National Visa Center (Dept of State)Sent an e-mail to the NVC yesterday. How long before a reply usually?

You just have to keep trying the number. I often get a busy signal. Try 30 seconds later and get through. I find the busy signal only happens during peak hours. If you call first thing after they open, or towards the end of their day it works like a charm.

K-3 Spouse Visa Process & ProceduresI'm starting my journey
but on the ir1/cr1 you are not able to travel freely to visit your spouse in the usa during the process as I understand....whereas on the k3 you can.

do i have my information correct?

when i looked at the 3 processes that was the downside of a k3 visa.

please correct me if i am wrong.

i'm in the midst of rerouting my plans....thinking about changing processes....which i am not happy about....but that's another story

Montreal for us was not that bad. We sent in our first application at the end of June, and we were approved on friday Oct 5. So it took roughly 3 1/2 months, give or take a few days.

Waivers (I-601 and I-212) and Administrative Processes (221g)police check
my apologies if I'm posting in the wrong forum, but, don't know where else to do it and assumed everyone here would be more knowledegable with the proper process. I know I'm going to have to apply for a I-601. I'm sending away for my record from the RCMP and their web site is a bit confusing (to me anyway). I've received a pardon (my record is from over 20 years ago), so my fingerprint check is not going to show anything. but, their web site does list another form to release pardoned records to a third person. should I ask for that one too since the U.S. is wanting the court records, etc? A couple of years ago I was refused entry into the U.S. when they did a random check and found out I had a record. I applied for, and received, a 5 year waiver a year prior to applying for our K-1, (we just received our NOA2) so the U.S. is aware of my record anyway. So basically what I'm asking is....since I've received a pardon, there won't be anything on the normal check that the RCMP returns to me.......what else SHOULD I be getting? thank you.

Waivers (I-601 and I-212) and Administrative Processes (221g)I-601 form questions
Could I please get some help in filling out the 601 application. Question #10 -(Reason for being declared inadmissible) I leave this blank until denied my visa at the interview in Montreal, and they tell me why it was denied....right? Question #11 - (previous visits to the U.S.) I've been to the U.S. 30 or 40 times, should I just fill out the 7 lines they have there? and also, up until I was denied entry due to arrest record being found out, I just went back and forth the way Canadians do, so what do I put for "immigration status"?. As of Jan/05 I travelled on my approved I-192, they gave me a card to show at the border. Is that a visa? if so, do I put that down under immigration status? don't know what its called either :-( and last.....I (Alien) can sign this application, right? I don't have to send it to my U.S. fiance to sign? your advice would be appreciated, thank you :-)

Waivers (I-601 and I-212) and Administrative Processes (221g)DS-156
Char, thank you for your reply on my previous post. However, the one question I still have is this: for question #28 on the DS-156 it asks if you've ever been issued a visa. Well, when I was denied entry to the U.S. in 2003, (when they found out about my arrest history,) I had to apply for (and was approved), an I-192. they issue you a card to show at the border with that. Does anyone know if THAT is a "visa"? thank you

i went for a K1 and it was only cash tht they mentioned, not sure in yr case..

I'm going for a K-1 too. Since I know I am going to be denied the visa, I went ahead and downloaded the 601 application to be able to hand it in at my interview. It was the instructions that came with that that stated how to pay. So maybe handing the application in in person requires cash, which would make my life easier.?

Waivers (I-601 and I-212) and Administrative Processes (221g)Montreal interview
Could any one going/gone through Montreal for their interview advise me on how they paid the I-601 fee? It's $265.00, but, I should expect fingerprinting too at $85.00? The instructions mention the $265.00 fee, but not the fingerprinting and I want to be prepared. Instructions state "money order or check drawn on a bank located in the United States". How can I do that???? can I just get a money order in U.s. funds from my Bank of Montreal? and as for them stating "in the exact amount only". Well, geez, if they surprise you with the fingerprinting fee over and above the $265.00 they tell you about...how does anyone have the "correct amount"? I leave Thursday for my interview, so your advice would be appreciated before I go crazy.

Has anyone driven to Montreal the day of their interview and not had to stay in a hotel? If so, can you tell me where you parked your car ? At 7:00 in the morning, I don't want to have to deal with the traffic there AND look for parking or I'll go NUTS. I don't know Montreal at all, and am afraid of getting lost if I have to drive the streets looking for parking. thanks :-)

wow, am I ever glad I cancelled my medical with him and went to Toronto instead. At first I thought to avoid the traffic going towards Toronto and go the opposite way to London (I'm actually closer to Toronto though, but hate the QEW). But, at the last minute I called Seiden and luckily got an appointment there and took the go train. And I did NOT have to have any kind of "hands on" physical. I did have a breast exam, but that was done by a nurse. anyway, its done, but, it was good that you posted your experience there, it will give other women something to keep their eyes open for....JUST IN CASE

K-3 Spouse Visa Process & ProceduresCanadian engaged to American... help!
I'm a Canadian Citizen I just got engaged a few weeks ago to an American CItizen and we have started to plan our wedding for September 2007. I'm not planning on living in the US till we get back from our honeymoon therefore I am thinking that I dont need a k-1 fiance visa. I've been reading through all the information on the guides & FAQ on this website and its helpful but parts of it are really confusing.

We want to have our ceremony with our friends & family in Canada and I've heard that its easier to get legal marriage documents from the US before September and then apply for the K-3 spousal visa. We want to go outside of the US for our honeymoon though, and as far as I've read, we can do this with the K-3 visa, is this right? Should we wait to apply for the the K-3 till after we get back from our honeymoon or does it matter when we apply for it?

Has anyone gone through a senario like this?

Any help would be greatly appreciated! Thanks!!!

K-3 Spouse Visa Process & Procedurestraveling to the USA while waiting for k-3 & other questions
I'm a Canadian Citizen and I'm engaged to an American Citizen. I'm planning on moving to the USA once we are married. My fiance visited an Immigration Lawyer this morning and I have some questions. I'll basicully tell our story and ask questions in between.

We are planning on getting "legally married" within the next few weeks here in Canada, once we do that, my fiance will go back to the USA and file the I-130 at a Service Center in the states (correct... or in Canada?). Which Service Center is the fastest for the USA? Is it Vermont? Ok so once we file that, and get a "receipt" (what does this receipt mean? That they recieved it?) we can then file for the I-129 (which I assume incorportates the K-3). Does my fiance have to file this I-129 in Chicago? Once its approved in the USA, its sent to the Canadian Consulate... right? I'm assuming that once it gets to Canada I will be shortly approved for the K-3 and recieve notice of this. Are there any interviews that take place during this? Where would we have the interviews, in Canada or the USA? While we are waiting for the K-3 to be approved, can I travel to the USA? I have a childrens choir that I'm leading in July which takes place in the states, will I be able to do this?

Sorry for all the questions, I'm just trying to work everything out and make sure I'm doing it right before I file anything. Thanks so much for all the wisdome & help on these forums!

US Embassy and Consulate DiscussionHow long is it taking to get an interview in Montreal?
I've been searching on here for some timelines as far as how long its taking between getting your NOA2 and getting an interview scheduled in Montreal for a K-1 visa but I'm getting a bit confused... I'm seeing anywhere from a month to 4+ months... what is the average scheduling time right now for an interview in Montreal? Does it matter if you are doing a K-1 or a K-3 interview or are they both the same time frame?

Thanks!

K-3 Spouse Visa Process & ProceduresChanged filing office?
QUOTE (pushbrk @ Nov 11 2008, 11:07 AM) <{POST_SNAPBACK}>
It's probably good news alright but will the OP please confirm the mail said Vermont was not the filing office or just indicated the file would be transferred. Vermont is definitely the correct filing office but they are free to transfer cases. They also quite often chose the wrong form letter to send.

I'm talking to my wife on the phone now who has the package.

It says:

QUOTE
Transfer Notice:

We have transferred this case because the record indicates that office has jurisdiction over the case.

I'm not quite sure what that means. The online page with the case information hasn't been updated yet.

K-3 Spouse Visa Process & ProceduresChanged filing office?
My wife filed my I-130 form to the Vermont processing office at the beginning of April. My wife lives in the state of Maine.

We've been waiting patiently for the processing office to reach our application processing date which I believe they just did. My wife received a package in the mail saying that the Vermont office is not the filing office for her district and forwarded the application to the California office.

Is this a recent change in policy? The California processing office has "6 months" showing as their processing time. Do we now have to wait an additional 6 months to be looked at or will California honor the original filing date of Apr. 8th?

Thanks.

true. my friend when they got denied on frist step thast before the NOA1, the reason was lack of documents, they re-file instead of appeal. now they just got their visa yesterday.

Hi Ken-Love!

Thanks for the response and Goodluck!

USCIS did not accept ours, coz we did reapply too. Instead they sent us the denial notice and we payed $585.

So, after your friend reapply how long did they wait 'til they got the visa? And USCIS did not ask about the previous application? If i may ask...

Please ask questions and look at other postings in this section. There are a few of really helpful people there that can guide you through the process if you can let them know what you were denied for, and how to go about it.

All the best, and sorry to hear about your denial. rose.gif

Thanks Carlawarla!

We know why we got denied, same thing w/ "Ken-Love's" friend, lack of documents. And we figure it out before they send us RFE. We call USCIS and ask what should we do? One representative said, wait until the next letter comes. Then the other said, you can just gather all the documents you missed and mail it to follow! and so we did... and that was like 7 mos. that we're waiting before we mailed the documents co'z everytime we call they said wait wait and wait... then by april 2009 we received the denial notice. (since they got our appln. july of 2008) it took them 9 mos. before they send the letter! And of course they disregard the documents that we mailed to follow co'z they want us to appeal and pay $585. and it's been five weeks now since we replied and still nothing!

K-3 Spouse Visa Process & ProceduresNeed advice for a specific situation :)
Hello everyone,

This is my first post on these forums. smile.gif First let me explain my situation. My girlfriend and I have been dating for over 5 years. I live in Canada and my girlfriend lives in the US. What we would like to do is get married first; probably in Canada. After, we plan on buying a house and living together in the US. I currently have a full-time job in Canada and would like to keep this job. My girlfriend works in the US. From what I have read it seems the K-3 Spouse Visa is the fastest route to take to achieve our goal, but I'm wondering if there is faster or simpler method anyone else has found who was/is a similar situation. I would still like to work in Canada and I am wondering if there is any other forms or anything that have to be filled out to achieve this. If I work in Canada, do I get taxed more or anything because I live in the US? Also, I would like to have dual-citizenship (Canada-US). I am wondering if anything else needs to be done to obtain this, or would this be implied if I got the K-3 Visa? Just wondering if anyone has any useful suggestions or different routes to take. Thank you so much in advance, I apologize if I missed any information after browsing this site that was easily obtainable.
