Hi guys, I'm Australian and I lived in the UK for 2 years and also Canada for 2 years on Working Holiday Visa's and now I am applying for the K-1 visa and I will now need Police Criminal Background checks in both countries for the NOA2. I'm based in Australia at the moment and while Canada is pretty straight forward in getting the background check (I can get my finger prints taken in Australia at a local police station and mail them to Canada) the UK is almost impossible to get any information on which department you send it to or application forms...If anyone has gone through that process I would love the help! I will help you with this one!!! We just got a police report from the UK ...

I don’t know if you will have this problem from where you are but the problem I had was we couldn’t find any bank that would transfer dollars to pounds... You have to send a UK postal order, UK check, or a Bankers Draft (cashiers check from the bank) but what the police report doesn’t tell you is that you can also do a bank transfer from your bank to the police station. It is a lot cheaper is you have a friend who lives in the UK and they will transfer funds for you then you send them the funds. The Bank transfer from the UK to the UK is free where from the US it was very expensive to transfer funds!!! Very very expensive!!!!

But really the report is pretty self-explanatory… Here is the email address of the lady I was speaking with at the police station she is very nice and super helpful… and the UK will email you back no matter what time you email them… it great actually…

Hello. Can my fiance, who is in Canada now. I am in the USA. Can she sign and date her forms and then email me copies of them to print out or do they need the original copies with the actual ink on them. Asking so that we can save the time of her mailing them to me hopefully.

I am hoping she can just print them out herself, sign them, scan them, email them back to me?

yes that is all good.... i sent in train tickets, plane tickets, atm print outs (with a copy of my debit card copied with it)... i was also told by our lawyer start to buy things for the wedding so we had reciepts to copy and send in... i bought a wedding dress and it only cost 18 dollars... and shoes... stuff like that...

the more the better is how we felt i guess

I am the petitioner but I am going to fill out the DS-156 non-immigrant visa application form on behalf of my spouse and then send it to her. Quick questions:
1.) It asks things like how long the applicant intends to stay in the US and if they intend to work/study. Obviously, the purpose of my fiance coming to the US is enter on a K1, marry and stay forever and to work/study later on... but since this is a non-immigrant form, should the answer be something like "3 months, for duration of K1 visa" and that she doesn't intend to work/study?

2.) There is an area to attach a photo to the DS-156 form. When she comes to the interview, should she actually attach the photo to both DS-156 forms (duplicates are required), or should the photos be brought separately? (I am aware that bringing photos to the interview is a requirement, I am basically asking whether that requirement is talking about these same photos on the DS-156 or in addition to these photos?)

3.) In the field where it asks who this form is prepared by and what my relationship to the applicant is... totally okay to put my name and say I am the fiance?

4.) There is a part that asks about the applicant's current job or study. If she is neither working nor studying at time of application and so leaves this blank, will this effect the outcome negatively at all?

5.) Should a separate DS-156 be filled for my fiance's daughter (my step daughter) ?




I believe it says to fill out everything for everyone... and even if they dont need it,its better to have her name on the form than find out you need it in the end...

I just sent our stuff the the VFS office and we didnt attatch a phote to it, we put a baggie of photes with the file...

make sure you mark every line.. put NA if she is not working or not studying...

as far as putting your name, yes be 100% honest, you are the one who prepared that form or help prepare the form so be honest

One more :) There is a part that asks whether anyone has filed an immigrant visa petition for her before. I assume she will put yes and put my name, since by the time she is filling out the DS-156, I will have already filed the petition for her?

I need some help please.

I`m Erika from Brazil and I need your help .I had my interview for K1 visa on 07/24/2012 and the consul asked me more proof of my fiance`s support .. because in 2011 he stayed in Brazil for 10 months and just declared 2 months of taxes ... Anyways i went back to the consulate in the same day and I took with me the paychecks that shows from january till july of this year he made $35.000,00, and after two weeks waiting for an answer, I got an email saying that I wont get my visa yet because I still need to send those documentos:

But what I dont understand why they still want those documents if i took in the interview ... What do you guys think Should I do right now ?? Should I send again the same documents ??? I have doubts because They didnt make clear if i need a co-sponsor or something like this .. I guess if they wanted it they could say right ?? .

