Were you ACTUALLY arrested? Or just cautioned? If you weren't arrested then technically you didn't commit fraud. You'll need to get your ACPO report, which will show No Live Trace (if the caution weren't there it would show No Trace) and then request a Subject Access Report. These combined should show your CO at your interview that you don't have a criminal history, just a caution, and should clear the matter up. If nothing else, be prepared with waiver paperwork should you need it at the time.

We only included 7 photos, and had no problems whatsoever, but we were going through London. It also depends on what other documentation you have of your relationship. I included 38 pages worth of phone records, copies of our passport pages with stamps from our visits, emails back and forth, copies of boarding passes and receipts for our trips, a card he sent me for christmas that says "To My Beautiful Fiance" on the front, the receipt for my wedding dress, and a receipt for a christmas and birthday package my mom sent to him.

Compile as much as you can, if you frontload it, they can't claim it wasn't submitted.

Yes, I was aware that he wouldn't be able to work until he got his EAD, which is about 60 to 90 days at the moment. However, having to reconstruct the packet is pushing us back even farther, so now we don't know how long it will be before he gets his EAD. It makes the situation much worse financially.

My now husband came in with his K1 on October 6th. His POE was in Chicago, and they processed him in what seemed to be correctly. They wrote K1 in his passport on 3 places (on the face of his visa, on the I-94 (though not on the line of the stamp) and behind the I-94 where they stamped the passport entry again.

When he was entered into the SAVE database, they entered him as a B2 Visitor, not a K1. They also seem to have completely lost his file.

We went to the local USCIS office on an InfoPass appt on Monday to see if they could help us (at the insistance of the SSA office - they're the ones who discovered the error) and they couldn't even find him in the system until we pulled out our NOA2 and used the old EAC case number. No packet logged in after his POE.

We went to our local CBP Deferred Inspection location today and the CBP Officer (Steenburg) fixed the computer mix-up for us, but when I asked him about Peter's hard copy packet, he said he'd check, because the USCIS should have issued him a welcome letter within 2 to 3 weeks of his arrival and if we'd not gotten that, chances are they didn't have his packet. He looked in the system and Peter's packet was nowhere to be found. He said he'd bet that it's lost, 80% chance at this point, with the margin closing rapidly. He told us he called the USCIS office and that they told him they'd have to reconstruct the packet using my copies and hope for the best.

Hope for the best?? I jumped through all of their hoops to get him here. I dotted all my i's and crossed all my t's. We paid our money, we waited, we got his visa and now we're just supposed to hope for the best because one of their gubmint employee slackers misplaced his file???

We need to file for his AOS, but without them having his original file, how are they going to process it? This delays us even further, and he can't work!! I'm supporting 4 people on my own!! This is really irritating. And of course, to contact my local Representative for assistance means calling Mary Fricking Fallin. What a joke.

Problem is, those counts are probably pretty accurate, depending on the embassy/consulate. I've read up on the London timeframe and it seems that the majority of people say 3-5 business days, but some people have waited a week or two. Other places I've seen where they give you the visa the day of the interview, and some I've seen take closer to a month. Apparently it's as varied as the USCIS issuing the NOA2. :wacko:

I was stupid and planned a wedding for June of this year, taking a bad immigration attorney's advice and had my UK fiance apply for a B2 visitor's visa. He was denied, the wedding plans fell apart, and we lost all of our deposits.

Now we've got plans made, but nothing booked until the visa is in his hands. We don't foresee any problems, but I'm not taking any chances. We just can't afford it. The only person who is giving me my deposit toward the Plan B wedding is my florist, because he's great.

Since we're switching from June to December, an outdoor wedding in a vineyard won't really work, so we've chosen another location. We got nothing back from the vineyard, even though we cancelled in February. Oh well, you live and learn, and fire the attorney! :whistle:

Did he not get the information from the London embassy website about the ACPO certificate? That's the police certificate for the UK that they require. It costs about £30, and takes about a week or two to get in. Sorry to hear your day didn't go so well. At least you know all he needs to do is provide those documents and you're approved. My Filipino fiance is using the Doha Embassy for his interview since that where he is currently living and working. His interview has been set for July 23. However, yesterday he received a call stating that they could give him an interview date of this Sunday, June 9. The problem we are having is that he does not have his Filipino NBI clearance. We understand that his NBI clearance needs to be DFA authenticated which takes 10 days. If he does not interview on Sunday they are going to push his interview date beyond the original July 23 date. Any suggestions? Is it possible to get the DFA authentification expedited?

Congrats on the NOA2 approval. You're one step closer.

