It is consulate-specific since in Bangkok you may present any document in Thai or English. However, if it is another language, say Burmese, it would need to be translated into English.

The advice to refrain seems to support the null hypothesis of this principle i.e. not front loading is the preferable advice. I am uncertain of which is more advisable.



"Love letters" or other non-English text are not the only form of evidence with which to fron-load a petition.


Pushbrk is correct. The only thing I would add is: some of the evidence you could frontload without translations would be boarding passes, phone bills, photos, your credit card reciepts, etc....

I am glad to hear the father has agreed. But, although I am not 100% sure, I believe the USCIS might still need some form of court order at least granting you the custodial parent. I think this could be executed fairly simply. Just have it drawn up with visitation provisions, if the father wants them, ahead of time. The father could sign them both in front of the notary and a judge would only have to sign them in his chambers. As long as the father agrees, this should never have to enter an actual court room. I realise this might cost you a bit more in lawyer fees but, this would lessen the chances of the father changing his mind and lodging any sort of protest. And even if he does, it will strengthen your position in any custody battle.

Gary, RebeccaJo, or the Mermaid are all more versed in actual law than I am. If any or all of them would chime in on this part, I would greatly appreciate it.

As I recall from our own experience, the birth certificate that matters is the "long" form BC. It usually has both parents names on it. The short form does not. Unless the bio father has had rights removed, the previous posters have given you good information. If there has been no legal custody arrangement to date, I would suggest you proceed with that immediately. Especially if the "sperm donor" is just now threatening to cause you problems with the move. One thing you have to consider, is WHY he is just now becoming involved in the childs life. Did she just recently reveal to him that she has his child? Or, Has he known all along and chosen to ignore the child for the past 4 years? These can play a huge factor in a judges decision.
Another thing that you might need to show, is how a move would "enrich or enhance" the life of the child. IE...would she have a better quality of life in the US than she does in Canada? And do NOT be arrogant and think that "Yea it is the US, how would it not be better". You will not always have to show this but, it will depend on the judge that you get. Believe me, the judges are individuals and thier own biases can play a role in thier rulings. Been there done that.

One thing to remember, some cases get "touched" a lot and others do not. The USCIS is not the best at keeping this up to date. Some people on here have not shown even one touch on thier case and already have a GC (greencard) in hand. So, if your case is not showing touches, don't get discouraged right away. All it means is the person handling your case has not updated it on the web.

If you are just here visiting and he has proposed to you, YES it is ok to file for your K-1 while you are here. I would encourage that so you can both look over all the paperwork together and figure out what is needed. Odds are, if you are here only for a visit, you don't have all of the legal paperwork with you to have the packet ready to send. But you will know what is needed and can send them back to your fiance as soon as you return to your country. You will have to return to your country once your visit time expires. Also, you will have to attend an interview at the consulate where you reside.

LIke others have said, your question is a bit unclear. If you will rephrase your question to bring a clear understanding as to what you are asking, we can provide more specific answers.

Copies of airline tickets, copies of tourist and/or business visas, copies of arrival and departure stamps from your passport, and a few photos of the both of you together, all showing destinations (locations) and dates are almost always more than sufficient. I would think a 60 page phone bill is way overkill and would only frustrate your caseworker.

Definitely bind it all together with the two-hole at the top metal strap system as mentioned elsewhere. :star:



What I ended up doing was taking 5 pages out of two different phone bills all from different dates and putting them in there in the back. Only 10 pages, so it should not frustrate anyone. I punched all the documents with the two hole punch at the top and put it all in a folder that uses the two hole top system to hold that stuff in. I separated every section with a subsection list showing what was comming next, and then marked the outside of the folder with 'I-129F Original Submission' and my name and the bennies name.

I think I will be ok with the folder, the USCIS says dont use folders or binders that are hard to disassemble, and my folder is probably the same kind they will transfer it to anyway. I like it cause it keeps the stuff all nice and neat.

What is your guys advice on how much evidence of ongoing relations should be included? I am following the guidelines and instructions on the VJ site, but when it comes to attaching phone bills, mine are most times over 60 pages long. About half of our communication is thru SMS. Should I make copies of all 60 pages or just pick 4 or 5 pages showing a range of dates out of each bill and put them in there?

I had read somewhere that the only POE that issues the 90 day EAD to new arrivals was JFK, then I read somewhere that they are not doing that anymore, but looking at the recent POE reviews, it seems like people are still getting them there.

My POE of choice is Atlanta, but will change to JFK if that is the only place that you can get the 90 day authorization.

So,

1. can you still get an EAD stamp at JFK?
2. can you get an EAD stamp at Atlanta?

My fiance is Russian as well. I can tell you that this women is using you to get her and her son to the States. She is looking for a 'mule' and I'll wager that she thinks she has found one. I also wager that as soon as she gets her 10yr green card you will be served divorce papers. If this is ok with you then by all means bring her over. You will be in for a couple of years of hell, or worse. If you are looking for a real lady then drop this women and continue looking. There are real Russian ladies out there, they are just getting harder to find. I suggest looking for someone closer to your own age. Anyway good luck to you...

Just FYI, I got an RFE requesting more evidence of our relationship. In the RFE it stated that only film dated photographs were considered as secondary evidence. However, I have not ran into anyone else with this problem??? Just a heads up.


