The estimated time for California Service Center is about 7+ months to get NOA2. The Vermont Service Center is about 6 months/.. I would just relax until June, then start looking for it. Good luck

How's all my November filers doing? Hopefully we hit the halfway point til NOA2...I hope? It's kind of like autopilot now for me and sometimes are harder than others, but honestly every time I go to bed, I feel happy tha another day is under my belt. Anyone else get like that?


I WOULD feel like that, but there is absolutely no movement in CSC. That does not bode well :( I feel like I am on hold.

Thanks for the advice. I will take it to heart. Luckily, we preloaded the case when we registered my son's birth at the consulate. I can always continue to preload, we got loads of stuff :)

I will check out the regional forums for more advice.

Congrats on your Giants win. Even though I am now an American League fan (Seattle area, so Mariners), I was raised a National League fan back when my team in the far East was a NL West team and the Giants were always troublesome for us (Atlanta Braves fan back in the 1970s and 1980s), so I will always have an unshakable fondness for NL teams :)

My fiance and I are just starting out on the K-1 route. Working on gathering proof of meeting within the last 2 years. Our son was born on 04/17/2012. I signed his birth certificate in Lima on 04/20/2012 with her as co-signatory. We also registered his birth and and applied for his passport at the US Embassy 08/26/2012 (passport and citizenship document issued 09/17/2012). Do we really need to pad the I-129F with more proof, or is this more than sufficient?

Okay. Even if they just started deductions, contact them and find out what your standing is and make sure you are in some kind of arrangement. They will know exactly what your standing is. FYI for most suspension actions there is generally some sort of threshold (X number of dollars in arrears and Y number of months of non-payment) before actions are taken. These issues tend to vary from state to state (unless specifically mandated by the feds). So contact them and put your fears to rest.

Disclaimer: I work for Child Support... (albeit the IT section)

Please contact your Support Enforcement Officer and make arrangements with him for arrears payment. Even if the house bills you mention were to pass, they are likely be like the license and passport suspension programs. As such, if you are in cooperation with your child support agency, you would not be referred and this would be a non-issue. If you are already in cooperation, you should have nothing to fear. Your Support Enforcement Officer is also your best resource for this type of question than those of us here on this forum. I hope you have a helpful one... if not, respectfully and politely request to speak to the agency's costumer relations unit... they will be really helpful (given they are approached with the right attitude). Sounded pretty routine and can be safely ignored.

Another software engineer here. I concur. Content will be handled by some other unit (policy, community outreach, etc). Their maintenance is some back-end stuff that may or may not cause feature changes. Any feature change would most likely affect how the online case status, or the infopass stuff, work, but not actually update any of the data (unless the maintenance is addressing some flow in how that data is batched from the back-end).

Let me pile on :)

The K1 visa was set up by congress to avoid lengthy family separation. As such, in my opinion, 5 months is already too long (cause we are looking at 8 or so total months of separation... almost a whole year!). Expanding the window to a year would be inexcusable.

So, USCIS is failing at their mandate. They seam to be callous to the affect this situation is having on the families of American citizens. They have set up a system that is opaque and unaccountable. So, you can't even gauge what is going on or not. They act as if they are above any kind of regulation or oversight. They appear to be flush with resources, yet fail to use those resources in a responsible manner. This has got to stop.

I think the most important thing for getting your letter taken seriously is to show that you really understand the problem, that you aren't just asking your congressperson to chase your own personal rabbit down a rabbit hole, and that you expect your elected officials to take action on your behalf when a government agency is failing you so horribly.

To that end, I suggest devoting two or three paragraphs to meticulously explaining the problem. Talk about how, based on the USCIS's published data, there has been virtually no review of K-1 visas for at least three months at the CSC. Further explain how the USCIS is obviously manipulating their processing time frame in order to avoid accountability for creating this backlog. Finally, talk about how it all seems to be related to the DACA program and possibly political pressures that are forcing the USCIS to let DACA petitioners jump in line against citizen petitioners with no end in sight. Be sure throughout to emphasize how the USCIS has become completely unaccountable for and opaque about all of these problems and is in desperate need of oversight.

Next, I'd add some words about your personal situation and how the delay is negatively affecting you and your spouse. Talk about financial and emotional impacts. If there is some special hardship (medical, etc.) you are facing, be sure to highlight it.

Remember, the USCIS is a service run for the benefit of US citizens, not a service that is supposed to cause so much unnecessary frustration. Everyone deserves better than this and its up to us, who have firsthand experience, to tell our representatives, who likely do not, all the ways in which it is broken. And we have to make clear that we expect them to fix those problems on our behalf, one way or another.

The reason, by the way, that I don't just provide a form letter copy of what I wrote is because I think these types of requests need to be personalized. I'd hate for a single form letter version to get spread widely so that congressional offices came to recognize it and discount it.

No offense but you don't know anything about how federal agencies work or how they are funded. Getting a few hundred dollars a pop per case "does not a budget make". They get most of their funds from the big budget that Congress votes on, which comes from all of our federal taxes and a few other places. There have been big waves of layoffs the past several years from many federal agencies, USCIS included. Look at ICE having to let over 2000 undocumented people in jails across the country go free because they couldn't afford to conclude their cases. It is about to get worse despite the sequester "stop-gap" measures.

If you really want to rant then all of you should be complaining to your Congresspeople to stop cutting federal programs. If you want your government to function better then use your voting power and get all those free market, libertarian, laissez-faire politicians out of office. These folks dominate both political parties, by the way, so lots of work to be done. This issue is way, way bigger than USCIS and all of your individual cases or mine. There's a lot of things to be outraged about these days that affect our whole society so do yourselves a favor and keep perspective.


You starting out with "no offense" means you meant to offend me; that's cool. "Getting a few hundred dollars a pop per case does not a budget make"??? Really??? Look just run the numbers. K1 alone. 340 a case, 1500 cases a month for CSC alone. This is one service center and only one visa type. That is half a million dollars a month. That does indeed a budget make. And we aren't even looking at AOS, CR1, IR1, the other K visas, DACA, etc, etc, etc. We have more than a budget going on here.

USCIS is self-funded and it would appear they are flush with money. They need to use it for the purpose it was intended.

FWIW, I have also ranted to my congress critters and to the DHS ombudsman. I hope everyone else does the same.

I am sure your congressperson is well aware of the immigration timelines, USCIS is under staffed, and there is nothing a congressperson can do or say to anyone to change that. Even if you do go beyond what is normal processing times, the only thing he can do is inquire on your behalf. You still have a few months before you even need to worry about it. As much as everyone hates the fact that they have to wait, USCIS processes millions of visa petitions every year. It is what it is. Good luck on the rest of your journey.


Email your congressman. Why is everyone so complacent? They are understaffed?? Really? Then they are wayyyyyy over-funded. With all the fees they are raking in, they need to get better management to address workload processing, which includes using those funds to hire more people. Simply saying that they are understaffed is only playing USCIS apologist.

That being said, if the OP would like me to post what I sent (a general complaint letter, since I am only 111 days in and can't really start moaning about my own case, yet... I am mostly outraged for July and August -- and now September -- folks). We all need to whine and moan and complain. Only by voicing our outrage will things ever have any hope of changing. Stop making excuses for a federal agency that is failing in its mandate.

Whether you need to do this and how you do it will depend on the country. For example, the US has no requirement for you to obtain permission before leaving with your child (although both parents do need to sign for the passport... but once your passport is in hand you could roll right on out). Peru, on the other hand, requires a signed authorization to exit if the child has a Peruvian passport (my little guy has an American passport, so my fiancee could just walk right on out with him). These are only examples of what you need to do. Check with a lawyer or a notary or whatever your country's version of border control is for the steps you need to take.

Same here. Our son is a dual citizen too. He shouldnt need a medical as he is already a U.S. citizen.


Yeah. American citizens require nothing to come here, so your child is ready to come right now, just like mine is :)

Hello guys, We have our interview date at the embassy in Lima Peru for the K-1 visa; however, I was wondering how necessary it is for both parties to attend. A plane ticket is ~ $700, and I'd rather save that money for the interview cost, medical examination, or my fiancee's flight here.
So my big question is this: how much does the presence of the petitioner aid in the approval of the visa?
If i DONT go, will We be rejected?
If i DO go, is it guaranteed that we'll be approved?

I have heard that it is not necessary, but that it depends on the embassy. Some embassies apparently won't let the USC in. I don't think Lima is this way. When we went to do the CRBA for my son, they had both of us talk to the consular officer, then the consular officer wanted to speak to me alone (due to my sordid past :) ). I hope to go when my fiancee has her interview; it can't hurt and it has to put a positive spin on it... besides my fiancee will need someone to take control of our little rugrat while she is be interrogated :)

So, don't sweat it. If you can go, great. If you can't, don't fear... it should not negatively affect the process.

And even with transferring cases to TSC, there has been no significant shift in processing at CSC. It's been 2 weeks and I would have expected some tectonic shift, but nothing. The good news is that not even the CSC can get away long with such blatant failure. As the cases to continue to back up, pressure must necessarily mount for them to do their jobs. We, however, are key in this shift. Write, call, complain. It is our civic duty.

Did you send it to Cantwell or Murray? Doesn't really matter, both of their staffs are pretty helpful. When you get ready to call, sit down with your fiance and make some notes of what you want to get out of the conversation.

FWIW, I think you may get even better service working through your congressman's office. They seem to take a more personal interest in your case, but that may just be luck of the draw.

Just curious. I may explore the possibility of getting my fiancee an H1B tech visa. I am okay with incurring extra cost, but not having to start over (even if the H1B is less time). She is a project manager and there is the possibility that I could get her a job offer, then get married and do the AOS permanent residency. The question is: do you have to abandon the K1 process to do this? It is not the same as starting over CR1 and having to abandon K1 (i.e. the marriage has not occurred and the criteria for K1 still exist).

If this topic should be passed to a different forum, dear admins, please do your duty :)
