Disappointing is the mildest word to use in the situation. With the exception of the very polite man who told me I shouldn't have been there and  most of the agents in secondary were rather unprofessional. There was another young woman in there who said she had been there for over 2 hours, missed her flight already, and had been told nothing. I think part of it may have been due to the unfortunate timing of being sent in during the lunch hour/shift change, but I am somewhat tempted to write in to comment on the attitude of the agents (there is a sign in there outlining how they will behave with you).

 

 

Right now I am just thankful I still have a couple hours to indulge in free unlimited booze and food while I wait for my flight and hopefully this will be the last time I have to worry about all of this. I will chalk it up to a learning experience if anything else

So i just finished getting through secondary inspection at Pearson Int'l airport where the first  CPB agent tried telling me that just crossing the border to visit my husband for a few days would cancel our pending I-130 and when I politely said that wasn't the case she instructed me to proceed to secondary inspection where I waited over an hour just to be told I shouldn't have been sent in there in the first place. Just asked a couple questions about how far into the process we are, how often I visit and how much longer we expect to be waiting. Hell the nice man told me to thank my husband for all he has done for his country (soldier) and sent me on my way.

 

I was just asked by my father if this act of being pulled into secondary inspection would have any impact on my I-130 application. Logically I am pretty sure after being on this site for awhile I know that this is probably not the case, but I just wanted to get all of your input. Will this secondary inspection have any negative repurcussions?

My wife filed the I-130 for myself at the beginning of Apr. 2008 and we've heard nothing other than a case number. My wife said somewhere on these forums here someone posted they filed in May 2008 and got approved.

Are the forms really processed in order that they're received? Do some get processed sooner or faster than others? Our case is simple as far as I know.

I'm not sure if I should worry about this or not so I'll ask the question.

I'm currently in Canada, working full time, etc. as I wait for my approval to be processed.

My current job does not require me to work from the office. I can work anywhere in the world with an internet connection.

My current manager knows that I will be moving to the USA. My manager is in the process of getting approvals from higher up in the company to allow me to work from home on a more permanent basis so that I can move to the US and keep my job. I would like to do this, keeping my current job, just working from home in the US.

My question is, would this be considered a good thing by the powers to be - me keeping my job and being able to support myself once I move, or frowned upon by not fully moving my life there?

As far as her being denied visiting you in Canada, if you apply for her Canadian PR - well that's just not true. It is no more difficult than you visiting her in the U.S. - she would need to provide ties to the U.S. etc - I just mean it's not a given she will be denied.

Plus there is always the option of her living with you in Canada while the application is pending - not an option with U.S. immigration (barring AOS).

Anyway I guess that info is all moot since there is the issue with the children.

I know it's not a guaranteed thing that she'll be denied entry into Canada. I have a friend who lives in Texas who knew of a couple American / Canadian who was going to live in Canada but the American was denied access into Canada until the paper work was done.

With an unknown amount of time ahead of us for my paperwork I don't want to chance the only method we have of seeing each other.

This is bad news then.

I can't ask her to move here. That would be me asking my wife to leave her children behind because their father won't let them move to Canada.

Also, she can visit me when ever she wants. I've heard that she can be denied access to Canada if she applies to move here which means we won't see each other at all...

I've never had top secret security clearance for anything in the USA.

The closest thing I can think of is that I work for an IT consulting and oursourcing company here in Canada, where our US offices do stuff for the FBI, Homeland Security, etc. what they do I'm unsure of and I have nothing to do with it. I'm just a server administrator who does have admin access to many companies for my job but nothing that's really government related.

My wife is a RRT (Registered Respiratory Therapist) who works in a hospital. I don't think it's anything from her end.

My wife (who petitioned for me) called the senator's office today because she wanted to know what's going on with our petition. After seeing so many people get approved here who filed after us (contrats to all of you) she thought it was time to call again. It's also been 2 months which is what the senator's office told her the processing time would take once California receives the petition from Vermont.

Anyways, the senator's office contacted California's office via email and received a response that they are working on our application, currently doing an "extensive background check" on myself and that this process can take a couple of years?

Needless to say this is quite upsetting to us. Is this background check a normal thing for everyone that just gets done normally in a matter of days or are they doing something extra here?

I'm not sure if this helps. I was denied entry after my wife and I got married and was told that the entire application process would need to be completed before they let me back in. After finger printing me, photographing me, etc. they sent me home.

