Spent some time searching through the form. There was a guy in an identical situation to me some years back. In short, my wife is an Israeli citizen. We lived for a year in Spain and are now back in Israel. Her Spanish residency is expired.

 

I just wanted to confirm that the procedure is still to just get a letter saying Spain does not have a reciprocity agreement with Israel in terms of exchanging police records and that someone with expired residency cannot individually request her records.

In terms of the official stuff form the ministry of justice, I am not seeing anything barring someone with an expired residency permit from requesting the information:

I know that there has got to be tons of people here who did a study abroad in Spain etc and should have an idea of what to do.

If I have done the steps suggested and was not able to receive the certificate, is that enough for the nvc?

If the beneficiary lived in a country other than her own for a year but no longer lives there, she is to contact her embassy in that country to obtain a police certificate.


If her embassy does not have an agreement with the country for this kind of thing, is it sufficient to note this as part of the NVC application or must more be done to try to obtain the certificate?

You can exercise that option if you want to get denied and have to do it the right way anyway.  The right way is not always the easy way.

 

Gotcha. so for mine I should just leave item 13 blank (asks if I submitted a tax return and how much the income was on the previous tax returns)?

So my filling out an i-864 is just a necessary formality? Do I have the option of having my mom do an I-864A? It seems like less work.

You guess incorrectly.  The I-864a is used only when combining income or when the sponsor is a married couple filing taxes jointly.  This is probably the most common affidavit of support misunderstanding we see here.
 

 

So now I think I understand: If my mom and I don't independently meet the income requirements, we can combine because we are of the same household.

If my neighbor bill and I wish to sponsor, but neither of us meet the requirements, we can't combine because we are not of the same household.
 


The core of the I-864A is combination, and so it's not really necessary if a hosehold member doesn't need to combine; an i-864 is suitable.

Yes.  What is it about his job that disallows him from sponsoring immigrants?  It makes me wonder whether it prohibits him from signing an I-864a too.  Better check.
 

 

He works for the government and has a high security clearence. I suspect this is more along the lines of being a huge hassle for him rather than being strictly forbidden.

Is it absolutely essential that he fills out an I-864A? My mother has all the documentation showing her individual income (it's about 100k). When you file jointly, does that mean that whatever you income you earn individually is lawfully considered as someone else's income as well?

You and the head of your household (the one with the most and stediest income) provide your own I-864 forms and supporting documentation.  The joint sponsor's spouse provides an I-864a.

 

Under that definition, my dad would be the head of the household (he makes more than my mom) BUT he cannot sponsor immigrants due to his job. Should he still fill out an I-864A even though he cannot sponsor?

I'm still confused. I am the petioner and am a student. I don't have an income really - I made a few thousand last year from school work. I live with my parents. My mom files jointly with my dad, but only my mom is co-sponsoring. What form does she fill out?

I've paid for the AOS and have a cover sheet, and I have paid the IV fee and am awaiting a receipt (cover sheet). Can I put both sets of documents in the same envelope?

Also, as an aside - we are having problems tracking down a police certificate from a country where my wife lived previously. Such a document is most likely simply not unavaialble, a possibility aknowledged on the nvc website. If, for whatever reason, it is possible to obtain the document and they want it, what are the chances of them moving the case through the the consulate and having us bring the document there rather than holding up the nvc stage?

What should my mom put? HER individual income isn't listed on her tax return; it's listed on her W-2s (but it's not asking me for what her W-2s listed).

Gotcha. So than on my i-864 my household size will be 2 (I don't count either of my parents because income isn't being combined)? I am guessing that on my mom's, it will be two (her and my dad) as well as I am not legally considered a dependant at this point

 

Even if we are living in the same house, I am not necessarily considered a member of her household?

I am a student and have never filed taxes. My mom is willing to sponsor my wife. She files taxes jointly with my father, who really cannot get involved directly in this because he has a high security clearence. Whenever we have visited my parents, he has had to put in a request with the government so that a foreigener can stay at his house. I live at the same house with my parents.

Is there any way to save my dad the trouble of getting involved?

I sent my wife's police certificate from Spain along with all the required visa documents with the exception of her police certificate from her home country, which is only released to the US embassy. I got a letter today saying they did not receive the Spanish police certificate. This is the only document that is neither in English nor in the official language of her country. A certified translation was, of course, attached. Is it possible that they simply are taking more time to catalog this than it took them with documents that were in English or could obviously be verified at her consulate?

My wife and I spoke with an immigration lawyer-friend of ours. He suggested that writing a heart-wrenching letter to the consulate could help get us a May interview. I am a bit hesitant to do this, however. What's the conensus on doing something like this?
