at this current time i have not got a job, would this hinder anything at all and what things would i need to do if i submit the forms while having no work and get a job later?


Your income doesn't matter, it's just hers that matters since she is petitioning for you. The USC is financially responsible for bringing over their SO.

Regarding your fiance wanting to plan the wedding, keep in mind you have 6 months from the date you get the visa in which you can use it and then you have 90 days after you enter to get married in. This gives you a total of 9 months in which to play with, a totally do-able timeframe for wedding planning. My husband and I planned our wedding (typical US wedding) in about 2-3 months. I looked ahead and talked with the vendors I liked and explained the situation. Once we got his interview date I put downpayments on the places we liked as long as we could move the date within a year (still a risk but one we were willing to take at that point). He moved over about a month after he got the visa and we got married a month after he moved. We got married on a Thursday and everything was open then plus we got lots of discounts! Don't be limited or tempted to break the law based on the time constraints. Another option a lot of people do is to have a courthouse/legal marriage shortly after arriving, file AOS in time and plan the big wedding for later that year or the next year.

Visas can sometimes be extended, but I think you need a more compelling reason than a conference. You shouldn't run into problems entering the US, especially since your reason for waiting was for work, which makes sense in this economy!

Your denial was based on not meeting a requirement, which you can now meet, so it shouldn't have any affect on a new petition. The only benefit of appealing at this point is that you might salvage the $455 filing fee if you succeed, but if you don't succeed you'll lose the fee and end up refiling anyway. Skip the headache and just refile.

Also, PLEASE use punctuation and paragraphs in your posts. Your post is extremely difficult to read.


Agree with you, except I think while there may not be a requirement to prove the beneficiary can't travel, common sense would dictate that if he can't travel, she would need to prove she couldn't get into the US on a tourist visa. If she could, then should could fly over, satisfying the requirement to meet. JUst because the USC can't fly to the beneficiary's country doesn't preclude them from meeting necessarily. Just something I think anyone trying to prove hardship should include.

I have seen some consulates extend the 6 months for very serious circumstances, ie one lady in the UK had to complete chemo. They aren't going to say ok though for frivolous reasons (I can't think of the examples I've seen like this, sorry). I would pursue this route first depending on what the situation is and see what happens, the worst they can say is no.

If you have to re-apply, that is possible and people get approved re-applying for the same person. If you submit 2 applications in under 2 years at the embassy stage I believe you may have to do a bit more paperwork, but someone more knowledgeable on that than I can tell you what exactly happens with that. When re-applying, in both the I-129f packet and at the interview give them an explanation of why your fiance couldn't leave the country in time etc.

So in short, yes, both options I have seen work, the first with varying degrees of success.

EDIT: Oh, and if you need to re-apply, the 2nd time would most likely take the same as the first. No skipping to the front for frequent fliers wink.gif

I still don't have a job and I got my husband a K1 over 2 years ago! My mom co-sponsored my husband as well. A lot of people get their loved ones here when they are in college (like me) or shortly after they graduate and have no problems. In this economic climate, more and more people are getting K1's with a cosponsor due to being laid off. The US doesn't care who is providing for the fiance as long as someone is.

I will be filing my fiancee's visa in just a few short weeks when I have all the paper work finished. her son who is 18 would also like to come at a later date. what is the process to bring her son also? I will have him listed on the I-29f and the I-134 when the time comes. will I also need a G-325a for him included in the packet? Will he also need to attend interview with his mother or at a later date? I know he will need the same documents plus a military waiver ( he already has). since he will probably travel here when University lets out for Summer, should we wait to adjust her status until he is here?

So, you'll interview in Montreal. The good thing is only 3 cities in Canada have approved doctors to do your medical and Montreal is one of them. Also, you should work on getting your long form birth certificate (google Quebec Long Form Birth Certificate) as you will need this and inquire about your police certificates. Those you can do now so you won't be scrambling at the end.

Diana, where in Canada are you? This will affect where you will interview for the visa. If you are in Western Canada you will interview in Vancouver. If you are in Eastern Canada, you will interview in Montreal.

I hate to be the bearer of bad news, but I think you're looking at longer than 5 months. Canadian consulates are incredibly slow at the moment, espcially Montreal who is averaging about 3 months for an interview.

