Yep your right, DOS replies on their UN-dated system we as innocent people get stunk in the middle...my life is like on HOLD, we cant go forward due to this and it's so unfortunately for as citizens that we have to go through this dreadful game of waiting and hopefully end is near...if I get any updates, I'll let you know...I'll keep you in my prayers and hope you'll do the same :-)

I would strongly recommend that you continue to contact DOS...

What is the point? I think the only thing contacting DOS will do is keep my stomache in ulcers... they cant tell you anything, it doesnt do any good to call them, and they are a day behind the embassy... I dont mean to be so blunt... but the way I feel right now is what's the point?

Waivers (I-601 and I-212) and Administrative Processes (221g)AP @ New Delhi 2010

Hello Melody,

I am a US Citizen...My Wife had her interview in Islamabad, Pakistan on May 7th. She received a light green paper at the end of the interview stating temporarily refused for administrative processing. The paper also states that it can take 2-3 months but no maximum time. They kept her passport and gave her token...As I stated I have been calling DOS and they keep saying under administrative processing..We got married last year, June 10th 2009.

It's a waiting game, just wait and pray and pray and wait...From what I heard, females don't get AP (only 1% of them)...today is the 68th day since her interview and we are still awaiting...I also heard that candidates coming from Muslim countries always get placed in AP compared to other regions and especially if you’re a male then AP is a must...I wish they would do the AP thing prior to the interview or at least make a centralized place for people like you and me to check the status online or track it because calling DOS is not working at least in my opinion...someone else in VJ sponsored her Husband and had interview in Islamabad and it took about 5months and a 1week for her Husband to get the visa. She also posted that prior to 2 days, she contacted DOS and they said it is still under administrative processing and then she said like 2 days later, they called for her Husband to pick up the visa...we just gotta wait and wait unfortunately:-(

And it’s so funny, I have also spoken to Dana (the person that you are mentioning at DOS)…I have been calling everyday and I will continue to do so…let’s keep in touch and let me know if you get any updates...

Thank you so much!!!

I agree with you. DoS is not working... this whole system is not working... I dont find that their tacktics are fair or even uniform... but who am I?? I am sure that the government has their reasons, I might not agree with them, but in the larger scheme of things I know that this hellish nightmare will be over soon. I am sure that I will keeping posting everything I find out ... so lets do keep in touch!!

Well.. if this is the case then August 19th would be my 60th buisness day... lets see.. I am going to do my best not to call or email them until this date...

Well I find that my 60th buisness day is also my 90th day. October 4th is my 90th buisness day excluding holidays also.. Such a big difference.. I might call DOS and ask them what should I use when counting the days... This process is so depressing :crying:

After your visa interview, if you were found temporarily ineligible for a visa you received a pink, green, or yellow Section 221(g) handout.

If you received a pink handout, you can check the status of your case online.

Check Case Status Here

The case status report is updated twice a week. Note: Due to circumstances beyond our control, the case status report may not get updated every Tuesday and Friday. Do not contact the Embassy as there is no cause for concern.

Please note: The Embassy cannot begin processing your application until you have provided all of the requested documentation. Your case will not appear in the on-line case status report until we have all of your documents.

If you received a green or yellow handout, the information on this page and in the case status report is not relevant to you. Instead you will be contacted by the Embassy if and when further action is required. Do not contact the Embassy.

How to interpret the case status report

Find your BATCH ID in the "Check Case Status" link above case above and note the case STATUS. There are only four case status remarks: PENDING PROCESS, CONTACT EMBASSY, SEND PPT, and PROCESSED. Each remark is explained below and instructions are given where applicable.

PENDING PROCESS

Your case is still pending administrative processing. The Embassy cannot issue you a visa before completion of the processing. The Embassy cannot waive the processing. Do not contact the Embassy.

CONTACT EMBASSY

Your case has been processed and the Embassy needs additional information from you to process the case to completion. Please e-mail the Embassy (nivadmin@state.gov) and request the list of documents you must submit. In the subject line of your e-mail state your BATCH ID and then write "Contact Embassy." Submit requested documents as explained below.

