Ok. So I just called and spoke to my attorney for about 45 minutes. She continued to insist that the letters of intent are not required and are optional at this point. I informed her of the research I had been doing online and also that I had contacted a separate attorney to receive a second opinion. She told me that she was very upset with me as her client contacting elsewhere to receive information after she told me it wasn't needed. She informed me that she did not want to be my representation if I was not going to trust her completely. She said she was insulted by my persistence on pursuing my own investigation of what the requirements are. She told me how she has done over 500 k1 cases in the past 2 years that were approved without letters of intent. She said the cover letter that she had typed up and attached to the front of my pocket stating our intent to marry was good enough and that we did not require documents from myself and my fiance as well as the cover letter. She also said that is highly inappropriate for me to contact her on a saturday when she was at a family function, said she didn't appreciate me second guessing her, and told me how rude it was to contact a professional pretending to know more than she did. She basically told me that I should not be even reading forums online or discussing immigration matters with anyone besides her. Basically told me that she deserves an apology and that when I don't get an rfe she wants an additional apology. I in turn asked her to send me a email containing our conversation summary of what we discussed so that if I do you get an rfe I can then file for malpractice based on that and other information she gave me incorrectly.

The bulk of our conversation however was about her telling me how I needed to file and I 130 as well and she told me she would not represent me if I refuse to file and I 130 along with our adjustment of status.

I think once all is said and done I may just contact the bar association after all

I have email PROOF that my lawyer told me these were not needed, and I also have email evidence that she was informing me to file an I-130 after we get married in the states on an I-129f along with the AOS. Can I sue her to get my attorney fees refunded? These are TWO MAJOR overlooks on her part. I want my $5000 in fees back.

So the more I look through forums and flowcharts and guides the more I think we were required to submit the letters of intent. We did not, as our attorney told us that we already had a lot of evidence and didn't need it. Am I waiting for a guaranteed RFE right now?

I am going to be veryyyyy bitter if we get one for that, as I still have the communications from my attorney saying they were optional and not needed in our case.

I asked the same question to both my lawyer and also as a thread on this website. The response my lawyer gave me was that it could take up to 2 weeks after obtaining the visa to actually have it in hand. The response most users gave me was that you could pick it up at d h l within a few days.

Also be aware most consulates will not allow you to enter the building.... some have waiting rooms.... but regardless they will not allow you to be at the actual interview

when i submitted my packet to the csc i included evidence of my many trips there, letters and communication between my fiance and my family (10ish pages) text history (2-3 pages), pictures, proof of gifts, google voice call records from only a few months, and proof of exchanged funds (from me to him only). my case is still in review so i cant say for certain that this was the only documentation they needed... but i did have a laywer prepare my packet with me. i had THOUSANDS of pages of emails, facebook chats, skype logs, msn chats, etc. We didnt submit a songle conversation log of any means to the csc. I am praying that i dont get an RFE but my lawyer (whos advice at this point regarding other issues is questionable) advised me that we should be fine with all of our other proof without submitting any of our conversations. like i said we have yet to even have a touch on our packet yet but the impression i have received is that there will be no issue without submitting any of that. i obviously am not recommending you omit it entirely but in my specific case i felt comfortable with the evidence we had to leave out the conversations entirely. we WILL be bringing samples to the interview when we get to that step.

No, the letter points their website where you can find all the info and forms. There are no actual 'packets' with Juarez. There is nothing to send back before the interview. All the forms will be filled out and then you take them with you to the interview.

These are the questions I have asked my lawyer several times and gotten responses like, "It varies based on embassy." And then I reply, "so then can't you figure out which embassy our case will go through." And then gotten responses like "Only the NVC can determine that".....

Which Juarez is obviously the only place it could be.

The only thing that would get sent to your fiance in Mexico is the invitation letter he needs for the interview in Juarez after the petition is approved and your case is received at the consulate there. The Mexican mail system is #######, and a lot of people do not ever get their letter at their Mexican address. The good news with that is the letter is also sent to the petitioner in the US, and that letter works just as well as the one sent to the beneficiary. The letter would have come to you, and no need for it to go to a lawyer.

I had never been involved in an immigration situation before either, but I managed to handle it just fine on my own. I think doing the AOS part yourself is a good choice. Saves you money and you have full control over what gets sent and when.


What about the packet of stuff to be completed before the interview and the packet for medical? they don't get sent to him directly via mail service?

Our situation isn't complicated, I guess I was just nervous to do it on my own since I have never been involved in a Visa process. So between those nerves and also my impatience, I thought it would make the process more seamless. Also I wanted to have a lawyer involved because they receive all of the paperwork at the same time I do, and his address in Mexico is unreliable and he often doesn't get his mail. I guess I was just a newbie and a little worried. Now that the 129 is submitted I will be completing the rest by myself, I just wanted to confirm that I was correct in thinking the I-130 was NOT needed.

