IR-1 / CR-1 Spouse Visa Process & ProceduresOctober K3 and I-130 Filers who are still in waiting for NOA2s?

In any case, I dont know what magic you've got, but please do spread it in thoughts to me! You got your NOA2 in record time - do you do any visualization exercises? if so, what do you do?

I actually do, not just me though, my husband also :) we also got our DS-3032 accepted in only 3 days when ppl are still waiting :P

I use the power of imagination, I use my intuition, mixed together with lots of prayer and fasting <I fasted every other day for 6 months before I sent off the I-130> and when we recieved the NOA2 it was a really awesome time, my husband was actually at this temple down in Pune< we hadnt been able to talk for 2 weeks due to his phone not having reception,> the day I recieved the NOA2 he had been in meditation the whole day, then the approval came and his phone also started working the same day :P . DO you believe in the Power of NOW? Thoughts are things, Thoughts become things... we are like a magnet, if we wake up with negitive energy then negitive things are drawn to us... wake up with positive energy then positive things are drawn to us... less you ask, how do you wake up in positive energy.. through meditation and my husband does krya yoga... I am not able to do it as yet, so I just concentrate on my breath... :P

Your still in my prayers... it is comming soon... my thought on it... I think the hold up on your I-130 is that you didnt send in any pics with the petition.. 1 picture speaks a thousand words... I know that you sent a butt load of other stuff, and maybe they are just verifing everything.. I would just start gathering all your stuff as if you were already at the NVC so when your case gets there you can zoom zooom zoom!! XOXOXO

from my understanding the pics that you sent to the uscis for the I-130 will not be returned to you. I am not sure if you sent in a request to return them if they would even do that then... I know at my husbands interview the pics that I sent in were not returned..

here is the link for ya... you can get the address and contact number from the site, my husband didnt have to have an appointment but that was with the New Delhi location..

https://www.vfs-usa....ndia/Index.html

As far as to what to take them... I would take everything that was in your IV package:

New DS-230
2 passport photos
copy of BC
copy of both PCC's
copy of passport
medical

Some offices require different things, the New Delhi office just wanted the new DS-230, passport photos and medical... take everything just incase and they will check it off when you are there.

IR-1 / CR-1 Spouse Visa Process & ProceduresCR-1 PLEASE HELP

I have some questions and would greatly appreciate any help that I get.

I am confused about when I-130 goes to NVC.

1. Should my husband fill out all the paperwork and documents before we get the IV bill from the NVC so that we have it ready to go?
2. Do I send it the NVC? Or does he take it to the embassy?
3. The documents do they need originals or copies?
4. Do they need documents from me (I am a US Citizen) or him?

5. What is the Sign In Failed, that everyone talks about? And why are you happy if it failed?

I know I am in the beginning stages of our process, but I like to be prepared and know what to expect. So I know what I need to do.

Thank you for any and all help. I have already learned so much from this site and I am so grateful for all of you.

IR-1 / CR-1 Spouse Visa Process & ProceduresHi, new here

Hi
I have been around for a while absorbing all the good info you guys give.

1.)I am a naturalized USC since 2003 and want to bring my spouse of many years and my 2 kids here.I am thinking of going the K3/K4 route than the I 130.

2.)The income tax returns that i have to show are filed married filing single. But someone told me recently that the filing status should be single since my spouse is not with me.Which is correct?

3.)Secondly the birth certificates issued in India do not have the new born child's name on it, just the mother and father's name.I heard Immigration needs the child's name on the BC.How to resolve this issue?

I would appreciate your replies. And you will see a lot of me around.
Thanks again.

1.) K3/K4 is dead they did away with it this year. look into the IR1 you will have to file I-130

2.) As long as you have filed your taxes you will be ok, I personally filed single even though through my employeer I have I am married.

