K-1 Fiance(e) Visa Process & ProceduresMiddle Name Question.
[/quote]
We filled out all K-1 forms with my wife's middle name, but when it came time for DS-156 we used her name exactly as it appeared on her international passport. It didn't cause any problems.

Joe,

Could you please tell if Nadya has her middle name written in her travel passport? Thank you!

K-1 Fiance(e) Visa Process & ProceduresMiddle Name Question.
Like all Russian and Ukrainian people my fiancé has a long middle name. Her middle name is in her birth certificate and in her Ukrainian passport but not in her travel passport (passport that she has to bring to embassy). She believes that this is how the travel passports are issued – without people’s middle name. I am working on I-129 petition to USCIS and for now I included her middle name on all forms. My concern is that later she will have to fill out DS-156 for her interview and field 7 says “First and Middle Name (As in Passport)”. Then she will have her middle name everywhere else including her birth certificate but not in her travel passport and DS-156. I am wondering how everybody else handled this problem. Thank you very much!!!

K-1 Fiance(e) Visa Process & Proceduresbank statements

Im getting my packet together for my fiancee's interview, i exceed the income requirement by far, from the last 3 tax seasons, so thats not an issue, i have a full time job with the military, so employment is also not an issue, thankfully, so the question is, does she need my bank statements to for her interview? and has anyone gone to the interview without one and got approved or denied, thanx VJ

Although Abeku had my bank statements for the interview, he was not asked for them. Akua

K-1 Fiance(e) Visa Process & ProceduresPicking Up Packets

From what others told me. For our Ghanian fiances they have to go pick it up. They get the packets same day along with the interview date. They should be notified when to pick it up- but some said they never got it... so give it a little bit and call the embassy!

Hi Thymbo,

I understand that your fiancee is unavailable at the moment to pick up the packet in person. I recommend that you call the embassy to find out their policy for substitutes. I have never heard of someone picking up a packet for a beneficiary but it may be possible.

K-1 Fiance(e) Visa Process & ProceduresParental consent document

Yes I was thinking Thursday flight into CJ (Holiday Inn express, reservations in advance thursday- tuesday)then friday medicals which means we can lay low for the weekend then monday go early to check the TB result and either get into visa interview same day or next day tuesday...I think with approval they may still not do visas same day, but that gives us the rest of the week for DHL. I see no reason for Lupita & kids to be denied, she was never married, they have a very real relationship & kids really like fiance! I have my fingers crossed for all of them!
Were you on a vacation to Cozumel? Isn't it nice??? American fiance & I will fly to Cozumel, pack up Lupita & kids, go to Cancun, fly to DF then onto Cd. J...eventually crossing at El Paso and flying to Minnesota...yipes now THAT is a trip!
Sounds like you have had a long waiting process for your fiancee as well...best wishes! I have a question for you, was she ever married? and if not, did you need to prove that since she had a child? I am wondering if we need to show proof of Lupita never marrying the kids dad.

It may take longer than a week now with K2s. My husband and my stepkids came through CJ in February. We had planned something similar time-line wise as you are planning, but their week in CJ turned into three. Thankfully they were staying with family!

When my husband (then fiance) went for medical with the kids, they only allowed him in and informed him that he has to have his visa approved before consulate will allow the kids to have their medical done and then their interview.

So, the first week was him getting his med. done and his visa interview, some days closed due to holidays the next week and the four day wait for the 13 yr old once my husband got his visa approval and a letter from the Consulate allowing the kids to have their medical the third week.

They got their visas at dhl on a wed. and crossed that night at 2am.

K-1 Fiance(e) Visa Process & ProceduresGirlfriend has a multiple entry visa - can she visit and marry me instead of doing a k1?
Steve, we just get a lot of people here who are legitimately trying to get around legal requirements. They know better but just think their relationship is apparently much more important than everyone else trying to bring a loved one here. I'm sure you can see how that hits peoples nerves, so we all kinda jump on people when they ask that, regardless of if they didn't know or are just jerks. Dont be scared off though, VJ is a great resource for those last minute stupid questions and for support in what seems like the never ending wait. Good luck on all this and make sure to read the guides, they are a awesome.

