I didn't get the impression that they were changing the form.

"If it was through an IMB on March 06, 2006 or after, Immigration may request information about the IMB and proof whether they completed the compliance requirement." Meaning if the petitioner states on the I 129F that they met through an IMB, then they *may* request information and proof about the compliance. I don't see how that 'proof' could be anything contained on an I 129F.

Your message prompted me to do a yahoo search on IMB and below is info from a legal website. It is fairly clear. The March 6, 2006 law is for newly filed I-129F petitions. So if your NOAA 1 is anytime from March 6 or after then USCIS will incorporate the IMB background check. You scared me for a minute there. I could not imagine that all embassies worldwide would return approved petitions. All they would need to do is write a letter to each Petitioner and ask them to provide the criminal background checks. It is a procedure that the Petitioner does in compliance to USCIS regulations and they submit that with the I-129. Anyways, I feel relieved now!!!!!

The Immigration Petition Process: Starting on March 06, 2006, any newly filed I-129F petition, which is expected to be revised, will ask the U.S. citizen petitioner to disclose all criminal history and past domestic violence and more. The petition, as before, will ask the petitioner how the couple met. If it was through an IMB on March 06, 2006 or after, Immigration may request information about the IMB and proof whether they completed the compliance requirements.

If however the couple met through an IMB BEFORE March 06, 2006, and thus BEFORE the law's compliance requirements went into effect for the IMB, then it would be expected that, by logic and fairness, the Immigration Officer would apply the standard administrative protocol, "grandfathering", and not inquire further about the IMB and its conduct.


So why wouldn't they have new I-129F forms then for people filing after March 6th? I used the one on USCIS's website and it doesn't ask for any additional information.

I feel your pain about being on the other side of the country. I live in Ohio and he lives in British Columbia.

This is a tough decision but our feeling was we would rather be apart in the beginning than to have to be apart once we were married. This is how we made the decision between K-1 and K-3.

What people are mixing up in this entire IMBRA mess is that most members that are concerned and calling all over for info are not simply trying to speed their own process up, most are only trying to get answers as to when something will happen, ´cus things are just thrown out there in the open, with no firm deadline for anything. I do believe it´s our right to at least get an estimate. My NOA1 was a little over 30 days ago, and I´m not trying to get someone to give me a NOA2 TODAY, all I am trying to know is if we´re looking on a wait of one month, two months, 6 or more, ´cus depending on their answer, some of us might change plans about visiting our fiances or anything while we´re waiting.

My petition is being returned from the Embassy back to NVC. After repeatedly contacting NVC and them telling me that they have not received it yet THEY told me to contact my Senator as Senators have a direct way to contact Embassys that they don't have. So I am neither "threatening" USCIS or making a fool of myself, thanks.


Well, seeing your reaction I can tell why NVC told you to contact your Senator. You have a massive attitude problem.
You didn't say something how long it is missing nor did you give any other information which could be helpful. If you really want a serious opinion you should give out a few more information.

I wrote a letter to my congressman. His office is right down the street from my work and I will see him on Monday at our local parade.

Here is the letter I wrote to my congressman:

I am writing to you today with reference to K-1 Visas and the new IMBRA law that went into effect on March 6, 2006.

I have a petition sitting at the Nebraska Service Center waiting to be processed. I am a US citizen residing in Olmsted Falls, OH. My fiance is a Canadian citizen residing in Kelowna, BC. My first Notice of Action date is April 21, 2006. A statement was released yesterday by Department of Homeland Security that even though the law is in effect they are not prepared to enforce the new law. As it appears now, that all service centers have been halted due to the new policies and procedures not being properly in place nor followed. They have recalled over 1100 petitions because of policies and procedures not put into place. Most of these petitions were from the Vermont Service Center due to their quick turnaround in processing petitions. The notice also states that a new I-129F form will be required for all petitions after March 6th. This form is still not available.

There has been no direction given as to how the new security checks will be performed, what will be required or what they will do with thousands of petitions sitting on the desks of the service centers waiting to be processed.

I frequent a website called www.visajourney.com. This board is designed for people going through marriage based visas. It gives guidance, forms and a place for people to share their stories through this long journey. However, the consensus is now that we are all on hold until the government figures out what they are doing and how to handle this. My question is why wasn't this happening between the time that the President signed this in January until March 6th when the law went into effect?

When an individual contacts USCIS, they have no idea what you are talking about when you mention IMBRA, new forms, etc. This has become a very frustrating process. At the time, I first submitted my petition I was told it would take 80 to 110 days to process my petition. However, now with all the service centers at a halt I cannot see how my petition will be processed within that time frame.

I have two girls from a previous marriage that continue to ask me why Darcy isn't here yet or coming soon. How do you explain to a 9 and 5 year old that it is the government holding us up from being a family?

Under normal circumstances and seeing it is VSC, yes, 30 days would seem long for a NOA2.

But, now things are different, so we have nothing to judge it by for precedent.

Yeah, it really sucks not knowing and just waiting to read or hear something. If at least we could be using this time to gather up any information that they would/might want, fill out a new questionnaire, or order the background checks. But we just don't know what it is that they will want, so we wait.

Once it breaks free, it's really going to be a mad dash all at once, which will in turn create even more backlogs for all of us. All of the thousands of updates coming in all at once at the same time.

I see you got a touch last week??? Thats the first one I have seen in a LONG time from Nebraska! Hope it's something good for you!

I think I could handle waiting if I knew something was being done and that my petition was being viewed at all. It´s this lack of info and knowing nothing is happening in USCIS that´s killing me. ´Cus I know that once they restart processing, there´s still A LOT of cases ahead of me, when I were so close to being adjudicated ourselves.
