Darcy was born in Winnipeg, Manitoba but he has moved so many times in his life. :blink: He has recently lived since I have known him in Calgary, Alberta; Winnipeg Manitoba; and Kelowna, BC.

Now his butt is planted in Ohio. :P

Like everyone else said just have him put in his carry-on. Darcy came down before his interview to the states for a trip to Walt Disney World we had planned. He brought the x-ray with him at that time because Vancouver consulate told him he didn't need it for the interview. He went back to Vancouver for the interview and it was never asked for. Its useless at this point!

If there is a way you can to the Detroit/Windsor border, you can get a stamp there. Darcy worked until December 26th. We filed our AOS shortly after that. I guess we are one of the exceptions to the 90 day rule for EAD card because our AOS was approved in 29 days without interview!!!

P.S. Darcy is from Kelowna, BC. He flew from Kelowna, BC to Hamilton, ON. I picked him up in Hamilton, ON and drove to Windsor/Detroit crossing. I realize that is a bit far from Texas but I wanted to let you know it is possible.

Just remember to not give them ANY originals. I stressed this over and over again to Darcy but it somehow didn't sink in when he went for the interview. The woman at the Consulate took my original paperwork and never gave it back. GRRRRRRRRRRRR!!!!!!!!!

We decided we are going to use Upack too. Its going to save us a ton of money rather than using U-Haul. It will just be a plane ride home rather than a 16-hour trip in a U-Haul. :P

Once we get to that point, I will post our experience so others will know.

I am looking into Darcy using U-pack as well. We got a quote from U-Haul and it was $928 CDN before tax and fuel.

We have a confusing situation so I am trying to weigh all of our options. His interview will be in Vancouver because he lives in Kelowna, BC. His stuff is in Winnipeg, MB in a U-Haul storage locker because this is where he used to reside in 2005. We were going to fly from Kelowna to Vancouver for the interview. Then fly from Vancouver to Winnipeg to visit his grandmother for a few days. We would then go to his storage locker at U-Haul pack up a truck and drive the 16 hours to get to my house here in Ohio.

I am just trying to figure out the best way.

I know this wasn't the topic but to me Canadian M&Ms taste different than US M&Ms. Frankly, I can't stand the Canadian version. M&M is my favorite candy and when I was working up in Canada I bought some at the border as a treat. Ack! :no:

I do like the Aero bars and the Coffee Crisp. I will have to check the stores around me to see if I can find Coffee Crisp.

Darcy's accountant in Kelowna is filing him as single. I hope that is right. I guess the reasoning is because he was 'single' when he left Canada to come here on his K-1. I probably should have Darcy question that when the return comes for him to sign it and mail back in.



It's not your status when you left that was important.. it's his marital status as of Dec. 31. If you were married before December 31, you have to file as married... If you were married after Dec 31, you can file as single...

You'll be sending your T1 to the International Tax Services Office anyways, so they know that you won't be eligible for any credits...

From CRA..

Marital status
Check the box that applied to your status on December 31, 2006. Check "Married" if you had a spouse (see below), or "Living common law" if you had a common-law partner (see below). You still have a spouse or common-law partner if you were living apart for reasons other than a breakdown in your relationship. Check one of the other boxes only if neither of the first two applied.

But upon further reading on CRA Bulletin T4056, one could argue that it should be the marital status the date that he left Canada as the leaving Canada return is only meant to reflect your tax status as of the date that you left... But if you opt to do a Section 217 return, you would have to reflect his marital status as of December 31...

BTW.. Is the accountant looking at Section 217 if your husband received EI income... it may result in him getting a larger refund...


Thanks Zyggy. I am going to email his accountant tomorrow about this. He didn't have any EI income. He had two jobs in Canada until he left for the US in September 2006 on his K-1 visa.

I am still hung up on the US side. I have talked to the IRS three times and still not convinced on the Foreign Income Tax Exclusion (Form 2555). I think I am going to take my taxes to H&R Block and see if that makes me feel better.

I hate taxes and I am an accountant!!! :wacko:

Actually I have. I kick myself now for not buying it a few years ago when Darcy lived in Calgary. It was a car flag. I will let you know if I find it.

I can't believe it is time already to file the removal conditions. I was scanning through the list of things required. I hope I have enough stuff. We don't have many pictures together. I have been a little lazy in having pictures taken of us or saving any cards we may have received. I guess I will have to start searching for evidence.

Thank you for the question and the response. My husband's expires on January 31, 2009 too. I wasn't sure if it had to be filed exactly 90 days prior or what. The response makes it clear. We too are in the same boat as I have most everything in my name and very little in my husband's name. I guess I just forgot to change everything as I haven't moved since we were married in 2006. We have a few things jointly such as my car, bank statements and a credit card. I was also bad about saving stuff over the past 2 years like cards and such from family. Oops! We do have an anniversary coming up so I will be sure to save any cards we get from family. I will be scraping together pictures to as we haven't really gone anywhere. whistling.gif I will have to see what I can dig up here over the next couple of weeks.

Current Status: Card production ordered.

On February 13, 2009, we ordered production of your new card.