Sorry, I have not yet given interview. Before few days of interview date I (in India) have to submit the above documents to the local USA VFS office then they will review it before my interview. So here the lady didn't take few documents as I told(may be she is new to the office). So I am worried about why she hasn't take? And is this going to be a BIG disadvantage?

the whole things usually takes between 6 and 8 months... Ours was just about 8 months total to the day of the interview .... and even though we have an interview date the USCIS web page stills say initial review... that will never change... call this number and talk to a person there 1-800-375-5283 but even those people sometimes dont know anything either... good luck

Just a quick question:

While waiting for Robb's interview date I'm going through things with him like a mad woman trying to make sure everything is neatly compiled and prepared. While doing so today I simply looked up "Packet 3 New Delhi" on Google and came across this site: http://newdelhi.usem...acket309k1.html . On this site it says that he'll need to have the DS-156 but when I asked him to check the paperwork he specifically received in his original packet 3 there seems to be no mention of it. What gives? Do we need this form or not? Just like the many others out there we're desperate for this to go right.. thanks for any help you can provide!


In Mumbai I made sure that my fiancé had everything and I made sure it was in the order of the check list too... but I’m sure you’re over thinking everything because that’s what we did too hehe... just remember to tell him to be calm and breath and be honest with the interviewer... but yes I agree with everyone on here I would have that form ready just in case they ask for it... I would rather you be over prepared than under...

My fiancés interview went by very quickly they only asked him 4 questions:
What is your fiancés name?
How did you and her meet?
Why would a well-educated man as yourself choose to be with someone like her? (I was shocked they asked that actually)
How do your parents feel about you marring her?

Remember they already have all of your paperwork on their computer from when you send stuff in, and if the USCIS didn’t request any additional paperwork then you guys should be good as long as you follow what’s on the check list...

I sent $150 dollars’ worth of paperwork to him via FedEx and they didn’t look at anything I sent him, not one thing!!!!!

our lawyer said to be calm and to remember that this is just there job, they have to do it, but that the embassy wants to approve you even if they act like they don’t, they just have to be careful on who they let into the US....

I agree with the others you could always try a spouse visa. But your fiance still needs to get a job regardless! One cannot survive on only one income in the US anymore - unless perhaps the one income is from a wall street banking gig. What is your fiance's education level? Could he attend job counseling? It's definitely not easy getting a job these days, but if you are persistent and dedicated then eventually your number will come up. I speak from experience.



I disagree with you about living in the US and having to have 2 incomes... We only have one income and we are fine, it’s about not living beyond your means and learning to budget your money correctly... they could live on one income here it is possible... We live a modest life in a nice home and have vacation still and go back and forth to India as much as we want... Don’t buy into the whole you need 2 jobs thing in the US… where there is a will there is a way remember that and god bless and good luck…

get passport pictures from her is a big one... i had to wait to get them from my fiancé after i left him...

i took the most recent phone records, skype records, emails, gtalk , chat records to my fiancé up to the time we met for him to keep for his interview. that just cut down on the amount of paperwork i had to send him and stuff.

you will need a paper saying you plan to marry within 90 days of her coming her, i would type that out and have her sign that before you leave and bring it with you.

our paper said:

I ____________ plan to marry _________________ within 90 days of him reaching the US. We are both free and willing to marry each other

also she will need to sign the forms you have to send into the USCIS, print the forms out and make sure she fills them out and signs them before you leave.

Hello Everyone,

This is my first post here. Thank you in advance for this great resource.

I am pulling together my application materials for a Fiance visa and I am wondering how important it is that I provide written exchanges (chats/letters/emails) as proof of our ongoing relationship. We have been together for three years. Here is the evidence that I plan on submitting with the application.

-Pictures of us together and with one another's families
-A copy of the lease with both of our names on it
-plane tickets and passport stamps documenting my trips to Japan and her trips to America
-Skype records showing daily phone conversations over the last two years
-A screen-grab of my Facebook announcement of our engagement with over 100 "likes" and comments.
-A copy of the engagement ring receipt.

