As far as I'm concerned anybody willing to sign up to possibly die for their country deserves whatever special treatment we can give them. I think letting them marry and spend some time with the ones they love before being shipped off is the least their country can do for them.

I do believe that the poster you replied to was being sincere and just meant you congrats. This whole process is a PAIN in the A$$. It was two weeks short of a year between our file date and my POE. Montreal's slowness has tried all our patience I'm sure.

CanadaAnother Problem - Support Form

So at this point I'm wondering if I need a co-sponsor since the sponsor's forms are all good to go...
His salary is 14$ an hour, and he has 40 hours a week, which equals to 29,120 $ a year (52 weeks). He has 3,596.11 in savings. The reason why we wanted a co-sponsor is because last year, he only made 15,533.12....

What do you guys think? And I was thinking, the letter from the employer, should it state he makes 29,120$ or his hourly salary?

When I went for my interview we were in the same situation. My husband makes enough yearly income according to his letter from his employer but his previous year income was half that(and not enough to sponsor myself AND 3 kids) because he had just moved back to the US from Canada and wasn't working for almost 6 months. When I got to the interview I told them he made X a year but last year he only made X and we DID have a co-sponsor if needed....she said no thats fine and only took his paperwork. Now for the AOS part...I sent the co-sponsor stuff in JUST IN CASE...

Some banks require a SSN to open an account. My husband added me on his account at Bank of America with no problem without a SSN. We hadn't even applied for a visa at the time actually. If its going to be in your name only then I can't see them doing it without a SSN. Since you are coming in on a K-1 you can get a SSN in a few weeks and then it wouldnt be a problem. Then you'd have to go back to change your name later to your married name. If you are changing it of course. I didn't look to see if your the bride or the groom. lol

I would send an email to Montreal and have it transferred to Vancouver. It wasnt that long ago that we all of us K-1s were wishing we could do that as Vancouver is way faster then Montreal. I'm sure that someone's transfer has gotten lost but I'm sure thats the exception not the rule. They can lose anything at any point so travelling to Montreal and going out of your way doesn't guarantee anything. Let us know how it goes...I'm sure it'll take them a bit to respond to your email (it always does) but it should go smoothly and you'll get a faster interview. Good luck!

Yea, I will have to agree to what the others have said, it certainly looks like an overstay of under 6 months. Which WILL impose a 2 year ban on entry to the US. I think overstays over 6 months are a 10 year ban, and before you ask, they count the time stayed in the US in a 12 month year, consecutive, there is no date that it resets and the Canadian gets another 6 months to stay.
Even then, the amount of time the Canadian CAN stay in the US is really up to the POE officer.
If they plan to get married before the ban is lifted, they can do one of a couple of things: he goes back to Canada, they file an I-129f petition for foreign fiancee and start that process, at some point in the process they will need to try getting a waiver to have the ban lifted early, Im not sure what all is involved in that another poster likely will have that information, I know its a pain in the butt, however will need to be taken care of unless they dont plan to marry within 2 years.
Another option is for them to get married NOW, and file for AOS, Once the AOS is complete and he has a greencard IIRC overstays are forgiven and there will be no ban, this comes with a HUGE caveat though, under NO CIRCUMSTANCES should he leave the US before or during the AOS process, not until he has that greencard, if he does, the AOS is considered abandoned, and the ban will be enforced.
It is an extremely risky game he is playing right now if he and your sister are serious about their relationship and are considering marriage. Border officers have access to a fair bit of information, and if he drove across earlier, or flew, there is a record of it in their databases, so they will know that he is a risk to immigrate illegally (and is trying to do so right now in their eyes) With illegal immigrants becoming more and more of a hot button topic right now in the US, it is something the CBP officers are looking at a lot harder these days.
Im curious how he managed to get into the US for a duration of 6 months in the first place? I tried to go across for 2 months once and was hauled into secondary where I showed I DID have ties to Canada (not enough though) and despite a return ticket I was only granted a 4 week stay. Sounds like he has even LESS ties than I did, so I am assuming he likely gave them a different duration of stay when he crossed, If so, he could be looking at a penalty of misrepresentaton as well, and if Im not mistaken can incur a LIFETIME ban.
Im going to suggest the get married and file AOS route now, since the overstays can be forgiven and ban avoided, but the process isnt too quick and he will have to miss his cousin's wedding because he wont be able to leave, but thats the price he will have to pay for gaming the system like this.