SEND PPT

You are required to submit your passport for issuance of the visa. Submit the passport as explained below.

PROCESSED

The visa has been issued, or the case is closed and no action can be taken at this time.

Document or Passport Submission
Please submit requested documents and passports via VFS. You may submit them at the nearest U.S. VFS application Center. To locate the VFS center closest to you, please check www.vfs-usa.co.in, and click on US Visa Application Center.

I have seen this question alot and found a quick easy answer... What is the difference between Administrative Review/Processing:

Administrative Review: Is when your case is being looked at more closely for accuracy and to make sure all security name and fingerprint checks have cleared and your visa can be adjudicated. This review is normally done at the Embassy Level.

Administrative Processing: Means once you have interviewed it is in security checks for any of these situations: you have had a name hit in one of the many data bases, background checks for fraud, or has missing and incomplete information that must be submitted and the rechecked. Processing is more in depth and than the review process and there is no time limit for this processing to complete. Administrative processing can last a few days or months and in some cases it has endured for years.

I called DOS to ask them a question today...I have read alot of different opinions on VJ and wanted to clarify it with someone that might know something... this is ... When you contact the Embassy does it put a negitive mark on your file with them.. say you email the embassy once a week and your spouse calls them twice a week... will this urk them and they subsequently deny your visa... Or will this delay the process because everytime you call they pull your case out and then it puts you at the bottom of the list... Dana from DOS almost laughed at me... but, what she said is that you could call them everyday and email them everyday and it would not negitively affect your case. She said that you can call DOS everyday and check on your case and that would not have any impact on the outcome of your visa... then I confirmed with her that the Embassy DOES make a notation on your account everytime that you call... but she said this isnt in a negitive or positive way... it is kinda the same as when USCIS "touched" your case and made an update in the system.

I honestly dont know how I feel about this... I am personally not contacting the embassy anymore except once a month.. I dont see how calling them all the time will make a difference and I dont really want to risk urking someone off just because I am inpateint. This of course is just my 2 cents

I recieved this email today in response to my inquiry:

Dear Petitioner:

Thank you for your e-mail inquiry.

Some applications require additional administrative processing, which requires additional time. When administrative processing is required, the timing will vary based on the individual circumstances of each case. The processing is mandatory, must be completed, and cannot be expedited. Section 221(g) of the INA prohibits the issuance of a visa to an individual whose application is incomplete or inconclusive, or whose eligibility has not been firmly established. As soon as this processing is complete or if require additional information, we will contact you.

We hope this information is useful to you.

Sincerely,

Hey, just wanted to start a topic for ppl that are on AP from the New Delhi Consulate. I know there is more than just me out there... if not.. I have just managed to start my own thread to freak out in so I might stop bothering other ppls threads.... anyways... would love to hear from you and share and compare notes... I will go first

Interview of course was May 27th, 2010 we had an early appointment at 7:45... the interview went great and the CO told us that we were approved and would recieve the visa in 1 week. They kept his passport and gave us a Welcome to America pamplet... welp.. that never happened... Here we are 7 weeks after the interview and we are still on AP.

This is what I have done:
*Called the embassy <once a week since this began>
*Called DOS <twice a week since this began>
*emailed the embassy
*emailed my senator
*emailed the President of the US <not my brightest moment>
*emailed the media <a friend of mine> to tell them about my case
*filed an FOIA
*emailed the embassy <2nd time>

so far... nothing has helped... the only benifit that I see in doing all this is that I have passed 7 weeks... so atleast being proactive is keeping my mind at bay.

My Hubby is planning on going to the embassy in person this week.. I will post to let everyone know if they will allow him past those two old guards.

