I think it might depend on what they are denying you for. If it is just, "Oh, hey, we need some more pictures." or "Give me a new 2009 I-864 and info from your co-sponsor," then that is one thing. I think if they deny you for having a criminal record or attesting to having tried drugs even once in your life, your answer might be different. I think it also depends on if you have children or not.

I personally would move to Peru if my husband gets denied because we have a child together and he has already missed so much of her life. I also want my family to be together. Then again I have to weigh the pluses and minuses for everyone if we were to move there. So much to think about.....

Since the interview will be in her home country, they should be able to conduct the interview in Indonesian. I'm sure if you contacted the embassy there, they could tell you for sure (or ask another Indonesian on here). I'm in the same boat, my husband doesn't speak any English and I'm confident that they will conduct the interview in Spanish for him. I would think it's a given that not everyone coming to the US is fluent in English.

As for your evidence, do you have chat logs or e-mails or phone call logs between the both of you since returning and before you two got married? How about photos from before you were married? As for the comingled finances, if she hasn't been to the U.S. before, there isn't really much you can do about that. It is an added evidence and not a requirement.

Hey Rumba! Have a good time!

Here is a break down as I have seen it recently:

-After you get your NOA2 (and depending on if the NVC has sped back up or not), it will take around a week or two weeks for them to assign you a case number. Once you have a case number, you will talk to the operator and give them yours and your wife's e-mail addresses.

-You can e-mail off your DS3032 the same day as you get your case number or when you receive the 1st e-mail from the NVC. Your e-mail may or may not receive an auto response and may take up to 2 weeks to be accepted.

-Then possibly that day or within 3-5 days they should send you an e-mail for you to pay the AOS fee online. This could take anywhere from 3 days to a little over a week or so to clear. Once that shows as paid on the online payment portal, you have to print out the cover sheet which shows the AOS as PAID. This will be included with your I-864 packet that you send off.

-Going off of the DS3032 that you will have e-mailed, once that is accepted by the NVC, they will e-mail you telling you to pay the IV bill (the visa bill) online. If you keep up with the payment portal, the bill might be available to be paid before you receive something from the NVC. Just like with the AOS fee, once this fee shows as piad, you have to print out the cover sheet from the online payment portal that says PAID. Then you can send off your DS230 package with all of the supporting documents.

-This last part depends on how speedy the NVC is. Once they receive both of your packages and have input them into the system as according to the operator or the "voice" you get when you call, it may take anywhere from 10 days to 8 weeks to get a Sign in Fail on the online payment portal and Case Complete from the operator.

-Then finally, depending on how quick your embassy is and when they schedule interviews and when you got your SIF during the month, you might get an interview date for the following month of the month after.

So, based on when you get your NOA2 and how slow or quick the NVC is, it might take anywhere from 3 weeks from when you get your case number to when you get a sign in fail or it might take 10 weeks from when you get your case number to when you get a sign in fail.

I hope this was helpful and I'm sure someone will come along and correct whatever mistakes I have made.

Hey Ces,

Glad to hear things are back on track :) Does your husband live with his mom or do they live in different places? Is she married or does she claim any dependents on her tax return? All of those questions make a difference in how much she needs to make to meet the poverty guidelines.

As for the second question- your husband can be the choice of agent still. Is he going to go back to the U.S. or just stay there with you until the interview? Either way, he can have his mom send the documents to NVC or you can send them direct from the PI (as long as you have everything together) to NVC.

Billy- You don't need to submit anything of yours with the DS230 unless they specifically ask you. If you are a USC by the N400 then you would've submitted that info with the I-864. Yeah, we did policiales a few months ago but they aren't needed anymore. I told him about the place in San Isidro and he said he had heard about it. I don't know where you are from but for him to get there by bus would take a while (he lives in Lima but in El Agustino). Are they only open until 12 like the other places?

That depends on if your baby will be able to get US citizenship through you or not. Do you meet the residency requirements? You can check all of the particulars on the US Embassy website for Colombia. If the baby can get citizenship through you, then no...the process is much much much cheaper and easier. If not, then it will be some what similar with the forms and fees.

