Well, without trying to air all my struggles this year.....
I absolutely think it's worth it if you can have your spouse with you. But how can I get him here? As it stands my income is down to $800 a month to raise my 3 kids on and I can't get public assistance because on paper they think I make significantly more.
I understand your struggles, I was trying to tell you that I was also a mother of three... Not that it really matters but the job that I had when I married my husband.. well they fired me about 3 months after that, because I was married to an indian... So, I know how terrifing it is to have to start over at square one.
As for my job they only allow personal leave for 30 days at a time and after that you have to resign and reapply. The company contracts for clients where information and the job change daily so they even tell you that they don't expect you to be capable of doing your job if gone longer than that and they send you back to square one (training) when and if they rehire you. I'm not making excuses, this is unfortunately my reality. I have no money, I have nothing left to sell because I've already sold it all. That's also why I've said that I'm tempted to just say screw all of this and move to India with him and just be done.

I'm definitely going to check into the getting married then registering that you mentioned because I had been previously advised here and he had a lawyer there tell him that I needed to be in the country with an address to provide the registrar there for 31 days while our information was posted on a board for anyone to be able to dispute. Maybe I read it wrong when it was written on here to me by an Indian citizen, which I'm gladly hoping I did because maybe then I can find a way through this.Yea check into it, I am telling you that I flew to India last July 12 and we were married on July 25th and we had our marriage registered with our local marriage registar and the certificate was picked up on the July 29th... I used this marriage certificate at USCIS, NVC and at the interview and I did NOT have any issues with it. And the only reason it even took that long was because we were preoccuppied in other things :blush:

This is not an issue of his worth at all - it's about trying to balance life with funds I don't have. I've invested quite a bit of money into this relationship already, it's just that the money has run, out. I have no problem sacrificing. But facing all this and trying to think about starting over with $1200 plane tickets, $700 for a wedding, $500 for filing fees (or more with the new fee schedule coming out) and not knowing when I will even be able to start all of that is worse than holding onto the shred of hope that this may still go through.I totally agree with you, it seems unreasonable.. this is why I pointed out to you that I used my income tax return, I know that with 3 kids I recieved a little over $8,000... and even if yours was half that amount then there you go, what you would have to do is start planning now, Maybe for March... get everything arranged verbally, plan on going then... your job should of rolled over to a new year then, plan to stay for 2 weeks, Marry him come home, file again <you can do this because you would alotted the money from the income tax return> and then vola You can spend Christmas 2011 together :thumbs:

I'm just trying not to post all my personal information here for the world to slam me harder than I'm already getting slammed. I can't afford to refile right now and getting to India is also going to pose a major challenge sine I'm dealing with my son's medical issues.
As a single mother of 3 girls I can understand the finacial strain that kids put on you, but dont you think having your spouse with you is worth the sacrifice?
I'm just missing too much work to save enough money to go and keep all the expenses paid here while I'm gone.
I totally agree that it is hard to save money <when you have kids and only 1 income> but you know how I was able to manage, I used my income tax return to by my plane ticket and to pay my bills while I was gone. I stayed with his family and cooked at home while there so it didnt cost me any out of pocket money. If there is a will dear ther IS A WAY!
I'm not quite sure how I could stay there the required 31 days to get married either because that would pretty much mean quitting my job.\Ppl take off for there marriage all the time, I am sure if you went to your employer and told them that you needed some time to get married that they would allow you, and if not then you use the law on them and file a Family leave It's hard enough to get a week off much less 5 weeks (counting travel). This is not true.. I am not sure who you have been talking too. You do not have to stay there 5 weeks. The only way you would have to do this is if you were going to have a court marriage.. But in my opinion that would be stupid because you would miss out on the wonderful rich culture and so would he. You can have a religious ceremony and then file your marriage with your local marriage registar and have a certificate within a week. My husband arranged the whole wedding.. he was sooo adorable at this time... Your man could do everything before you came <really it would be his mom and sis's if he has anything> and then you could plan on spending like 1 week.. I personally would say try for 2 weeks, but 1 week can do it if you arrange everything before you go... My HUGE wedding only cost around $700.. I was totally shocked!! Ugh...I'm still hoping that this will get reapproved and then I will do whatever it takes to be at that Embassy this time. And the lawyer is more about filing for consular misconduct because there isn't much else she can help us with.
I am going to say something here and my intention is not to offend you, It sounds like you are making excuses. I have read several of your post and there has been some excellent advice from alot of different ppl. This is spelled out in black and white and what you have to decided is.. Is it worth it to you to sacrifice your time and money?How bad do you want him? How can you breathe without him... I unfortunately cannot without my husband.. he if worth EVERY sacrifice

Thanks for the update... I totally agree with ELW, I would go there and get married and then file again, if you choose to not come back home that would be ok, you could do the DCF if you live there more than 6 months, it isnt suppose to take as long... I am not really sure on the process though...

