So I emailed the embassy tonight... this is only the second time that I have emailed them... I am so nervous though... I know that we are just a bunch of ppl on here... and everyone has there opinion... but what does everyone think about contacting the embassy... do you think that they would deny a visa because you called them too much? This is what someone else had told in a post about AP... I really dont see how they would deny you because you called them.. I would think that the opisite would be true and that if you didnt call them and you didnt want to rock the boat then they would think why isnt this person like desperate to be with there spouse.... uuugh or are they like why is this person calling all the time they must be desperate to get to America.... #######... it could go in either direction really... I think I have started talking to myself

I am also a serious control freak so this whole process has been hard for me because there is no way you can control this.I have gone form anger to crazy to sadness to depression then finally now i am at acceptance. Ok so u might think this is funny but i use to work at a drug rehap. And its kinda like aa and na. Step 1You have to admit you are powerless to control our journey, the dos and the embassey. Thats the hardest step. for me and you for sure. Step 2.Believe that a power greater than ourselves can resort us to sanity. and so on.....Its called the 12 steps to recovery. I seem to be better after seven months of Ap. I have had to find a creative outlet for my crazed energy from nerves because i was having problems with a bleeding ulser from worry. So i opened Shutup&drive. It is keeping me so busy i dont have much time for going insane waiting. i miss Alen so much . The other half of me is missing but i must go on and do this so im ok and it will give us a great income. He want even have to look for work when he adjusts his status because i will have a job at our business for him. It takes alot to open a state approved driving school but it is very lucritive. So if you are so crazy from worry and not being able to control this. Do you work? Have hobbys? try and find something you can do to take you mind off the wait. It really has helped me alot. And i have ocd and am a control freak....

LOL... I work 2 jobs..I have several hobbies one being I am learning Hindi.. I have some days that are better than others.. but all in all I think I am doing very well..I have thought about opening another buisness but right now I am lacking the motivation.. I know this too shall pass... I just wish it would pass sooner than later

Thank you for your reply, SO, I guess he will just take his chances and I will report pack for others that might go through AP at the New Delhi Embassy.

This process has confirmed my sneaking suspension that I am a control freak... via the withdrawal symptoms that I have been experiencing.. <sudden out burst, crazy emails at 1am to the President of the US, posting weird pics that only I laugh at,angry replies on VJ to innocent ppl>

All the statistics that I have looked at were so sporadic that I figured my case could of been finished from 1 week into Ap to over a year... not to mention in WhatzNexts AP Tracker ppl from India had the highest number of denials :(

Thank you for your encouragement... to think that it would only be 1 to 2 more months is exciting...

Thanks Darnell, I am fixin to call him to see if he went yesturday, If not, I am going to also tell him to take a copy of my passport and his passport with him... idk... but seems that might be helpful along with the appointment letter

Is there anyway to get an appointment to speak with them? Like with the USCIS you can get an info pass... is there something like that with the embassy?

every interaction with the consulate is noted in the system.. whether it is by email.. congressional inquiry or in person.. they all get noted... thats not to say we get anything out of our inquiry.. just that they note it... they can get upity and throw a case to the side for as long as they want... but if they get called on it they end up having to explain why...

I visited that link that you gave and I have a question, several of the ppl had gone to the consulate to inquire about their case and a visa was issued soon after... My Husband is planning on going to our Consulate today or tomorrow depending on work... and he thinks that they are just going to throw him away and tell him to call... what is the procedure on going to the consulate after an interview? They have kept his passport and I am not there to get him in... so my thought on it was to take the original interview letter with him and explain to them that he had his interview, they kept his passport and they didnt give him any additional papers and he would like to talk to someone about his visa... right sounds simple enough.. But by all means I dont want to urk anyone.. so should he wait longer? I was thinking that since the embassy told us that it would only take 4-6 weeks and it has been over that it shouldnt be an issue..

Yea, I was talking to an DoS operator about this, and they were telling me that the embassy makes a notation on your file when you call them, but DOS does not. Becareful not to piss the CO off and it get onto a power play

Yea truthfully looking back into the fbi site i really dont belive that the 90 day thing is accurate... i mean as far as i kno maybe but than i wonder what have they been doing with my case for the past year.... i dunno...

as far as the writ thing goes i get scared to threaten them bc they can just deny the case all togther. i suppose just like scottthuy said its not when we want it to be over, its when they decide its over... :crying:

i totally agree with you, except.. I dont understand how some can get through in 4-6 weeks, others in 90 days some in 5-6 months and then the rest in a yearish.... It is out of our hands... and I think that is what makes me so crazy. I am a control freak and not being able to control the situation or make it better.. Makes me think that my sanity is in question here

Didn't someone post a while back that 99% of those in AP--get out within 90 days? If that is accurate, lets hope and pray that those of us who haven't reached the 90 day mark are part of that stat. That stat is the only thing giving me hope right now 18 more days for us till we hit the 90 day mark.

