somewhere that there are ways to just skip the photo part on the online forms and carry on. If anyone can enlighten me before I get started, I would appreciate it.

Also wondering what info is required on the DS-160 and DS-156 so I can have it ready before I fill them out online. Has anyone got an example?

In my opinion...If you are married, it will be assumed that you're sleeping together. I think you're worrying for no reason. It's not likely they'll ask you that question.