1st - I don't know where you've heard that you have to have $5k in your bank account, but that's not true. I don't think many of us here could pull that one off! :rofl: The visa issuance fee at the interview is $350, plus about £14.20 for the courier fee, but you'll also have to pay £190 for your medical exam prior to that. As far as your Affidavit of Support from your fiance, what you'll need to do is have an original, signed I-134 from your fiance that shows that she makes the minimum required amount over the poverty line to sponsor you and to keep you from becoming a public charge. You can use the search engine on here to find the I-134 tips and poverty guidelines information, it lays out the details of that very simply for you. You have to have an ORIGINAL, so she'll need to get that together rather quickly and send it along with all of the required documentation: 2009 Tax Returns, W-2's, letter from her employer stating when she started, how much she makes, etc., and a letter from her bank stating when her account was opened, current balance, and how much was deposited and withdrawn for the past year. (Her bank may charge her a small fee for this, and sometimes it takes a week or so to get it, so she might want to request it quickly.)

2nd - Police Certificate. Since you've lived in London for five years, the best way to start that is to probably request an ACRO certificate. You can search that on here, or through Google. It's £35 and takes 10 days to receive. You will probably also need a police certificate from NZ going back to age 16, I'm not sure what their certificate costs or how you go about getting it, I'm sorry.

3rd - It usually takes a couple of weeks to get your Packet 3 from the Embassy. Since you've been living in London for so long that's where they should have you interview. You'll get instructions in the packet for how/when to schedule your medical exam at Knightsbridge. If you haven't already, check with your NHS GP about the vaccinations you might need before your AOS (probably your Tdap and MMR and Varicella if you haven't had chicken pox already) and see if you can get them prior to your Knightsbridge exam. If you can, it'll save you having to find a civil surgeon to give them to you and re-transcribe everything onto a new medical form and seal it prior to your AOS. Your interview will probably be scheduled about 3 to 5 weeks after you send in the checklist from Packet 3.

4th - They understand travel for your job. If you explain this in the interview it shouldn't be a problem. It never hurts to have documentation for things just in case, but it's doubtful you'll need it in the end.

5th - There are plenty of people who live in countries other than their birth nation. There's always a chance this will cause Administrative Processing, but it's unlikely so long as you're a documented resident of the UK in good standing and have no police violations. Nothing is guaranteed, but having documentation for everything is the key to making things go as smoothly as possible.

Prior to your interview, you will need to make sure you have originals and copies of all of the required forms/documents to take with you, and most importantly the I-134 Affidavit of Support from your fiance in the US. Be sure to check out the poverty guidelines for the I-134 to make sure you won't need a secondary sponsor.

5. The medical exam must be completed prior to the interview, or your approval will be "pending" until they receive the results. Be sure to schedule the medical exam with the medical facility they designate as soon as possible after you receive Packet 3, as they may have a waiting list for appointments as well.

6. At the interview, if all goes well and you have all the documentation you needed, they will approve your visa, and keep your passport until it is issued/couriered to you. You will have to pay the $350 issuance fee and the courier fee designated by the embassy. You should receive your passport back with your visa within a week or two of the successful interview.

First off, Welcome!!!! I'm relatively new here too, but there is a lot of information to gain here if you use the search feature and read through it all.

Ok, to answer your questions:

1. You're right about waiting for NOA2 and them sending your case to the NVC/Montreal (if Montreal is where yours will go, there are 2 Canadian processing embassies if I'm not mistaken).

2. Packet 3 is a group of forms and a checklist sent to the immigrant fiance (you) from the embassy/consulate. You'll need to complete the checklist to tell them you have the required documents, sign it and return it to the embassy/consulate. Do NOT send in the actual forms, JUST the checklist. You bring the forms to your interview. Once your checklist is received they should schedule your interview. Warning: Montreal is historically very slow in processing because they are so backlogged. You will have instructions in the packet for scheduling your medical exam and what is required there. You will need to complete all of the forms in this packet and bring them (along with copies of each and all required documentation) to your interview once it is scheduled.

3. There is no Packet 4.

We're not having a wedding in Russia! I'm sorry, you must have misunderstood. This has just been a topic on here recently that others have gone through. My fiance and I are having a wedding here in Oklahoma City after he arrives. He wants to go straight from the airport to the courthouse and get married on paper day 1 so we can start the AOS process asap, but we'll have an actual wedding with family and friends about a month later. (Christmastime, we hope).

The Texas Service Center is processing some of the overflow from Vermont. They've been sending cases down there lately to get things rolling. It took me roughly 6 days from the time they received my packet before they opened it and cashed the check. I didn't see the check hit my bank until 2 days after they cashed it. You'll probably get the NOA1 hard copy within a few days after the check hits your bank. If you're lucky, you'll see a case number on the back of your check when it's cashed (if you get check copies on your online banking feature).

