Got great news yesterday that my I-129F made it to NVC. :yes: It took a month from NOA2 at CSC. After having started down the K-3 path we noticed that some folks were having some luck with actually being able to interview at the embassy for CR1 even after launching the K-3 process. It seems to have some advantages as far as eliminating some redundant steps involved in both K-3 and AOS and of course priveledges of CR1 are obtained as soon as beneficiary enters the US. There is also some financial advantage. So I also got some other news yesterday regarding our I130's. My stepson's was approved and is being forwarded to NVC. My wife's I130 however was mistakenly sent to National Records Center awaiting AOS. The CSC rep I spoke to confessed to the error and promised to "expedite the file to NVC". Of course, there might not be any such thing but... It seems they have to have the file returned to CSC and then forwarded to NVC from there. All in all this sounds like another month at least until both I130's are at NVC. So, if I am racing my petitions and need to make a decision on whether or not to pay the DOS fees (vs. AOS) how close to the embassy interview date (for K-3) is still a safe bet?

I've just gone through a similar situation with my stepson's RFE. They needed his birth certificate - duh. Hard to believe but the I-130 actually doesn't specify that document as required to prove a step-child relationship. But, when you think about it how can they approve this petition without it? They need something to verify the legal name and age. I think it is just an oversight in the design of the form instructions. On a different note, I have my stepson's petition moving on to NVC having cleared the RFE, but my wife's I-130 was sent to the National Records Center instead. In the process of correcting that error now and hoping that everything will sync up at NVC.

My husband just got his permanent residency visa and arrived to live with me in Ohio. We took him to get his learner's permit and they didn't require a Social Security number. I don't know about foreign driver licenses because my husband didn't have one.

As far as I know you can take the actual driver's test without a SSN. The Bureau of Motor Vehicles is required to verify legal presence in the U.S. so they'll ask to see your visa but again, my husband registered for his permit and took the written test without being asked for a SSN.

I don't have an answer for your question, but I am curious about what you asked.
Do you mean RFE from USCIS or NVC?
I don't remember having to send beneficiary's birth certificate for the initial filing of I-130 petition. I thought you only send the birth certificate to NVC after your I-130 is approved!
Has your I-130 been approved? You may want to update your timeline if it's approved.

I have 2 children from my previous marriage, and their father has agreed to sign papers so I may get their passports and go to the UK if need be. So, my ties to the US would be my children's father (his visitation rights)..my family...my bank account...would that be good enough? And how hard ...or how does one go about filing for a visa to the UK on a Limited Leave to Remain Visa?

:( I know I shouldn't complain and I know there are a number of people who have waited to be with their loved one longer then I have, but despite knowing all of this, I must say I am quite disgusted and depressed by this whole immigration process. I do believe the immigration process is a process to discourage people from marrying people from other countries and thereby stopping people from immigrating to the USA. Although I have read in other posts that the people at the NVC have been helpful, it makes me wonder who the heck were they talking too? I have gotten nothing but vague answers or downright lies. An example, that automatic voice response telling the lie that a fee bill has been mailed and three weeks later after talking to a customer service rep, I get a response that the fee bill was mailed yesterday and not three weeks ago. Or how about the amount of time it takes to process paperwork you overnighted but does not get processed 3 or 4 weeks later. My theory is...half the time this stuff sits on somebody's desk who doesn't give a rat's bottom that people are seperated from one another. Oh yeah and is it asking to much to include a fee bill with the paperwork that you need to fill out to keep the process moving? What is this pay a fee, we send you the paperwork and holding the barcode hostage until they receive the money? It's real simple, if the fee isn't paid, then don't process the paperwork. Oh but then again if the NVC should happen to do their job in a timely manner or equip applicants with the information they need to speed things along then some government workers would be out of a job.

Now I feel much better now that I have gotten that off of my chest!

In fact, since all the forms are online anyway, why don't we simply just send in EVERYTHING FULLY paid. Its really not that complex. As Albert Einstein said, "things should be made as simple as possible, but not simpler".

Of course folks will say they are backlogged, but poorly designed, inefficient processes create backlogs by default. The system is DESIGNED TO BACKLOG.

Anytime you want to complain about immigration, feel free to send me a message!

Nevertheless, we need to stay encouraged! At least during the NVC portion of this process is more "interactive" so you feel like "something" is happening. Waiting for the USCIS service centers for NOA1 and NOA2 was an excruciatlingly lonely, silent, and non-responsive process. At least NVC communicates every now and then by mail.

Not true... My wife is Colombian. Her Colombian friend is marrying a guy from the UK. They will marry and receive her visa 2 days later.

