I got a few notices in the past year. Only one stated I797 Notice of Action.
Our process had many long period of silence. Most of time calling did not help and the website never was correct. There have been times where I could not find out the current information on our papers. It is not an easy process. I would not assume anyone lied without some solid proof. I remember being told no interview date was set on the phone. The next day the letter for the interview arrived. The letter was date 7 days earlier!

That's what I was thinking. But wanted to know what other people think about it.

I just don't understand how the firms that advertise proxy marriages suggest
to get proxy married and use marriage license in K-1 visa application process
to show seriousness of the intent.

At the k1 interview in Moscow, it did show very serious intent. They did not look at the emails, phone record or photographs. They saw the marriage license and supporting papers for the marriage. They checked the support papers. Ask her a few simple questions and told her approved.

You are either married or you are not. You can not be a little bit married for one purpose and not others. It's like being a little bit pregnant. There's no shade of gray when it comes to being married.

In order to qualify for the K1 visa, the beneficiary MUST NOT BE MARRIED AND BE FREE TO MARRY. Your wife would not be free to marry, so she cannot qualify for the K1 visa.

If the proxy marriage (unconsummated) does not confered by Immigration the status of spouse, then you can not apply for a K-2/CR-1. The immigrating spouse need be processed as a nonimmigrant fiancee (K-1). The couple are legally married at the time of the proxy wedding. They need to comsummate the marriage within 90 days after POE. If marriage is consummated before POE, cr1/k-3 is used because status of spouse is confered.

You will also need to bring the details to the adjustment of status interview. Save every paper from the wedding and bring to the interview. The Columbus Oh office did not believe a Texas wedding was even legal if done as a proxy. They also needed to be given a copy of the U.S. Department of State Foreign Affairs Manual Volume 9 information of the proxy weddings with link to offical government website.

Don't know if they do that in Colombia, but in Germany they went over all the papers with me at the Interview, and asked if I had to make some changes... so if you don't here anything from them, take a corrected form with you to the Interview, and tell them that you did those 2 errors... no reason to freak. If you do can't wait until then, just send them an email, or mail the correct forms with a note.

In the letter that I got from USCIS it says, if I dont hear anything from NVC in 30 days, I should either call them or write them an email. I got the letter from USCIS on July 20th. Also, I contacted my lawyer that's helping me with my case, and she said it usually takes the NVC office two weeks to enter your case in their system before you hear from them. Just like you, I'm patiently waiting, at least trying to :) :)

We got NOA2 on July 11th but then on the 25th we got this email:

Your Case Status: Post Decision Activity

On July 25, 2011, a USCIS office received this case from the State Department with a request that we review it. We will notify you when we complete our review, or if we need something from you. If you move while this case is pending, please use our Change of Address online tool to update your case with your new address or call our customer service center at 1-800-375-5283.

For approved applications/petitions, post-decision activity may include USCIS sending notification of the approved application/petition to the National Visa Center or the Department of State. For denied applications/petitions, post-decision activity may include the processing of an appeal and/or motions to reopen or reconsider and revocations.

We called NVC and they said they got our approved case then they send it back for review and we have to contact USCIS for more info. Then when we contact USCIS they didn't give us any reason why our case got sent back and told us to wait for 120 days. It took us 6 months to get NOA2 now they told us to wait for another 120 days. Anyone have any suggestion?


Wait until you get a letter from NVC office of what you should do next. Im waiting on the same thing!! Good luck!

We sent our k1 packet out on 1-10-11 through UPS to the same location (texas). It arrived on 1-12-11 at 10:30am and was signed for by CATES. We still have not recieved any notification regaurding our packet. I know how you feel I was expecting some type of notification just to let me know they actually have it in the right office there. Hope we hear something by the end of this week. I just want to know this process has started so I can get on with the wait. :whistle: lol.

K1 visa: Trying to check in early for my flight today online. Not sure how to answer questions that are asked when trying to check in. Question is "Do you have a permanent resident permit or alien resident card. Yes/No. If answered no then states you can not check in because ESTA was not done. If marked yes then asking for a number but the K1 visa number does not fit in entry area. Can anyone tell me what to answer on this or do I have to check in at the counter at the airport? As far as I understood a ESTA was not needed cause k1 visa approved and in hand.

I remember from long ago you had to interview in the country you married in. Is that true of the CR visa also? So this is another thing to look at if you want to go back there for the interview or not.

You will need to show proof of finances at the interview (8-9 months or so if you were to file now) and again when you file for the green card. I can't remember if you need that at the interview or send it with the AOS package. Also the I-134 is not legally binding, so if you envision having a job with enough income around a year or more from now, you could have your sisters co-sponsor the I-134 and then you can independently sponsor for AOS.

