The best thing I can tell you going through this is that your wife can show them that she is in fact wanting and willing to marry you she has to be confident a very sure about her realtionship with you the biggest amount of fraud cases come through HCMC. If you are really true and she can answer all there questions you should be fine we brought bags of info letters phone chats etc organized very well all they asked for was some pictures and asked her who was in the pictures and that was that. My fiance was denied entry to the U.S. a year and a half ago. They took his tourist visa and told him to reapply at a later date. The reason was simply that they felt he had more ties in the U.S. than to Mexico. And that he was simply visiting the states to frequently... which was true (to see me). My question, we decided to just wait and apply for a fiance visa rather than have him apply for his tourist visa again. It has been a year and half since he has been in the U.S. We want to know should I attach a letter to the form that asks the questions about denials and visa confiscation, stating the situation surrounding his denial and visa revoking. I am worried about just putting yes on these documents without an explanation. Because otherwise they could assume he had been denied for a real criminal reason. He has never had any trouble outside of this incident and even then it was not really for anything bad.... Please give me your thoughts, suggestions, experiences.... Thanks!

Our friends had their interview 4 years ago and they were both allowed in for the actual interview. But, I have heard since then different responses. When do they run the name check on my fiance (Mexican Citizen)? After everything is sent to Juarez?
Since he was denied entry at the border once for visiting too often and they made a record, would this trigger anything in the name check? We already plan to attach a letter explaining there is no criminal reason for his denial and he has no criminal background.

Okay. I am starting the worrying game even though I haven't even filed my I-129F yet. I have everything organized and am ready to file.

Previously, I had posted our situation about him being denied entry to the U.S. at the border with his visitor's visa. The border agent simply stated that she felt he was visiting too often and wasn't keeping good ties to Mexico. She took the visa, made a report and told him to reapply in one year. That was a year and a half ago. We have a copy of the report she made and it simply stated the denial at the POE was related to the"ties" thing. I have already got confirmation from the site about simply being honest in my paperwork and that it should be fine. Additionally, I emailed the consulate and got the same advice about being honest and that my fiance can explain in his interview what happened if asked.

My new question is my fiance told me when he first got to the border that day that she first asked him why he didn't turn in his previous 1-94 form. When he told her that he certainly did turn it in, she was like okay. And then switched gears into the "ties" thing. She never made a reference to the I-94 question again. He obviously wouldn't have been attempting to cross into the U.S. with his visa again if he had overstayed his last I-94 and I think she knew that. My question is should we be worried about this I-94 question? Or should we simply stay on the original plan of attaching our explanation and explaining if asked at our interview? Please help, I am a major worrier!!!!!!

My husband was given a removal order with a 5 year bar on reentry to the US, and we were able to successfully apply and get his K3 visa from Juarez once the ban period had ended. It's almost guaranteed they will ask about the POE denial at the interview, and you can almost be sure your fiance will need to have fingerprints taken. But if the denial at POE is the only thing that comes up matching his fingerprints, I wouldn't worry.

The only comment I would have to make is this... where you say...

working while on a tourist visa is illegal. He was legally present in the US, but by working he violated the terms of his tourist visa. I am not saying it to be mean, but because you might not want to stress that point so strongly in your interview as you did in your post, as it seems like you think your fiance didn't do anything wrong. My husband and I when asked said yes he did work for a short period, and we realize now that it was wrong, and obviously we know now, as we have been paying for it by having our life put on hold for the 5 years. The consulate truthfully weren't that concerned with him working without a work visa, they just wanted to make sure that is the only thing he had done, and that he never crossed again during the ban time. I'd say you'd be smart to take proof your fiance was in Mexico the entire time after the POE denial and that he hadn't crossed without inspection once his tourist visa was revoked. We took paystubs for the entire 5 years.... hehe! The consulate will then also prove it via ensuring his fingerprints only show up for the one incident.

Chin up :) It's very scary imagining what is going to happen and what you're going to have to go through, but the consulate is actually more understanding than you're expecting or worrying about. My husband's interview was more difficult because someone else had used his name when they were caught by INS during the ban period :angry: , and we had to go through extra fingerprinting so INS could prove it wasn't my husband. Once the 2nd and 3rd set of fingerprints came back and they saw it wasn't him, his visa was granted. He definately should not have done any form of work while on a visitors visa, but he was never illegal. Very scary moments for a while, but we knew he hadn't ever reentered once being sent back, so we knew the fingerprints would show we were telling the truth.