I'm looking at your timeline and you've got an informal wedding planned in Russia in July. You do realize that if you get married before you bring her here that she's no longer a fiance, she's a spouse and therefore the K1 is null and void, right? Be very careful there. Some religious ceremonies aren't considered legal in other countries, but if you bring wedding photos back in her luggage, etc., you might have problems with the immigration officer at her POE.

It says on your timeline that you got your NOA2 in 6 weeks. Not your visa. You've still got a couple of months before you'll have that. Your petition will be sent to the NVC (National Visa Center) where it'll be put through another (usually swift) round of checks, and then send it on to the embassy. Your fiance will still have to go through the whole interview process (including medical exam) before a visa is approved and issued.

It will probably be August before he's interviewed and approved at this rate, and then he'll have 6 months to use the visa to enter the US. October seems like a very good estimate for an arrival, giving plenty of time to tie up loose ends.

Also, my ex did get one charge brought against him 13 years ago, but not for as much because he didn't usually write checks, since he always took the cash. He was in the army, so they didn't touch him, UNTIL he chaptered out of the army and we came back from being stationed in Germany. He was nabbed at the airport in Dallas when he stepped off the plane and the IO ran his passport. He'd been flagged for the warrant here in Oklahoma. It was November, and they were having a freak snowstorm, so he ended up spending a week in the county jail in Dallas before they could extradite him back to Oklahoma.

I flew to the UK in March and came back, they ran my passport in Minnesota and cleared me, no problems. Don't know if it's because the warrant is so old or if it really just didn't show up. Hopefully it'll just stay that way until I've got the money to deal with it.

In Oklahoma, they generally won't come to your house over a bench warrant, but they will pick you up if they run your license over a traffice violation and find the warrant active. This being said, at times they change that. I was arrested 2 years ago from the charges that were filed 5 years ago. They had done a bogus check sweep in the county where the charges were filed and I was one of over 250 that they arrested in a 2 day period. I spent 2 1/2 hours in jail and was bailed out. I appear once a month at the bogus check court and make a payment. After all of the fees and fines, $1200 worth of checks (including rent and bills and a few $20~ checks for pizza and one to Walmart) the total they charged me was over $5800. Paying $150/mo, I've got about 15 months left to go. Hoping for a lottery win, but not holding my breath.

90% of Oklahoma district courts don't have thier records available in the state's OCIS database. Some of them still give a vague docket sheet online for each case, but don't give complete information, some of them aren't online at all. It's only been in the last few months that this particular county has put their information into the state's OCIS database. (Trust me, I'm a paralegal, so it's not like I haven't searched my name before, I just didn't find it till now because it wasn't there!)

I'm the USC petitioner, so I wouldn't have a police certificate. He has no criminal history whatsoever, so his police certificate will be free and clear.

Thank you, guys. I've never been this embarrassed, and if you knew me, you'd know that's saying a lot!

I've read in threads that the only time a USC petitioner's criminal history has any bearing on the case is if it is AWA or VAWA related, but I've also read that people have gotten an RFE for court records (but didn't know what kind of crime it was) so I just didn't know, and I'm scared.

I love him so much, and we've been apart for the majority of 2 years. Every day is another agony, so the thought that my stupidity in trusting my ex could jeopardize our marriage is just too much.

And yes, Peter does know everything about the charges. We've been brutally honest with each other from day one. There isn't a single thing they could throw at him in the interview that he would be shocked about, because we've trusted each other and told each other everything from the start. That was our rule - no secrets or it wouldn't work.

Ok guys, I need some help here.

It looks like something from 10+ years ago is coming back to haunt me - not from the USCIS, but just something I found in my own checking.

My ex had a bad habit of taking money out of our joint checking account after I'd already written checks for rent, bills, shopping, etc. Because he used cash and I'd written checks, the DA hit me with bogus check charges, and since I lived in a small town and had to travel to get anywhere, I had charges in more than one county. I couldn't prove that he had done it and I hadn't written bad checks on purpose, so I just begged for mercy, was on probation and paid them off, never heard another word about it. He did it again 5 years ago, and I threw him out. I am still paying on the one from five years ago (only started paying 2 years ago, but it was a MAJOR amount after all of their fees and fines).

I did a cursory search of my name in our state's court database and it looks like there was another check that I didn't know about in another county 10+ years ago. I never knew they'd filed charges, and I've been pulled over for a burned out tail light, they ran my license and nothing came up, but according to the online database a warrant was issued 13 years ago.

