First off, this guide will help you answer several questions if you haven't read it already:

1. Yes, he should have it all ready to go so that all he has to do is send it out.

2. The paperwork gets sent to the NVC.

3. That depends on your country. I would check with your embassy website page to be sure. Usually it is originals as well as a copy of each document sent.

4. They will need your marriage certificate, his birth record/certificate, his police clearances. Mostly stuff from him The guide I referenced above will tell you what all is needed.

5.The sign in fail is when the NVC is done with your case (you paid all of the fees and they have received all of your information that you have sent (I-864 and DS230) ) and then your case will be complete and sent off to your embassy to schedule an interview. (Like I said, read the guide. It is much more clear than I am.)

You will get a customs form on the airplane that needs to be filled out before you get off of the plane. The I-94 isn't needed but the customs form is. As for other things needed at the POE, of course you will need to bring the brown envelope from the embassy. A good attitude will help as well if you get stuck with someone who is in a bad mood or trying to trip you up. Have a safe trip!

Oh man! I am so sorry to hear that. I have no idea how long an RFE from USCIS takes. You could always call USCIS tomorrow and see if they can tell you how long or what it was about. Hopefully it isn't anything major. Any ideas of what it could've been? Good luck and let us know what happens please. Maybe it won't take too long and then they will send you your NOA2.

If you are unemployed right now, there is no job letter to give them. For the I-864, you should submit you 2009, 2008, and 2007 tax returns. If you were unemployed all of that time as well and didn't file taxes, you have to write them a letter saying why you didn't file for those years.

Your co-sponsor will need to submit 2009, 2008, and 2007 tax transcripts as well. Also, whatever else they are using to show that they are above the 125% poverty guideline for their household (example: husband, wife, children claimed as dependents, and the immigrant).

FROM PETITIONER (Components for I-864 AOS Package) :

The I-864 is known as the Affidavit of Support. It's proof that the petitioner and/or co-sponsors can afford to support the beneficiary.


* I-864 [6] completed & signed by petitioner which is the Main Sponser(ORIGINAL)-- View Sample of Completed Form [7]

* IRS Tax information - 1 year is required, up to 3 years may help.

* Tax Transcripts, optional but may help. Call the IRS to get it FREE! 1 (800) 829-1040

* W-2s and/or 1099s

* 1040 from most recent tax year

* Pay stubs for current year (6 months should do)

* Employment letter showing your income and position.

* Make sure that position/title is consistent on all forms.

* Co-Sponsor in same HouseHold: I-864A and all Tax information as above

* Co-Sponser NOT in same HouseHold: I-864 and all Tax information as above

* The petitioner must ALWAYS submit an I-864....even if there's zero income.

* NOTE: Even something as simple as Painter on one form, and Painting on another, could trigger an RFE (Request for Evidence)

* Assets may be used to supplement income (such as bank accounts, equity in a home, but when an automobile is used, the first car may not be used...only 2nd, 3rd, etc)

* Assets of Petitioner are calculated at 1/3rd value. If the Petitioner has $30,000.00 USD in a bank account, they will be given $10,000.00 USD credit toward income requirement.
* Assets of Beneficiary or Sponsor are calculated at 1/5th value. If the Beneficiary has $50,000.00 USD in a bank account, they will be given $10,000.00 USD credit toward income requirement.
* Assets may be used to entirely satisfy the income requirement, but you will still be required to submit the Petitioner's most recent tax return.

I was wondering if that was the case. Yes, just write them a letter explaining that. Since there is a calendar difference and not a "you don't even know your spouse's birthday?!?!?!" difference, you should be fine.

Yay! I'm glad that she found it. How did you get her birthday wrong???? I'm not sure at all but I think NVC because they have your case now. You might be able to call them and correct it. If not, then def have a letter explaining with the DS230-since you have to send in the birth cert and a copy of it anyway. Good luck!

My NOA1 was full of missing names. After several failed attemps to correct the NOA1, I was told that the weren't going to send (a 3rd NOA1) a new NOA1 and that it was corrected. My time was not affected by this. I got through in 93 days.

Let me clarify "interview".... If a case is fwd'ed to the local office that means they doubt your marriage and want to interview you before they approve your i130. My petition was forwarded to an office... Idk which office... So I'm here at the local office to find out where it is. If its here, can I get an interview same day???


It probably depends on the office your case was forwarded to, you'd have to check with them, but I'd think it's probably unlikely that they'll just let you walk in and have an interview.

Yeah, I-130 for Permanent resident filling for a spouse or child under 21 is around 14 months, but anything else is 5 months.

I just went to uscis.gov's website and entired the search criteria to find the estimated processing times for I-130 petition for marriage/spouse and it says estimated time is 13.9 months!!! :wow:
Then I entered search criteria for 129-F petition for fiance and it says 5mos! Why the enormous discrepancy here???? This seems to me to be grossly unfair. They receive more petitions for 129-F and yet the processing time is faster? Really?
Can someone give me some insight as to why this would be? Because that's just ridiculous in my opinion. :wow:


It might have something to do with the fact that the I-130 is an immigrant visa, and the I-129 is non-immigrant, and processing works differently between immigrant and non-immigrant visas.

hope someone can advise me on this. I file I 130 for my wife dated 10/6/2011. After 7 months I contacted USCIS thru senator's office and got following reply:

"A check of USCIS records indicates that this case is currently under extensive background check review and it should be processed within 180 days. We apologize for the delay and inconvenience caused. Thank you and have a wonderful day."

Neither me or my wife ever broke any law (except speeding tickets). She never been to USA. We have wedding videos, pictures.....anything they can ask for to proof that we are married. They didnt ask for RFE.

I got my citizenship thru prior marriage which lasted over 5 years. We got divorce in good term, wasn't a massy divorce.

My questis are:
1. Did any one of you had similar situation? If yes how long it took you to go thru the process?
2. Do you advise that I should file I 129f?
3. I contacted Citizenship and Immigration Services Ombudsman today. Will it help?

Hope someone can help me.

It's possible they saw some kind of red flag in processing your application. I'm not sure if contacting the Citizenship and Immigration Services Ombudsman will do you much good, you may just have to wait out the background checks.

Sorry for asking so many questions but I just wanna make sure I'm doing and filling out the right thing on my i-130 form. I am confused what to put in Part C # 21 since my wife and I just got married last february 04,2012 in Philippines. After the wedding we'd been travelling most of the time for more than 3 weeks before I came back here in US. Should I just put N/A or Am I required to put the place we've went and stayed for 10-20 days after the wedding in the Philippines? a lot of thanks and God Bless us all in this journey! The I-130 form says how payment should be made.

1. The check or money order must be drawn on a bank or other financial institute located in the United States and must be payable in US Currency; and
2. Make the check or money order payable to U.S. Department of Homeland Security.

You really need to read all the documentation properly to avoid RFEs.

Hello, my spouse just entered USA on CR1 VISA. What is the next step for us to remove conditions.

Are we going to recieved GREEN CARD in mail or do we need to apply for one.


You can't file for removal of conditions until 90 before the expiration of the current green card which will be 2 years from the time of entry. The green card should arrive not long after entry into the US.

If you're not there for 21 days, then you probably don't need a visa, but maybe while you're there something will change and you need to stay longer. You might be safer to get one.

You aren't able to mail it on his behalf, it needs to come from him. Sending in a hard copy via snail mail is a waste of time though. When you have the NVC case number and have given an operator your email addresses they'll email you the request for the DS3032 within a couple of days, and just get him to send an email based on the template for the form, it will be much faster.

I have been requested an employment letter to verify Affidavit of Support...my employer does not grant such requests, we use THE WORK NUMBER, how can I go about getting this from my employer? they wont give anything in writing unless I provide them w/a written document stating Immigraion does not complete such verification method...any ideas??

Im really excited! i cld NVC today and they generated a 'package' on 10/20....she metioned something about fees so Im thinking its the DS?? and the affidavit of support!! im really hoping things go by smooth and fast, I have all they need except letter of employment, my job does want to give me the info yet and my attorney has not sent me the letter requesting such information from them!!!!!!!!!!!!

Thank you for replying...that's what I thought I understood from the 1st operator I spoke with...she said 'your case completed today, feb 9th and no further information is needed. we now have to send to embassy for scheduling, we schedule appointments as they are given to us by embassy by the second week of the month, to know if your interview is scheduled for March, we must wait and see if your case is sent by Feb 20th"...than I called back and the second operator gave the same information...im hoping I was given accurate information...

I called NVC 02/09/09 to question my wife's case...It has been COMPLETED at NVC and is pending for Interview to be scheduled at Ciudad Juarez...they have given me hopes that POSSIBLY in March...they cant say YES or NO for scheduling, we must wait and pend unitl about Feb 20th to find out if scheduled or not...has anyone that sent I130's in August has been scheduled? anyone processing through Ciudad Juarez in Mexico? Awesome news....we are PREGNANT!!!!!! 6 weeks...saddest thing is my wife and I have not heard about INterview scheduled yet...we still got a couple of days left to know...((NVC sd we'll hear by the 20th if scheduled or not)) so, im keeping my fingers crossed....does a pregnancy prevent the beneficiary from comming?? I would say no, as it is my understanding that children born to US CITIZENS outside the US have immediate US CITIZENSHIP...I would just have to know what the process is JUST in case 9 months go by and we havent been scheduled...which I have FAITH will not take that long...

Our petition 1-129F has been approved by the USCIS (October 6, 2009) and NVC and was forwarded the U.S Embassy in Abu Dhabi on October 13th, 2009. I recieved Packet 3\4 in the mail on November 6th. However before I recieved a packet in the mail my fiance and I sent and email to AbuDhabiIV@state.gov inquiring about when out interview date is. They provided us with an interview date of Feb 7, 2010. The only issue we ran into was that our I-129F Petition expires on Feb 5,2010.

We contacted the Embassy about the date validity and they assured us that it would be no problem. I hope this information helps. I would assume your fiances interview would also be some time in Feb of 2010.