Make sure you do write up a summary of the incident and include it in your cover letter with the I129F packet. We hired a lawyer who did this for us, and stated the part of the law that showed my husband was eligible to reapply for a visa once the 5 years were up.

If you are still worried about it, you might do a 90 minute consulate with a good immigration lawyer who can review your case and any facets of it you might not have considered, and hopefully ease your mind. It's a way to get an expert opinion without spending a fortune.

How did you know when your husband had the 5 yr. ban or just a denial? My fiance was simply told to reapply for his visa in one year. And after sorting through all of his paperwork, I don't see anything that says a 5 yr. ban has been placed.

My heart is heavy with worry. I have previously posted questions regarding my fiances denial at the POE and his tourist visa being taken. The groups advice has always been to be honest and explain our situation at the interview and that previous visa cancellation or POE denial would most likely not effect our K1. My fiance sent me the complete report that the border agent filed regarding his POE denial day. It was two years ago and he was questioned, photographed and fingerprinted. They said that he was visiting too often and after going through his wallet found what they called "evidence" of him having a life here. They found avideo rental card (he was added to his sisters acct.) and a gym pass. They scared him to death by putting him in a room for hours and he admitted in his questioning that he did wrongly do some work while here visiting. On the report it mentions that he provided proof of his residence in mexico, proof of his employment and such, however the agent even questioned if his paystubs from mexico were legit. I think she was just looking to find something wrong. They did several background checks on him which all came back negative on the report. On this report they also put that at the time of his entry he was illegal, that he had not turned in his last I-94. Which is completely wrong. He has never been illegal. He definately should not have done any form of work while on a visitors visa, but he was never illegal. He always turned in his I-94's. To make a long story short, he has never had a single criminal activity and besides this event at the border has nothing on his record with Immigration. We had planned to attach a letter with his visa application to explain this incident in detail, but I am so upset that they will deny him based on this incident. I mean he honestly admitted to working and he was punished with his visa being revoked. He has not applied for any form of visa or attempted to return to the US since this denial at the POE which was 2 years ago. Should we continue on with our plan for the K1 and just provide the thorough explanation??? Surely this one incident can't completely ruin everything. We plan to be completely honest about the whole event. Please provide advice I feel so discouraged and sad.

I called the consulate in Mexico and talked them about the things that we face questioning about during our interview 1) POE denial/ visa cancellation 2) lost I-94, from when he entered Mexico (the last one he turned in before he was denied entry)

My fiance and I have thoroughly typed out an honest account of the events at the border to explain the denied entry and visa cancellation. And I was planning to attach it with my I-129f packet and to give him a copy to take in his interview..... Addressing the lost I-94, the consulate agent told me to bring bank statements, utility bill receipts, pay stubs and university enrollment forms that show he was a resident of Mexico during the time in question. So I have gathered all of the above information for the year 2003-present. Which covers way before and past this small time in question. Do you think this is good enough?

Also, I know my fiance is most likely going to have a name hit when they do the background stuff, due to his incident at the border. He has no criminal background at all. So what will happen? Do they just move on after the name hit is confirmed? We will eventually make it to an interview right??

I want to make sure I have this correct, I hear alot about 3rd packets and stuff and I am not sure what they are referring to....So here goes:

1. I-129F sent in
2. NOA 1
3. NOA 2
4. Paperwork sent to my fiance in Mexico from the Consulate
5. Some paperwork will be sent back to the Consulate, some will be taken in person to the interview.

I know there will be emails from NVC and TSC, but are these the basic steps?

Also, when we go to the interview, is that when he will actually fill out the DS-156 (application for visa), the reason I ask is because when I downloaded the "fiance' packet" from the consulate website. It only had other forms and the DS-156K..... which is not the application, it is a supplement. I just wondered if they will actually make him fill out this DS-156 form then???

We have complications that we have to answer at our interview. Re: a tourist visa cancellation and a question of an alleged overstay.

We have already contacted the consulate and know that we will get the opportunity in our interview to explain the circumstances of the visa cancellation and we also have gather documentation from 2001 to show that he has lived in Mexico solidly, except for when he did visit on his visitor visa.

But, there is still a chance he will be denied his K1 visa. If this happens, what do we do? I know if you are denied a K3 visa due to overstays, that there is a waiver available. But, what if they deny you for a reason not related to an overstay. Do you simply file again for a K1 or K3 or will they most likely provide you with a list of items you need to bring again to the consulate to qualify???
