IR-1 / CR-1 Spouse Visa Process & ProceduresDS230 question 39 help

No need to apologize. :) Your explanation makes sense as does the example form. I interpreted it differently and was fine with my submission. While the example forms are helpful I have found some to be a bit misleading and incomplete.

If you had no problem with it, and as I am not at that stage yet (coming up though), I would be curious to see what others put. I would sure hate to get a 'stupid' RFE because I didn't put the correct information.

IR-1 / CR-1 Spouse Visa Process & ProceduresDS230 question 39 help

The DS-230 is all about the non-US spouse. So in this case the "Petitioner" would be your wife. That is how I filled in my DS-230 and had no problem.

Sorry OBX, IMO I think in this case Q39 would be the husband (Petitioner). Yes the form is about the Beneficiary (in this case his wife), but on the form, Q36 would list the wife's name & Q39 would be the Petitioner (husband). In the example forms, although it is an old form, it has the same format (Q26 & Q29). VJ Example Form DS-230

IR-1 / CR-1 Spouse Visa Process & ProceduresSpousal Visa ..people in the same situation?

So there is no point doing the K3 so glad we found this out before applying, a immigration lawyer actually advised me to do this.

 That should be your answer to getting an attorney right there (at least that one).

In all seriousness though, as others have said, if your case is straightforward then you can do this yourselves. I was really really nervous about it myself   , but over time reading VJ posts, guides, and the wonderful help from fellow VJers, I feel a little less anxious. IMO, an attorney, however, would be needed for denials and such, but one that handles only immigration.

Good luck and Welcome to VJ!

IR-1 / CR-1 Spouse Visa Process & ProceduresPOLICE REPORT-NIGERIAN CONSOLATE

Dont really have the answer to your question but please keep in mind that the police check is only valid for 3months so you might want to wait a little closer to the interview date to get that......Good Luck

Okay now I'm confused. I thought the Police clearance was done at the NVC stage for CR-1/IR-1? And the medical/immunizations are for the interview stage.

IR-1 / CR-1 Spouse Visa Process & ProceduresG-325A Employment - incomplete, unemployment and studying

The problem is that I'm currently in the US and I have sent my portion of the application to the UK to my husband for him to submit it all. It would cost me another 50 to re-send him just this page and delay our submission by a few days.

Is it really that necessary?
Thanks

I agree with you Nik+Heather. But IMO if the missing info IS on the signature page, then spending 50 more to send in complete and correct documents to USCIS is better than getting a RFE and wasting time sending back to them what should have been sent in the first place

IR-1 / CR-1 Spouse Visa Process & Proceduresquestion !!!!!!!

Come on guys, lighten up! She said that he's been coming a lot; and while some of you are still snickering, I'm sure that she means that he has been visiting her a lot. This I can relate to. I had to account for all of the times that I have visited my fiancee and discovered that in the last 3 years, I have visited her 13 times. If you ask her, she will tell you that I don't come enough. Stop snickering.

 **sorry** :innocent:

IR-1 / CR-1 Spouse Visa Process & ProceduresHow big was your ¨Proof¨ package
Well said Darnell and thekfc

Being my hubby is from a HIGH fraud country and the embassy in Lagos is known for foolishness, I felt I had to front load (heavily) our I-130 petition with as much evidence as possible. Who knows, it still may not be enough.

That said, I think Darnell and thekfc hit the nail on the head, it depends on each couple and the embassy where the interviews will be held on how much and what should be sent.

IR-1 / CR-1 Spouse Visa Process & ProceduresInterview Dates?

I think were the confusion lies is that since everyone who files for CR-1/IR1 deals for the most part with the NVC they believe that the NVC is the one that schedule there interview dates when in actuality it is the consulate telling the NVC this is the date this particular person will have there interview the NVC then sends the CR-1/IR-1 there interview date which is closer than a K-1 visa. so it looks as if the NVC are scheduling your dates meaning the CR-1 people. And it looks as if the consulate is scheduling the K-1 since we email them and they send us a date which could be 4months out. I hope you understand what I am saying. so really in my eyes the consulate is scheduling both but the NVC communicates with the consulate for Cr-1 people and let them know case is closed and you need a date whereas K-1 people we email them once our case has reached the embassy because we still have forms we need to download and take with us to the interview. I hope this makes since. Good luck!!!

Yep I'm understanding...thanks patient2010

Only diviance is that NVC Supvr said for the CR-1, they are provided a block of available dates for interviews, usually for the following interview month and NVC then schedules according to the cases closed in order and forwards your packet to US Embassy.

Thanks Rod. So in essence both NVC and the consulate schedules...NVC based on the number of cases closed and dates given by the consulate?

IR-1 / CR-1 Spouse Visa Process & ProceduresInterview Dates?
Hi everyone,

Just trying to clear up a bit of confusion for me. Although I am not at this stage yet, I was wondering who schedules the interviews...NVC or the Consulate? (for me specifically Lagos).

I have read that the K-1s get their date from the consulate, but from reading VJ and the travel.state website, I thought NVC scheduled the CR1/IR1s, until tonight when another member stated the consulate made the interview dates and it never comes from NVC. So which is it?

This is what I read on the travel.state website: Here and
Here

Thanks in advance...