Oh god, I hope and pray that is correct, but at the same time I dont want to hold my breath on it. We are on day 44 so that would mean I am half way there <sigh>

I've been cleaning, organizing and making room in my closet for Mr. Lostinlove. I just hope it's one of thoe unknown signs that he will be coming soon.

I had done this a year ago :( But I guess I could tweek up his spots, What I have done is I went and got a pedicure Thursday and my hair done Friday, My Grandmother is thinking I am hiding some information..lol.. I wish.. just trying to make myself feel better
I'm tired of all his co-workers traveling to Kenya from the U.S. coming back and telling me they had a great time and it was good to see him. I know its really good to see him, I wish I could see him. : (

Well, i really do wish we could be outta AP in 4 weeks.... I would be ecstatic....tomorrow is my hubby's birhday and it truly sux that we cant be together again because of AP. This has been such a terrible experience. Like I hope for everyone on VJ that no one has to hit the year mark because truthfully it stinks.. Does anyone think that filing a writ of mandamus will do anything.... :bonk:

Oh MQ, also im looking for where I put that fax number sorry hun.... I promise I'll let u know k....

A writ of mandamus to my understanding would NOT be for us right now... it is for someone that has spent an excessive amount of time waiting... i am sure we have heard all the operators tell us... well it could be 2 weeks it could be 6 months or even a year.... What I havent heard them say is that it will take 2 -5 years ... ya know... so I would think after the one year mark that we could think about filing one... it is basically you sueing the government.. it sounds glorious and most of what I have read has been the lawyer sending the embassy a letter of action with 30 days to respond.. and most of the time <except in this 1 indian case I was reading> they get the visa sent out pretty quickly.

i am feeling kinda numb today...

Went to a local psychic this evening <for the first time in my life> And she told me that My husband will be here in 4 - 6 weeks but maybe sooner :D The astrologer my husband went to said he will be here the end of this month or the first week in August...

BTW: the psychic started out by trying to read my palm... and was talking and talking and then asked me if it was correct... I looked her dead in her eyes and said No... then she said... well my english isnt that good what I meant to say was... and then she changed her story to accommodate what I wanted to hear  After that she decided that she wasnt going to read my palm that I could just ask her a question and she would tell me an answer... he he he

Question: For those of you placed in AR after the interview did they keep your passport too or did you get it back?

They kept my Husbands passport at the interview, and they had also told him Congrats you will recieve ur visa in 1 week, I was there and I asked the CO if we could pick it up directly and she said yes..

So.... what about you.... any updates or responses from the peopl you contacted? has your husband gone to the counsel yet?

I havent had any responses yet, except the auto response from sending the emails. My Hubby got stuck on a job this week, so he is going first thing Monday morning, I will report back to yall about it on Tuesday

Thuy went to the consulate this morning... "they are still processing your case, go home and wait until we send you notification"

its only been 4 months of AP.... why should we expect them to have it completed already.. they have only processed over 4,000 cases that came to the consulate after I submitted the docs they requested 4 months ago and completed those cases...
They told me our case is pending and will be reviewed in the order recieved to be fair to all applicants.. hmmmm 'fair'? In my book there is something very unfair about setting our case aside while they process thousands of other cases that came after us... geez its only been 165 days since our interview....

This just blows my mind, all this time I never thought that they would have to process all the other SOB's<no ofense if you are one of the SOB's> before me, this would be the reason why it would take so damn long... I guess I was truely having a blonde moment

One day the lady told me "Acually your husbands case was... put under AP" i thought she was gonna say approved i got MAD. Lol

No, what gets me is when you first call them, and you give them your case number... and then it takes like 20 mins for them to find your case.. and then they ask you again what the case number is... I am always like... woot woot if they cant find us in the computer maybe they are done processing it... but they always manage to find us.... damn..

So the trends that I have seen is... there are certain weeks that you could get off of AP and recieve your visa <atleast for India>
4 weeks, 8 weeks, 12 weeks.... then 6 months, 8 months then uuugh 12/13 months

So my next exciting dates will be the week of the July 19-23.. then Aug 16-20... if I get to the 6 month mark yall can just hang it up I think I would of already turned sooo crazy you wouldnt be able to make sense of my post here anywys:whistle:

AMits astrologer says that he will be here the last week in July to the first week in August... I actually think this is what is keeping my Husband sane... but rest assure that if this doesnt happen that he will join the crazy train with me!!!!

