IR-1 / CR-1 Spouse Visa Process & ProceduresNVC to Interview at the Embassy in Philippines....

My apologies... I DO need to update my time line, however my case is somewhat special. You see, I never received a NOA2... I called the 24 phone service every so often, checked the status online at the website almost every day, and had email notifications turned on... i never received a single thing, the status date never changed on the website nor on the phone service. My wife received a letter from the NVC on May 19. When I called the NVC, the operator said they had our paperwork for about a month. We lost a month.... my wife could have been here one month sooner... Anyways, I guess I'll put something like April 19 for NOA2... since that time, I have been terribly busy with the military, my wife's paperwork, missing tax papers, etc, etc, etc. Currently I have paid the AOS bill, sent in the AOS packet and sent in the DS-3032... still waiting for NVC to get those into the system so I can pay my IV bill and send that packet....

Regards,
Andy

I forgot to mention that I was a total dummy and forgot to let the USPS know that i would be gone from my house for 52 days.... consequently, they emptied my mailbox and sent all my letters back to the original senders... I will have to call the USCIS service center to request an official copy of my NOA2....

Andy

they might charge you for the copy.... best ask if it is free.
if not, don't bother... lots of people here told me that the USE manila won't need it or ask for it.
As long as your case is in NVC already, and they complete it.. you're good to go.

Carlish, that was super fast.... i don't think they do a month lately... maybe 1 1/2.
Wish I can have Early August interview.. but it looks bleak since the last one who got an interview date is set for August 5 already. sad.gif

IR-1 / CR-1 Spouse Visa Process & ProceduresTaking his last name after marriage.
you can change your name anytime so long as you have your marriage certificate.

In the I-130, there's a space there asking what other names you have gone by. USe that to put in your maiden name.

IR-1 / CR-1 Spouse Visa Process & ProceduresWe got married from the very first time we've met.
yep. married my husband first time he came here. he spent 3 weeks here.
you have more history with your husband in terms of years of courtship,
just make sure you line all your ducks and prepare documents properly.

i'm waiting for interview schedule and we have managed to keep our papers in order for USCIS and NVC, didn't have problems about quick marriage. don't know about the interview but i'm positive i'll survive.

good luck!

Have you sent NVC the I-864 packet and DS-230 and other required docs? If so then it may make it to the consulate before K-3 interview and the consulate may simply drop the K-3 and make the interview a CR-1 interview.

KEEP the I-130 moving through NVC.

Yep! if you've done paying for the I-864 and DS230, then continue the process.
If not and you're stuck somewhere in NVC, keep the k3 interview and do k3 by Aug 3.

Good luck!

Well, im doing the CR 1 but my wife says she called immigration and they said that the cr 1 can take another 6 months. I know this is not true. I think that they are thinking she is talking about the k1? No idea.

We got the interview for the K3 and its Aug 3, i was just going to ignore that but shes so worried that now the CR 1 is another 6 months. Can someone please tell her on here that its NOT 6 more months.

Her Embassy was the one that told her that.

IF the interview for the K 3 was Aug 3 then how long do you think it will take for the CR 1?

Thank you for your help.

I'm confused. If you have an interview for August on a K1, why would you apply now for a CR1? By the way, depending on which center is processing the CR1 (and in your case it would probably be Vermont) the processing time IS 6 Months. It could be sooner, but probably will not be.

no they have interview on August for K3.

I don't see your timeline... it is not updated yet.
Exactly how far along are you in the CR1 NVC process? Details are important when you are asking questions here.
Also, some fly through NVC in 17days some takes 1-2 months depending on how ready your documents are.

I don't think it will be areason for him to be denied, it's just like you've been AWOL from a different job. But i think it will be better if he will get a clearance from PNP just to make sure that everything is clear with him and PNP (wherever he was assisgned). I am the wife from the Philippines (FYI).

thank u for the replies. well try to get his case settled with PNP so by the time his police record will be questioned by NVC or at the Embassy, everything will be clear.

it would be best to do this... if you can ask for an "honorable dismissal" if there is such a thing. I don't know. Or a clearance form... something that says he didn't commit any crime or there was no administrative case filed against him when he went AWOL.

Please keep in mind you will need the NBI Cert. not a police record, and this can take 5 to 10 days. Good Luck!