I am terrified and pulling my hair out. Will this affect my fiance's visa? It's not a violent crime, it's not a felony (in Oklahoma, if you have more than two checks they can charge you with a felony) there was one charge that was a felony, but they dismissed it with costs paid. I just don't want this to cause us to be denied. My ex is apparently still able to control my life, even though we're not married!!!

I'm embarrassed, I have told Peter all about this, it's not like it'd be any shock, but I don't want this to end up being the reason we can't get married. USCIS hasn't contacted me at all, but it's only been 3 weeks since they received my packet, so I don't know if it could just be a matter of time, and I'm so stressed out I'm sick.

Does anyone else know anything that would help me?

Most embassies allow 6 months to 1 year validity for a signature on the I-134. I'm going off of the London info and they allow 1 year, some places prefer 6-months with the current economy. If you're very concerned, just scan/email copies of your current pay stubs for your fiance to print out and add to show that your income is still current. This should show them that you were doing due diligence to get the paperwork to your fiance in time, but that you are continuing to update with fresh information to prove you are still gainfully employed.

These forms are sometimes enough to make your eyes cross at how #######-retentive you have to be in making sure every i is dotted and every t crossed. Don't worry, it's not as horrendous as you think in the end. You just have to try on a little crazy till you get them done, if you don't have enough of your own. Then, you'll breathe easy when you've got it sent off, and sit on pins and needles till you get each Notice/Approval/etc. finished.

Yes, for the I-134 you need the sponsor's tax return, along with W-2's, a letter from their employer stating that they are gainfully employed as a regular employee (not temp) and in good standing, and how much they earn per year, along with several recent pay stubs to show they make a regular wage.

If the sponsor is a co-sponsor, not the fiance, you'll also need proof of citizenship (birth certificate or copy of info page from their passport).

No, the USCIS will send your entire I-129F packet to the NVC, who will then forward it on to the Embassy/Consulate that will handle your interview. The Embassy will then send you the Packet 3 checklist and forms or if they're going greener, a link to the forms where you can fill them out. You can probably find all of the packet 3 forms on your embassy's website and get a jumpstart on filling them out.

Make sure your fiance in the US sends you the signed ORIGINAL I-134 Affidavit of Support and ALL accompanying documents (Birth certificate, copy of passport information page, tax returns & W-2's, employer letter, pay stubs, etc.) Make sure you've got photos, boarding passes, etc. to prove an ongoing relationship. Make sure you've got your shots all up to date and check out the vaccination requirements prior to coming over so you can get those knocked out prior to your medical exam.

Sorry, I didn't answer your question.

Right now, your petition packet is being sent from the VSC to the NVC. The NVC usually sends it off to your embassy within a few days/week and then the embassy sends your fiance Packet 3.

If you haven't already, send your fiance all of the necessary documentation/I-134/etc. for their interview portion. Make sure they have all of their vaccinations and are ready for their medical exam. Go to your Portal page on here and check out the info on the Norwegian embassy so you can see all of their requirements.

Wow! You got that QUICKLY!!! My petition was received at VSC on June 2nd also!! We've seen lots of very quick NOA2's lately. Here's hoping the luck holds out a while longer!!

"I called today to check my status and was basically told its being worked on, and they cannot contact anyone unless it is outside of ther processing gguidelines (5 months). I asked why some get approved faster than others, and was told that it depends on the agent working on your file, some have mmore cases than others and some work faster) Im hoping I hear something soon."

What info do you need to call them? What's the number? I was touched some time ago but nothing since... wanna figure out what's going on.


That's basically all they CAN really tell you. I actually reached someone beyond the initial methodical answer forum on the Misinformation Line last night. If you specifically ASK to be transferred to the escalated tier they can do it. It's just a matter of if they WILL do it. The people on the first rung of the ladder there are reading a script, it's all they can do. The woman I spoke to after I was transferred gave me completely opposite information than the first girl did. She told me flat out that the people who answer the main line don't have a clue how the system works or how things are processed, and that she and the ones who do also call them the Misinformation Line as well.

I wish I could give you a better answer, but until it's either adjudicated or you get an RFE, there's really nothing you can do but wait. I'm sorry, and I hope you have more luck soon.

You can probably download all of the same forms and get the medical exam information from the embassy's website and submit the checklist/required forms (if your embassy asks you to mail them in, most don't) so you don't have to worry about losing more time if you're concerned.

I've seen 2 NOA2 approvals today from people with an NOA1 date the same day as mine or the day before - and that was just June 8th!! There was a slew of approvals last week in the Under-30-Days category too. Looks like VSC is really churning them out right now! Hope the luck holds out.