Immigration really isn't that hard... the USA makes it hard as if its rocket science. In fact, being an engineer I can tell you that rocket science is a heckuva lot less complex than the convoluted USA immigration process.

I asked this same exact question recently (on 1/3/2007).

That is the NVC message which really means that they have generated and mailed the DS-230 to the Choice of Agent they have on file.

It is a confusing message because, as you correctly stated, they are REALLY waiting on the Biographic Information OF the BENEFICIARY.

The message is so confusing that the live operator I spoke with at NVC was confused when I told her what the message said. She told me to ignore the message, but verified for me that the DS-230 had been mailed out to me.

Also... I just received my DS-230 in the mail today (1/15/2007), but I have already sent it in using James' Shortcuts (I sent it in the same day I got clarification of the NVC message). Of course I got my wife's signature far in advance so I would be ready to send it in as soon as possible.

I just got off the phone with "AJ" at the NVC.

Same exact scenario. The automated message said my letter was sent out 1/16, which was yesterday. He told me to ignore the letter because it is just a "reminder" to send in the DS-230, which he acknowledges they've already received on 1/8/2007...

He said "they must have crossed in the mail", which of course is impossible, since they mailed out their letter 8 days after they acknowledge entering the receipt of my DS-230 in their system. They actually received my DS-230 on 1/4 because I mailed in via overnight mail on 1/3.

So let's get this straight... the NVC systematically mails out an automatic letter, approximately 20 days after they mail you the DS-230, to remind you to send in the DS-230, irrespective of whether they have received your DS-230 or not?

Worse than that, they update your personal voicemail message telling you that you AUTOMATICALLY have missing information in your file, which will delay your case...
How inefficient is that?

Can someone say... "Immigration Reform"?

This isn't a matter of throwing more money at the problem to hire more people, this is just a matter of applying an ounce of common sense to the process...

How long after the NVC approves a case, do you have to conduct your interview at the embassy, before the time expires for your CR-1 Visa?

For example, suppose the NVC forwards the case to the embassy. Then the couple encounters an unexpected problem that would cause indefinite delay (family issues, relationship problems, acute illness or hospitalization, financial distress, etc.). Meanwhile the embassy issues an interview date, but the couple needs or decides to delay the interview for an extended period of time... how long do they have before its too late?

For example, the NVC says if you don't send in the DS-230 within 1 year of it being generated, you have to resubmit all your documentation and fees to continue. Is there a different deadline AFTER the NVC approval, or would the same deadline still apply?

Hence the need to consult their tax advisor...

I am having problems with the barcode generator. The barcode gets generated but when I try to copy and paste it the image does not transfer. Has anyone else noticed this problem? I am trying to send in the tax release form.

He did not take one I had to send the affivadit to the NVC, and I filled out the one they send me, the NVC acepted the affivadit, however the caunselor did not, I dont know why and I am not going to try to find out...


Well, if you don't find out WHY, then you run the risk of being denied again because you STILL didn't provide them what they were looking for... now that would be REALLY sad...

Better to find out from them what they want. Its probably something you can easily provide. You don't want to have to go through THAT again...

Just a thought.

I received the IV bill yesterday, in the instructions it says that after they receive and process the payment they will send the DS-230 form to be completed and sent back. They ask not to use any form dowloaded from the internet. I have the DS-230 filled, signed by my wife and ready to send using the James Shorcut. What do I do?

Yes, you can use Jame's Shortcuts to send in your DS-230. I did, and many others have also.

RanynRose referred to (their) "MNL" number. A more accurate way is to say "your case number" is what you need to have at the top right hand corner of each page.

The first 3 letters of the case number refer to the city of your embassy, so "MNL" is embassy specific. Your case number will start out with 3 different letters.

Also, RandynRose referred to sending in Police Certificates and NBI clearance. This information did not need to be sent in with our DS-230, so you will want to verify. Maybe it is something specific to the Phillipines immigration or certain other countries not including Colombia (in my case)?

The only thing required to be sent in with our completed DS-230 was what was indicated in James Shortcuts and the letter we received from the NVC. Please verify your own requirements with NVC if you haven't done so already.