My mother-in-law passed away last week on Monday and I was determined to get across the border to be with my wife for the funeral. After calling everyone including the crossing border we use (who has a folder that's 15 inches thick on us) they said they would grant me a B2 visa if I supplied them with a list of things. Utility bills to show that I have a home in Canada to return to, a letter from my employer saying that they know I'm crossing the border and that I'm returning home, etc. A couple things they check even though they don't mention it is return tickets - I had a return train ticket already in my hand - and they check to see what you're bringing across for clothing. Only bringing to sets of cloths they then believed that I was not planning on staying and they granted me a B2 visa to allow me to enter the USA for 1 week for the funeral. I just returned home from the USA two nights ago.

From my understanding, they will only let you cross for humanitarian reasons on a B2 visa. Just wanting to visit won't work.

So what happened? Did he cancel his $190 check and then send USCIS a check for $455? If you don't pay the correct fee, they are not going to process your application. Also, I think other members who did not pay the correct fee had their entire application sent back...not just a letter saying the price changed.

They will not even look at your application until they have correct payment of fees. You would get an RFE for the biographical information in a separate letter after the petition has been received with the correct fee.



so what happened is they returned the wrong check $190... and then my fiancee got the correct amout and sent it back to USCIS... that's when we got our first letter NOA1 after he mailed the correct amt of check... they didn't send the whole application though just a letter saying the fee went up... so right now we're waiting for the RFE for the biographical info... my fiancee asked the rep from USCIS if he can just send the bio info together w/ a letter explaning the case but they said "no" so i don't know if thats a good idea my fiancee asked or what??? hehehe... anyways, we'll just gonna wait whats gonna happen next... i can always visit him there or he can come here in canada...

fyi my husband and i filed for k-3 last year I-130 is already approve but the I129f still pending and its already past their processing tme. soour lawyer suggested to file for a IV, filed it dec. 18 and now im getting ready fo my interview on the 17th thank god we hired a lawyer. im not telling you to get a lawyer coz its relly case to case basis. but you may wanna consult somebody who really knows about the immigration. hope this help

Include your case number from the NOA 1. When I had been calling NVC and found I was missing a document I mailed everything in before I ever received the RFE. If you have paid any fees online and can print one of those coversheets that show your case number I would include that too. It's very odd that you have not received an RFE yet as its been so long. I am surprised when you call NVC they didn't tell you that you were missing those documents and tell you how to send them in.

The first thing they check is the check/money order, they don't even go through the rest of the paperwork until whenever they get around to it, which is when they will send you an RFE for the missing documents. Unfortunately, you are still technically within the "processing times" listed on the uscis.gov website for VSC - April 15, 2008. I don't think it would hurt to contact a congressman/senator and see if they can get involved. A lawyer won't do you any good. Good luck!

I take it you haven't received an RFE yet? I'm not sure a lawyer would be of any assistance at this point. Basically, when you omit information from your petition, USCIS will contact the petitioner and request that the missing information is submitted.

Can you check the status of your case online? Have you contacted USCIS? It could be that they have not begun to adjudicate your case yet and therefore have not even discovered that the information is missing. Sadly cases are not always completed in the order they are received and some may slip through the net.

First thing I would do.....call.

Hmmmmm...your petition has been waiting a while. When was the last time you contacted them? If i were you, i'd stay on top of them. Call again. And consider getting your local representative involved. Sometimes a jolt from the right official will assist USCIS in seeing the merits of processing your case. Your over the magic six month mark now and whilst USCIS cover their butts by saying they are still processing April petitions....a rep might help move things along.

I feel for you guys. It must be hard to see other people being approved and wondering why nothing is happening with your case.

crying.gif ... ok, this is our case... my fiancee file I-129F last july '08... and then the processing fee went up... so he sent the correct amount of fee... and then we got our first letter (I-129F NOA1) july 30, 2008... and up to now it was touched only once (08/06/2008)...

and then i spoked to his friend's fiancee who filed the same case but a month later than us... and they were already approve early this month... "congratulations to both of them" ... it took 5 mos. for them to wait... and we are on our 7th mo...

my fiancee and i talked about the application before and i told him something is missing in the application... he didn't include the 4 copies of biographic info (G-325A), but its too late coz he mailed it already... and i know now that this is the reason why our application is getting behind...

my only advise for all of you who haven't file your applications yet, it is better to call USCIS to order your application to get the complete set of application, guidelines and any other important documents you need to add when you file... than just downloading it by yourself... good luck to all of US!!! good.gif

I have another question...