I think that question turns on what other kinds of evidence are there with the photos. If you have strong primary evidence, there's probably more wiggle room on the photos (I know I've seen plenty of people say they handwrote dates on their photos - not everyone has their camera set to print the dates on the photos - I don't - it ruins the pictures!)


Yes, I agree. I sent 9 nine photos printed on two sheets of paper. I just wrote under each photo the date photo was taken, where it was taken, and who was in the photo. My primary evidence was strong, so maybe the photos did not need to be considered...

If the final divorce decree states a waiting period to remarry then the petioner is not free to marry and must wait out that period before he/she can file the I-129f. In my case, I had to wait 6 months after my divorce was final to file my I-129f...

And I don't think you can circumvent this requirement by going to another state...

In my case, I am also a resident of Wisconsin. In this state it clearly states in your divorce decree that you are not free to marry for 6 months after the final hearing. So whether or not you are free to marry would depend on what your divorce decree says. If it states you must wait to marry, then I would think you are not free to marry. I think there all some state laws that all other states recognize, divorce laws may be some of those laws. I am not a lawyer, but I think this is the case. Anyway, the judge at my final divorce hearing was quite clear, I was not free to marry any where in the world for 6 months and it so states in my decree. I waited to file my I-129f...

I was divorced in Wisconsin. It clearly stated on my divorce decree that I was not free to marry for six months after the final hearing where the divorce was finalized. If your boyfriend was divorced in Wisconsin it will state this on his decree as well. Since you have to send this decree with your I-129f as proof of divorce and you must be free to marry at the time of filing your I-129f you will have to wait out the six months. I did.

Hey Mike, Its the departure card for your fiance from Thailand. Get it at the ticket counter in BKK. You will recieve your arrival/departure card when you leave the USA.
Your fiance will still have the arrival portion of the card after she leaves thailand but yours was used when you got to BKK. Make sure you save the rest of her card for the next time she goes back to Thailand. Sometimes they complain when you go back and don't have it for them. My wife lost her's but they still let us in. Let me know if this clears things up. :thumbs:

I have another question and am glad we have this community where I can ask Thailand-specific questions. Where it asks on various forms (G325A etc) for address (number and street), we can use the house number and neighborhood (Moo) number right? That's what we use for mail and we don't know the names of some streets, especially for the former residences and former employers. For example:
Number and street: 55/129 Moo 12, Tambon Sansai Noi
City: A. Sansai
State/province: Chiang Mai
Country: Thailand

I just want to be sure there's no problems on the forms, I'm sure you all understand that!

sometiems even in Thai I leave out the word Tambon or Ampour too. my mail normally arrive fine .. But you can also go to the post office and ask them for the best way to write in English too. :D

My wife was admitted to the US on a k-3 visa she received from Thailand. We frequently travel back and forth from the US to Thailand spending about 3 months in each location. We now have the option to start the AOS here in the US (Las Vegas) or to continue with the immigrant visa processing (ir/cr-1) in Thailand. I have been looking for a topic that is more related to K-3 visa's and Thailand but have only found this one. Does anyone have any input as to which process is faster/cheaper/easier to pursue?

If someone could point me to a more appropriate thread for discussing this, that would be most appreciated.

Well we made it back from bangkok today. All we needed was the 2 advance parole forms to get through immigration in dallas. We had to wait in a special room with all the other special cases but after about 30 minutes we got the stamp on her I512-l form and off we went. One word of caution though if you fly through Tokyo. If you fly standby like me you have to have a transit visa for anyone holding a thai passport. We had to buy a refundable ticket just to prove she would not get stuck in tokyo without a visa, now i have to get my money backon the ticket. All because we didn't have a confirmed ticket. Well Jenny got her AOS approval letter in the mail today, just 2 days after the interview. its says Welcome to the United States!!!!! We made it! Finally a break from all these forms for 2 years!!! All they asked was where we met, how many visits, and to show stuff with both our names on it. The only other paper we showed them was ID and Passports. Everything else they already had from before. Hello,

I'm having major confusion over this I-693 Medical Examination report for the AOS process. I'm getting confused a little on whether or not we need this document from a civil surgeon or just the vaccine supplement we already have from the original medical examination given in Thailand.

I really want to get our AOS packet sent in and I have just about everything ready to go, ecspecially the I-131 AP document which I'm hoping will be given as quickly as possible since my Fiance's mother is very sick & ill.

I literally just got back from a local civil surgeon's office and they wanted roughly $450 to get my I-693 finnished and sealed up. I thought that was a little high so I backed out last second and I have called the USCIS twice since then before this message and I have gotten two different answers.

Would it be wise just to send in the packet with the vaccine supplement rather than the I-693 with a worst case scenario of having them RFE myself at a later point...

I just finished the AOS interview and all you need is the vaccination supplement from the Thailand doctor. If you have any vaccinnes that are marked insufficient time and don't have a mark for not age appropriate, then you will have to go to the local clinic for the shot. My wife just needed the varicella shot and we were able to go to the walk in clinic, get the shot, and go back to the INS office with the sealed envelope, and drop off the paperwork. We did it all in the same day and now the interview is being processed. Make sure you have some stuff in her name, like bank accounts, medical coverage, and beneficiary info to show at the interview cause they want that. They call it "bonifides".