If he goes back to Canada and applies from there if there is an overstay which there is at this point ...he would have to file a waiver but you can't apply for it until your visa is denied. So after the interview at Montreal. Then the waiver goes through Montreal and the US Citizen would have to prove hardship. In other words why she can't move to Canada. These waivers are NOT easy to get approved.

Honestly at this point he came into the US not planning on staying and getting married and leaving at this point is not going to help him at all. I would get married and file for AOS. He would not be able to leave the US until it was approved and filing for advance parole would be a waste of time. They'd give it to him but he'd be automatically banned on departure from the US. Sorry but I think attended the wedding in Canada is a bad idea.

I think the packet like everything is kind of 'general' and they send the same one to everyone. He obviously lives in the US...he applied from the US and you're showing an affidavit of support which shows his job....again in the US. Its like the forms that you have to fill out along the way...so does a lot of other visa types so some of the questions make little sense or don't apply at all.

Like Peachey said...K-1's do not have to prove domicile so don't worry about it.

I would print off the immunization page from Dr Seiden's website for the 4-6yr olds. Your Dr is being ridiculous....does he really think an overpaid panel physician is going to send him a personal letter. I would try again with your personal Dr and tell him that just to see this Dr is going to cost you a lot of money and you only get to see him once and will not take calls nor write any personal letters. Might be helpful to print off the page that recommends that you get all immunizations done at your personal Dr. Other then that I would guess a travel clinic as well. Or even try a walk in clinic.

They wont approve the medical till after the first shot is given. We were never given a prescription for it for my youngest. I called our doctor and he didn't give the hep b shot since its done at age 12 or grade 7 and he doesn't keep it. I called the health unit and we got it through them. They will charge you for it, can't remember how much think it was under 20$ though. Its a 3 step for that age and the first 2 are done 1 month apart then 6 months for the last one. The health Unit for me was the only way to get it in SAult Ste Marie.

I cannot travel to the States anymore. I was told last time I do not have sufficient ties to Canada so therefore I cannot see my husband unless he comes here.. and he has his own business to run there all on his own. So visiting is not an option.. all we can do is wait.. while with a K1 visa, you can apply for what's called advance parole, and go to the States for 6 months at a time I think it is, and basically wait there with your significant other. I know this for a fact because a friend of mine did just that.



You have it backwards. A fiance has their interview and if approved gets their visa. Crosses in the US and gets married within 90 days and then applies for AOS and advance parole. During this time they cannot leave the US. Advance parole when finally approved lets them leave the US to visit another country, it does not guarantee them entry INTO the US to live with their fiances for 6 months. Fiances can and sometimes do get denied crossing the border to visit, like you, during the time they are in Canada waiting for their approval or interview. Any Canadian can visit the US for 6 months at a time unless the border guard says different and if your friend said "I'm going to go live with my fiance for 6 months while we wait for it to be approved" I doubt they would have been let in either.

I too kind of take offence at the 'just a fiance'. My now husband and I lived common law together in Canada for many years before he went back to the states and applied for fiance visa. We then got to spend almost a year apart while we waited for it to be processed and for me to get an interview. We applied April 30th, 2009 and I came to the states April 13, 2010. You don't know the specifics of each person's particular case so dumping them all in one group is a bit unfair. We're probably been a couple longer then a lot of the ones applying for CR-1's. lol

Good info Wishing! I don't think those prices are bad at all. We have a similar plan with Verizon and we end paying around $110-120 a month, but that's with a second line added. It's nice to have a cellular option. We have digital voice at home so we can call Canada, unlimited minutes, without any extra fees, but sometimes you need to make a call and you're not at home. Skype and all those other options are great, but it doesn't replace that need to contact people when you're out of the house or not on the computer. Personally I'd rather pay more to have that flexibility, but that's me. It also provides that no roaming option and there are not extra texting fees. It seems like the only way to stay in contact with my teenage sister is to keep the texting package alive :hehe:

Actually I don't think people quite get the skype thing....everyone automatically thinks computer. I pay 2.95 for Skype and use the Skype to go feature. They provided me with a local number to call and from there I can then call any number in the US or Canada. I added the Skype number to my 'friends and favs' so I use no minutes when I call it.