So we were looking at what getting married in Ontario is going to entail...always read the fine print (ugh). To be married in Ontario, because my fiance was divorced before, we need to get a letter of opinion from a Lawyer, and then apply for the marriage license. They are only valid for 3 months and he needs to go with me with his passport and birth certificate. He is coming to see me in early June, and the the wedding is Sept 22nd so that's obviously not going to work out.
Now we are considering getting married here first and having the reception / renewal of vows etc in Ontario.

my question is - if we get married here and I don't have a K1 Visa and tell the POE officer that I'm just visiting, is it considered fraud? I would be returning to Ontario and waiting until after our wedding to file, it would just save us a LOT of money and headache to be married here first.
Will it affect my ability to travel if I'm married here vs. Ontario and filing, or is it all the same in the wash?

Thank you for your replies! Well that is a relief...Sitting in that meeting yesterday with the lawyer I was thinking it doesn't make sense...why would the US rather me come in on a K-1 visa and struggle and sit on my behind for 6 months vs. come when I am approved and prepared and ready to job search right away?

If I get turned away at the border, will that affect me other times that I choose to come? I have been asked before if I've been denied entry into the US, even though I've never been.

I think we are going to look more into doing the paper work ourselves...the cheapest lawyer we've found has been $2k, all the way up to $5k, with application fees additional. That could be money in our pocket...from what people are saying, it sounds as though it's pretty straight forward.

Are there any negatives to getting married in Canada first vs. the US? We were thinking that we would need to be married on US soil first, but it sounds like that would be considered a "fraud" to the US government if we do that without first obtaining a K-1.

So, my fiance and I have met with 2 different lawyers now. We have been getting conflicting info. Here's a snap shot:

He is a US citizen who works for the State.
I am a Canadian citizen who works for the governemnt of Ontario (social work). I have a house, my full time job, and a horse. We have struggled trying to figure out what to do with our upcoming marriage, because I am NOT going to be able to drop my house (I wish to rent it vs. sell it) or leave my horse (who I board out) for several months. I am also not going to be able to come to the US and not work for several months (such as with a fiance visa) while I wait for the visa to be approved. It's just financially not do-able.

The conflicting information we have gotten is that 1 lawyer told us that we can file for a spousal visa, and I will be able to travel back and forth from the US while this is occuring IF I maintain strong documentation of my intent to return to Canada (bus ticket, plane ticket, mortgage, horse board, letter from employer with vacation approval, etc). Keep in mind I travel to the US almost monthly for 4-5 days at a time.

The other lawyer has flat out told us that once the petition is filed, I CAN NOT travel back and forth, regardless of documentation, and that there will be complications if I am stopped and then denied (ie. processing will be slowed down and/or it can jeopradize my visa approval). The logic given to us today is I can show all those documents, but I am contradicting myself about returning to Canada by having filed for a spousal visa.

This would mean that for the 6-12 months of processing, I could only see my fiance for 2-3 days every other months when he is able to come to Canada (due to the nature of his job and the way vacation is accumulated)...I have been very upset about this all day and trying to find answers on the internet but have been unable to come up with any solid documentation on this.

I generally travel by land to Buffalo from Ontario, Canada and fly out of Buffalo.

Do the US Customs officers have access to information about petitions filed, etc? AM I allowed to travel once the spousal visa is filed? What have been other's experiences?

I called NVC today and our case has been chosen for AP (additional processing). It has been there since Aug 3rd. Oh my gosh. Yesterday my dad called me to see how it was going and I told him still nothing. He said he would call our lawyer to see if he could find out what was going on. I was about to leave work and thought I should write down the receipt number. I logged onto USICS and saw that there was a touch on 8-13 I freaked out and couldn't bring myself to go any further than that page. I was so afraid it would be a denial. I finally opened the page and it said APPORVAL!!!!. I cried and hurried to the store to buy a calling card to call David. When I told him he said...are you serious? are you tricking me? And finally he believed me. He and I were soooo happy. It was the best day smile.gif

All the touches - Got the RFE email this morning. She reacted like many have posted. At first she was crying she was so happy. But it didn't take too long for her to start freaking out about next steps, even though we've talked about it 100 times.

She's been on the phone all day with her family and they're all happy for us. Her family is very supportive, as is mine.

For everyone - Please don't lose hope. It is coming. Like I told Amy a few days ago - even if something happened and we wanted a delay, we wouldn't be able to delay it. It was going to happen and finally did. They're moving through them now and nothing will stop everyone from getting it. Our hopes are that it will be very, very soon.

I'll be out of town for a couple of days, but will be back Sunday. You'll all be in my thoughts and I hope to return to a lot of celebration.

Yeah thats crazy eh...22 days. No expedite either. Odd how they just slam one through so fast with no apparent reason. Maybe its a good sign though....maybe all March, April and May filers are on different people's desks and that guy just started at the wrong end of his pile.