Lostinlove03 and Amit-N-MelodyI think you both could think of a few more intimate things to spice up the homecoming ........ Lostinlove03 tonight will be a long night but get some rest tomorrow will be a very long day Im sure you have a ton of catching up on and thanks for all the good wishes To all the good people on VJ Im very sad to say I dont have good news. I feel like Im sinking down into a dark pool of water but just to let you know Im not exactly drowning yet. My husband went to the Embassy with all the requested papers and photos. He was interviewed again like it was the first time the interviewer didnt realize this was a reaffirmed case. At any rate she asked for a signed I-864 in blue ink by me. Now I have to send him this piece of paper by FEDex at the cost of $157.00 and he has to ride a train for 10 hours to put this paper in a drop box at the Embassy. The sad thing is we all know they have the signed I-864. So now I am wondering as always Whatznext. However after I got this piece of info I called DOS to see what they said. She said he had his interview so what exactly do you want to know. I explained the I-864 she sad she understood my point that they have to have it but that is the info the Embassy is requesting at this time. It disgusting to think we have such incompetent people working at the Embassy. Anyway bottom line is no visa yet Kevbev09 congratulations LOL I guess some Embassys are better than others Keep us posted on the date the visa is issued.Amit-N-Melody I might have missed it but do you have a arrival date for your husband yet???????

OOOO I have several more "spicey" things planned

I am so sorry that you didnt have instant wonderful news... what a bummer :( But... I honestly think that you will have the visa in hand soon <keeping positive thoughts> ... I have read on several different occasions that after the forms were requested and sent back in that they issued the visa soon after it... I pray that this is in your case also

Yes!!!!! Yess yess yess I do have an arrival date!! Sept 1st he will be here in America... but due to some flight delays he wont be in my arms until the 2nd!!!! 8 more days!!!

I know what you mean Melody and I will attend the funeral with you. My now spouse finally got his visa after 17 months of AP and then he waited two months to come here. I was ready to kill him. Just remember there are a lot of loose ends to tie up back home as he is making a major life change.

Oh and remind him he can return home for a visit to finish tying up those loose ends and to reassure his family that the US is not the great Satan and he will be ok here.

I will remind him that if he feels the urge to pee anywhere that he could always spend the money to go back and do this... that he doesnt have to pee on every rock before he leaves India... he damn near is acting like he will never return... When in reality we are planning on living there in just a few years!!!

Melody just remember he his telling his family good bye and it is a big step and a scary one I know if and when my husband gets his visa it will take him at least 3 weeks to prepare to come I know I want him here the next day but.... he has things to do. LOL men think different than we do.

WhatzNext I could totally understand that it might take 3 weeks... but 5+ weeks to pee on stumps is not acceptable in my standards... I wasnt thinkin that he would of been here the day after the visa.. I was thinking like the 18th of Aug... I can find all kids of tickets the plane is not booked... I can understand that he might be scared to come... but atleast he has me... the first time that we met I flew to India without ever seeing him in person... and stayed with him almost 3 months.... now tell me that isnt freaking scarey and I have been back twice since then and even took my mother on this last trip... So IMO he can kiss his freaking nerves goodbye and get on the freaking plane and come to AMerica!!!

I agree with all of you... but Sept 4th?? is he freaking serious? And he hasnt even really booked the ticket yet... he said that he has 'tenitively' booked the ticket for the 4th of September...This is only after he told me that the reason why he has not got the ticket was because he was waiting to get a 'free' ticket... this freaking "free" ticket was from some shady character... that I so happened to freak out on him about the other night... He claims that it isnt money that is an issue.<yea right, its more like Male pride> But that he is just searching for the "best deal" OMG!!!!

OOOOOOOO yea right... loose ends... he has loose ends... try peeing on the india/china border as part of him 'tying' up loose ends... I could understand if he was visting his sister and new baby in calcutta... but hanging out with his school chums... come on now he is just hurting my feelings... The icing on the cake is that yes he will see his sister.. this is an after thought on the way back through Calcutta as he is traveling somewhere else... And as far as tying up loose ends... what happend to the passt 2 months of AP?? Couldnt he be freaking peeing on places in these 2 months?? I mean coooome oooon...

Anyways I know I am a little dramatic... but I told him today after he told me that he had 'tenitively' booked his ticket that I was not calling him back and he better not contact me until he was at the airport. And there might of been some ranting by me as I said something like I was going to personally shove his visa up his A$$ if he wasnt here in a timely manner... But hey! I cant honestly remember All my rants

Hi guys,

Thinking bout you guys and hoping you all get good news soon. We have the visa in-hand--thank god! He plans to travel on the 17th and arrive on the 18th (same day as whatznext interview).
I am still worries and feel th embassy could call at anytime and say "oh we forgot to do this or that." The day he went to go pick up his visa it took 3 hours and they had told him it would take 10mins. I was sick t my stomach and thought somthin serious had gone wrong....like him being arrested or something. I kept remembering bridget & allens story.

Anyway---everyone just have faith!!!!

uuuuuugh... 'everyone just have faith' still makes my skin crawl!!! When we first got put on AP the very DOS Lady that I talked to first told me to pray... it rubbed me sooooo wrong... I do pray... I do have faith... but golly I dont need someone that isnt going through this sh!t to tell me too... Not saying you have rubbed me the wrong way... just remebering that day! We couldnt have gotten as far as we have if there wasnt some Divine Intervention on our part... I am really praying that we have some good news from all our peeps soon... keeping everyone in my prayers!!!

Now yall will have to come to my Husband funeral if he doesnt by the damn plane ticket soonish... it is really driving me crazy his procrastination!! ANyone want to RSVP? ha!

You know what I find strange in this whole process of AP.... My Husband called the Embassy on Monday, he was letting them know that he was out of town and wanted to see how they would contact him concerning the visa. They told him that they would call him or send him and email and they confirmed both of these with him... I woke up in the the witching hour one night and couldnt sleep... so I was like what the hell I will call the embassy... <cuz yall know I turned the crazy on a long time ago> This was on the 30th... the guy that I spoke to made me verify the case number 3 times... and then slowly told me that he was put on AP on the 27th of MAy <duh> and that his visa was issued on the 29th... boy you know I started crying...lol and I told this guy that I loved him.... lol he started laughing and then still giggling he said Congrats Welcome your Husband to AMerica for me :D So... my point is.. they didnt call him/nor did they email him... ####### right!! I guess we would of found out when they tried to deliever it.. I hate this process it totally sucks balls... I was talking to my Hubby the other night and was telling him that I wish when they send you the passport and visa with the sealed envelope that they also encluded and explanation letter... telling you why you were selected to go through this hell, what they have been doing for the last couple of months and to apologize for the wait.... is this my wishful thinking or what :D I guess they figure that it is none of my damned buisness.. I sure cant wait until some more of you are through with this process... until then I am here with you.. Maybe if a big enough prayer chain is maintained God will here us!!

i hired a lawer that spoke with the embassy and im so pissed off right now you have no idea. the embassy had misplaced my case and it has been bacicaly lost for all this time so this 4 months have been nothing. now there going to send it over for name checks. im so angry right now i swear it not fair.

its NOT fair.. this whole process isnt fair!! I hate it... makes me feel like a 2 year old with a tantrum problem :( I cant believe that they have lost your file.. Uggh and If I am not mistaken you are not able to contact your embassy directly are you?? I was blessed that I was able to call our embassy and talk with them. How did you find out that they have misplaced your case? Did they contact you and tell you that they cant find it and request you to send everything back in? How did you find that they are just now sending it over for name checks? Is this what DOS told you? You can do this dear... it is time to pull out the big guns and start harrassing some ppl :D Or as in my case pull out your crazy and unleash it on them!!! IF this is something that DOS has told you... then I would throw it away with a grain of salt perferably over your left shoulder... I will tell you.. I called DOS after my Hubby recieved his passport and visa just to see what they would tell me... and guess what!!! I am still pending AP.... ####### ever... I told them that he had already recieved his Visa and Passport... the lady named Susan said that it would take a few days for there system to update... soo the moral to this story is... DOS doesnt know #######.. I hate them  I am here with you girlie along with everyone else.. MY DEAR TELL UR HEART THAT FEAR OF SUFFERING IS WORSE THAN SUFFERING ITSELF!!! You have to suffer alittle bit to have anything good inlife!!!