Here is some important information for those of you waiting for their cases to be completed by NVC:
The automated system apparently does NOT have updated information. I called NVC this morning because it seemed to be taking a little longer than normal for NVC to complete our case. I received the same automated message which has been on there for about 3 weeks "NVC has completed the review of your documents and has found some information missing or incomplete. The NVC mailed a letter on Jan 17th indicating what info is missing...." That is the bogus message which most everybody seems to be getting. NVC's asks for the DS-230 even though it was received weeks earlier. I decided to speak with an operator this time just to make sure that there was nothing additional I needed to know. She informs me that our case was completed on Feb 1 and will be forwarded to Bogota shortly! Our case was completed 5 days ago and the automated system still does not reflect our correct status. Those who have been waiting about a month since sending in their DS-230 may want to call and speak with an operator at NVC.

Similar situation... I just talked with "Zoe" at NVC. She told me my review was completed today, 2/6/2007, although the automated msg says that they are waiting on missing info.

She said my case will be sent to the embassy within 2-4 weeks (March 6 at the latest). So, naturally, I inquired why would it be so long before shipping my case to the embassy since the review is already completed... she said because they ship the cases to the embassy in bulk, not one at a time... :wacko:

NVC's asks for the DS-230 even though it was received weeks earlier. I decided to speak with an operator this time just to make sure that there was nothing additional I needed to know. She informs me that our case was completed on Feb 1 and will be forwarded to Bogota shortly! Our case was completed 5 days ago and the automated system still does not reflect our correct status. Those who have been waiting about a month since sending in their DS-230 may want to call and speak with an operator at NVC.

You and I were thinking the same thing this morning, because I called also. I didn't take the extra step of talking to a live operator. Since my case has been a few days behind yours, I may wait until next week to call.

Hopefully, you and I will get to hang out in Bogota together...

Our I 130 was approved on Monday. I haven't received the approval letter, but I had a few questions to ask the USCIS center.

I rung up and asked when the approved application would be sent to NVC for processing. She told me that since I was a US citizen, that when I get the approval notice, I should send it to my husband in London, and he should take it to the US Embassy and ask them what to do next. She said that they may requrie some additonal information, health check etc, but that since I am a US citizen, it wouldn't be forwarded to NVC at all. #######??? Everything that I have read, and I have read a lot, says the complete opposite of what she has told me. From what I understand, the app will be sent to NVC, then they will send out the support form to me. I need to pay and send it back, then they look it over again. They send a form to my husband asking which consulate the stuff should go to, then they have a nother look and then they send it on to the Embassy. Am I wrong? Is it as easy as she says?? I am so confused... :unsure:

Welcome to the rollercoaster ride of the inefficient and often ridiculous US Immigration process. Before even reading your post, my short, simple answer to your question was, "Yes, USCIS is giving wrong info". :)

After reading your question, my answer is still the same. It sounds like you have a VERY accurate view of the process. My case has just completed review by NVC, so I can vouch for what you have stated above.

Disclaimer: I am 99.9% sure that I am correct based on my own experience, and countless hours of research on VJ over the last year. However, I reserve the .1% right to be corrected by someone more knowledgeable on VJ who is more in tune with the facts of the above case... such as someone else filing a K-3 whose spouse is in the UK. :)

My husband's interview is in Montreal on Feb 20th. We have been trying to prepare for everything and leaving no stone unturned. I have a question: When I filed for his affidavit of support about 3-4 months back I was a contractor for a company and we also used my dad as the co-sponsor...since January my situation has changed, I have been hired as a full-time employee by that company and also got an increment in my salary. Now, do I need to file a new affidavit indicating my new position and salary and if yes, is it a good idea to do my taxes before he goes for the interview and show that on the form as well? Also, the form version we used earlier has an expiration date of 09/30/06, so does my dad also have to file a new I-864A? I checked the USCIS website, and this what it says: "Edition date: 11/01/06. Prior versions other than the 1/15/06 edition are not acceptable." Please guide as to which one should we use? Thanks.

Disclaimer: I am simply applying basic logic based on the limited amount of information you have provided. I'm sure that someone else more knowlegeable will respond, but while you're waiting for that, I may as well put my 2 cents in if I can help.

Having said that...

I presume you have a co-sponsor because by yourself, you did not meet the income requirements for the PAST 3 YEARS. Therefore, I don't see what a last-minute change in your income and/or job status does to change your situation for the last 3 years. So you STILL need a co-sponsor.

So what possible benefit could there be for you filing another I-864/AOS and confusing the immigration officials even more... with the possibility of delaying your case, interview, and/or approval?

Basically, if it aint broke, don't fix it.

If I were in your shoes, I would simply provide documentation of the new increased income level and job status to the interview. That way you will have it, just in case you need to convince them of anything.

My husband visited my country only once and we decided to get married after a month of our first meeting and then he stayed with me for 10 days. Will this cause any problem? I have my marriage ceritficate and wedding album as an evidence.
