if you come to the states and get married there is a waiting period before you can apply for a visa. if you do the fiance visa then you can get married and do what is called AOS for a green card to stay. her father can co sponsor her petition and u should be fine. just remember the waiting is a pain and very frustrating for some. if you use the guide as most of us have you should have no problems with submitting all the forms.

My fiance is from Ukraine and has a daughter who is 6 years old. Her ex-husband refuses to give permission for the daughter to immigrate to United States. He has been periodically active in her life and I am not sure if his refusal is out of love for the daughter or a last attempt to control my ex-wife's life. He has refused any offer to persuade him to change his mine (including money).

My fiance has been told it is unlikely she can win a court decision to allow her to immigrate with the minor because he always paid his required support and the courts are reluctant to terminate a fathers rights in Ukraine. I would agree with the courts if the father had been more active in his daughter's life, but now I honestly believe she will be happier here. I just don't know what can be done?

Anyone have any advice if the father continues to refuse to give permission?

I really don't see how a lawyer can help you at the interview. If your fiance's financial stuff is standard, tax returns and W-2's, and you have a real relationship, proof of that.
I'd tell him to keep the money and spend it on you when you get there...LOL

It sounds like you've basically completed all of the work already. What exactly is it that the lawyer is going to do for you? Maybe put a stamp on the envelope and drop it in the mail? Is his "friend" planning on flying to the Philippines and going to the interview with you? As long as you bring all of the required documentation to the interview you should be fine. The questions they ask are based upon what most people in a legitimate relationship would normally know about each other. If you haven't already, check the VJ Wiki for a listing of likely questions for the interview.

No, he's not flying here to the Philippines upon my interview. He said that he just want to guide us coz the tough part is upon my interview here in Philippines coz Consulates are strict and wanna make sure this is not scam/fraud, but I told him that we don't have anything to worry about coz we've been together for 2 years and I've been to his country should've married him in the first place when I was there but I just wanna do it the right way since there's nothing to rush. I fully agree here. I have 2 very close friends who are specialized in Immigration Law. One asked me for documents that are not necessary at all which drove me crazy trying to locate the records myself while he was working on USAF Base Iraq (his HS Diploma for an I-129F??) . Not to mention the $$ fee $$ she was asking was ridiculous to say the least and 'that was with a discount'. Ahem. My other Legal Beagle Immigration friend told me DO NOT HIRE LAWYER unless needed for a serious and difficult problem, such as the 5% mentioned above. As stated earlier, if you can read and follow instructions exactly on what the USCIS requires, then you should have no problems. If you don't have what they require, no worries, they send you an RFE, and you just send in what they want. If your fiance's lawyer friend was sincere, he'd of told you both you really do not need him, in my humble opinion. Besides, you'll get a ton of questions answered here, with much support. (F)

Lastly, and this was total coincidence btw, one of my childhood friends and her husband work for USCIS and basically they told me that the process is systematic. For us, with the I-129F (actually all Visa apps), they are looking for proof the relationship is not fraudulent, or a scam. And, that most everybody eventually gets approved. Oh... lol, and that they don't like lawyers. LOL LOL :lol: So save your hard earned $$ for the future fees you'll encounter with the VJ. Best of luck to you both, Mari and Kadir

Thanks for telling me that they don't like lawyers :lol: you saved me there....Yeah we're almost pretty done with the forms and I'm ready to send him the signed docs too (thanks to VJ for guiding me through that process). We have a lot of proof like pictures and boarding pass coz I've been to his country and he's been here too. Though right now I'm not so sure if he should keep the original docs (boarding pass,plane tickets,food stubs,etc.) just in case USCIS will ask for them or is it me for the interview here in the Philippines if I'll get approved. I'll be mailing it to him on Monday so just wanna make sure I send him the correct stuff. Thanks for boosting up my confidence :dance:

A lawyer guarantees only that you'll finish the process in more time and with less cash. It will take more time because the lawyer can't fill out any of the paperwork without first getting the information from you and your fiance, and if you have to write this stuff down for the lawyer then you might as well be writing it on the forms yourself. You'll have less cash for obvious reasons.

For 95% of people this process is entirely bureaucratic rather than legal. There's nothing a lawyer can do to make things go smoother, unless you just happen to be particularly lazy and don't like reading form instructions. Unless your fiance's friend is an immigration lawyer then he'll be just as much a "noob" to this process as any of us were when we first started. Even if his lawyer friend reads all of the relevant federal laws, as well as the policy manuals for the Department of Homeland Security and Department of State, there are still things about the process that you can only discover with experience. VJ is a repository of the experience of hundreds of people over years of time. There is more collected experience and knowledge here than many experienced immigration lawyers have, and far more than any attorney who doesn't usually practice in immigration.