IR-1 / CR-1 Spouse Visa Process & ProceduresURGENT - Advice about Divorce Certificate for I-130

Hello Everyone,

If anyone is out there and has any advice, it would be much appreciated. I am really anxious to get my petition sent in and it keeps getting delayed due to wanting to get the right information, mail, husband working late and post office being closed, etc.,

I've tried to find someone to speak to at USCIS but keep getting automated voice systems. Here's the deal.

Husband is American, I am Canadian. He is petitioning to have me move there. Our petition package is completed.

However, I am second guessing what we have is sufficient. He was married three times before me.
Currently he lives in Kentucky. Two of his marriages (the later two) were terminated in his town, so we have certified copies of his divorce certificate.

The other one took place in Florida. He has the original certificate he was given. It states the divorce took place, signed by the judge and has a ruling on child support and custody on it. However, we haven't a clue if it's certified.

So my question is: Do I order a certified copy and wait until it arrives. I obviously don't want to because I want to get this thing sent in. But I also don't want a Request for More Information thing either.

OR -

Do you think what we have for his first marriage is sufficient?

Any advice would be great or even a telephone number I could call and ask someone, if it exists. LOL

Thanks,
Shannon

I am just curious as to if all three would even be needed? Wouldn't he only need the most recent divorce decree as he couldn't have married until the previous ones were final? Just a question...

IR-1 / CR-1 Spouse Visa Process & ProceduresElectronic Filing

I just sent my I-130 on the Nov 15th still waiting for the NOA1.

Can I sent the submission form for the G-1145 E-filling notification. You know the one where they send everything to your email.

Will this be impossible because I don't have a case number yet.

And when will I get a case number? Will it be on NOA1 or at the NVC?

I totally missed sending the G-1145 with our I-130, but I was still able to sign up on the USCIS website: www.uscis.gov. Once you sign up, it gives you the option of signing up for email and/or mobile notifications. Can't tell you if it works or not as I am still waiting for NOA2, and I signed up after receiving the NOA1

I was touched on 11/02/10 how soon to expect a result? any experience of others?

Like everyone has said it varies...but I, like Markieboy received a touch and an approval in the same day.

I kinda tend to believe my "touch" WAS my approval, because I did not click on the Receipt Number link when I saw the touch date (too excited and forgot), but an hour later when I remembered to click on the number it said the same thing my email said...that it was approved.

So all that to say, maybe click on your receipt number as well as looking at the date last updated. By the way we have the same NOA1 date (6/15)....sooooooo

I was wondering when the invoices become availale to pay for the I-864 and DS-230 can I go ahead and pay them even though I am not mailing the documents in immediately (probably in a few weeks or so).

And is it better to send the documents in together or separate...or does it matter?

I just paid for the aos bill anf when i went to click on pay, to pay for the iv bill the box did not check, it said not invoiced or something, and the box to the right said something about not everyone has to pay for the IV bill? im confused about this can somebody explain this please?

Someone more knowledgeable will reply also, but mine says the same thing and that is because they NVC has not invoiced (billed) for the AOS yet. When it is ready to be paid, I believe it will allow you to check the box as well as show the amount to be paid.

Thanks everyone for your responses and advice. I have not sent in the DS-230 yet, so the information will be correct on that and I will also attach a note as you all have suggested. Calling NVC is not a bad idea either. I will do that tonight when I get home (hopefully I can get through).

@Tero: Is there a reason I should call USCIS? I am out of that stage now...I'm in NVC.

@MrsO.: You are correct. I (the Petitioner) filled out the info wrong on the Beneficiary's form (Doofus me...can't even post correctly in a forum, the topic description should have said "For Beneficiary" not "For Petitioner". I didn't know how to change it. :bonk:)

@Candian_Wife: Thanks...on your G-325A, how did you go about correcting that after you mailed them? Was that at the USCIS stage or NVC?

@NigeriaorBust: No I did not sign the G-325A for my hubby...we filled it out together online and I emailed the final to him, which he printed and signed. Obviously he did not catch the error either...Ughhh!!

IR-1 / CR-1 Spouse Visa Process & ProceduresWrong Birth State on I-130 & G-325A
Hello Everyone,

I (Petitioner) just found out that I listed the wrong birth state for my Hubby (Beneficiary) on both the I-130 & G-325A (I have no idea what I was thinking ).

We are still in the NVC stage awaiting for our submission of the DS-230. So I was wondering if I should try and correct both forms before submitting the DS-230 (since the birth certificate info will not match the I-130 nor G-325A) OR should I just put the correct info on the DS-230 and don't do anything with the other 2 forms?

If I should correct both forms, how do I go about doing that?

Thanks in advance.

P.S. The description is incorrect for this post (ughhhh!!!) It should say 'For Beneficiary' - not For Petitioner

That is just the receipt. You have to call NVC and see if they received all your documents or not. If they have received all your documents than they tell you to wait 6-8 weeks for interview date if you don't have an RFE. Usually it takes 8-10 business days for SIF. Goodluck :star:

My wife didn't have to pay anything for her visa after she got the approval. I believe it is like that for most consulates, but some are different. Perhaps someone else from Morocco can answer your question. Goodluck :star:
