Hi everyone. Firstly Lorry and I want to thank you for all the many well wishes on our Wedding Day ( 7 /7 / 07 )
It was a beautiful sunny day and everything was very nice. I'll see if I can figure out how to get pics up on here

I'm about to start filling the AOS paperwork and need some help. What else is new eh lol lol

Does Lorry have to fill out the form I-864 Affidavit of Support to go along with the AOS forms? We already did the income thing with the I-134 so is it required now again with AOS and an I-864

Do I send the EAD forms and the Advance Parole formsalong with my AOS application?

Thanks for any info that can be given I'm sure by the time we're finished filling these out there'll be a few more questions.

Yes and yes .. I've got mine ready to be completed with the stuff I get from the boarder (I94 ect) so that I can file by July 30th :) (fingers crossed) .. and don't forget to take the vaccination worksheet to a civil surgeon to fill out the proper form (should be done same day .. in cleveland only $25.00) you do not need another medical .. Hope this helps :)

Dr. Seidens in TO will ask to see your letter from Montreal where it has your MTL#. I had the medical done (booked 2 weeks in advance) and had the results within a week.

Use the forms that Montreal sent to you ... I think that they are particular. Complete the one that they tell you to online as it produces a bar code. Complete the checklist even if you don't have all of the information yet .. you have more than enough time to complete everything before your interview. Mail back the checklist and the completed online form ASAP as when they receive this they will put you in line for your interview by this receipt date.

As for your medical ... you know that your interview will not be for a few months after they receive package 3 .. so my advice is to wait a bit before booking it (unless you forsee any possible delays ... see other posts about these delays). The documentation from Montreal told me to get 5 passport pics done .. three would be required for the medical and two required for the interview. The medical only required one (would have saved me $30 as I paid $15 each for a set of two for me and my son).

One can very easily spend days and days reading through all the info on this website, and still not know what they are supposed to do.

So, in an effort to get all the info available in one spot, I am soliciting our VJ experts to let us new comers know where we can find the important info/discussions surrounding preparing for a move to the States.

These can includes links to pages within or outside of VJ, and cover topics such as....

- What happens to my taxes when I move?

- What do I do with my Canadian loans?

- What is EI?

- Do I have to revoke my Canadian citizenship to become an American citizen?

I included a letter to the RCMP telling them I was sorry for waiting so long to send it in, but, could they PLEASE expedite it because I had an interview at the embassy. I included a copy of our NOA 2 as proof. they had it back to me in 4 1/2 weeks.

A photocopy should probably be okay, because all they really need is your application number. Has Montréal changed things since half a year ago? The cover letter is a separate sheet from the checklist in my packet 3, IIRC.

Time of Day? You mean time of YEAR. I filed end of April...received NOA1 and I'm not in the system. None of the May people are either. People have their NOA2's...had their interviews, got married and have been living in the USA for 6 months and theirs still says "processing".

In other words....don't waste your time with Vermonts site. It's useless. A few called and were told that they were busy 'updating' the site and they probably won't ever show up online.

I see you're a Feb filer....alot have been getting approved but not one of them seen anything online...all of them either got their NOA2 in the mail or they phoned the NVC and asked if their case was there. Be better off grabbing a lawn chair and a cooler and hanging out at the mailbox.

It may not have been a 'serious' charge. The US considers ANY drug charge to be serious so if he was caught with a joint in his pocket .....thats enough for them. Canada its a DUI. Its not a serious charge in the states but Canada won't let you in unless 1. its been over 5 years in which case you can apply for criminal rehabilitation or 2. pay them $200 at the border for a (year long) permit IF they think you deserve one. To get in the USA if you have a criminal record you have to apply in advance and the cost is around $600 AND I believe its only good for ONE visit. I looked into it for my brother because he has a DUI and I think a possesion charge from about 30 years ago :S As for the court case and lifetime ban thing....well if he has a lifetime ban applying for the permit won't do him any good. Sounds like he doesn't want to discuss exactly what the charge was....could be he's just embarrassed about it.

Well I think I'll wait till we go back to Canada and re-enroll them there so I can at least list that as their current school. At least then they see that we left. If I fill it out and send it now would have to put the US school as their current and I just can't see anything good coming from that.

Actually when I crossed the border we didn't plan on doing that at all. It only came up because my fiance had lost his job. He lived in Canada with us before moving back here and he was still helping to support us in Canada. I ended up supporting him because he was ineligible for unemployment benefits because they don't count his Canadian earnings. The only way we could keep afloat at that point was to stay here and put the kids in school....which we thought was fine as long as we did not overstay.

I think its all going to be up to the CO at this point. Apparently I'm not the only dummy that has done this. I seen another post on almost the same thing but they never posted again to say what happened.

Anybody know a good lawyer? The last lawyer we spoke to at the beginning of this process was clueless.

Yeah I know that .....I know its going to come out either way...there's no way I'm going to lie about it and face even worse consequences. I'm just not really too sure on what exactly I'm facing here. I'm just debating on which looks worse. Putting the USA school as their current school or waiting and listing the Canadian school as current school when we go home next month. Or does it even matter. I'm the benificiary, from Canada. We have applied and received our NOA2 and I'm getting packet 3 forms ready to go now. Now my problem. I came to visit my fiance in the USA in July with my 3 children (also Canadian). Not knowing any better we enrolled the kids in school in late August where they have been attending until now. We are leaving in the middle of Decmeber to go back to Canada. I've now realized that we've screwed up. The school told us it was ok but obviously according to immigration it is. I'm losing sleep over this now. Should I wait till we are back in canada, put the kids in school and list that on the form as their 'most recent school' which in truth it will be. Or bite the bullet and just list the US school because obviously someone is going to notice we were in the USA for almost 5 months. As Canadians we are allowed 6 months and we have not overstayed. What kind of issues am I looking at here? I don't think either waivers apply in my case. I'm just not real confident that they are just going to 'forgive' me that easily.

As far as I know, Canada also does not allow polygamy. If the two of you are still legally married, then he can not get canadian residence based on common law marriage.....due to the fact that he is legally married to someone else (you) already. Report your marriage and this to the Canadian immigration officials.

Not true unfortunately...you can be still legally married and common law at the same time as long as you are separated. It works for them for tax purposes, if common law wasn't in effect people would just live together, have kids and claim single. Way better tax breaks.

I didn't leave any blanks...put none or N/a. If they are deceased then put N/a for current address or deceased. If their current address is the same as yours I'm sure 'same as item 13' would be fine. I wouldn't put holes in the pictures...I put mine in a plastic baggie and attached that to the form. Don't worry about the black ink. You're over thinking it. Just make sure all the questions are answered and it'll be fine :)

K-3 Spouse Visa Process & ProceduresAlready filed 129-F, - can I change to Green Card?
Well first she couldn't have just done AOS while she was here. She came as a tourist and it wouldn't have been really good to try that. K3 isn't 'finished' its just rarely used at this point because CR1 which is a spousal visa as well takes about the same amount of time and you get a green card where as a K3 you have to file more paperwork after arriving in the US. K3's used to be faster which was their main purpose...to reunite the couple faster. You say your already 2 months into the process. I assume since your local office is Tampa that you sent it to VSC and when I look at their latest processing times its saying 108 days from NOA1 to NOA2. So maybe another month and a half before you get yours? I think I'd just continue on the path that you are on. I looked at New Zealand embassy and they are saying 1-3 weeks for an interview date. Thats pretty quick, in Canada we waited months before finding out our interview date was months after that. Your spouse could be in the US in a few months. In the meantime they will expect you to provide proof of domicile so you would be better off to stay in the US and prepare for the arrival of your spouse by gaining employment, renting or preparing to purchase a house, opening a bank account etc. It will all show that you are planning on making the US your home. I don't know about New Zealand in particular but this was a very important topic for the embassy in Canada for the married couples.

I have a question regarding the Affidavit of Support form, I-134 for the K-1 Fiance visa. I currently live with my mom and am probably filed as a dependent on her tax return. I will probably file my own Affidavit of Support for my fiancee. I would think my household size would only be 2, my fiancee and I, since I do not support my mom. Is this correct? Or would my household size be three just because of the fact that my mom lives in the same house? I understand that if she files a joint-support Affidavit then she would put 3 for her household size. That makes sense. But I do not think it would make senUnless you are claimed as a dependent on her taxes. so se for me to have to put three.

Unless you are really young or disabled, I highly doubt your mother would be claiming you as a dependent on her taxes so as a co-sponsor her household size would be 2. Your household size is also 2. It doesn't matter how many people you live with, it matters how many you have an obligation to support. Check with your mother about the taxes.

My now husband (living in the States) had a felony from when he was young. He was refused entry into Canada back in 2003. After we became serious about spending our lives together he started the process to remove the conditions of not being able to enter Canada (which had to be sent to the Minister of Parliament and did not happen until after I moved to the US and we were married). He was able to come up for three weeks to stay with me in Canada after his Brain surgury by showing up at the border and they gave him special permission for humanitarian reasons. Then when he tried to do the same thing after he had radiation they denied him entry and told him that if he just showed up at the border again without his permission being completed by the Minister of Parliament that they would put him in jail for the attempt. The border guard lady that told him this was a real nasty. I think that they have the ability to do it .. maybe he gave them a hard time and the guard pulled a power trip.

I believe I have a pretty good handle on which forms and the associated fees are necessary for filing the petition and those after my fiancee immigrates. It seems there are lots of forms to file and each has its own fee. Do any of the forms required by the Montreal Consolate have a filing fee?


The form's don't specifically but you will pay a visa fee of $100 in Montreal at some point. Of course, you'll pay a fee for the medical exam.