I called DoS today hoping to get Chris or Sarah. Of course, I didn't get either of them, I got this rude lady. She looked up the case and states, "it's pending." I told her that Tuesday a rep told me some of the checks were done 50% and she see's that my case had some work done it on it, does she see that as well. And, she goes, "LOOK, it's pending, I don't see anything else besides pending and people here like to say whatever they feel like it." I was calm and said "thank you." Ang, hung up. SERIOUSLY???? WOW!!!

Thank god for my supportive co-workers and family. They keep telling me, "he will be here soon, don't worry." The waiting continues...I seriously hate this process!!! Okay--going back to work.

Hey, My Husband recieved the same thing... the stamp in the passport accompanies the RPO PCC You should also have a certificate from this department... so this would be (1)

Now she would have to go to her local Police Station and get an PCC this would be (2)

If you like you can PM me and I will send you a copy of what both of my husbands PCC's look like including the stamp that was placed inside his passport

IndiaIndians Will you take US citizenship?

I would only naturalize if and when India allows dual nationality. I will NOT surrender my Indian passport. It is an irrational sentiment, but that's how I feel. I remember when I was ten years old and I received my first passport and read the first page. "These are to request and require in the name of the President of the Republic of India all those whom it may concern to allow the bearer to pass freely without let or hindrance, and to afford him or her, every assistance and protection of which he or she may stand in need. -- By the order of the President of the Republic of India."

I still remember how how proud I felt at holding that booklet and how deeply I was touched that the President would show such profound concern for an ordinary citizen like me. Of course, I was a lot more naive back then.

I love the US, I have now been here for five years and I enjoy the time I spend with my husband. I know plenty of Americans I am proud to call friends. I'm grateful for the thirty-two flavors of ice-cream and buffalo wings with blue cheese that is available in the supermarket aisles. It is a beautiful country and I am happy to call it my home. But I doubt I'd ever feel American. Not now, not if I lived here for another twenty years.

Though the thought of naturalizing is tempting just to be done with USCIS. Of course, it would be a lot more convenient in terms of travelling but I cannot, in good conscience, swear an oath I don't truly believe in. To me, my flag and soil are sacred and I refuse to give that up.

There, that's my $0.02 on the subject.

Indiais Indian real estate a bubble?

One of the main reasons like mentioned earlier, now days families are moving from joint family to more of a nuclear family.
Secondly the younger generation has much more access to funding, which was not the case in older times.
Now the younger generation is able to get a loan from banks, same as American way and get an apartment on installments. (so naturally the demand for the apartments have gone up)
Also now with all the industries booming lot of people have extra money and what could be better investment, definitely property for which the prices are sky rocketing. (again increase in demand)

So will all these increase in demand and limited supply as cities like Mumbai don’t have room to grow horizontally and even vertically it is limited by govt. regulations. (creating a shortage)

Shortage in supply and heavy demand = rise in prices.

You as the petitioner must fill out the AOS forms. Your husband (the beneficiary) is not required to.

AOS=adjustment of status....... I am not sure what this has to do with the affidavit of support.... I was asking.... Do I or Do I not have to have a affidavit of support with the K-3 visa.. this is for my hubby.. I have read several different things on this...

AOS ALSO means Affidavit of Support. Yes, you DO have to file the I-134 to show that you can take care of your husband prior to adjustment of status where you will file the I864.

Lol, looks like some were somewhat confused when reading your post! smile.gif

Yes, you as the petitioner of a K3 must supply the affidavit of support, I-134, (not I-864) for your husband. He'll need to have this to submit to VFS prior to his interview at the embassy.

I was not in the least confused given that AOS means two separate things.

Seeing as how AOS is more 'generally' used for Adjustment of Status (probably to avoid confusion), it only made sense to assume that there was a little confusion about what the OP 'meant', nothing more. She just wanted to know if an affidavit of support I-134 was required at the time interview. It was not by any means an intent to insult, so please do not take it that way. No hard feelings, ok? It's all good. smile.gif

K-3 Spousal Visa Case Filing and Progress ReportsAffidavit of Support
I copied this directly from the USCIS website:

Affidavit of Support

Form I-864, Affidavit of Support, is not required when applying for the K-3 or K-4 nonimmigrant visa. However, the K-3 or K-4 nonimmigrant will need to furnish evidence showing that he or she will not become a public charge while in the United States. You may opt to complete Form I-134, Affidavit of Support, to help demonstrate that your K-3 or K-4 nonimmigrant will not become a public charge while in the United States. When the K-3 or K-4 nonimmigrant visa holder applies for adjustment of status, he or she will adjust status as an immediate relative, and at that time will need to file Form I-864.

I thought that I had to have the I-864 and show that I am 125% above poverty in the interview process ... so is this something that my hubby is going to have to have in the interview and they are going to look at but just isnt required. I think I have read so much stuff that I have confused myself sad.gif