K-1 Fiance(e) Visa Process & ProceduresGirlfriend has a multiple entry visa - can she visit and marry me instead of doing a k1?
Keep in mind that if you did decide to have her come and stay (which is illegal how you are suggesting it) you would have to prove that she didn't enter the US with intention to stay AND that you have a bonified marriage, which will be very dificult considering you hadn't met before. Look at the picture from the interviewing officer's eyes. Girl from PI comes on a tourist visa, stays and gets married to a man she has never met in person AND she has family here. Not saying you guys aren't on the up and up, but there are a LOT of people who enter into a situation like you are suggesting to get a relative here for friends. PI is a high fraud country, so you guys need to have lots of evidence that you are legit. Not having met isn't going to do that.

I agree with the above poster. I am not going to be in the USA (If I pass!) until late 2009. There is no way they can do it in a few weeks. Even with Lawyers.

I love my lawyers to bits and they have sped up the process, but if your lawyers are saying it will take "weeks" I would double check who you are hiring.
I am actually in Bristol too and had my application received on May19th. And they told me I will not hear anything before October.

What about if it's expedited?

Expedited for what reason?

There has to be reason for USCIS to process an expedite.

Now you have got me confused... unsure.gif Why would my case me expedited? And just to clarify that means sped up right? It will be my bad luck causing it not to speed up I guarantee.
And what are the USCIS reasons to process and Expedite??

Sorry for all the questions I am new to this and not to good with law (Med student!) so I am having a huge difficulty understanding things... I hired immigration lawyers to help because doing it on my own would be awful, and now I am glad I did blush.gif ..

Don't be confused, I think they were just saying that the only way it could be faster was if it was expedited, but that is really hard to get. Usually reserved for military personnel who are put on active duty, so you didn't miss anything. I'm in med school too, but luckily we did all this before I started. No idea how you are doing it while in school! Yuck!

He can try a B2. It wont harm the K1 petition if he's denied, just costs the $$ for filing.

I dont want to start any petition until i know i have picture proof. I would like him to try to get a b2 to get him here to visit and to get as many pictures as we need. If he came here, he could stay for up to 3 months. If I went there, it would have to be about only a week long visit.. so I figure its more worth it if he trys a b2 before me going out there. I just dont know if they would approve a nonimmigrant visa(b2) after knowing he's tried an immigrant visa (k1) ... I thought maybe they'd assume he's trying to stay here permanently on a b2, when in reality he would be going back and we would file for a k1 after he goes back to his country.

If the b2 goes wrong with him, I guess I'm going to have to visit him for a short period of time, and get some pics of us together. If I go that route, I'm undecided whether I should do a k1 or a k3.

Thanks everyone who's helped so far!!

And about the security camera, when it usually saves footage (30 days worth of footage) the camera is very clear surprisingly. And it does do a "still" or you can also do a print screen from the keyboard button. I have seen previous pictures taken off the camera when people have stolen from the store. I really dont think anything can be retrieved though since its been 8 months now.

If you are considering the marriage visas, look into CR1. It comes with a green card, saves money and is taking approximately the same time as K3 now.

Look around on the reps website. A lot of them have a specific form to fill out for a service request or a number of someone to call. If you don't see that, then just contact the office and they can point you in the right direction. And I would contact them ASAP. WHo knows how long you could be stuck in this limbo. My mistake. I guess I should have been more clear about my son. He's actually my step son. Over time I've come to love him as my own.

Evidence of meeting would be the plane ticket, passport stamps etc you have over the last 2 years. Include the pics and stuff to enhance the evidence of meeting and relationship.

Have her sign the paperwork when she is visiting you. The signatures need to be original, not photocopies or e-mails.

Regarding Guam, you can marry anywhere in the world and file for a spousal visa, no need to fly anywhere in particular. Benefits is its a bit cheaper and she would have a green card upon entry (as would her son assuming you go CR1). Down side is it takes longer.

For her son, he would need a K2 if you went the fiance route. I'm not too sure about how that works since neither of us has kids, but I believe he is listed on the K1 petition (I-129f). Read the guides for more info about it.

do I need to send the:
1) I-134 now with my last 3 years of tax returns?
2) the letter of intent from Julie?
3) the pictures of us?
4) phone bills & emails?
5) the G325?

please help I am just burnt out right now and cant even think straight!!!

Very wrong time not to think straight, mistakes can be very costly.

You don't need the tax return forms at this stage, they are meant to be taken to the interview. You will definitely need to send the letter of intent from both of you. You need to definitely send picture which show the both of you together if they have dates on them, within the last 2 yrs. Phone bills and emails are for the interview stage and the G-325A is needed as well.

Just calm down and sort it out, so do it when you are not stressed or burnt out. All the best.

Not sure how you meant the bit about the G-325a, but it is required at the initial filing. Sorry if I'm repeating what you meant, just wanted to clarify. You need to include all 4 pages (original, NOT photocopied) from both of you.

Photos are nice, but make sure you are also sending primary evidence of having met, such as passport stamps, hotel bills, ticket stubs, that sort of thing.

Regarding a binder, its a waste of money. It will cost you more and they will jsut take your petition out of it and file it in their own system. You aren't going to get denied because you didn't send in a hand made caligraphy scrapbook of your life smile.gif As long as all the required documents are included and in a relatively sensible order (like what you list on your cover sheet) you will be fine.

K-1 Fiance(e) Visa Process & ProceduresI-129 for Fiancee - Specific Questions
1. Sort of. You are perfectly allowed to come to the US and get married. However you can't stay and adjust if that was your intention upon entering the US. So if you want to come and get married and then file a spousal visa, that is fine.

2. Since she has legal residence in canada, that is where she would interview. It shouldn't make any difference on the US side regarding which country she is a citizen of.

3. Usually around 3 months, but it varies a little bit. That is for the I-131. You can file for this along with the paperwork for the green card and it is included in the price. There is no reason not to file for it when you file for your GC. Not something to be avoided. Some K1's get approved for their GC without an interview, but best to assume you will have an interview and may have to wait for 6 months or so to get an interview and be allowed to travel otherwise.

4. Yup, apply for those two and the AP. All included in the I-485 price

5. No idea, if no one comes by, go over to the Canada subform and ask there.

K-1 Fiance(e) Visa Process & Proceduresevidence of relationship/support
My husband was studying in the US when we met, so I submitted his visa/passport stamps, some paperwork he had stating where he lived. I also submitted an official school thing stating where I lived (since I also lived on campus). I also sent some pictures and I think we had a hotel receipt together I sent in. What you have looks good for the US stage of the process. Obviously the Morocco embassy is a tough one, so make sure you get advice from the couples going through that embassy to weigh in when you get to your interview.

K-1 Fiance(e) Visa Process & ProceduresFiancee had J1 Visa, Will this cause problems???
QUOTE (bigkeeser @ Apr 5 2009, 02:52 PM) <{POST_SNAPBACK}>
Hello everyone,

I've been reading posts here for a while now, but this is my first post! Let me start with some background info to make this easier. I'm in the military and have been stationed in Germany for the last 3 years. My fiancee is a German citizen and is still in Germany. She spent last year in America on a J-1 Visa as an Au Pair. I believe that part of her trip was funded by a 3rd party company (Au Pair in America). She returned to Germany in July of 2008. I'm set to return to the States in December. We want to apply for the K-1 Visa as soon as I return.

My question is: Will the J-1 visa interfere with getting a K-1 visa? I've read another post where others were having problems and had to wait for a 2 year period. I think it was called 2 Year Home Residency Requirement.

If you can answer that question, I have a few more... Can I start the K-1 process when I get back in December, and just have to wait for a final approval after July 2010?

And yet another question.... She plans to visit some friends in the States this summer for a 2 month period on a regular tourist visa. Will this add to the potential 2 year waiting period?

Last question, I swear! After hearing our situation, would getting married in Germany before my return to the States, and applying for a K-3 Marriage visa once a return be a better alternative? I do not know if this 2 Year wait would also apply for a K3 visa.

Thanks for reading my long post.

Q1: Not sure, some are some aren't. We checked my husband's visa and it didn't have that checked and he met none of the conditions for the 2 year.

Q2: You can file any time you like, even if you are out of the country. Not sure how the military side works, but regardless you can just get paperwork sent to a trusted friend or relative in teh US in case you get an RFE or whatever.