My Husband and I are also planning on only living here in the states for about 10 years and then permantely living in India...

I've given all your answers to my previous posts much thought. I can't stand going through another year of the kind of hell I've been through this year alone and things only keep getting worse. So I have decided to pack up and go to India. But I'm not sure how long I'm going for. I don't want to get married the same week I get there. I want to relax a little, spend time with my fiance and then get married. This will make the 6 month tourist visa validity a tight squeeze to work into. So I'm thinking about moving there for at least a year, possibly a lot longer. I've searched online and at official Indian websites but I'm still confused about some things. First off....how the hell do you immigrate to India. There doesn't seem to be any visa paperwork for that so right now I'm considering an employment visa though I know that's a stretch. Is there any kind of marriage visa or immigration process for people who want to become citizens of India?

Also, I need to know more about this going over and getting married thing without having to be there 31 days first. Just in case I do have to get married quickly because I'm not sure I can work my plane ticket and other factors in my life around getting there well in advance of whatever date the astrologer sets for us. I know his parents can arrange everything but what do I need to do/have/take. What's my part in this besides showing up and participating so that I can get the legal certificate to be able to bring my husband back if I come back. Any pointers, tips, advice from people who have been there and done that is appreciated. Thank you in advance.

I know atleast 5 couples that have moved to India some stay 365 days a year others travel back and forth... I think actually talking with some of these Women would help you out... I can tell you what I would do.. but since I have not and am not going through it I just thought it might help you to talk to someone who actually has...

as far as information about getting married.. I can only tell you what I did and what was best for me.. I am not aware of being able to track your I-130 once it is approved... My suggestion is to call the NVC about 3 buisness days after it is approved to see if you have a case number yet. In my case it took about 9 buisness days after the approval before the NVC had recieved my I-130 and issued my a case number.

ok, so I just want to complain for a minute. I have been researching processing times and now I want to cry.<not really> But anyways... it just doesnt seem fair that the same Visa that I am applying for others are able to get it in an amazingly short amount of time. I was reading this one and he was from my same state filing for a K-3 spouse visa for his Russian Wife and they got approved in 53 days, same service center and everything... and then I was reading another one that gets approved in 14 days... Low and Behold... everyone with a spouse for India ... always getting approved in 7 , 8 months some even longer... sad.gif I am extremly happy for the other ppl.. I dont want to sound to sour for them... I just wonder why it takes sooo long for some countries and sooo short for others... you would think that they would all have the same waiting time... I feel like a kid in a car on a cross country trip asking "Are we there yet?" what about now..... Are we there yet???

I dont know if this will apply to you but thought that I would share it, My hubby was able to put me on his Bank account with the ICICI bank.. and I think that would show co-mingling of finaces.. I was not able to put him on any of my bank accounts here in the US... but India doesnt need the documentation that the US does... so if she has an account with that bank or any bank... just see if she can add you.. I was able to take a print out of the bank account and send it in with my I-130 packet. It was a little process.. but I think It will save you a head ache in the future... as far as the other evidence that you are asking for... I think that they all would be good... but because she doesnt have a SSN# it will be hard to add her to any of your accounts here in the US. The embassy already knows that your co-mingling of finaces is going to be limited, so dont stress yourself out to much biggrin.gif

I have a pic of it that I am going to share here. Do you think that this would be something that I could add when sending in proof of a bonafide marriage? I already have a ton of other evidence, so I dont need any counseling on the proper documents to send biggrin.gif Just curious... I also have some wedding pics of me in my sari and you can see this tattoo clearly ... I would love to hear if anyone else has some not so typical "proof"

thanks for the response :P I know how to deal with my hubby just a little :whistle: and he is good to go... it was more the USCIS giving me a RFE when they caught that his name on the G-325a is different than on Amits Birth Certificate, and then again the new Birth Certificate would be different than the original one we sent in, so when it comes time to mail the other packets I thought they might notice the corrected BC and give me a RFE..... :bonk: I will just stop thinking.... thanks again

Hello!