Bridget... you are still on my mind too.. this is totally sucking for everyone.. I am sorry... makes you want to rack your brain... I tell you I pray that it is not the 221a3b? or what ever it was... maybe you will find out tomorrow or this week that they told you wrong... stranger things have happened!!! Keep your chin up... Good will always triumph over evil

As long as the reasons they sent it back have been addressed it should be pretty streamlined... If the CO is a real tool, they may try to get him frustrated and see if they can get him to provide a contradictory statement... he needs to try to be as confident as possible and expect an azz of a CO... if he is prepared for a roug interview it will go much smoother... after all he has been through it will seem overwhelming that it is almost over... he can take a small photo of the two of you with him to the interview to hold in his hand and that can give him strength to get through it... it only takes a glance at the photo to remind him he can do it...

I totally agree!! He can do this.. I know that the two of you are on your game... I am sooo excited... atleast we know that someone is going to have progression on their case next month... the time is going to fly now that you have a date... Are you planning on going to the interview??? I know that my consulate will allow me to attend the interview with my Hubby... wasnt sure about yours...

Okay here goes I called DOS on Friday the 9th and spoke to Chris he told me your case is pending AP I tried to pick him and he would just say the case is in AP. I called on Wednesday the 14th and spoke to Katie she said on they are just waiting on an interview date its summer and they are busy with other visas I can tell she is looking at the first screen and I said You know its been 2 years and Im getting a little confused as to why its taking so long. She said mmmmmm wait a minute she apologizes and tells me she was on the wrong screen she says its in AP they are working on it and I said how long will this go on she said oh! oh! they sent a letter dated Thursday the 8th requesting a new medical, police report, DS230 and new photos Im in shock and I tell her thank you and hang up. So I tell m husband to schedule a medical we have the police report and to call the call center and see if they give him an interview date( Ukraine has a call center you buy time to talk to them $12 for 8 minutes) They ask for his case number and tell him his interview is August 18 So now I have still not heard from the Embassy and neither has my husband so Im not sure what he is suppose to do. Im just hoping that the call center would not give him a date unless it was cleared by the Embassy to do so. I called DOS today and spoke to Brian he told me the same thing I told him my husband didnt get a letter and he said they also sent me one so Im waiting for mail from Ukraine LOl in the past they have always sent emails why not now. At any rate it seems to be moving forward.

SO awesome... I pray that it is truely moving forward and that you will be with your hubby soon!!

Hey hun, yea i know they are not consistent with wat word they choose to use, its either, review, processing, or pending IMO(I think that they are reviewing the pending process.). the thing is with me im more confused than ever becasue this was the first time anyone told me that the embassy was processing it. about 3 weeks ago i was told it was in washington, than now all of a sudden its being done at the embassy. is there a possibility that it was in washington before and is now being looked at in the embassy. i figured theres 2 things that can be going on they are either completely clueless themselves, or watever was going on in washington finished and is now at the embassy. i really dont know. jeez. im driving myself nuts. lets say chris is right and its being looked at in the embassy, is that a good thing? anyone who has anything to say feel to respond.... even if its to tell me im nuts lol.

I am going to tell you like the Embassy told me.... I (thank God) have an embassy that will atleast answer the phone (LOL)... They wont tell me much about my personal case but they are more than willing to answer generic questions..SO I was confused with what DOS had told me ... was my case in washington/ was my case at the embassy (who is processing it.. is anyone processing it, looking at it, getting cheeto covered finger prints on it?)... Almost like I needed to sing the song.. where oh where has my paperwork gone ,oh where oh where could it be... the file was cut short with the process long ohh where oh where could it be... So my embassy told me that the case never leaves the embassy, they share files with Washington and other appropriate athorities, but that your file will stay at the emabassy until it is either denied and sent back to the USCIS or approved and a visa issued.

