Hi, my fiance and i just recently filed for the fiance visa, i am in the uk, he is in the usa, and because i cant visit him, we have to scrape together whatever funds we have to get him here when we can..

Lots of people have had to go through this i am sure, but i need to know how everyone coped because im finding it really hard, and to make matters worse my fiance is depressed.

does anyone know how long this visa takes esp coming from the Uk or is it the same everywhere?

So for those that dont know, today was terrible for us. I think Melannie spent 90% of it sobbing unconsolably. Thank God she finally went to sleep now. The embassy is now trying to take away our approval, as they say we lied on our application as Melannie was arrested in New York under a deportation order in the mid 90's while she was in college there. This is all untrue. I do believe she would know if she had been arrested!!!!!!!!!!!!!

LUCKY FOR US, and I cant believe I'm saying this, we hired a lawyer for this K1 process. I thought it was a huge waste of money up until today. They have earned every penny of their fee today. Turns out Melannie wasnt even in the U.S long enough for what the embassy man say happened to have taken place. Our lawyer was able to sort all this out with evidence in a way we never would have managed. Also, at the lawyer's advice, I contacted my congressman, Fred Upton, and he is going to get to the bottom of this, as well as a somewhat nasty letter from our lawyer to the embassy.

The lawyer seems VERY confident this is somebody's error who hasnt a clue what their job is. It is his thought we will get our visa quickly as whoever is at fault will try and dump this before it burns them.

So Melannie is headed back to Scotland tommorrow until this is sorted out.

I am so thankful for Allan LOlly and Associates legal service. I dont know how we could make it through all this without them. Hopefully the situation reaches a speedy and sucessful end. And as for the embassy officer who was so rude and cruel to my love today, I hope a friggin bus hits you.

I hope nobody else finds themselves in a situation like today has been for us.

Just called DOS again and was asked to stop calling so much! Still no progress, I'd say chances are none that we'll be getting married this week. At least the marriage license is good for one month, hopefully that'll be enough time. I hate to tell Melannie, she's really not going to take this well.

Well the visa courier service has completly screwed us over. Melannie didnt get her visa again today, so we lose a $400 airfare as its completly non-refundable. I guess we shouldnt have been quite so eager. And even worse, I dont get to see her tommorrow. We are just praying she'll get it in time so we can still get married on Friday. 3-6-09 only comes around once a century!

So I finally have my duplicate Australian Police Check. Its such a poor cousin to the UK one. Its just a piece a paper. Any way I called the courier service but after talking with AN IDIOT I found out they won't pick up the phone in that department till Monday, so I am planning on flying back Wednesday 4 March.

We will have them by Monday. They were mailed to Melannie's old flat. It feels great to have a date when the hardest part of this process will be over!

-- The marriage document shows sufficient identifying information

(e.g., biographical data such as age, date of birth or parent's names), and

-- The identifying information matches the information on his/her Social Security number (Numident) record.

The applicant may need to submit an identity document in the old name along with the marriage document if:

-- The marriage occurred within the last two years and has biographical information, e.g., age, date of birth or parent's names which does not match our records, e.g., the SSN record.

-- The marriage occurred within the last two years, but does not show biographical information, or

-- The marriage occurred over two years ago (with or without biographical information.

The identity document used to establish the old name must match the name on the current SSN record. The identity document is acceptable even if over two years old or expired.

In name change situations when evidence of identity in the old name is required and the applicant does not have any acceptable evidence of identity in the old name with him or her at the time the SSN application is filed, we can request the following documentation to process the name change:

1. Name change document (e.g., marriage document) showing the old name that agrees with the name on the latest Numident record (Numident) (e.g., maiden name), and

2. Acceptable evidence of identity in the new name (name to be shown on the SSN card), excluding marriage document if it was submitted as the name change document and

3. Verification of identifying information (SSN, name(s) on latest Numident record, date of birth, place of birth, parents’ names) from the latest Numident record.

If these three documentation requirements are not met, the name change request cannot be processed under this new policy. Evidence of identity in the old name would need to be submitted per EM-06064.

Note: Refer the Social Security office personnel to EM-06064, which was issued 10/02/2006 and EM-07045, which was issued 07/03/2007 for the current procedures regarding name changes based on marriage.

-- Health insurance or Medicaid card showing, in addition to the person’s name, either a photograph of the person or his/her DOB

-- School identity card or record (for current school year) showing, in addition to the applicant’s name, either a photograph of the applicant or the applicant’s DOB

-- Life insurance policy for the person showing his/her age or DOB.

However, the acceptability of an identity document must be evaluated on a case by case basis by the office processing the application.

Note: If the applicant has changed his/her name after an immigration document, i.e. I-94, was issued, e.g., married and is now using the married name, but has not obtained a corrected immigration document showing the new name; this is not a name discrepancy for enumeration purposes, i.e. SAVE clearance, if the applicant can provide an acceptable legal name change document to establish the new name.

The 14 day status expiration limit for assigning an SSN and/or issuing a card applies even if an individual submitted his or her application before being within the 14 day period and entered the 14 day period while waiting for his or her status to be verified.

If ineligible to be issued a replacement card, Social Security offices can provide written notice using Form SSA-L676 to explain that an SSN cannot be assigned due to your not having provided authorization to work in the United States for SSN purposes or evidence of a valid nonwork reason for needing an SSN.

The following are valid nonwork reasons:
-- Receive Social Security benefits
-- Receive Medicaid
-- Temporary Assistance for Needy Families (TANF)
-- Food Stamps
-- State/Local General Assistance Benefits

Needing an SSN for school aid or enrollment, tax purposes, private health insurance, banking, credit cards, loans or to be issued a state professional or driver’s license are NOT valid non work reasons for needing an SSN.

However, you can request an SSN Verification Printout, which will provide you with proof of your SSN and the name that currently appears on the record until you are eligible to be issued an SSN card.

Thats part of our plan. Although now we are doing the civil John would like that to be it. I keep reminding him I am a girl. I didn't know I needed the white dress and my friends and family but I do.

And b/c by the time I get back I will not have been working for 2 months, I need to work. I'm going nuts, now. I read all that about the change on 02/02 but I'm going to go via JFK even though it will be later in Feb.

I think Hannah is right. In most cases I have seen if you use the temp EAD linked to the I94 it lasts the 90 days. Then you need to AOS with an EAD. The EAD in most cases takes less than 90 days to be issued and in the cases I have seen is back dated to date the application is received. (Yep there is another series of NOA's in your future.) So if you apply for AOS while you have the temp EAD the new one should overlap with start dates.

This is no guarantee of course I base it all on anecdotal evidence provided by the others on VJ.

You can apply for EAD before AOS but it will only last for the length of the I94. It will also be a seperate application fee. Where as if you apply for the EAD & the AP along with the AOS, it is just the cost of filing AOS.

So now we're not sure what to do.

We are going to get married at a courthouse so we can file for AOS the day after Melannie arrives. Then we will have our wedding at our leisure and not have to worry about all that other stuff at that time.

The one we rented is a B&B without the second B for breakfast. I think they put out some stuff, but nobody lives on site so staying there, they'll pretty much be on their own.

The other one is just a weekend/vacation retreat that is just around the corner from our house.

I wish I could say we found them in some special way, but they are just places I have known about for years. I did think of the one we rented when I searched "weddings in paw paw mich" and saw the name.

I would say this is all just small town stuff, you'd probably have to get out of the city a ways before you'd find places like this. As Carmen says, everything is so expensive in Chicago or any other city for that matter I would think.