My Husband got his certified Birth Certificate and there is a miss spelling of his father's name on it... instead of Bijender they put Bizender as his father's first name... My husband is very aggervated that I have requested him to go back to the office and get them to correct it, he seems to think that it will be ok, since that is the only mistake on his Birth Certificate.... I have already sent this BC with the I-130 and I-129f petitions... should we worry about it now and get it changed... will changing it mess everything up... is this something that I would recieve an RFE for.. and if I did wouldnt they just wanted the corrected BC?

My wife's birth certificate (issued from the state of Kerala) only has her 1st name and her father and mother's first names. Will this be an issue, when she goes to the interview in Chennai? She has valid passports and all. Thanks!

I would like to know how you all cope with the separation etc...and how does the US citizen cope....is he/she supportive/...my worry is if anything goes wrong with K3, then what??? is the pressure on the US citizen to leave their country? My b/f would never leave Seattle!!!! My boyfriend gets frustrtaed with the process...is this common????





Coping with the seperation is a constant battle... I personally struggle with depression over it... I have been married for 6 months and have only seen my Husband 2 weeks out of that time. And it isnt like I will know exactly when I will get to see him next unless I plan a trip overseas. It is amazing though... no matter how down in the dumps I am about the immigration process evertime I talk with my Hubby he melts all my frustration away. He is very supportive and understanding. I think he hides some of his emotions to keep me strong :D If anything goes wrong with his visa then I am more than willing to move to India to be with him... One way or another in the end we WILL be together.


In the waiting game I like to call the visa journey... my suggestion would be to start a new hobby or pick an old one back up, the busier you are the faster this process will go :D

My next question is then... I am looking at the I-184 form, Part 6 :( Sponser's income and employment, Question #22 a.) is this where I would include my child support as income? and what would I put, Child Support and then the total that the court ordered per year? I went to the county clerk and got a certified copy of the Order for Withholding. I have also printed out all the statements from last year that was deposited on my state issued EPPIcard (mastercard) I have a folder for last year, and I am starting one for this year to keep it current.

Also, My dad is going to be the co-sponser, and I had a question about it.... he is currently retired from FedEx and recieves a pension every month. How would he get an employment letter... or what would be required from him? Obviously his retirement check, tax transcripts, W-2's and I will print out all his bank statements. I am just trying to start gathering all the information right now.

Last year I only worked 9.5 months out of the year, so I made $27,707... which with 3 kids, my spouse and then myself makes a total of 5... on the chart that I am looking at it says $32,238 would be 125% above poverty level for 5...

The previous years I made:
2008 $32,291
2007 $47,593

I started a new job in October 09, and I am positive that I will make more than $27,707 for 2010... I have talked to my employeer and they will give me a letter stating my salary for the year, position... etc....

I have a court ordered decree on childsupport.. I recieve $700 a month that is garnished out of my ex's pay and deposited on a State issued MasterCard every week. I have a certified copy of this court ordered child support along with the monthly statements from this State Card. This was done last year and my children are fairly young, <10, 7 & 6> and this decree is good until there 21st birthday<unless we go back to court to change it>

If I am able to use my Child Support it would bring my income up to $36,107.... more than enough to qualify

My question is this:

***When it comes time for me to prepare everything for the AOS can I include the Child Support as a source of income?

***Should I go ahead and have my father be a co-sponser just incase? He is retired his income is $32,500 a year ... just to make sure.. my father would include my mom, himself and then my spouse.. which would make 3 ( he has no other dependents besides my mom) ... and all he needs to be over 125% is $22,888

Ok, I dont know if anyone is still reading this... but I thought I would throw this out there.... If you click on your timeline and you scroll down it will say.... estimated processing time: and mine says this

Based on timeline data, your I130 may be adjudicated between February 28, 2010 and March 7, 2010*.


My question is to anyone out there that has already gotten there NOA2... how accurate is this time frame? Did you recieve your NOA2 before, during, or after this time frame on your own timeline?

wow... I am happy that atleast you recieved some news. I keep calling the NVC and I knw that it takes a long time to get through.. no more than 5 mins of calling getting busy signal, hanging up calling back... do this like 100 times and then you will get through I promise.. but then once you are through you will have to wait 15-30 for an operator... :P

same here!!!! been wondering the exact same thing. wonder if there's another #...i also emailed them, but no reply (emailed them last thursday)...




I am getting through with the NVC 603 334 0700... just talked to them this mornin... it is a headache.. the line is busy for the first 5 mins that I tried to call them, but I just kept hangin up and pressing redial... after about 5 min it went through :D