Congrats!!! Did you get your NOA2? We had the same problem a previous poster did in that they didn't send a bunch of NOA2's out at one point. You don't want to talk to the normal USCIS people since they can't see anything special on their screens. You want to follow the prompts for an RFE and that will put you in touch with someone at the service center who can see more information and make changes for you. That is who you want to talk to about your NOA2. They will charge you otherwise. They probably thought since you hadn't been approved, you shouldn't have your NOA2 yet.

If you look at the website, timeline etc.... The guy "Dan" is the beneficiary... and it says he called the US embassy for some forms? Im just wondering what other things do I (the beneficiary) need to gather apart from everything on the I-129F.


Just clicked on it and it is from 03. I would just ignore most of that stuff since it is so old. Lots has changed since we went through London in 07. Look on here for more updated experiences.

If it were me, I would submit with that and take my chances, but there is no guarantee when it comes to this and they may or may not take it. I would also submit an explanatory letter that fully documents the trip and the loss of passport. Include any evidence of your lost passport (I'm assuming you reported it missing and have some documentation of that). With reciepts from the country during the time your itinerary shows you were there, luggage tags, a hospital bill and pictures I would think that an explanatory letter and proof of stolen passport would make a complete picture.

National City agreed to do it, but we went to a small branch that had the time. The guy had to go through each statement from the last year, month by month and add them up. He then wrote this on a piece of paper and signed it. If you feel you really need it, maybe gather your statements for the last year, highlight the deposits, add them up for the guy and see if they will simply write you a statement with the info you provided and sign it. I think income requirements would prove to be easier though. Good luck!

We had a very similar situation and aren't big picture takers either. I submitted all the evidence that he was at the university the same time I was, all his visa paperwork from that trip, all the passport stamps from our visits and I had a few photos I sent. We knew we were going to have to go through this before we filed, so I made sure to take pictures more than I usually do. We had an easy embassy though, so lots of evidence of our relationship wasn't needed at the interview.

I agree that at this stage it is her responsibility. However, the excessive number of calls and the near re-schedule needs to be addressed with her. If she is going to take an active role, she needs to better understand the process she's entered. Maybe tell her to draw up a list of questions she has over the week, discuss them with her and then if she is still in need to clarification, she can call with a better understanding of what she's asking. And if it's bothering you so much, this is an issue that needs to be addressed for the health of your marriage. I will tell you that when it got to the embassy, my now husband made no calls and the only time I called was about the interview date since I could do it for free here.

You either can't meet at all, which means C doesn't matter, or you can meet, in which case A doesn't matter. Before you decide anything you need to decide what exactly you are even asking.

Personally, I wouldn't send that at this stage or only send a page or two. Highlight the calls to your fiance. THey don't need evidence at the first part that you are a "real" couple, only that you have physically been in each others presence sometime in the last 2 years. For more strict consulates, sending in this evidence early can be useful but the UK is relatively strait-forward interview-wise.

Looks good. I would include a bit more evidence of meeting that is primary. Ie boarding passes, receipts in each others towns etc. E-mails and photos aren't primary evidence. Also some people like a cover letter.

Just a few things where people trip up: Did you include all of the pages of the G-325a? A lot of people just send the first page accidentally. Is everything signed in person, not e-mailed or faxed? Did you remember to sign the check? Did you make a photocopy of the packet for reference? Were you able to fit your "how you met" onto the I-129f? I didn't see that included, but some people can get it to fit on their forms. That's all I can think of right now. Good luck!

You can always send receipts from your time in China, copies of your luggage tags, etc. Regarding proof of the relationship, that tends to be country specific and China can be very picky. And yes, you are still eligible for the fiance visa. If they do recognize your time out of the program as unlawful presense, you just need to file a waiver at your embassy. Definitely look into if you DO have the 2 year rule applied, since if you DON'T, it would make much more sense to just marry now and directly adjust. Much cheaper, quicker and easier

Your income doesn't matter, it's just hers that matters since she is petitioning for you. The USC is financially responsible for bringing over their SO.

Regarding your fiance wanting to plan the wedding, keep in mind you have 6 months from the date you get the visa in which you can use it and then you have 90 days after you enter to get married in. This gives you a total of 9 months in which to play with, a totally do-able timeframe for wedding planning. My husband and I planned our wedding (typical US wedding) in about 2-3 months. I looked ahead and talked with the vendors I liked and explained the situation. Once we got his interview date I put downpayments on the places we liked as long as we could move the date within a year (still a risk but one we were willing to take at that point). He moved over about a month after he got the visa and we got married a month after he moved. We got married on a Thursday and everything was open then plus we got lots of discounts! Don't be limited or tempted to break the law based on the time constraints. Another option a lot of people do is to have a courthouse/legal marriage shortly after arriving, file AOS in time and plan the big wedding for later that year or the next year.
