On your NOA1 it will say whether it was sent to the California Service Center or the Vermont Service Center or somewhere else.

California cases start with: "WAC"

Vermont cases start with: "EAC"

Hello :) There are varying ideas on the best way to handle this. You can see if your husband could go get some titers done to test his blood and show proof that he had those vaccines or it may be that he will just have to get booster shots of the basic shots anyway.

It sounds like the USE is waiting for your wife to submit co-sponsor documents that show enough financial support as required. Once that it handed in and approved, her visa should be set to go. Generally the fact that they kept her passport is a good thing :)

Was any documentation given to her that you could post so that others can give you a better answer? Something like a blue slip stating what she is missing or anything else?

Man! That sucks royally! I'm sorry to hear this. I can tell you that the American Citizen's Services is most likely never going to help you because they don't have jurisdiction over visas (so they say). They should've told you that when you spoke to them. :( As far as his visa being on hold...if it is a matter of national security, he could be held up for a long time. You can try and contact the Department of State (as it sounds like you have contacted already) and a Congressman to see if they can receive any further information for you. The Visa section of the Embassy is who you need to talk to but an operator is the one who answers. Have you been able to get a hold of a consular officer when calling the USE Visa Section?

Good luck! I hope you are able to get answers soon :) If you were to go to the Embassy in person, you would want to speak to a consular officer and any other higher up you could to see what the issue is. Official documentation of what is missing or wrong would be most helpful in trying to get someone to respond to your request for info.

RogerandMai- If you are filing for CR1/IR1 visa then no. The I-864 doesn't come in to play until after USCIS has approved your petition and your case is sent to the NVC.

As much evidence as possible for the I-864's is the best. Does your wife have W2's for 2008 or 2007? Or...if your wife is submitting IRS transcripts (these can be obtained for free by calling the IRS number), then she doesn't need to submit the W2's. Your wife's income will be "counted" as well as your father in law's b/c your wife and your f.i.l. will be financially responsible for you :)

On the USCIS website for your account number, it will tell you if you are approved or not. If it still says, "Initial Review" then you haven't been approved yet. USCIS will send you (if you signed up for these on the website) an e-mail that you are approved as well as a text message that you have been approved. If you didn't sign up for those, then USCIS will send you (they send this either way) a letter saying that your petition has been approved.

After you are approved, then your case gets sent to the National Visa Center (NVC). Here is a guide that explains the steps that happen after you are approved:

If you think that you might be approved already and that your case has been sent to the NVC, you can always call their number: 1-603-334-0700 and once you get to when they ask you for your USCIS case number, you put your WAC+numbers in (NOA1/I-797C receipt number). If you are in the NVC system, the automated voice will tell you when the NVC received your case. If your case isn't with NVC yet, it will tell you that they don't have any information for that case number.

Sorry! I am the US citizen & he is the beneficiary. I have no criminal record. He was charged with simple assault & he plead guilty. There was no possible jail time for the nature of his charge. I believe the maximum he could have gotten was community service, but he only ended up with 8 weeks probation.

Hi everyone!

This is my first time posting on this site & I'm new to this whole process. My boyfriend & I want to be married & want to start this process. We want to hire a lawyer, and have already spoken with one. He is wanting to see the certified police report before letting me know if my boyfriend's criminal record will be something that will hinder this process. My boyfriend is 25, and was arrested in the beginning of the year for assault on a police officer. He was outside of a bar & was drunk, and pushed the cop. He didn't have any jail time & was assigned 8 weeks of probation, where he had to wear a tag on his ankle. We're currently waiting on the police certificate so we can start this process with the lawyer. In the meantime, I thought there might be someone out there who has a similar situation and could provide some insight. As this is not classified as a "crime of moral turpitude," I do not think it will prevent his K1 visa. However, I am worried that it will delay processing and/or present problems when it comes to the interview. Any help would be much appreciated!

It depends on the minor crime. If it involves any of the items under moral turpitude then yes. Most minor crimes are not a big thing unless they are recent. Just make sure you get all the documentation.



According to 4 different lawyers & everything I've found, it does not constitute moral turpitude. It was simple assault on a police officer in the UK (he pushed him.) It was quite recent though, about 6 months ago. There was no jail time he could have gotten, he received 8 weeks probation. When you say documentation, wouldn't that just consist of the police certificate he'll send in with packet 3? Aside from bringing along a copy to the interview, I'm not sure what else there'd be for him to show.

