Hope somebody here could enlighten me out on this. When I was still a permanent resident, I got married and immediately petitioned my wife (I-130) and wrote in the application form her maiden name instead of her married name. My understanding that time when I was filling up the I-130 application form was I had to follow what is written in our marriage certificate so that USCIS could match the name of my wife in the application form from the marriage certificate.

Now my concern is, whenever I will upgrade my wife's case from I-130 to IR1 soon, will it be a cause for concern if what appears in her record was her maiden name instead of her married name? She'll be issued a lawful permanent visa entry with a maiden name printed on it but her passport and related documents such as police clearance etc. show her married name already and perhaps immigration officials may question why those don't match.

In connection, as we prepare to upgrade my spousal petition after I take oath, shall we write her Married name in forms DS-3032 (Choice of Agent) and DS-230 (Application for Immigrant Visa and alien registration) or write her Maiden name as what was printed in I-797 (USCIS Notice of Action 2)? But then again, like what I said this is the dilemma, that if I follow what was printed in I-797 and write her Maiden name on prerequisite forms such as DS3032 and DS230, her documents such as passport, police certificates etc are all written with her Married name.

Is there someone here who had the same experience? What transpired in your case? What are the things to do? Or it's not a concern at all since I had the marriage certificate to prove anyway? Thanks.

try calling again to get a different operator/person.
we did not receive our NOA1 and we asked for a reprint and they gave it for free.
in fact, they sent it twice coz we called them twice about it.

anyway, as most people here said, you don't need it so no need to fret for now.
just try to keep calling and get a different ans. they're not very reliable so if you get lucky
somebody will give you a reprint for free.

Photos are part of proof of bonafide relationship.. that you have met in person yada yada.
if you sent in your I-130, that's for the CR1/IR1 visa... subsequently, if you send in I129F form then the I129F is for K3.
If you didn't send in your I-129F then all you have is a case for CR1/IR1 visa.

They are absolutely two different petition.

For the I-130, you go through steps in NVC.
For the I-129F the NVC will forward the petition to the US Embassy and you will do several packets there.

For I-130, the beneficiary receives either a 2 yr conditional green card or 10 year GC.
For I129F, this is not the case and you have to adjust status later on (more money)

it takes a week roughly... depends on the mail service.
it could be too that they never printed it due to system glitch.. my NOA1 was never printed so we got them to send it to us cost free.

try calling NVC, maybe your case is in their system already and you can get your case number and start the ball rolling.
i'd call USCIS after 30 days if you haven't received your NOA2 because they'd let you wait for that long anyhow.
if they ask for lots of money, don't bother to get it... everyone that i've asked about the NOAs says you don't need them down the road.

Wait!!!!!!!!!!!! You FIRST need to know EXACTLY why you were denied, and not for immigration purposes, that is not listed on reject form.

tomuts, not to mention once you reach 30... it is a lot harder to get work here. even the home grown Filipino men must catch a good job at age 28-29 otherwise it will be downhill for their career. Very rarely would companies here hire 30 somethings.

my husband would've moved here too if he can make good money here.. but having only so many experience and a HS diploma in the US.. there's not many options for him in the Philippines.

When you sent DS3032 via regular mail did you print your own bar code or did you just write your case number in that sticker bar on top of the form?

because i'm the beneficiary, i signed the form and mailed to my husband earlier.... before we got the barcode.
So i asked hubby to print the barcode and paste it in the box! and stamp our case number on top too.

1) DS-156 is an application for a non-immigrant visa... I assume you will be applying for an immigrant visa (DS-230)
2) Only provide originals if they are specifically asked for.
3) If she arrives on an immigrant visa then she has her greencard

-Not needed for CR1. BUT would be safe to send her copy of your I-864 and all attached docs.

- I heard in some embassy they do, I heard in some they don't. I suppose once approved you can ask if you can get them back. If not, I suggest you guys get another certified copy before she leaves... you may need it for something else while in the US.

-You are an IR1 visa applicant, (two years married already) then she will get a 10 year GC upon entry to US. Might take a while before the actual card arrives to your doorstep but she is a 10 yr. GC holder already. No adjustment of status.

Again, you already have a GC... however, i think if she wants to become a US citizen you have to submit the marriage certificates again.. or something like that. Check the guides to help you with this.

At the NVC (National Visa Center) stage, that is when you will submit your supporting documents for the DS-230 and I-864.



no no, not part of DS230... only the I-864 or known as the Affidavit of Support.
Don't worry, once you reach that stage, they will send you a checklist.

Her Photo - two visa photos - Send in 4 just in case they misplace one or it gets blown away... or some of such accidents. Put it in small baggie and stapple it to a bond paper.

DO NOT FORGET : Bar-Coded Cover sheet. and to stamp or put your case number on top of the documents.

she must marry the father of the child before she can petition him over.

no idea to the legalities. but i heard it is more expensive to change passport in Phil Embassy in US.
In my humble opinion only, I don't think you'll have problem with the visa, it is quite common for some women not to change their name when they get married. Just make sure you bring a NSO Marriage Certificate during your interview and when you fly to US so you can show it at the POE.

My apologies... I DO need to update my time line, however my case is somewhat special. You see, I never received a NOA2... I forgot to mention that I was a total dummy and forgot to let the USPS know that i would be gone from my house for 52 days.... consequently, they emptied my mailbox and sent all my letters back to the original senders... I will have to call the USCIS service center to request an official copy of my NOA2....

they might charge you for the copy.... best ask if it is free.
if not, don't bother... lots of people here told me that the USE manila won't need it or ask for it.
As long as your case is in NVC already, and they complete it.. you're good to go.


Carlish, that was super fast.... i don't think they do a month lately... maybe 1 1/2.
Wish I can have Early August interview.. but it looks bleak since the last one who got an interview date is set for August 5 already. sad.gif