Now, in addition to the above, I could also provide emails, chats, and letters that we have exchanged over the years. The problem here is that these are all in Japanese and, while I could translate them myself, I do not want to invest the time and money in having a professional do it unless it is absolutely necessary.

I don’t think you would have to translate the letters and chats really, but you do need to send them in when you send your packet... the evidence the better is how I was told to put our packet together… You don’t have to send originals in just copies of the cards and letters you have…

Also I would get letters from your parents and his parents and your friends and family members saying they are happy for you and blah blah blah… also a letter or receipt from where you plan to have your wedding is good too, or from the pastor who will do the ceremony.

You have to prove you are in a relationship so really you are guilty till proven innocent kind of, but the embassy just wants to make sure you are in a legitimate relationship with your fiancé… My lawyer told us the more stuff we have to send to immigration the better our chances are of getting approved… And we did get approved so I guess what she said worked for us …

I received the NOA1 today on the mail! :) super exited we are one step closer. I know it is still early and we have a long wait, but I know everything will turn out! By the way I have a question the tittle is the receipt but it does not include a case number only a receipt number. Should I be getting another letter any time soon or is the next letter until the case is approved?



and remember that the USCIS NEVER UPDATES THERE WEB-SITE.... and even if you call they will tell you what the web-site says.... buttttt if you have a lawyer (thats what we had) your lawyer should get the great news of approval and let you know.... my finace had his interview in september and the USCIS web-site still says our case is still in initial review... even though he is approved to come here... so dont loose hope if the web page never changes... Right when we thought all hope was lost we got out approval letter... so hang in there it will happen and this stage is the longest one...

we got approved and then 2 days later some how got an interview letter that said he had an interview in 13 days.... so it will go fast for you guys... GOOD LUCK GUYS =)

Hello everyone I'm new to visa journey but someone told me it really helps with the whole immigration process. I have a question I applied for my fiancé to come to US on a k1 visa, he resides in India everything was going good until I got a REQUEST FOR EVIDENCE letter about us being first cousin ( we are first cousins). I live in the state of Illinois and its illegal in Illinois to get married to your first cousin now they are asking for proof on how are we going to be getting married and all. We did decide to get married in Florida where it's legal but what letter can I send them to proof to them that we intend to get married in Florida and we intend to live there afterwards?



Hmmm this is a tricky question I think... did you submit and "intent to marry" letter when you sent your paperwork in? that would prove you are planing to get married... I guess In the US we dont hear about many 1st cousins marring each other (well at least where I live). If you have a lawyer I would ask them what to put.... Sorry I couldnt be of more help ....

My fiancé was approved a K-1 visa on September 6th 2012 at Mumbai Embassy in India. He was given a G221 form and told to get a Police report from The UK. He submitted the police report, his passport and the g221 from into the VFS office and they told him it will be 4 to 5 days and his visa will be done. Then 3 weeks later he gets a phone call from the Embassy and they ask for an Indian PCC now (which at first they said they didn’t need). So we go and get the PCC from India and submit the paperwork, the passport and the new G221 form on November 9th. Well the problem we had this time was the G221 from was in someone else’s name, so we had to call the Senators office and they had to email the Embassy in Mumbai and get us a new G221 form. So anyways on November 9th the VFS office again told him he had to wait 4 to 5 days and he would get his passport. Well now it’s December 5th almost and he they just keep telling us “your case has been moved to the highest authority” … which is a script that they tell everyone…. Has anyone else had problems with their G2231 taking a long time?

Nope you came on a K-1 so the relationship is already established. You need to follow the guides to adjust status from a K-1, I485 and assorted documents including your marriage certificate.

Yep, your lawyer is really super duper wrong. I suggest firing him/her... that is a bad mistake.

It can take 4-9 months, depending. You can get a free EAD and AP in the interim so you can travel and live normally, in case it takes 9 months. Read the guide and good luck.

I got my approval on dec 6 and subsequent letter from NVC giving my fiancee a case number and telling her that my interview would be scheduled at New delhi consulate on dec 17 2012. However we have been waiting ever since for the packet 3 & 4 and havent even recieved any information regarding this. We emailed to the embassy and the visa sections and all they told her was to wait. Just wanted to be sure if nothing is missing from my side and how long does it usually takes for them to send the packet 3&4..any help would be greatly appreciated.