We used to have the verizon Canada plan but honestly they pissed me off. Its supposed to be no roaming charges but every month we had an extra 7-8 bucks in roaming charges. My husband got tired of calling them monthly to fix the bill and a few times they wouldn't saying I must have been using data when I was in Canada :/ Once I moved here we swapped our plan over to the regular family plan. Both the at&t and verizon plans cost more for the canada plan then the regular US plan so paying 2.95 to be able to call canada from any phone works fabulous for me.

If you are travelling to Canada frequently then the Canada plan would be a good choice but if you just need to make calls to Canada from your cell then my wallet prefers the skype to go. lol

I personally can't see how it would be a problem. How many times has one visited the US and withdrew money from a bank machine? Why would it matter when the money was deposited into that account in Canada? You are not allowed to work in the US for a US company and take away a job from a citizen or LPR. Thats why the law is in place. Not to prevent people from visiting and working for their Canadian employer remotely. That would kind of end a lot of business trips.

My grandfather was a US citizen, I grew up on a border town so it was common. My father had claim to US citizenship but never had any reason to bother with it. I looked it to it because of my husband and that sure would have made this a lot easier but since my father never actually lived in the US after his 14th birthday I have no claim. They changed the laws a few times so it depends on the year your mother became a citizen and the year you were born.

The laws governing whether or not a child born outside of the United States acquires U.S. citizenship from parents have changed several times. You'll need to look at the law that was in effect on the date of the child's birth (and the parents' birth, if grandparents were U.S. citizens) for guidance. These laws differ for the following time periods:

  • prior to May 24, 1934
  • May 25, 1934 to January 12, 1941
  • January 13, 1941 to December 23, 1952
  • December 24, 1952 to November 13, 1986, and
  • November 14, 1986 to present.
Here is an article that explains the different laws but unless she lived in the US for at least 5 years after her 14th birthday then unfortunately you probably don't.

Didn't have to remove my shoes and regretting wearing the ones I did as nobody except the other people waiting ever say them anyways! Everything is done at a window....frankly I doubt anybody ever noticed what I was wearing from the waist down (higher even, I'm short). You walk up to the window they are busy looking at papers, after you are there they look up to talk to you. I seen a lot of women in dressed in high heels and skirts...I was glad I hadn't gone to that extreme. I wore business casual, blouse, heels etc. I'd have went for the more comfy shoes if I had known, my feet were killing me after walking to the consulate and being in there for hours and then walking back.

By my count, I could have my EAD by that point if lucky, but more likely, it'll still be a month or so pending. If I require the EAD to get my license, I see no way to get around not renewing (and eating another expense).

Along with that, I was wondering if obtaining a driver's abstract from my local dmv would be of any use when applying for insurance down the line? Will US insurance companies even blink an eye at that, or am I stuck being considered a fresh driver no matter what?

I know there are a fair few Canadians who have made the trek/are making the trek to Florida and hopefully someone can at least help direct me to a better place. I've searched the forums here and can't seem to find anything concise about Florida... and their own websites seem confusing as ever.

I'd just get a Florida license as soon as you get here. I've also read the license site as well as know a few 'snowbirds'. Getting a Florida license is easy for Canadians. As for the driving abstract and insurance....I've talked to people here who have crappy driving records while mine is pretty much spotless and they pay less for insurance. Not sure if a driving record from Canada would do any good but you could have your fiance call his insurance company and ask. I highly doubt you'd be considered a 'fresh driver' because if you were...you'd have to go through all the testing and stuff first. Know what I mean?

