An attorney stands in the same line we do, with no time savings what so ever. The paperwork is far from complicated if you can read and follow simple instructions. Have a question? Your fiancée needs either a legal court order stating she is the sole parent (father has surrendered all rights) or a letter with apostille stating the father gives 100% permission for his child to emigrate to the US with no guarantee or promise of return.

As others stated, this issue can escalate. There are cases where the father has held his signature hostage in order to extort as much money as he feels he can from the future step-father.

Many people believe they are multiples of the same form. They are actually not exact copies. If you look closely, they each have a unique page number and notation for routing. You must fill out all four pages (should auto-fill from the PDF) for yourself and four for your fiancé(e). Submit all with your I-129F smile.gif

I put my fiancee's name as it appears on his passport and national id and I also can not quite remember but there was a section on one of the forms that asked for other names this is where we put any other names he may be referenced to. His father and mother's names appeared as they did on his birth certificate. Not sure if this is right but we haven't gotten anything back regarding this being incorrect.

When my fiancee went to pay the 131.00 fee for the visa at the CIB Bank they told him he needed to fill out a form DS 158 and bring it to the interview with him. Those of you who have had interviews have you done this? Some of the questions on the form from what he was telling me seemed a little different but I do not want to bring this if it is not necessary.

Glad you found out. I was going to say that as long as it wasn't registered at the Ministry of Justice and the Ministry of Foreign Affairs you can file K1 from what I have heard. If you are asked at the embassy level and you explain what kind of marriage that you and your SO have they will understand completely, they deal with this all the time and this can be done only because it is a non registered marriage. There have been several couples that have said that they done this and yes told the consular at the embassy what the marriage or paperwork was and they understood from what I have heard. I believe that you can register that marriage if you got the paperwork together and made a case with the courts but not sure of the process. If you need me to check pm me, my SO was an Egyptian attorney and he could tell you the process. We will probably not be online for a few days as he is arriving today but I can check back if this is something you need information about.

That is incorrect. File the I-765 (and for Advance Parole if you want to leave the US before the G.C.) with the AOS and it is all the same fee. You pay 1010$ fee for AOS regardless of if you file for the EAD and AP or not. You should get both AP and EAD within 90 days.

3) Also related to IMBRA, although it's been well beyond the two year window, I will now be required to check "Yes" on item 11 on the I129F, which asks if you have ever filed a petition in the past. I've only done this once, as mentioned in 2004, so I don't believe I need to ask for a waiver. (yeah?) However what I am curious about is whether or not checking the "Yes" box causes any grief down-the-line in the process. Anyone experienced that, perhaps in the interview, something, dunno-what-but-needed-to-ask?
4) Regarding the G325A, specifically the section that lists your employment history, I have a question about what you should list...specifically in addition to being an engineer, I am a part-time flight instructor. I do it for fun and because I enjoy it. Will listing multiple jobs for an overlapping period of time cause any heartburn later on? Should I just list the "primary" places of employment? Being the overly-honest-and-open individual that I am I want to list everything, but I was curious if anyone else had done that too.
5) Is the FC-029 REALLY no longer needed?
6) When I filed before I don't remember sending in ANY originals, even for the I129F nor the G325A. I seem to remember thinking at the time that the FC-029 took care of that issue. Do we really need to send in the originals for the two aforementioned forms? I assume then that the remaining elements (letter of intent, etc.) can be copies?
7) Not that money is an issue for me, but is anyone aware of WHY the USCIS increased the fee so much? IOW, when I first saw that I thought "it's because of that #^$^@%@!& IMBRA" - or am I just being biased? (note that this is only a curiousity type of question)

Ok that's all I can think of at the moment. 'Preciate the feedback. Good to see that VJ hasn't changed much during these past few years. Nope, no FC-029, I've never heard anyone mention that in the last year I've been on here. Again, don't send originals, except of the forms you need to fill out. Make sure you have originals for the interview though. They raised the fees so much to hire more people etc... Of course we wont see any increased speed in processing, but hopefully in a few years there will be an increase in speed.

What we always said was "here to visit" if they asked who, "my fiance". He was always let through with that. We always brought the K-1 paperwork and evidence of his employment back home. Also bring a lease or rental agreement, stuff stating you go to school, whatever shows that you have ties back home and aren't going to stay in the US.

We had the same problem. For some reason in May, they didnt send out a bunch of hard copy NOA2's. You absolutely need it for AOS (specified in the instructions) and while some people may have had luck filing AOS without it, I would not risk the several months delay and extra $$$ and RFE for this would cause. What we did is wait for one month (after I found out we had been approved in the first place, 15 or 20 days after... GRRR) then I called USCIS and got the run around like you have been getting. So then, I called back, but this time I hit all the buttons for having an RFE. This will put you in contact with the actual service center, NOT USCIS's crappy call center. Tell the service center rep the problem and they SHOULD send out another copy within 2 weeks. If that doesn't work, ask to speak with the supervisor for the normal USCIS call center and keep pestering them until they submit a service request. Stay on top of this though, as you will NEED it for AOS.

Oh, for evidence to convince him ( hehe silly men!) go to the USCIS website and download the AOS form. You will see it specified in the instructions for filing after a K1. Good luck!

They have a nice list of what to send etc. If I were you, I'd file now since if things go very quickly, you can always take longer to submit the packet of info to the embassy and once your fiance is issued the K1 visa, you have 6 months in which to use it.

Igor, I wouldn't stress about the NOA1, its not even been 10 days! Last year when we filed and they weren't backed up, it took us 10 days to get the NOA1.

Common wisdom is bring documents that you are returning home (rental agreement, letter stating you are returning for work, document from school etc.), if you have NOA1, bring that, don't pack everything you own and be able to afford the return ticket if you do have to go home/get turned away. My husband wasn't asked to show anything, but some people get grilled at entry, kinda luck of the draw. Keep in mind she will have to go home to fill out paperwork, get her medical and police cert and go for the interview. Good luck!

My husband and I both traveled during the K1 process. When I went to the UK, I said I was visiting my fiance and they asked the normal, what nationality is he, where are you staying, how long have you been together etc. 30 sec. of questions and I was off. I brought a couple of things to show I was going back to the US like our NOA1, thingy showing I was still in school. He visited the US and brought a letter from his boss, thingy from Uni and bank statements and a copy of the NOA1 that I sent him. He said he was visiting his fiance and they just said ok and let him through. No other questions. Both times we weren't dumb and didn't pack half our life, didn't seem nervous and had no problems at all.

Oh, the previous time I had been in the UK, I stayed for 3 months and didn't have any questions asked about it.

Previous denials, unless they were for K1/K3 kinda thing shouldn't matter. You MUST meet in person, make sure to document that meeting with pictures, credit card receipts, hotel bookings, passport stamps, airline tickets etc. Then file for the K1 (or K3 if you marry while she visits you). We all have family and work commitments, but if she wants to bring you to the US, she will have to make the time.

I'd stick with 3 hours. Some people get called for secondary processing, and this can add up to an hour or more to the wait time. My husband didn't go through that, so he was out in the normal amount of time. I just figure there's enough stress that day, why add to it by having one hour less to clear immigration.