3.) It is very common that the birth certificate wont contain the name of the child... you will have to get this resolved... very simple you would just go to the place where they issue copies of Birth Certificates and get the name of the child on the BC. My Husband had to get his BC corrected after they misspelled his Fathers name.... If you need the exact name of the place let me know, I am not sure where you are located but if it is in Delhi I could tell you exactly where to go

You should study up on other ppls timeline from your consulate and india in general to get you a better expectation of when you will be through with this process. Also fill in and keep a current timeline to help other ppl. Just because you are pregnant is not reason enough to expedite the whole process... believe me when I say a whole lot of us would use that excuse... There was even a girl that was pregnant and due to stress had her baby several months early and she was not able to expidite the process <she even had a lawyer>. You should expect this process if ran ontime <without any hiccups> to take atleast 7-8 months before you get an interview..

My perdicitions for you:
I-130 NOA2 : Oct 2010
NVC complete: Dec 2010 if you dont have any hiccups
Interview in Jan or Feb <more than likely Feb>

IR-1 / CR-1 Spouse Visa Process & Procedureswhat do i do next
you filed your I-130 in May? I believe this is what you are saying... and this would be for a CR-1 visa? if soo then you do nothing right now... except wait... and wait some more and just when you think you will looose your mind you will have to wait some more time... and then in about 5+ months from your NOA1 date <probably sometime in October> you will recieve your NOA2

I have seen some ppl get the NOA2 in about 4 months, but at the same time I have seen it take 6+ months to get it.... I think the average for India is about 5 months though

Good Luck  and Happy Waiting

IR-1 / CR-1 Spouse Visa Process & Procedureshope you could advice me on this...
Interesting... First off the USCIS did NOT request you to send in the original documents... actually they said NOT too, I am curious on the you did. But I do know that the USCIS will send all the documents to the NVC.. so I would assume that the original documents would be submitted to them. When your case has been sent to NVC I would call them and ask them what to do... it might be that they require you to get the original documents and send them in again... If I were you I would just apply for all the Original DOcuments and atleast have them...

IR-1 / CR-1 Spouse Visa Process & ProceduresName on PCC

Ok so I called the National Visa Center to get some clarification on this stuff.

They told me since my wife was interviewing in New Delhi that they only need the Police Certificate from New Delhi to be sent in. They do not need it from the other location she used to live in because she has never lived outside India, currently lives in New Delhi and will interview in New Delhi.

They did however mention that the certificate should provide clearance for ALL names ever used by my wife.

I dont know how correct this information that NVC gave you is, My husband also interviewed in NWD and he was required to have both PCC's... he also only lived right outside of Delhi in Bhadugardgh his whole life..

I assume that the worst thing that could happen if you dont recieve it would be that they would issue and RFE in NVC or they would put you on AP if they need it at the interview stage

As far as the name on the PCC I think you are thinking to much... on the forms it asked about a maiden name.. and I am sure that you put her maiden name on the I-130, DS-230 etc... sooo I believe that they can cross reference..

Just my 2 cents

IR-1 / CR-1 Spouse Visa Process & ProceduresInterview Approved.. but no visa???!!??!!

I think it's horrible that people have to go through this just because they've met online. Meeting people online is a normal thing these days. When I was in the States visiting my husband, I've seen that internet is a #1 place where people meet other people... does that make it not real or less real? No!

I dont think that it has to do with us meeting online.. I think it is because I am a white american female that is divorced with kids... and my Hubby had never been married before... so it makes red flags come up when applying for a visa, since it is kinda against his "culture" to have married me in the first place.. All the US is trying to do is make sure that he isnt scamming me, or that he isnt some member of some covert terriorist group  Woot Woot...<--- this is me trying to stay positive... :P

Just the basic facts about your case and given that it's New Delhi (which is a high-fraud Embassy unlike Mumbai or Chennai in India) is enough to warrant an AP.

I called the embassy today and talked to the same female operator that I spoke to last week... I used a different method on her this time.. instead of extreme panic and frustration i was cool and calm  She told me that our case is under mandatory administrative processing, it is being reviewed now and to call back the end of the week or begining of next week... <sigh> humm...she also said that each case is different with different processing times, some take shorter amount of times compared to others..<is that a glimmer of hope> what she didnt say was 4-6 weeks like last week

thanks for all the info everyone... I have not called DOS yet, I am going to call them once I get back to the US.. .. so my plans are to call the Embassy tomorrow and see what they say.

