Damien, it'll probably come within a few days. Did you see an EAC..... number on the back of the check image on your bank's website? Sometimes they'll put it there, sometimes they won't. They didn't on mine. You can probably call the Misinformation Line and ask for your case number. They were able to give me mine over the phone two days after they sent the check in (2 days before it hit my bank). Be prepared, they'll ask you if it's been 30 days since you sent it in (they have no way of knowing on the phone when you mailed it). And since you don't have the number yourself yet, they'll have to transfer you to someone in a higher dept to give it to you. I didn't spend long on hold at all though, so you should be able to get it pretty quick.

K-1 Fiance(e) Visa Case Filing and Progress ReportsIs this a normal time line?
Your wife's friend who got her NOA2 in a month must have gotten really lucky. There were a group of us who filed in late May/early June right when they were starting to send things to the Dallas Lockbox who got approved really quickly. I got my NOA2 in 22 days. I had NO touches after the initial online file setup. I was actually at the doctor's office when I got a text saying we'd been approved, we weren't expecting it for a while longer. We had some really bad luck with an attorney who didn't know what she was doing, so she delayed us quite a bit, but in the end, we got the visa in hand within 3 1/2 months of our NOA1. This is NOT normal, it can take 3 1/2 months or more to get your NOA2 and you'd still be within what the USCIS considers NORMAL processing time. Don't give up. I'm notoriously unlucky, and so is my fiance, and in this one instance where it mattered most, we got it quickly. Hopefully you'll hear something soon and it'll fly through the NVC as well.

You'll get there. Take care, and good luck!

IR-1 / CR-1 Spouse Visa Process & ProceduresVisa limited to the validity of the medical examination?
The visa itself is valid for six months from the date of issuance. Has her visa been issued yet? I believe that statement means that the visa itself can only be issued if the medical exam is still valid.
DodiFemaleUnited Kingdom2010-06-25 08:17:00
IR-1 / CR-1 Spouse Visa Process & ProceduresCo-Sponsor
They don't care about what you owe. They don't even see what you owe unless it's being garnished off of your pay stubs. They look at his Tax Return and Pay Stubs for income, but they don't look at your bills.

You are required to still use the Petitioner's I-864 as the primary sponsor, but if they see that his income is not sufficient they just switch over and look at your co-sponsor. At that point, no, your husband's income wouldn't matter so much.

K-1 Fiance(e) Visa Process & ProceduresNOA1 processing time. How long?!
I apologize, I read your post wrong. I thought you were asking how long before the NOA2 for some reason. Please forgive, it's Saturday, my brain is in weekend mode.

K-1 Fiance(e) Visa Process & ProceduresNOA1 processing time. How long?!
Two to three WEEKS???? Where did you read that? Someone must have been either joking or VERY optimistic. Two to three weeks is unrealistic. Right now, the USCIS processing time on the I-129F's averages at around 2-3 months, with the national reported average of 5 months. Your case will likely stay in the "Initial Review" status online until they either send an RFE or approve/deny it. My petition went in about the same time yours did, so I'm in the same boat, and just as impatient. If it helps, the way I'm passing the time is by combing the boards here (and a few other forums) to glean all the information I can and compiling documents to send to my fiance for his interview/checklist to help make that go more smoothly. Good luck!
DodiFemaleUnited Kingdom2010-06-19 19:48:00
K-1 Fiance(e) Visa Process & ProceduresNoa2 in the mail but . .
No, you're thinking of Package 3, which comes from the embassy itself to your immigrant fiance. And in reality, Package 3 is just a set of forms and a checklist. When you receive the NOA2, your case has been (or is being) transferred to the NVC (National Visa Center) which then forwards it to the embassy or consulate that will conduct the interview and final checks on your case.

What you can do now is to make sure you've got all the documents compiled that your fiance will need for their interview. You can get a list of what you should need by googling your consulate/embassy and seeing if they've got the required forms online, and by looking through the guide for the list of documentation they require. For certain, you'll need to send over your ORIGINAL SIGNED I-134 Affidavit of Support, and all of the documentation for this ESPECIALLY your last year's tax returns and W-2's. That is VERY important, and your fiance won't be approved without this. When you send them to her, be sure to get delivery confirmation or send via FedEx/UPS/DHL so you'll have tracking info.

Other than compiling paperwork, just stop and take a breath now. The first stage is over, you're one step closer. Your fiance will be contacted by the embassy/consulate soon and will be instructed on how to schedule their medical exam, and where to submit their signed checklist, and what other documents are required.

Congrats on NOA2 and good luck!!

K-1 Fiance(e) Visa Process & ProceduresGeneral K1 questions
When you say you're in the process of filing... have you filed the application or not? That could have a bearing on your visa application. That could put you into administrative processing before/after your interview. They'll want to know why you've applied for citizenship with their country but are now moving to the US. Be prepared to answer that.

K-1 Fiance(e) Visa Process & ProceduresGeneral K1 questions
Chris:

I'm pretty sure you could get the information from the Met on where to get your official US-accepted police certificate from NZ.