Patience is part of this process, we've all been through it and thankfully they are moving faster than when we were processed

Diana, I don´t think there´s anything we can do to make the process faster, however, it seems like the packages sent in april, may and june are being processed very quick, and that makes me very hopefull...(see the timelines...do you have one?)
What do they want? a clean record, proof of the relationship...pretty much it!
As for documentation, there´s a pretty good load of information that you can find on this website....

Trust me, I know your pain...I wish I could be with my love as well, but since I can´t...I keep planing up our future...seing places we can travel...schools that I can enroll, jobs that I might be able to get...and alsoooo...there´s a long journey until the green card...

I also just got my NOA1, and I am anxious about this process as well.
I think the best we can do is to gather all the documents, take our shots, do the medical exams, and also organize our lives...I mean...I have so much to before I leave, like drop school, work, cancel bank accounts...pass my car to someone´s name.. and I guess you probably have a lot to do too.
Also, I am trying to enjoy my loved ones as much as I can..it will be hard to say good bye.
Meanwhile, we all have this website to dispose our anxiety!

Hi Everyone! Im a new member! How is everyone!? Im from Canada, my name is Diana. My petitioner is from the U.S. We filed the I-129F form for the Fiancee Visa. He recieved the confirmation #. And now we are waiting. Im squeezing my brain to see if there is anything we can do to make the processing times easier and faster. I hope I dont have to wait 5 months. And I hope I get approved. Any advice? opinions? Anyways I miss him so much. He came visit me last month. I wish I knew many things I know now. And I wish people would have advised me and told me stuff like this. Darnell, many consulates do not accept "packet 3" and nothing is sent to them. Kiev and Moscow are examples. I do not have specific info on Warsaw but would not be surprised if it is the same. With these consulates you simply call and make an appointment using your NVC case number, then bring your "packet 3" with you. I am fairly certain this is the OPs predicament. The case has been closed and sent away. When he tries to make an appointment they do not have that case number. Senind a "packet 3" to Kiev or Moscow, for example, would just confuse people, they would have no clue what to do with it.

IF the child was listed on the original I-129f petition and was listed as a FTJ on his mother's K-1 application then the consulate has made a big error. Government agencies of any persuasion should never be expected to "self correct" their own errors. The OPs best bet is to contact someone that oversees the agency...his representative or inspector general.

The OP should be documenting ALL of this also as it could possibly provide a defense to not complying with the age out rule and even allow a green card to be issued after age 21 because of their incompetence.

The OP needs to DOCUMENT and contact the proper authorities. Lawyers cannot fix this for him, BTW, they can only drain his pockets and give bad advice.

When I applied for my original 129, I listed my now wife as the K-1 and her son as the K-2. All went well. All emails and letters from the Warsaw embassy showed both of them on the paperwork. Her son could not attend her interview, but would follow a few months later, because he was in the army and now that he is out I asked the embassy to schedule his interview.


When I called today, I was told the they have closed the file, sent it back to Washington and her son cannot apply nor is eligble for the K-1. They said that they have no record of the son even though I told them I have all their letters showing the son's name. Basically they said too bad.

Even worse, the son will age out shortly, this Novemebr, so I dont even have time to file a new application if I even knew how to do this.

Can anyone give me some solid advice here?

I would rule out Mexico due to most flights from the UK have to stop off in the USA to Re-Fuel or pickup more passengers, therefore requiring the UK citizen to travel freely on the Visa Waiver Program which in this case he is unable to.. As for Bermuda.. I would not do this as I would want to know that my marriage certificate was valid for immigration and I am not sure if Bermuda is a valid location for this.. Canada on the other hand seems like a very good choice as you only seem to need to obtain a marriage license costing $130 Canadian Dollars and then you can get married at anytime.. well that was my take on the research i just did, I could be wrong.

But good suggestion.. note that if either of you have been married before then the Canadian authority will require a minimum of 4 weeks notice to check the marriages are dissolved along with documented proof.

ANY person can be denied entry at ANY time. Even when you have a VISA you can be denied entry.

To visit you need to be able to show proof you will return to Canada. And just to clarify, when you get your visa you will NOT have to show proof you will return.

You can call 1 million people and the answer is the same. NO ONE has a guarantee they we will be allowed entry. So what? Canada is the same way. We are planning a trip to Montreal for the day Friday but we MIGHT get refused entry to Canada. I am not losing sleep over it.

If you want to visit, put together some documentation and visit.