Thats ridiculous. Once one has their visa in hand they shouldn't have to worry about the border not letting them in. Thats the whole point of getting the visa in the first place! So you can sell your house or give notice and pack your stuff to move. Somebody needs to account for this horrible error. Either your visa is denied or not but to give one and then take it back is beyond reasoning.

If it is standard to have to file the waiver for all past convictions then the embassy shouldn't have granted it on the first place. Seriously this is nuts. Denied at POE after being approved....thats horrible. Now have to file the waiver and wait a year because it has to go through Montreal which we all know is backlogged. Some things don't come easy for me! :lol: I actually heard about a doctor up on the north side of the metro who does it for $10.00 after I had already had the interview and finished the process. It wasn't one of the doctors I called when I was looking, so I guess I just didn't call enough people. I lived in Littleton at the time, so I was focusing on doctors in the southern part of town. Glad you were able to find someone easier than I was!



With your interview notice, there is a checklist with documents you are required to bring to the interview. You will notice that the I-693 is on the list. There have been many people who were asked for the I-693 at the interview. However, some of us were not, including me. If you chose not to have the I-693 transcribed, there is a chance you will be issued an RFE at the interview and the GC will not be approved until they receive it.


I wasn't asked at the interview for it either.

I included the worksheet I got at the medical at Toronto for me and my 3 children. Never got an RFE and went through the interview and was never asked. Personally with 4 of us needing it transcribed it was going to cost us a fortune. I rebelled after the hundreds and hundreds I spent on medicals and passport photos.....

It worked out fine for me and I saved some $$$. If the AOS was delayed and I had got an RFE it really wouldn't have made a difference to me.

I miss Timmies. For me Timmies is a fond childhood memory. We had one within walking distance to our house and my mother would go there daily for a coffee. She would go with my father on the weekends, one brother or another would meet her there in the afternoon before/after work. I'd go with her at lunch or after school or sometimes on weekends. She was always meeting friends and family at Timmies and thats where we would have our alone time with Mom and chat. She passed away when I was in my teens and every one of us has fond memories of that place and always will.

This is frustrating! I don't have a photo right now, but will bring it to Montreal with me. I've been reading alot on VJ that you can just try to upload any pic from your computer, then when it fails you can click on "continue without photo." Well when I click on that it just sends me back to the first page. I can't see any way to get past this stage. I know that others here have managed to get past the photo stage without successfully uploading a photo. How do you do that?? Suggestions? :help:

I've mention this before but not sure if you read back to your old posts, but they need a picture. It's why they ask for it :innocent: if it wasn't mandatory ahead of time they wouldn't ask for it. When you arrive to the US just have you man take a picture using a digital, crop it and use that. It's easy to do, don't worry!


I wonder how I managed to get to the digitally signing part if the picture didn't work? Oh well, I'll do as you suggested. I suppose the pic of me has to look somewhat like my passport pic so they know it's me? lol Oh horrors! :rofl:

As for the picture, I never did upload one. Well I uploaded one that it didn't accept (just a pic of a flower, because I didn't have a pic of myself on the computer lol). And then I managed to get past the picture uploading part and made it to the end. I understand that I can just bring the pic to my interview, right? So last night I managed to get all the way through the online DS-160, saving data as I went. I digitally signed it at the end, then clicked "print confirmation" and the printer wouldn't respond. Tried everything. Since I was using my cousin's computer and it was getting late, I needed to go home. I did copy down a confirmation number I saw at the end, just in case I needed it if I had to contact anyone. Is that what you'd call my confirmation receipt? The number starts with "AA" followed by a combination of 8 more letters and numbers.

So now what? I need a printed out confirmation receipt, and of course a copy of the form to sent to Montreal as per the packet 3 instructions. If I can't get access to a working printer, what are my options? Has anyone run into this problem themselves?

By the way, tomorrow I'm leaving on a surprise trip to see my sweetie. Not telling him until tomorrow morning that he'd better pick me up at the airport! :yes:
