It's not going to be a problem, once you file for k1 he will be divorced right? ( Do not file unless his divorce is final) and at the time of interview 4-5 months divorced, by that time he uses the visa after more then half a year after divorce. At the interview he can actually take a copy of his one year separation to have it with him if they ask for it. Other then that it won't be a problem.

Please help….. We have sent for our 129f-fiance' visa and just received our NOA2 that it was approved. It is saying that I can file an I-824 to notify another consulate of the acceptance. So….. my question is… now that my petition is approved will my fiance' receive the packet in the mail for him to continue with the K1 Visa in the UK? I understood that they would mail him his packet to fill out and pay the 340 dollar fee and return it and keep the forms they say and then give him a date for his medical and interview in London???? Or is there anything else that I need to do for him to get the ball rolling on the UK side….. ANOTHER question…. My fiance is actually here for another 2 months (on the visa waiver program) and can he go to any approved medical office here for his medical or does it have to be in the UK where he is from? If he could do it here then he wouldn't have to leave early how we figured the timeline on things. Any information would help us greatly… We are just wanting to not slow anything down :) Thanks!

I cannot speak to London, but I can say for Colombia we needed the Case # from the NVC before we could go online and schedule the interview. We actually got the case # before we received the packet 3 or 4 from the Embassy so we were able to schedule the interview before the embassy even got the packet.

you cant do anything without your "LND" case number and that is issued a day or two before your case leaves NVC. you can schedule your medical once you have your "LND" case number but i wouldnt advise sending any forms back until your sure the embassy has logged your case in to the system. if you look at my timeline it was only a week from my case leaving NVC until i received packet 3

Note: Only applicants who been notified by the Immigrant Visa Unit that a petition has been received in their name should complete the visa application forms. Forms received without the applicant's case number will be discarded.


If your forms arrive before your approved petition is logged in, it could slow you down. They have a system in place that is most efficient for them. If you get the cart before the horse, they might toss you forms in the pile in the corner because they haven established a file in your name. Just a thought.

Hey :) So… we have received the NOA2 and my fiance received the letter for him to start his K1 process through London. We have filled out all of the forms and are ready to mail everything off… which is good… BUT… My fiance is here in the states for another couple of weeks and he did not bring his birth certificate with him. So…. should we wait for 2 weeks until he goes home and then have him mail it off to the Embassy in London… or since we received the notice almost 2 months ago that it was approved should we mail in the packet with our case number and then have his mom mail his birth certificate in a separate envelope with our LND case number. We have the medical scheduled and are trying to have the interview done as quickly as possible so he can hurry back and we can get married. So…. What do ya'll think…. should I send it off without the birth certificate and mail it separate or have it sent 3 weeks from now? Would they accept the application without the birth certificate and update the file once they get it or will they reject it and have to resend it all again? Thanks…. :)

Unfortunately the appointment letter doesn't give more info unless they changed it in the last few weeks. Call the number and pay over the phone some time before the appointment--now or after letter. You pay $16.00 from the US for the privilege of them answering the phone. He pays 1.23/minute (pounds). Pick your poison. They email a receipt to show at the interview.

Hey everyone… I can't find the phone number to call from the United States to pay for the K1 Visa through the operated assisted number to the London Embassy. I tried calling the number that is on my fiance's letter but I can't call from the states… It is restricted calls only from the U.K. I had seen a post somewhere that I could call a different number from within the states to pay for the visa. I have tried the advance search for the place I found the number with no luck. I know that In the post that had the number it stated that it was $16.00 for up to 7 minutes calling the number. Anyone know the number to call if calling from the United States? Thanks so much! :)

We are in the last part of the process for the k1 Fiance Visa…. My fiance received "packet 3" or the letter with instructions on filling out the forms. He is visiting me in the states and we completed the forms online and mailed in the forms and the DS 2001 ready letter…. We have included his medical date which in one week from today…. So………… My question is…. Where do we send our i-134 for to? I read someones topic that it needs to be mailed the "slow way" but it did not say to mail it off in the instructions of forms to mail to the U.S Embassy in London. SO….. Do we just have him take it to the interview with him or were we supposed to mail it off to the Embassy as well? Thanks so much for all of your help.. I would be lost without this place :)

So... My name is Al and i live in New York. A little over a year ago i met my future wife. She is the love of my life. Anyway.. we started dating and things got serious, which is awesome. We got engaged on January 29th. Heres the catch shes canadian and im american!!! NOW WHAT?!?!?!

Well, we want to live in New York and we travel often back and forth. I go there for a few days and she comes here for a few days. Today i started doing research online on how to legally make her a citizen.

Here were my initial questions:

What if we spontaneously decided to get married while she is visiting me can we go to city hall and make that happen? Is that a better way?

If we decide to go through the paperwork will i be able to keep visiting each-other (in other words can we travel freely between Canada and the US)?


It appears that the correct way to move forward would be to file a I-129F for a K1 visa. But then what? Can we see each other at all? if so, are there restrictions?

Can anyone help me out?




My fiance' lives in Scotland and we were debating the same thing. We decided that we would go with the fiance' visa (the i-129f) because it would work best to get him here permanently faster. After our petition my daughter and I went to visit him for a month and was only asked a few questions because it was holiday season so they understood a lot of people traveling for Christmas. So.. After I returned from my month trip 3 weeks later he came to stay with me for 3 months. He did have to give his job notice seeing he would be gone for so long.. so we were worried since he didn't have proof of "ties" to his home country. They did pull him aside and ask him a lot of questions…. He had a bank statement saying the amount of money he had and that was basically all. He told them about the fiance' petition that was filed. They asked him if his intentions were to come marry me and how could he prove it… He said that he just visited me in October and we could have done it then but we are trying to go the appropriate route. They sent him on his way with no more questions. So.. I think if you do get married and then travel back and forth she may have a lot of trouble getting in the U.S. (my opinion only) I do think that the government wants us to ask them permission first…. they are kinda our parents… saying "hey mom and dad… I want to get married lets plan a wedding"… is different than saying.. "Mom and dad… we just went and got married I hope he can stay" … But again… my opinion. :) Good luck in whichever route you decide to go. My vote is for the I-129 and continue visiting each other as often as possible. :)

What the Knightsbridge doctors said is ridiculous or he misunderstood. They don't look at other shot records at the interview. They only check the report from Knightsbridge. He could get a visa with zero shots so shots aren't an issue at his London interview.

Shots ARE an issue when he applies for AOS. I'm not going to write all the scenarios right here because I have a thousand times before. If you will find out exactly what he has recorded on his immunization page from the medical, then I'll narrow it down to his case. Looking for what is written by the lines (dates or words) and what box is checked to the right if any:
MMR
Tdap or Td
Varicella
Influenza

What is ticked under results?

Is the page signed and dated?
What was the date?


I will get the information from him and post asap…. All i Know is he said he had 2 shots to get for the AOS… And I told him to get them at the medical if he needed any but the knightsbridge doctors suggested he get them at his physician back in Scotland. :/ I hope to God this doesn't mean its going to cost us a lot of money since they weren't done at the medical… My hearts pounding as it it.. money money money… sigh…………

Thanks again to all who read these and try to help us on this journey… I am so very thankful for you all! So……. My next question is I sent off our Packet 3.. all the forms that were required… but we also mailed the 2001 form that stated we are ready for out interview. We attached the cover letter and stated the date of the medical. Will they accept this with the other forms or does it need to be mailed separately once they have the other forms? I just want to make sure we are in "line" for an interview soon. My fiance just did his medical in London this Tuesday so I know the Embassy will be waiting for the results. I just don't want to delay the interview if possible. Thanks again y'all :)


Oh.. another question when my fiance did his medical they told him he iwll need 2 shots for his AOS and told him to go to his doctor and get them for free back in Scotland. So….. since he didn't get them at the approved physician will he have to re-do his medical when applying for his AOS? The knightsbridge doctors told him to take the letter from his physian to the interview showing the shots were given to him. Any advise on what this means would be grateful! Thanks :)

Hi everyone,
I need any and all advice...we waited so long for our packet 3, (took over a month) and were waiting for our packet 4.
I happened to email the embassy on Friday to see if they had scheduled a date yet.
They responded by saying his interview was May 22nd (tomorrow)
He just got the packet 4 today when he got home from work.
All the doctors are gone, so he can't schedule anything for his medical, etc.!

Do you think they can reschedule for us???? Would not going to the interview be automatic grounds for denial??
I don't even know if they will get the fax he just sent about rescheduling by the normal interview time! This is ridiculous!!!!

Please, any advice?? Should he show up anyway without medical results and bring them in another time? I thought all the forms and the medical had to be done by the time of the interview (at the Paris, France embassy anyway it does)!!

So i hear now that If I do not have to be the sponsor for my UK fiance'. I thought that I didn't need to be if I had a sponsor who met the requirements. So……. With all the debatable answers I had my fiance call the embassy to make sure that I don't need a form filled out and when they asked about his sponsor they said It HAD to be a relative of me… I have never seen this anywhere that the sponsor had to be a relative… even on the instructions page of the i-134 it doesn't mention it has to be a relative to do the sponsorship… So.. anyone have someone else other than family be a sponsor? His interview is 3 days and he leaves in 2.. I can't courier him the new forms and bank information ect that is needed for the interview in time… We are really stresed… anyone… someone… please tell me that it doesn't have to be family :( Im heart broken and so very disappointed that I didn't see that anywhere… Any input will help us greatly.. hi my wife and I are about to send our AOS paperwork away but I had to go see a civil surgeon first to make sure all my shots were up to date. When I was in London I only had to get another 2 shots and thought i was excempt from the varicella shot as I am from the UK but when I went and saw the civil surgeon today he said that I need the shot or proof that I've had chicken pox before …….Can anyone tell me if I do need this shot or not ???

I contacted the consulate and USCIS, after the interview (Jan 27, 2009). Yes, my petition was returned to USCIS and they recieved it 3-31-09. The last contact i had with USCIS was 9-29-09, an email that said processing of your case has been delayed; your case is not yet ready for decision, security checks remain pending; contact us in six months.

I need to add that I don't think he said anything to suggest fraud. By the time of his interview, we had known each other for two years.

When my Ahmed had his interview April 2009, the Casa consulate wasn't asking to see income information. I had emailed them prior to the interview and they said none was required. So I think recently it isn't being required. Did you try emailing them and asking them to explain? They were very helpful over email, I thought.

I think it's possible the reason for denial was something else. From my understanding, the CO's job is to try and determine if there's a bona fide relationship and/or it there's any fraud. It's possible that your fiance mistakenly said some things which made the CO suspect he was being fraudulent, or that the relationship isn't valid. There's nothing we can do about that, being here in the US, unfortunately, as we can't be there at the interview.

All that being said, did your petition get returned to USCIS? Maybe you should try and contact them.

I am a bit confuiesed. Your petition was approved or you would never have had an interview.

Are you saying your visa was denied? You did not say that before. Here is the problem and it goes back to "deserving" something or thinking you deserve something.

There are actually no hard and fast rules for the I-134 and qualification is strictly a judegment call. If you have non-taxable income you need to make this very clear both on the I-134 and with attach documentation. That said, a consulate CAN make their own decisions about that income or assets they want to include. In any borderline cases, which yours certianly is, I would always recommend a co-sponsor. Again, you are not applying for a visa, your fiance is and he is not entitled or "deserving" of anything in the eyes of the government, YOU need to overwhelmingly show you are qualified to sponsor him.

If the REAL reason for denial is/was lack of income based on their interpretation of your income, then your best route is to get married in Morroco and file for a CR-1 where your financial ability will be judeged on an I-864 by the NVC and the very difficult consulate in Casa Blanca will have nothing to say about it.

Yes the petition was approved, I received the I-797 Notice of Action. Notice type: Approval Notice valid from 12/06/2008 to 04/06/2009. Ahmed had his interview jan 27, 2009. He received form: OPTION FORM 194, which says, "This office regrets to inform you that it is unable to issue a visa to you because you have been found ineligible to receive a visa under the foolowing section(s).....etc, then the box is checked, Other: your case is being returned to USCIS for further adjudication.....

To me, this mean the visa was denied. Where i get confused is, does this mean the petition was denied? And, also, the approval notice has expired, obviously.

As far as deserving, I am refering to people with disabilities. Ppl with disabilities deserve to have a fiance/spouse just like everyone else.

Ahmed had the I-134 with attached documentations.

I can travel to Morocco, marry and file a CR1, but I do not want conflict between a K1 visa still pending and a CR1 visa. I do not want him permantly banned from the US.

That way, i would have known the reason. She checked the other box: Your case is being returned......... I don't know what that means, is it a 221(g) or a 212 ??????? I don't know bcos it doesn't say. That leaves me wondering and wondering why why.

Sorry, i mean i qualify. I read all the financial requirements and i really don't think i need a sponser.

It's about the intending immigrant becoming a public charge, not the USC.

Your SSDI falls just under the 125% mark for 2009.

When you included the asset information did you submit the proper documentation of the value? See the I-864 instructions for a better guide to the assets.

Yes i did follow instructions on the I-134, but the co wouldn't look at it. I have read all the info about affidavit of support a long time ago. I read that the I-864 is for adjustment of status. Admed had copies of everything.

Ok I think I understand the confusion now. Earned income and income from benefits are two very different things. Although it states no where on I-134, but usually it is up to the Immigration Officer (IO) to approve or deny a petition based on income from benefits. To my knowledge, the majority of the IO's get very quirky if you are using benefit income as a means to provide a financial guarantee and dare I say it which no one probably will not even the IO, but if you are receiving ssdi you are already a public charge, and thats why the IO's see you at a greater risk then someone who is actually earning their income.

No i don't take it offensively, but I think you don't understand. It is not SSI income. SSDI is insurance through Social Security. I paid into this program; my deceased husband paid into this program; we all do. I use to work, but became disabled and can no longer work. Am I really a public charge???

Maam disability is not disqualifying you. It is the income level. If you cannot work because of your disability, how do you plan to support ahmed? or how will you guys go about your daily business in the long run

There is a minimum income limit that has been set by USCIS for a reason i.e. they do not want the beneficiary to become a public charge.

Please do not take this personally.

I checked the income limit when i applied and i qualified. I have other income also, i receive teacher retirement benefits and a death annunity monthly for the rest of my life. I also have savings and 4 rental properties. I did have 5, but have since sold one. She didn't look at any of this information.

SSDi is acceptable income and should be stated on your I-134. Attach a copy of the determination letter and evidence of payment, checkl stubs and/or bank statements showing direct deposits. You are good to go.

I will caution you about expecting to "deserve" anything. There is no problem in your case, your form of income is accepted (it may not be sufficent, the poverty guidelines increase March 1) but your savings and assets should make up the small shortfall...but NEVER assume you "deserve" anything. Your fiancee is not entitled to a visa and can be denied for any number of reasons or no reason.

The problem is I don't know why the visa was denied. All I am saying is disability should not be a reason. I would like to find out the reason, we should be told. Bcos i am guessing could it be this or that reason?????? I don't know

My husband also receives social security disability benefits and from what i know it doesn't make a difference. He got a letter from ss stating he receives benefits and how much etc. so that i could send it in with my aos application. I don't think it matters and if it does matter to them then that is so some serious discrimination.


thanks, i just assumed that this would all go so smoothly and it hasn't. It has been so long, i have forgotten that tax year 2007, i had other income besides ss. Some of that other income was from child care and i reported it as self employment on tax. The interviewer looked only at the adjusted gross income and told ahmed that i didn't make enough money to support him. She did not even count the ss benefits which were not taxable and not encluded in the adjusted gross income. She would not even look at the I-134 that i sent to him which had proof of savings and properties that i own. Its like she already had her mind made up before he got there to deny the visa petition.