I wonder whats the fastes anyones finished AP is  is it unrealistic to think that we could have the visa this week? I have been going over red flags and everything that could put your case on hold and neither one of us have anything.. he has never applied for a visa, no criminal past, never been arrested... etc... same here on myside... soooo my thinking is that it has to be a name check... but even his last name is so uncommon that I wouldnt think that it would take long...

Oh well... and I thought waiting for my NOA2 was bad... and then I thought NVC was hell... my God!! it doesnt compare to this :(

Dont feel to bad my fiancee was approved May 7th at the kingston embassy all the lady said was we were approved and I was with him at his interview.
Also at least you know you are on AP. I still can not get a response from them.

I am sorry :( typically the K-1 visas fly by without an issue... Keep trying to call them hopefully you will get and answer soon

Thanks everyone!! I am planning on calling DOS when I get home.. Yea.. the good thing is they did keep his passport he took the oath and signed the DS-230 form... so everything proceeded as normal... not to mention the lady told us that we were approved.... so... IR-1 / CR-1 Spouse Visa Process & ProceduresInterview Approved.. but no visa???!!??!!
I was wondering if anyone is going through the same thing... I have searched and searched and havent been able to find anyone in my situation... here it goes:

Husband had his interview in New Delhi on the 27th of May. I was able to attend the whole interview with him :D I watched the whole process.. finger prints, pre-interview <checking all our papers> and then finally the interview.. The Lady who did the interview made us both take the oath... and then she preceeded to ask me the questions... very simple like how we met... bla bla bla.. then she wanted to see some photos... then she looked at me and smiled and said I want to wrap this up really fast so flip quickly... so I did... while I was flipping she asked me if my family attended the wedding and I gave her a great big smile and said yes, they attended via web cam mom, dad, brothers, aunt uncles and grandparents... here let me show you... I fliped to the couple of pages where you could see my computer and web cam in the wedding ceromony... she started laughing and said I have seen enough... she scribbled some things on the file of paper work.. and then said congrats you are approved you will have your visa in 1 week... I then asked her if it would be ok to pick it up at the VFS office.. she said sure no issues with that... then we left on cloud nine  she didnt hand us anypapers/slips nothing... we just walked out smiling

Sooo... From the VFS website and other ppl I have talked to I know that within 3 buisness days we should of been issued the visa.. when this did not happen I called the embassy and talked with a guy... and he told me that we were put on AP.. I was like what!!!! I couldnt think..so I let him go... collected my thoughts and called them back.. <I think this is what irritated the next lady :( > This reallllly rude Indian Lady is who I talked to next.. I asked her about hubbys visa and she again told me that we were put on AP... I asked her why the Interviewer told us that we were approved... the Lady said that she didnt know that they were going to put him on AP... then I asked why wasnt he given any slip or paper.. no 221g nothing... she said she couldnt disclose this... I then asked if the embassy puts everyone on AP she said no only a few.. I asked her how the Embassy would contact us if they needed any additional information or to let us know about the visa and she said that I would come to know.. I could see that I was getting nowhere except on her last nerve.. so I asked her how long should I should expect my husband to be on AP, she said that normal is 4-6 weeks and that I could call back next week to check on the status..... so now I sit in the firey pits of hell... I meant in India at a nice guest house... confused..

sooo please direct me... I know that I might never know what this AP is for.. but I have racked my brain.. if they were doing a name check.. my god wouldnt you think they would have already done that? Background checks.. I mean ugggh.. I really wish the Lady doing the interview wouldnt of smiled at me and said "Congrats you are approved" it is kinda like a horror film.. the smile and the voice is even comming in my dreams!!!!

as I am writing this Hubby is singing..... "You're stayin' alive, stayin' alive.Feel the city breakin'And ev'rybody shakin'
And we're stayin' alive, stayin' alive.Ah, ha, ha, ha,Stayin' alive.Stayin' alive.Ah, ha, ha, ha,Stayin' alive.
Well now, I get low and I get high. And if I can't get either I really try" gotta love the freaking BeeGee's!!!!

You will be fine, IMO if they needed anything from you that was different than you sent in then they would of given you an RFE at the NVC instead of an interview date
