I'm sorry Fiaz. However, them keeping your passport is definitely a good sign. They can't hold your passport for very long (i don't know if it is against any law but it will definitely impede your right to move around freely) so I don't think they'd want to hold it for so long.

I will keep you in my prayers.

IR-1 / CR-1 Spouse Visa Process & ProceduresWhere do I send my application?
Okay I'm sorry in advance because this seems like a really stupid question. blush.gif

I live in Ohio and was wondering where to file the I-130 (I am filing as CR-1). On the I-130 instructions it says the following:

If you are the petitioner and you reside in Alaska, Arizona, California, Colorado, Guam, Hawaii, Idaho, Illinois, Indiana, Iowa, Kansas, Michigan, Minnesota, Missouri, Montana, Nebraska, Nevada, North Dakota, Ohio, Oregon, South Dakota, Utah, Washington, Wisconsin, or Wyoming and you are filing only Form I-130, mail the petition to the USCIS Lockbox Facility. The address is as follows:
USCIS P.O. Box 804625 Chicago, IL 60680-4107

BUT THEN...below that it says if mailing courier/express, send here:

For couriers/express deliveries:
USCIS Attn: FBAS 131 South Dearborn - 3rd Floor Chicago, IL 60603-5517

I'm really confused on which place to send it because right above the second address it talks about sending the I-130 form with I-485 to another address...would the second address be where I mailed it priority overnight via post office? or use the first address? Thanks in advance.

Thanks. I was really concerned about this. The affidavits do not say there is an expiration date. Unfortunately, we need them because we don't have any of the other items listed, i.e joint bank accounts or any children together. For evidence that we are still together I plan on sending current IM messages/phone call log records, and hopefully current pictures, if I get to visit him again.

IR-1 / CR-1 Spouse Visa Process & ProceduresDated materials...Expiration Date??
Is there an "expiration date" for materials that are to be sent with the I-130? Such as the affidavits (as part of the proof of bona fide) and pictures? I received the affidavits from my husband in April this year, but I still have not been able to send the documents in, due to unforeseen circumstances. Should I try to get more recent affidavits before I send the documents in, or is the April date okay?

Thanks in advance.

IR-1 / CR-1 Spouse Visa Process & ProceduresCopy of Birth Certificate/Passport
Hello everyone,

Just wondering if a copy of my husband's (beneficiary) birth certificate and/or passport needs to be with the documentation for the I-130 form? I know mine does as the petitioner to show U.S. citizenship. I have read that it is no longer needed, but in the CR-1/IR-1 Guideline and the state department website states to have a copy of either. Kinda confused now, please advise. Thanks in advance.

IR-1 / CR-1 Spouse Visa Process & ProceduresI-130 Payment
Hello everyone,

I was wondering if it is better to send in the I-130 payment in the form of a check or money order?

Another question I had was my checking account has a hypenated name (ex: oldname-newname). Should I get the account put in just my new married name? The I-130 and the G-325a do have the oldname listed as previous names used. What do you think? Change the account name or leave it?

Thanks in advance for your advice.

IR-1 / CR-1 Spouse Visa Process & Proceduresyet another question
Hi,

I filed on June 9th, and totally missed the G-1145. Thought I was SOL too, and would have to wait for snail mail. But once I received the paper NOA1, I registered here: https://egov.uscis.g...is/Dashboard.do and entered my receipt number. Once I did that it told me when the I-130 was received as well as the last touch. So if I am not mistaken, it will tell me electronically about the NOA2, rather than having to wait for a response from regular mail. Maybe more experienced VJers are more informed about this one as well, and can tell you if I am correct or not.

Good luck in your journey!

IR-1 / CR-1 Spouse Visa Process & ProceduresWill it count against us that I've only visited once?

I don't know if there is a lot of fraud in Turkey, but where my husband is from fraud is high. I have been to visit him four times, basically once a year. He just had his interview and they were not happy that I had only been once a year. They tried to use that as a reason to prove our marriage is not real. I was also told that I didn't need to be there for the interview and now they are requiring me to be there for a second interview. I am leaving in a week to meet with immigration. If you can, you need to visit as often as possible, save all phone records, skype records, emails, etc. Immigration doesn't care that you are in school, they want to see proof that the marriage is real. Hope this helps.

How the heck do they expect you to visit more than once a year, or even more than once??! I haven't seen my hubby since 2008, and when I went the first time it was very expensive for me and a major financial strain. I wish I could visit him more often, but it is not like he lives around the corner. Yes, I knew what I was getting into when we married...that this would be a long journey and somewhat expensive with fees and such, but to add expenses such as travel would be overwhelming for me as I am the sole bread winner in my household....ughhhh!

IR-1 / CR-1 Spouse Visa Process & ProceduresAm I forgetting something?

While our two year anniversary is this month the green card they gave him does not expire until 2/10/2012. So how soon before then should I do this?

"When to File: If you are filing jointly, the I-751 form must be filed within the 90 days just preceding the expiration date on your permanent residence card. This is the date that your conditional residence expires. Note that, despite the fact that you may see word "anniversary" used in a confusing way regarding the filing date for removal of conditions, your wedding date is completely irrelevant to determining the window of time during which you may file for removal of conditions...It is very important to file the I-751 within the correct window of time, and be sure not to file it before the 90-day window. If you file it too early, they will send your application back. You may file at any time during the 90 day window, but it is prudent to file fairly early in the window."

IR-1 / CR-1 Spouse Visa Process & ProceduresAm I forgetting something?

Despite my husband having his visa and living here now I could swear that I read something somewhere that said we needed to do some INS related thing prior to our 2 year wedding anniversary which is the 23rd of this month. My husband says he doesn't remember seeing any such thing. I've looked and don't see anything now either. I read so much information while going through the process that I suppose I could be mistaken about it but I don't want to overlook something and end up having my husband deported over it.

I seem to recall a few of you saying that once you have the visa in hand there are other things to do and that the government isn't going to remind you of what those things are or when you must do them by so now I'm all paranoid about what it is we have left to do!

I believe you needed to remove conditions within 90 days before GC expires.

"If your relative is your wife or husband and you have been married for less then 2 years at the time of his/her arrival at a port of entry, then he/she will receive a temporary I-551 Stamp and then later a Green Card by mail good for only 2 years. Ninety days before the green card expires you will have to file an I-751 form to remove it's conditional status." (excerpt from the I-130 Guide: http://www.visajourn...tent/i130guide1)

IR-1 / CR-1 Spouse Visa Process & ProceduresWhere to file I-130 form?
Hello all. I am new here. I was just wondering about this question. I am out of the country atm in Turkey. I did get married here and I will be going back to the US in few weeks. Its just that before I came here I left my job. I was living in New Jersey at that time with my parents and I will be going back there for a few days. But I will be moving to Ohio to start working with my brother-in-law there. I am just wondering where I should be sending my form too. I am not quite sure about it. I know for OH and NJ there are 2 different P.O.Box that it goes too. Plus I am not sure if I will have to change address and everything else?? Or will it be easier to do all processing through NJ since my parents are still living there??

I hope I posted on the right place. I hope someone can help me.

Thanks in advance!

I have a few questions about the form.

1. I put NONE for questions that didnt pertain to my wife for example Middle name we put NONE because she has none.
2. We answered almost every question but some questions had extra lines. Do we put NONE there or just leave them blank?
3. Applicants last address outside of the US for more than 1 year? Do we just put the last place she was living at more than 1 year or present? The present address she has only lived for 7 months so far..
4. Applicants employment last 5 years. The addresses were too long so we are attaching another sheet. So we wrote on the form: See Attached on the first line - Is that right? Do we leave the other lines blank or put none?
5. Attached Applicants emloyment: Also there was a time frame of about 8 months where she had no job so we put Unemployed. Is that correct?
6. Last occupation abroad if not shown above. She was in the US for 6 months last year as a student. Do we put that information?
7. This form is submitted in connection with an application for: Naturalization, Status as Permanent Resident or Other specify? We check other Specify:I-130 Petition <- we wrote that. Is that correct?
8. For native name? We put full name of my wife or just first name?
9. Does my wife need to send her passport copy or no with the I-130 Petition form? She hasnt changed the name on it yet. I know I have to send mine.

Sorry to be a bother about these questions. We did look through pretty much all of the topics related to G-325A. I know the questions are self explanatory, but confusing at the same time. We have just started to fill out the forms to get the I-130 package together.

current wife maiden name : you ( male ) write her maiden name if she dnt have maiden name then write family name

Its 2 questions and 1 line to answer or is it just 1 question? The way its written on the form, it seems there is 2 questions. So confusing, haha.

Do I have to write husband and write the last name of the husband? Or do I just write the last name?

The G-325A form says Current husband or wife (If none, so state)
Family Name (For wife, give maiden name)

It only gives 1 box to write so for her form do I write Husband and my last name? A bit confused on that part.

Form husbands or wives
Family Name

For that should we write her former husbands last name as well? A bit confused like the question above.

Hello everyone, I have two questions: first question: I live in the U.S. New Jersey, where do i send my I-130 petition?

Second question: Regarding the G-325A form. My wife did not put down her fathers Date of Birth on the G-325A form

because she never met him before, her father never been there for her, so she does not want to know anything about her father.

would that be a problem with my wifes G-325A form?

If you look under guides, it says to send to:

--o Petitioners who reside in AL, AR, CT, DL, FL, GA, KY, LA, ME, MD, MA, MI, NH, NJ, NM, NY, NC, OK, PA, Puerto Rico, RI, SC, TN, TX, VT, VA, U.S. Virgin Islands, WV, or District of Columbia are encouraged to file their stand-alone Form I-130 with the Lockbox using the following address:
USCIS P.O. Box 804616 Chicago, IL 60680-1029

Mail the package with return receipt requested / delivery confirmation. Send via USPS.

I am not sure about the 2nd question you have, sorry. Hope someone else can help you on that one.