On the other hand, if your case is one of the 5% where there are difficult problems to deal with - an overstay ban, inadmissibility, certain criminal convictions on the petitioner's record, etc. - then you need an experienced immigration lawyer to assist you.



Thanks for giving me a clear view, I told my bf that I'll be checking here first before we make decision since we already started out with the process. Also, I wanna save the money for future expenses in this process. You're right the lawyer said that it might even take like 6 months to a year, upon checking the timelines here it doesn't really take that long. Our case isn't complicated I've been to US met his family and same with him he came down to my country to meet my folks no overstay or anything....thanks so much for giving me your point, really appreciate it. :thumbs:

hello, I'm a newbie :) hoping Visajourney and people here can help me and my bf. We're done filling-out I-129F, made Fiance(e) Letter of Intent for both parties, completed G-325A, Cover Letter...in short we're almost done, we're just in the process of gathering all evidences like boarding pass, passport stamps, plane tickets, chat logs and pictures so I can mail it to him same with the signed docs. But my bf is still thinking of getting a lawyer just to make sure that process will be smooth. He has a friend who works in a law firm and he offered to help us though I'm not sure how's the process gonna be with a lawyer since I've been using VisaJourney as my guide. His friend is just afraid that I might have a hard-time with the interview it's actually pretty cheap like $200.00, any advices please if we still need a lawyer or not....really appreciate it

hello VJ peeps, we're done with the forms...yay! I'm ready to mail the docs to my bf so he can send it to USCIS, but I noticed that there's an optional form G-1145. I'm not sure if this is really needed. Based on your experience would you advice us to send this with I-129F packet?

For the photos, I've read some of the topic here it's typically Date, Location and Name needed to be written at the back. My question is how many pictures do you usually include; our photos with me so I have to print it here in the Philippines I'll include it when I send him my other signed docs. We just don't wanna overdo my application if I send like 15 pictures in the packet. How many is the ideal number of photos? Also, who should have the original copies of boarding pass, ticket stubs, etc. I was thinking of sending it to him in the US just in case USCIS will ask for original copies but I'm also afraid that I might need it upon my interview here in Manila.

Lastly, I know this is a very simple plain question but just wanna make sure :) should we staple the forms that go together? Like the "I-129F Supplement of how we've seen each other" Or a big paperclip will do. I really appreciate any advice, I just can't wait to send the docs to my bf so it'll start moving. :yes:

hello VJ peeps, happy holiday to everyone! :) I'm almost at the end of the process of filling out the K1 forms and gathering the evidences, I never thought it's really gonna be tough but I'm sure it's all gonna be worth it. Thank God for this site and people here that supported me. ;)

Anyways, for the passport stamps I've read that all passport pages needs to be photocopied. So I photocopied everything, but I noticed that I have a lot of papers now (it's as thick as a book like almost hundred or so). Coz I've been to US twice so that means I have to photocopy 2 passport pages and that doesn't include my bf's coz he's also been here in the Philippines. My question is do I still need to photocopy my tourist visa? Like all the passport page again, coz my visa is in the 3rd passport. Also, do you think that the USCIS would mind if it's as thick as a book? I'm afraid that they'll get bored browsing through the pagesand they might think there's too many infos.

For the labelling, I highlighted the impt. facts like name, dates in boarding pass and ticket. Would you also advise me to add a post-it note and indicate what happened to those attachments? Really appreciate your input on this, I'm hoping to send this after holidays coz it might just get lost in the Post Office. TIA :dance:

Hello everyone,

My name is Barnabas (using my baby's account) and I live in US, while my baby fiance lives in the Philippines.

So, I'm doing my taxes this year (I filed for an extenstion), and I know that I need to make 125% above the poverty level. My income was just below that (18,110).
So, I was filing on TurboTax and I wanted to add in some rental income that I had received from renting a spare room out of my home. However, when I was filing on TurboTax, they asked me about various deductions I could claim for depreciation, repairs and maintenance to my property. After adding everything up, it seems like I spent more money maintaining and repairing the house then I made in Rental income.
Therefore, 2 things happened.
1. My refund went up to a decent amount
2. My AGI (Adjusted Gross Income) went down to $15,000 something.

So, obviously I was happy about getting extra on my return, but I'm afraid the lower AGI will be viewed negatively by the people processing my claim when they decide to look at my income, even though my actual income was $18,000ish.