Believe me if I had gone with her and then when my I-130 would ultimately get rejected (as its not needed), I would have sued for malpractice. :)

I mean I did the packet myself basically. I gave them photocopies of everything, and it was already organized into exhibits and ready to go. Basically I was worried about filing myself because my fiance was previously married... they were seperated for about a year and a half when we met.... but he didn't have the money for a divorce and he never really needed it. After we had been together for about a year I paid for the divorce so we could start the visa. The divorce was finished around may last year, and we filed in october.... but I just didn't feel comfortable with the overlap in time where he was married and we were dating. I know it doesn't matter and it shouldn't appear fishy but I just wanted to make sure I made every investment into his visa that I could to ensure it wouldn't get denied and have to start over. I love him so much, and money isn't an issue for me.... time is. I'm too impatient to deal with a longer wait time than we need. I just want to be with him.

I was smart enough to know this sounded incorrect and refused to sign the agreement for any of the portions aside from the I-129f back in May.....

Honestly the reason I used an attorney to file was because I knew I wouldn't have enough time to prepare everything on my own (which I basically did anyways), and I thought it would look better coming from an attorney. My main concern was being able to get him here. I am thinking that once he is here and we are married and I know he isn't going anywhere.... I will likely file my own AOS and not pay the extra $1500 for her services.

She sent me a list of fees, before filing stating it would be $1440 between their fees and the USCIS Filling fee for the I-129F, $1270 for the the I-130, and $2500 for the AOS.

I then replied "All of the papers I have read state that you file the I-129f instead of the I-130, and you listed both on my fee agreement. I would only be doing the I-129f, correct?"

Her reply "You will still ultimately need to file the I-130, but not until after you are married. That is why it is still listed. I hope that clarifies."

My reply "Hmmmm. Sounds fishy. I thought the only time the I-130 (Petition for Alein Relative) was filed was when the immigrant was overseas.... so if he is here on an I-129f, he won't need it."

Her reply, "No. He will need it. The I-130 is the underlying petition and is the basis for the actual green card. Without it, the adjustment of status cannot be approved."

Me "I thought the I-129f was the underlying petition"

Her reply, "No. We will discuss this further upon your visit."

........ this was back in May last year.

My lawyer has communicated to me several times that after my fiance has received his visa and we get married in the US that we will need to file both a I-130 and the AOS. Everything I have read disagrees with this. I believe we just need the AOS.... right??

I love my lawyer and she has been great getting the prep work done and submitting for me but I think she is wrong?!!

I called in to the NVC on monday, 3/5/2012 and they said they had received my I-129f packet that morning. Then I called in today to ask a non-related question and she said "I can help you with that, but your packet was actually sent to the Consulate on 3/6/2012." ONE day processing??? I heard 1 month. Is this even possible to be true???

Sounds like your lawyer mixed up informations about fiance and spousal visas… (btw, I read your past posts about her, she looks more and more terrible!!).

I just talked to her about it today when I informed her that the NVC had already sent it on to CDJ and she said that it was a mistake because we hadn't submitted anything. Again I told her that we didn't need to and she said she would look into it. UGH.

Does anyone know how to navigate the website to schedule my interview? I put in his passport number and DOB and the case number and it let me in to the account, but no where shows me a link to schedule an apt. I found a link that led me to a "scheduler" but it required a username and password which I definitely dont have yet.... and there is no link to create a new username/pass

My fiance and I have the interview scheduled for April 17th.... we are interviewing in Juarez Mexico and having the visa sent to the DHL office in Juarez as well. Since we are staying in Juarez to wait for the visa to be in hand I am wondering how long we should stay for. I am preparing to book the hotel for our stay and I'm wondering how long we should book the hotel for. I know it varies by location and visa type but how long would you book for?

I am basically asking all of you who have successfully gone through the interview process how long it took after the interview to get the visa in hand. The hotel we are staying at does not refund for nights not used. I want to pay online before the trip to avoid international fees paid by booking there.

I knowwwww there is no set answer to my question, just asking for some experiences with this.

As another member has said here USCIS and NVC may drag this past the petition expiration date.

What I wonder here is a wedding for the girl is far more important than the male (in my opinion). It strikes me odd that she has a lack of family in the USA and she wants to get married there.

I can see in the IO's eyes with such extravagant and detailed photos of an engagement, why not just get married?

You want to see congressional or state representative help on this matter ASAP. You are beyond solving this by yourselves now and you need the extra help to get over the hump.

I have been being told that my case was received at NVC on 8/1 and that typically within 10-15 business days the information is all loaded. That would make for 8/15 or 8/22. Which is a lovely 45 days after my approval.