It cost us $18.50 US to send it overnight. And like I said, they forwarded it to Dallas almost right away, so my "mistake" (if it was that) didn't cost us much time at all. If I were you, though, I'd send yours to Dallas.


Ok, this might be a stupid question but should we change the address on our letters of intent if we're sending to Dallas instead of Lewisville? I don't know if that's something they'd care about or not but I guess better to be safe.

Nope, no experience yet. I plan to be visiting in the month of October, so I am just going to be as honest and prepared as I can be. It all depends on if the border patrol officer is having a good day or not, unfortunately. I've never had issues visiting but I know of people that have. It's pretty random.

As for my package, I think I sent it off to the wrong location. I must have. According to USCIS website, if you're using USPS, it's to go to Dallas. But right underneath, it says if you're sending it Express (which we were) to send it to Lewisville. Sent it off to Lewisville and a couple hours after it arrived, they forwarded it to Dallas where it was signed for by USCIS. I was pretty confused.



October is when Nick will be visiting here as well, we'll have to post how it goes then!

Yeah, I'm confused on the package because I thought you had done it correctly. Not 100% sure where to send ours now...what was the cost to send Express if you don't mind my asking?

Prepare to answer the questions in a polite, simple and honest way. When asked what he's doing on his visit, he should say visiting his fiancée and go from there. Bring proof that you've filed for your K1 and are doing things the legal way. Bring proof of a return ticket and any ties to his home country that he can prove. That's really all you can do.



Ok, sounds like a good plan. Have you had any experience with this? I'm just wondering because my fiance visited on 7/15, before we were engaged, and he was given a bit of a hard time in Minneapolis (just about visiting his girlfriend.)

Well I agree it shouldn't matter since we're filling out the K1, but the immigration officer may think differently. We just want to know what to prepare for.

Correct. For the US citizen a criminal record is of less consequence unless it is AWA related. They are more concerned about protecting the foreign fiancee and making sure he/she knows about the criminal record and is making an informed decision. They cannot keep a US citizen out of the US, criminal or not.

If your fiance is the foreign citizen applying for the visa, a criminal record can prevent issuance of the visa.



My fiance has a very minor (no jailtime) criminal record- the lawyers I have spoken with said the criminal record isn't usually a problem unless it's for crimes of moral turpitude. Is that your experience as well? Thanks!

I am gathering information (proof) in order to submit the K1. My fiance & I started speaking in April 2010. I have phone records from April through July of many conversations on my cell phone. However, during the month of May I obtained a home phone for the purposes of getting cheaper phone calls. We spoke sometimes for 7-8 hours at a time on the weekends. The phone company is going to charge me $25 a month ($75) for these phone records. I only want to purchase them if absolutely necessary, and I'm not sure if they are or not. I have many pages of emails/Facebook messages, copies of passport (stamp,) airline ticket stub, and receipts of things we did together. Can anyone offer thoughts on if these other phone records are necessary or even helpful? Or are they just superfluous? Thank you!

Although I wasn't asked that question, I did have an answer - I had been asked that by friends already. I basically said that "it is hard enough being apart while we are engaged - but it would be horrible to have to live apart after we are married! If we got married here (in my country) I couldn't go and live with him as his wife until after the spousal paperwork was done, and that isn't the way we want to start our married life together - separated. We want to be able to stay together once we are married so that means a fiancee visa and getting married in the States."

This is a little off-subject but with regards to the fees required for the K1, my fiance & I are trying to split the cost. My bank has told me they do not cash checks from England & wiring the money is going to cost at least $30 from what I've checked into. I thought I'd see if any of you have had experience with this & how you managed to transfer funds? It seems like there should be a cheaper way out there but maybe I'm crazy.

As I said in your post that you started yesterday, you are not sending anything to Nebraska. Go to the USCIS website or follow the instructions on the I-129F. You will be sending your package to Texas.


I'm well aware I'm sending this application to Texas, and I apologize, I didn't see your response to my post yesterday. I thought that Nebraska had a USCIS center (as the official website states.) I did not realize I would be going through Vermont or California only. I was merely asking about Nebraska because I thought that's where it would be processed through & wanted to check on the wait times. Both of our letters of intent are headed with the Nebraska address. Should this be changed? Thanks.