Sorry dear.. I would Welcome you here but... well why welcome anyone to hell :(

My fiance has been in AP for a while now.. her interview was in Jan this year and VN is not a MENA, Arab or Muslim country so your theory is only applicable to some AP cases... The name checks for AP is only a portion of the cases in AP... AP just means they are not done doing what they want or need to do before the visa is issued... could be AP in DC or at the consulate.. in either case it wont be done until the CO is comfortable with making a decision...

I know right  India is also not on the MENA list either, not to mention I have looked at all the sites that tell which countries get the red flag hits and India is never on them... I know that there are muslims in India not to mention scammers... but... hell.. uuuugh ... damn... I am sooo sick of this :bonk:

I dont blame you for wanting to take a break from all things Visa. I read your post to that A$$, I mean person... that suposedly was a journalist but wants to know if anyone ever had a women :hehe: I was going to say something... but you sounded WAy more educated than I would ... hehehehehehehe

When you were counting your 90 days did you take away all holidays and weekends? Are did you just count 90 days from your interview date? I find it soooo weird that the CO told you the same thing... it haunt me and I know it does you.. I wish they would of told me at the interview I was on AP... instead they told us Congrats you are approved... handed my Husband a Welcome to America pamplet... then I asked the Lady CO if we could pick up the passport/visa instead of waiting on it to be mailed and she said yes!! uggggh I have nightmares.

Well, I just saw my husband back in May/June... So I guess you could say that I have already seen him :( I am trying to make plans if not just in my head to see him in October after it has cooled off a little bit..

Our 90th day is Aug 19th... keeping my fingers crossed

90 days for us would be on August 19th... but take away the weekends and holiday our 90 buisness day would be Ocober 4th... that is supper depressing....that is damn near a 2 month difference...

Hello everyone, how are you all? :)

I decided to take a break from all things visa related, including VJ - it was good to stop thinking about it!! I thought I'd come and have a look and see what's going on...I didn't know whether I'd just lurk or join in, but when the first thing I read was the male/female AP thread and what I saw as an extremely offensive post, how could I not reply :bonk:

Anyway - a quick look shows me that no one has left the black hole :( What's going on??? I've been in AP for 141 days now, so much for the 90 days figure. It looks like I'll be lucky to get done by 180 days, that's SIX months :crying: I still can't get over the 'you're good to go, you'll get your passport back in a few days'.

Is anyone making any plans to see their SOs over the summer?

Hey Melody if you havent contacted the embassy it may work in your favor to contact them or it may not. Like the thing is it truly depends on your guys embassy. I know that my embassy will just send us back a generic response, but maybe urs is better. Plus if it calms ur nerves go ahead. The worse that can happen is they tell u the same as DOS, case still in AP.

Also, yea I am preggo, 6 months to be precise. I'm due October 26. It's our first child which is why this AP is absolutely killing me. Like I cant imagine having the baby and him not being here. It's kinda not fair. The worse part is like the embassy doesnt care. I feel as if my husband and I have served our AP alredy I mean its been a year, what else do they want to look at it I dont get it. I totally understand your despair, you just want your husband home and I'm on that same boat. Now after getting the letter from my senator I'm just kinda disappointed bc like it shows absolutely nothing positive happeneing anytime soon. I hope your case goes way quicked than mine has been.

Ohh God, I truely couldnt imagine what you are going through.... and you say you have been in AP for 9-12 months... damn... How you are still able to cope with all of this is beyond me... My thoughts and prayers are with you.

So I emailed the embassy tonight... this is only the second time that I have emailed them... I am so nervous though... I know that we are just a bunch of ppl on here... and everyone has there opinion... but what does everyone think about contacting the embassy... do you think that they would deny a visa because you called them too much? This is what someone else had told in a post about AP... I really dont see how they would deny you because you called them.. I would think that the opisite would be true and that if you didnt call them and you didnt want to rock the boat then they would think why isnt this person like desperate to be with there spouse.... uuugh or are they like why is this person calling all the time they must be desperate to get to America.... #######... it could go in either direction really... I think I have started talking to myself