Q3: I don't think a short visit would add to the 2 years

Q4: 2 year wait applies if you have it and CR1 or DCF would probably be better options for you right now

QUOTE (josh383 @ Jun 10 2009, 05:03 PM) <{POST_SNAPBACK}>
Thanks everyone for your quick responses. I was told that she was going to be denied by an attorney who turned up in a google search on the subject, he said it would be denied without a question...the only way to avoid it would be to withdraw and refile using the coporate name of the company who owns the bar...I have since consulted several other attorneys who have told me it will not be immediatley denied, I am planning on retaining her (the attorney) services, which to me seems prudent at this juncture...and she only worked there for 3 mnths until we met (outside of the bar), and no she never collected any bar fines...if that seems a bit defensive, I guess it is, and that's because I love her with my whole heart. 1 more thing, the first lawyer wanted $2800, the one I decided to go with, who has just helped a couple in a similar situation as my own, only requires $1000...

I think getting a lawyer in this situation is a good idea. Make sure, if you haven't already, that you have checked her out and she has plenty of experience with K visas from the PI. I've heard the price of lawyers being from around 1000-3500$, so she seems on the lower end of normal.

K-1 Fiance(e) Visa Process & ProceduresI Need A Help
Keep in mind that you will need to spend several hundred to thousand dollars just to get the visa, then you will need to afford the plane ticket over and then afford over 1000$ for AOS when you get to the US. If your fiance does not currently have the money for an apartment, I don't see how you two can afford this process (unless you have enough to support you both for a while). Keep in mind when you get to the US it will be several months after you pony up the 1000$ for AOS that you will get a work permit and be able to contribute financially (assuming you can find a job in this economy). Technically you may be able to file and get the visa, but realistically I dont see how it would be feasible to to start this process at this moment in time.

On a personal note, moving countries, starting your life over, gaining a step-daughter is all a LOT. There's a HUGE adjustment for anyone who goes through that and it can really take a tole on your relationship. Is it wise to throw such huge financial issues in at the start of your marriage? That is something that you two need to talk about if you haven't already. Sorry I wrote a lot, I have a family member going through what your fiance is but she is getting a divorce instead of attempting to bring a fiance to the country. Hope I didn't get too personal smile.gif Good luck to you both and hopefully she can get on her feet and you can be together soon.

I usually just don't comment on these threads because I find them to be pointless and the individuals in them to be idiots, but Gary I usually respect your opinions and the time you take to help out posters. I honestly can't believe you can make such sweeping generalizations about me, my mother, my friends, my family. Yes, that one noob was totally out of line, but so were you. To me, being selfish, spoiled etc that you described me as being is just as bad as being a #######. You are definitely free to love your wife and find her character traits to be the most appealing, but I do not think you are entitled to an opinion about me and every female I know without meeting each and every one of us. Maybe where you live all the women are as you describe, but it is not that way where I live. If you wish to turn a blind eye to everyone around you and only see the bad, then fine, but that is your issue and you do not need to broadcast such hurtful and ridiculous views on a site that meant to bring US men AND WOMEN together with their non-USC loved ones. Again, sorry for what that one idiot said about your wife and all of her female relatives, but please realize that for me you jsut did the same thing.

K-1 Fiance(e) Visa Process & ProceduresJust a word of advice!
That is so true. Expect for something to go wrong and delay you getting a work permit. I don't know how anyone can plan on sitting around not driving, working, anything for at least 3 months! UGH! At least my husband could drive and I could be home a lot, so it wasn't too bad for us. If your spouse will be working a lot, expect to be VERY bored and make plans to find something to do.

K-1 Fiance(e) Visa Process & Procedurestiming??
1. the London embassy will work within reason to accomidate flight and wedding schedules (at least they did a year or so ago).
2. Don't plan anything in the UK until you are here and have filed for AOS. AP usually takes 3 months, but you could get unlucky like Gary and take longer. AOS is extremely variable. Some people who filed when we did got their GC in 3 months without an interview. We filed in September, interviewed in Feb, were put on FBI name checks (which they have sort of fixed now) and got the green card in July. there were some individuals who were stuck in name checks for 3+ years on here for a while.

Honestly, don't bother to plan anything stateside or in the UK if you haven't even sent off your petition. Wait till you have been approved for NOA2 before you even start putting deposits down.

Just to throw it out there, I noticed you said you are living in Europe right now. If you intend on bringing your fiance back to the US soon, you will need to have filed your federal taxes. A lot of people living outside the US forget or do not know that they are still required to file, so you might want to do this soon if you haven't already.

To be honest anyone can hit snags with name checks etc. We had issues with my husbands very uncommon British name, who would have thought. There are no guarentees with who will or wont. Just wait and deal with what comes and cross your fingers you don't have any more wait than the rest.