I got mine in 1/2 a day... it depends if the person has same name with someone with criminal record or the person has a criminal record.

IR-1 / CR-1 Spouse Visa Process & ProceduresDo I need to get Police Clearances from places I have lived for at least 6 months?
If you have lived your entire life in the Philippines and have just been moving around the island... you only need NBI Clearance, NBI clearance will cover your entire stay everywhere else within the Philippine islands. i.e. you were born in Manila, at the age of 18 you moved to Cebu for 3 years, then went back to Manila. YOu only need NBI Clearance since NBI is a state wide agency... you don't need your local police clearance from the provinces. Anyway, these police clearances are not valid for embassy use anyway, they are used only for local employment.

However, If you went to other countries and lived for at least 6 months, YES you need PC from these places.

Her case was completed one day before me.

IR-1 / CR-1 Spouse Visa Process & ProceduresAnother question about changing spouse's last name
you can continue your papers without changing name. I wrote my married name in my I-130 and all other NVC forms but they still addressed me under my maiden name. I don't see any problem to it so long as you have a certified copy/original Marriage Certificate to present. And just inform them the truth when asked in consulate.

you can change passport to reflect her married name before getting the VISA so that they will issue the VISA under her married name. So I've read... I've just renewed my passport under my married name and the copies of my passport that I sent off to USCIS and NVC are all under my maiden name.

Just relax. Better yet, while waiting... I see that your fiance is from China... if she's not fluent in English, keep practicing to prevent any miscommunication during interview.

Good luck!

IR-1 / CR-1 Spouse Visa Process & ProceduresWould it help to hire an attorney?
hiring an attorny only helps in filling out the paperwork for you. we hired the attorny for the i-130 and i-129 and the only thing they did was file the paperwork. we had to do all the work gathering things. yes everything went smoothly but then we used them on our AOS and of course that all went fine also until we got caught up in name check where we have been for the past 3 years.

hiring an attorny does not make things go smoother in the aspect of getting approvals faster or anything like that. they just put the package together and answer ur questions...thats all.

another thing...things have changed since 9/11 and things dont move as fast as 20 years ago.

i cant say for sure but im going to guess....i would think u could. people adopt thier spouses children every day. just make sure ur marriege is on stable grounds first tho...there was a man i worked with who adopted his wifes kids from a previous marriege and they divorsed and he had to pay child support to her.

IR-1 / CR-1 Spouse Visa Process & ProceduresWhich visa for this situation?
i am also in ohio and my husband needed his work auth. before he could get his social security card. he needed his social security card for getting his drivers liscence. we were able to go to the social security office and get a copy of what his number was going to be when the card came. they just gave us a printout and we took it to the dept of motor vehicles and he was able to get his liscence.

he also did bring a international drivers liscence with him. they do exist. he was even pulled over and the police told him they were not legal here. the first page of it says they can be used in the united states. trust me...police dont know as much as they think they do. he just showed the police where it said it can be used in the united states so what else could he do...it was in black and white.

im not sure but i think u can drive a year on ur license from ur country.
Donna AFemaleSyria2007-12-28 14:47:00
IR-1 / CR-1 Spouse Visa Process & Proceduresmy husband visa was denied
i also beleive it was a misunderstanding. maybe she was asking how many times "before him" was u married and he said two but really it would only have been once so it made it look like he didnt know or was lying.

kinda the same thing happened to my husband years ago at his interview. they asked him how did we meet. he said i came to syria but really we met online. so it was kinda like he could go either way with the question. they did ask him again and that time he understood it they way they meant it and he then told them we met origionally online but then she came to syria to meet me in person.

so something like a misunderstaning could have happened with him. they were looking for a certain answer and thats not what they got.

IR-1 / CR-1 Spouse Visa Process & Proceduresdifference between hiring a lawyer and do-it-on-your-own i-130
It does nothing to make the process faster. It can actually slow down things. They wait in the same long line with no special treatment or powers. Just follow the instructions and you will be fine. If you get confused, come to these forums. There are tons of folks that have been through this with answers. Save yourself the grief and the money!

Stop feeding the lawyers! If we do, they should weaken enough to stop breeding. Over time, we might be able to drive them into extinction. The world will be a far better place!