We never got packet 3 or 4 in the mail just an interview date. i would gather all the paper work you need together, you can just google new delhi check list for immigration and have have everything you need. be ready because we only had 13 days to gather everything... once we got word my fiance was approved we had to scramble to get everything... so i would start now

It just depends on rather you will get the papers fast or slow... we filed and it took 6 months and my friend filed and it took almost a year to get approved through the USCIS... Its a very slow process and they dont care if you miss each other (sorry for that because i understand how you feel) but truly you just have to wait.

My husband got here on January 31st with a K-1 visa and we got married on March 16th, 2013 and send all of our paperwork in at the end of March. The USCIS got our paperwork on April 10th, 2013 and my husband has his biometrics interview on May 13th, 2013. Is there a round about time for when we will have our official interview with the USCIS? Maybe just an average time it takes to have the interview? Will he get his work visa before we have our interview? My husband is just getting board at home doing nothing he would love to be able to start and work.

I dont see why that would be bad... I dont know if she will be there in time for a wedding, but it worth a shot!!! the wedding is up to you not to them.... My fiance got here on a thursday and we got married that Saturday... good luck tomorrow =)

I was told by someone who went through the fiance visa process 8 years ago that I should have all documents that are copies of originals notarized. Is that true based on anyone else's experience? Thanks :)


I had my letter of intent to marry with in 90 days notarized and the letter from my parents saying they approved us getting married also. But in general that was all I had notarized...

Really?  They only issued him a visa that he had to use within 50 days of issue?  Is this normal or was that some administrative mistake?

 

It was an administrative mistake.... from the time he turned in his passport it took exactly 60 days to the day to get his visa... it was rather a mess, but in the end he was here... and now when i look at how long some people had to wait for there K-1 visas i know we were blessed that it only took 11 months....

Our K-1 Fiancé visa took from Feb 7th 2012 till January 9th 2013 to be approved and my now husband was in the US on January 31st. Now they say you have 6 months to enter the US with this visa, but let me tell you my husband Visa expired on Feb 28th, 2013.

 

Just be prepared to hurry up then wait!!!!!!! But I can tell you we got approved on August 3rd or 4th of 2012 and his interview with the embassy was on September 6th 2012. Then there was some complications and the embassy sent him the wrong paperwork in someone else name, but if it wasn?t for that he would have been here in October(ish) ?.

 

I agree with the above statement that they said if you are filing for a k-1 fiancé visa to start now. I believe that cost us $340 to file, then the AOS once my husband was here cost us $1070.00

It?s a long and irritating process, but it is totally worth it and I would do it all over again if it met my husband was here with me in the end again!!!!!!!

Great info, most weddings have both attending but if one can not, then there there is this option (kinda weird though).

 

 

I agree very weird, but in rare situations it is helpful. Most times it is not a good idea. In our case it permited us to marry before my step daughter's birthday. A minor can join Mother much easier than adult can join Mother in USA.  However it added the cost of trip to Texas for the proxy wedding, costs of the proxy wedding in Texas, plus costs for wife to travel to Moscow to USA embassy to have her proxy papers witnessed.

 

The down side of the wedding day was I sent my first night being married on an airplane flying back to Ohio alone...

I say that language is unnecessary and can only muddle and confuse USCIS.  We all know that to use a K-1, the couple can not be legally married and that marriage must be performed in the US.   And we all know the ceremonies and other may be performed prior to entry to the US.  This language, IMO, serves no useful purpose and can only lead to possible RFEs or at worst a denial (and loss of fee).

 

If the USCIS wants this language, they will ask for it.

 

 

K-1 is also used for Unconsummated proxy weddings. Read the information from the government manual information. Few people do proxy weddings, but they are legal. You do the proxy wedding and you are legally married, but without being consummated the USCIS by law must treat you as unmarried. However you are married for all other legal issues. The language is how to keep USCIS from becoming very confused. If you are not having an unconsummated proxy wedding, do not worry with the post.

 

My wife came to the USA on a K1. I have been through the process.