So I have a few questions.
1. Should I definitely find a way to boost my income for 2010 (through rental or whatever) to increase my chances at getting approved. I don't know if 18,110 is close enough, or I should definitely be above the minimum, 18,330 or whatever...
2. Should I exclude the deductions for my rental property so my AGI on my Tax forms stays at 18,000 +? I'm assuming that I should, but I just want to confirm that.

Also, even though I have my forms almost completed on TurboTax, and my refund will barely be anything after paying TurboTax, I'm wondering if I should just take my stuff to a Tax Attorney and spend a bit more to have them prepare it and make sure it's done properly, since this could be one of the most important tax filings I'll ever do!!

wow you really went out of your way to have this expedited Posted Image we actually have the same submission date of filling. Seems that CSC is working fast and approval is right around the corner. I hope your fiance and her family will be okay, I live in the Philippines and been to Mindanao but it wasn't too bad for me. Maybe you can also ask her to start seeking the necessary requirements such as CENOMAR, passport and her NBI clearance just in case you guys are gonna get approved. I'm sure this will still be valid once you receive your approval.

By the way, how'd you know the vaccination/shots that will be needed? I was also thinking of having these before the Medical (probably a lot cheaper) Thanks and Good luck on your expedite

well, there's Igor's list you can check fellow VJers timeline but there's really nothing specific like 'this is the date they're working on now". We only have estimates, keep in mind that probably we're only a part of the people who filled petition. If you check the link it seems that it's random, some people gets approved sooner, some later. Check the posts some people even got approved less than a month but for me I'm waiting more than 3 months now. So I guess better not to expect since you're on your 2nd month but once you hit the 5 months mark that's the time you make a call and follow-up. Posted Image

Do you guys think that we need to include his Real Estate to help us back up his Salary which is almost below poverty line? Do we also need to put his insurance amount?

The person who is filing for the K-1 (Your fiance' has to submit one)

And if you don't meet the requirements for support then you need a co-sponsor which is anyone willing to do it.

I didn't have a job at the time when we filed for k-1 so my brother was our co-sponsor. But the American fiance' still has to submit the paperwork as well as the co-sponsor. Not sure if you can use a resident though.

I don't know how it is in Jamaica, but I didn't have to go to my husbands interview in Denmark. I did go, but I didn't have to. There were no questions directed at me, they were all for him. You may need a co-sponsor if you don't meet the guidelines.

Hi,

I know that when you change your address from the address that were on the K-1 visa forms petition you need to let USCIS know, but what about a drivers license change? I am not changing my address. My address will remain the same to what I filled out on the I-129f forms etc, I will just have a different state license and license #.

I used to live in MI but moved to OH ...not bothering to change my drivers license since it was still valid etc. When I filed the fiance visa petition I put the new OH state address that I was living.

So will this matter? Do I need to tell USCIS?

Hi there,

So i have been reading the posts here etc, and decided to take a look at the forms I submitted for the K1 visa. I took another look at the I-129f form I completed for my fiance and I, and I noticed that the question about "list all children of your alien fiance" I put none.

At the time of filling this out, I read it as children who will be accompanying him over to the USA, but upon further investigation it looks like it meant all of his kids even if they are staying in England.

Which one should I have put? :blink:

Special note: On his kids birth certificates...he was never listed as the father

Will I get a RFE or was that lying if I misread the form?

I forgot to say....his kids will not be coming over to the USA with him. They are going to remain in England.

He did one of those sites and it just gives him this number he claims is the volume number and page number.

I agree with what everyone else is saying....instant message, Skype (Skype has been a life saver when you can cam and see each others faces!) I send him packages a lot, and he does too. When it is special events where gifts are involved we open them on cam with each other. We do phone calls. I think communication is the key...and the visit when it can be afforded.

We are getting closer to the end (hopefully) and we are getting more and more anxious, so its really tough. I saw my fiance last at Christmas, and I miss him so badly it hurts!

Hang in there...this waiting is SO worth it. Nothing comes easy, but the things we have to fight for are often the most rewarding.

I just wanted to vent and say that I am SOOOO anxious about getting the NOA2 approval for our fiance visa. Its getting to the 5 month mark, and I know sone have gone over that, but I am getting super anxious. I check the status every day...multiple times a day, hoping and praying I see approved. Its like I have NOA2 fever!!!

I called to check on the status...I know maybe pointless, but they told me the EXACT same thing they did last time I called - they are processing October 16th applications, and in 16 days I will be outside normal processing time.

The operator suggested I call back in 30 days. Yeah right...im calling before then. :wacko:

So my question, because even if you ask nicely you might not get it, how do I request a service request?