As far as the poverty guidelines go, to be more clear, for a family of two (just you and your fiance, neither of you having children), your fiance would need to prove that she makes more than $22,887 per year, according to her tax return/employer letter/pay stubs, to sponsor you or would need to get a co-sponsor. The amount of money you have in the bank at one time is helpful, but if you just put it there, it's not going to weigh as much on their decision as how much income she has coming in. Basically, if you had an emergency that depleted your savings, or if you used it for the wedding, and you had no income coming in to cover you, how would she support you?

Just FYI, most banks in the US won't put you on a joint account without a social security number, or so I've found. We tried to put my fiance on my account here on his last visit and they said they couldn't without an SSN.

You can get the Packet 3 forms online if you want to start filling them out early. London Processing info and Forms List. This link will give you the list of documents that you'll need. Visa Forms. This link will give you the forms themselves. Please note: The I-864 is for your AOS AFTER you're married. The I-134 is for the K1.

Average time for processing in London appears to be 4 to 6 weeks. Sometimes longer, sometimes shorter. According to the USCIS website, the waiting time for an appt is only 16 days, which was accurate for my fiance's B2 visitor visa in February, but I've heard people say it takes longer than that for a K1. If you have concrete travel/wedding plans you can sometimes ask them to work with you and bump it up sooner if you've got your medical planned out and everything, just be aware that it takes a week or more for them to get your medical exam results over to the embassy and they won't give final approval until they have those, even if it's tentatively approved at the interview. Here is a link to the London medical exam info London Medical Info

Again, congrats on coming this far and GOOD LUCK!!

Removing Conditions on Residency General DiscussionDid not file I751 on time
QUOTE (Maria In Trouble @ Aug 4 2009, 01:06 AM) <{POST_SNAPBACK}>
I have drafted the following letter that might help someone eventually ... I will send off tomorrow:

08/03/09

District Director
US Citizenship and Immigration Services
Vermont Service Center
75 Lower Welden St.
P.O. Box 200
St. Albans VT
05479-001

I am kindly requesting you exercise favorable discretion in accepting my late I-751, and restore my permanent resident status.

The following are the circumstances that caused me not to file within the 3 months prior to expiration

• I have been married to a United States citizen since 04/18/2006 for more than three years
• I have been a lawful permanent resident since 07/25/2007

When I received my permanent resident card, I was unaware of the requirement to file a joint petition to remove the conditional basis of my permanent resident status with a I-751, nor did I receive a notice as per the Adjudicator's Field Manual as my 90 day period approached.

I applied for naturalization via certified mail on 07/11/09 (attached) with the following:

• Form N-400 Application for Naturalizing (attached)

• Money order fee for $675 (copy attached)

• Supporting documents:
o Copy of Permanent Resident Card
o Copy of Birth Certificate of my spouse and our daughter
o Copy of Marriage License
o Proof of termination (divorce) of all previous marriages
o Joint Tax returns
o Joint Bank Accounts Statements 2006-2009
o Joint Lease documents and receipts 2006-2009

Yesterday I received a rejection notice (dated 07/14/2009, postmarked 07/31/2009) stating that I had filed my application more than 3 months before meeting the residency requirement for the Part 2 Section 319 (a) selected in Form N-400:

• Rejection notice (attached)

I am now attaching the following to this petition in support of evidence of the relationship:

• Joint Auto Insurance
• Joint Health Insurance
• Photos of anniversaries and family trips
• Affidavits sworn to or affirmed by at least two people who have known both of us since our conditional residence was granted, and have personal knowledge of our marriage and relationship.

I apologize for not following the correct process to file a joint petition to remove the conditional basis of my permanent resident status, and am humbly requesting your discretion to approve the attached I-751 petition, and restore my permanent resident status.

Yours truly,

Very Nice Letter:

But, be sure to include a copy of this letter along with your Removal of Condition application!!!!
(You can also include a copy of any proof you sent it to the District Director....but, in my opinion, it will do more good with your I-751 packet!)

You don't have to get the stamp.

My circumstance is rare, but I decided to share my experience anyway...

My conditional GC was lost in the mail (I never saw it), so I filed for replacement.
Local USCIS office kept giving me 2 month stamps on account of expected arrival of replacement GC.
Replacement GC never arrived and then I filed I-751 and got the receipt.
This time at Infopass appointment I was able to get a stamp valid until my passport expiry date (less than 1 year), with a note "I-751 pending".

USCIS officer told me that filing I-751 stops processing of I-90 (request to replace lost GC).

Thank you for sharing your story!

I'm sure it will be helpful to some now and in the future.

Hi guys. I just received another call. And this time she had more questions. Where we lived, what time I wake up, where my husband and I work etc. What do you think?

This made the hairs on the back of neck stand up. I'm not sure what information can be gleamed by asking what time you wake up.....I mean if it was at the ROC interview, as was stated by another member, okay. They are trying to determine if you are truly living together and want to compare your answers with your husband's. But, unless they are also calling your husband for this information, I would be very cautious....
Kathryn question regarding how can you be sure this isn't a method to find out your habits so you can be robbed, if an excellent point to make. huh.gif

I would thinking scheduling an Infopass appointment would be in order.

They should be able to tell you the status of your case, the status of your AR-11, and provide you a stamp in your passport extending your LPR status for an additional period of time. (The exact amount of time is usually left up to the officials at the USCIS location)