For the interview...you should bring tons of pictures and all receipts and the stuff you sent to USCIS and then the stuff you will send to the NVC and whatever else proof you have like chat logs or e-mails back and forth. Anything and everything that will show ties. They may not look at any of it but it is better to have proof than nothing at all. :thumbs:

There are several ideas of what you should send in with the I-130. The ACCO fasteners are not required. You can just paperclip things together and your application will have a smooth journey as well. The important thing to include are the actual forms (I-130 and G325A for yourself and your wife) plus the 2 2X2 in. passport style pictures of yourself, and your marriage certificate, and the copy the USC's brith certificate or ALL pages of their passport.

The other things are extra. This stage isn't as important to have the bonafide marriage materials...that will come later at the interview. You can send as little or as much as you would like right now. Some affidavits will suffice for now. You can also send some pictures of the two of you before or after the wedding as well as wedding pics. :thumbs:

If not...then she files the I-864. Her brother files the I-864. Her sister-in-law files the I-864A (because she lives in the same household as her husband).

Good luck with your upcoming interview. The CO will probably ask why your wife hasn't visited recently. You can just explain why she hasn't able to travel. I don't think they will deny your visa for that. You are going through a very tough country so they might put you on AP or request more documents from you. Hello!

As for the NVC part...that doesn't start until after you have received your NOA2 from USCIS approving your petition. Then your case will be transferred to NVC and NVC will assign you a case number (which you have to call for). Then you will give the operators your e-mail address and your spouse's e-mail address. Next comes in to play the DS3032, you can e-mail this out as soon as you have your case number. You will most likely receive an e-mail from NVC asking you to send the DS3032 even if you have sent it already. That is because it is an automatic e-mail that has other important information for you.

2nd part- You will need some other things for the IV package during the NVC stage but your wife can send you her civil documents and everything that you need from her and you can send it to NVC (which is where it goes). Once you are at the NVC step it will makes sense (or you can also try reading LingChe's guide for some help or join one of the monthly NVC threads :) ) Your wife could send it all as well to the NVC (which you will have to make sure she prints out the invoiced sheet from the NVC payment portal...this will also give you the address to send that package too). But you might just want to make sure everything is there before it gets sent. Depends on how well you both go over the packet to make sure everything is there and accurate.

I hope what I said made sense. If not, just reply and someone will come along and make it more clear :)

For the I-864 bit...yes, your wife still has to fill out the I-864 and submit a letter of why she wasn't required to file taxes for the last 3 years.

Her father will be the co-sponsor :) and he could make photo copies of his 3 last years of tax info and send it to your wife so that she can submit everything together with the barcoded cover sheet (invoice of AOS bill paid) to the NVC. Or he could call the IRS and get tax transcripts for free (in minutes if he is in front of a fax machine or in a week or 2 if sent through the mail). Since he doesn't have pay stubs, copies of his pension and what ever else that proves his "income" would be beneficial (usually...depends on who reviews your case at the NVC).

For the IV packet- Looks good. Of course there are your country's specific requirements of documents that you should double check to make sure you have. I would also have the beneficiary's full name and case number on all pages (on a sticky note for the original documents) in the I-864 package and the IV package. On the back of the 2 photos I would include the full name of the beneficiary and the case number as well as the date of birth of the beneficiary.

I hope that made sense and was helpful. I'm sure someone will come along and correct this is something is wrong (sorry if there is something I am mistaken about).

Hello! Well, the answer to that question depends on how long it will take NVC to complete your case. Lately it has been around 3 weeks from when all of the documents are updated as received in the AVR. Then from there it matters whether you hit the cut off date for scheduling. Since NVC generally schedules interviews the 2nd week of every month for the following month (i.e. The second week of November they will schedule interviews for December). So right now it is just a game of waiting and seeing when they complete your case. Usually, if you miss having a case complete for one month then your interview will be pushed to the next month.

If she is pregnant, you will need something form her doctor proving that she is pregnant. Also saying that she can't have a chest x-ray or such and such vaccine. Without proof, I don't think they will believe you. :thumbs: You should be fine though. Most people are understanding. :star:

The 2009 income is what they will mostly be basing your approval of I-864 on. the other years are optional and it shouldn't hurt you. :thumbs: You can add whatever you wish but NVC should just pass your file along. If you feel you need it, you can always take it to the interview at the Embassy.