Losing hope for September interview date now :cry: Please dont make me spend my birthday alone

I was approved July 11th and we are still waiting for an NVC case number. I called this morning and the guy stated that my case is "here in the office somewhere but nothing has been processed" I asked how long that process normally takes and he stated 15 days. When I mentioned we are now on day 28... or the 20th BUSINESS day... he said "ooh... well... maybe later in the week they will have done something with it!"

This letter has caused confusion for a lot of people. Your case goes to NVC first regardless of what the letter says. As another poster said, there is currently a backlog at NVC, and cases are taking around a month to be received and entered into the system. If you call tomorrow (and talk to a person) with the number on your NOA2, they will hopefully have a response for you. Most likely it has been forwarded on to the consulate by now, and if not it will hopefully be on its way soon. Good luck!


Some instances it does get sent straight to the embassy as well.

Call NVC or DOS to get and update as to what is going on with your file.

It took a month for NVC to receive my case and another 10 days to enter it into the system to generate a new NVC case number.

There is a current backlog at NVC and it started right after the July 4th weekend.

So I was all excited this morning when I checked the status of my package and said that it arrived to Texas! I checked it right after lunch sure that nothing change since it was sent to a PO Box and it was not going to be out for delivery when this message came up "We attempted to deliver your item at 10:12 am on August 19, 2011 in DALLAS, TX 75222 and a notice was left because an authorized recipient was not available"

What does that mean?? I would understand if it was sent to an actual person but it was for the USCIS and PO Box!!!


No worries. They will have someone go to the post office and pick it up.

Hmmm...

So I have the same kind of deal going.

My father is the only joint sponsor and I sent joint filed IRS tax transcripts, his w-2's and his job letter. I did not send an i864A for my mother and I was approved at NVC without any RFE's . She has not worked all of last year and was on unemployment.

Should I be ok or should I have an I-864A ready with mom's signature just in case of this scnerio? They have all the documentation I believe they would need to break the income apart as I only claimed my Dad's income on his I-864. So all the numbers on the I-864 reflect his income only.

Depends on how fast you answered the 221g. It can be as short as a few weeks to several months. Again, it depends on how fast you were able to respond to the 221g and get it back on the officers desk/hands.

Thank you for your honesty.
I already know we are up against a tough consulate. I could have filed our I-129F petition months ago but I chose to do more research and gather more supporting evidence and I'm very glad we did. Even by doing this, we are still preparing ourselves for the possibility of getting a 221g and being placed into AP.

I was simply asking a question that crossed my mind because I commonly see people going through New Delhi being asked to provide fingerprints when a name check is under review.

It's actual smart that you did. It's better than filing and then making a mad dash trying to scramble to get these documents and you and I know it's a chore to a lot of these documents in India. It really does test your patience. I'm glad my wife was doing all the leg work for those documents we needed in India as me being born and raised in the USA we are quite spoiled with the great system we have in place for most services. People don't realize how spoiled we are here compared to a lot the other countries throughout the world.

I hope you are the outlier in stats realm of the immigration process for New Delhi and can skirt through without a 221g. I wish this for everyone but we know how diverse other case files can get and how difficult they can be to decipher.

It does not matter what you do to be quite honest. The consulate will do whatever it wants to do and they will clear his name with their system. You providing documents upfront to clear his name is not beneficial to them. They have a system set in place and they will do it internally and if they need any further info they will contact you and ask you to provide those documents.

I know you want to escape a possible 221g, but you have to also consider the other aspects of your file.

This is a fiancee visa, your an interracial couple, the petitioner is female, he has worked abroad and your going thru New Delhi consulate. I am sorry you have to hear this but you already have some common 221g material for India besides his name check.

I in no way or form mean harm to you with this, but it's the reality of the situation.

I wish you the best of luck and hope you don't get a 221g during the interview.

It's a tough issue as India exclusively uses the pre-paid system leaving no monthly paper trail. In the US we are post-paid and have a monthly bill/statement at the end of the month. I am lucky that my wife's number has not changed during the entire time. She lives in a larger city from where you describing your fiancee lives so we don't have the connection issues you are having.

I would be thorough and get anything and everything you can from the US side in terms of statements and phone records. I was able to obtain T-mobile phone records when she called my cell phone so it shows her number when she called me. I also use Reliance Global Call to call India via discounted rates and they have an excellent billing statement monthly that perfectly shows what phone it is being dialed from and which number was dialed to and how long we talked. They can easily verify my number with the T-mobile statements I sent them.

In terms of India. You can have your fiancee try to contact his mobile service provider to see if they can provide past phone records. I don't know how it works in India but it's worth a shot. You just be thorough as you can from Stateside as it is much easier to obtain these records than in India.
