I guess everyone going through a K1 process goes through the problem of setting a date, as nobody knows when visa'll be approved or *if* it will.

Having a wedding ceremony that is *not* legally binding before getting the visa shouldn't pose as a problem. If you're having any kind of minister involved to perform the ceremony when exchanging vows, you would have to check whether that wouldn't be considered as legally binding as per the laws in the country where such ceremony will be held.

Also, you'd have to be extra careful for the interview. If the consular officer has any reason whatsoever to believe that you guys have gotten married before the visa was approved, it would be grounds for denial. In that sense, the petitioner and the beneficiary, for example, should avoid referring to each other as husband and wife and should not provide the consular office with any evidence that would slightly give them the impression that such a ceremony resembles a wedding.


This makes me a little worried too. My fiancee and I had a traditional Thai wedding ceremony in the morning, and then later that day, in the evening, had a wedding party. Although no documents were signed at that time, I wonder if that is considered a legal marriage in her country. Will the U.S. consider it a legally binding marriage or not? Did I apply for the correct visa? K-1 or K-3? Oiy!! Can someone help to enlighten me? Please & thank you

Its allowed in 4 states . But like us, we spent over $4000.00 for paperwork to marry in France, we turned it all in, and 3 days before it was going to expire, they called us and said they needed a utility bill from me translated into French, and I was already back in states, so we could not get it done in time, so paperwork expired, and money down the drain.



wow! i think we only spent less than USD20 for the license itself. We got tired filing all the paperworks but it wasn't that expensive.
Just got shocked that some states still allow it. here in the Philippines, they made it illegal because it is one of the fastest route for slave trade, sort of like a modern version of it. Not saying this to offend anybody here. Just sharing.. you know.

If you submitted this during USCIS/NVC process you shouldn't "need" it but as with other documentation it may be wise to have it.
FYI...many at here VJ have said that CFO will ask to see spouse divorce decree.

Bring everything you sent to NVC (Original BC, MC, CENOMAR, NBI Clearance), yes... including the divorce decree (bring this to your CFO appointment). Also, if you changed your name to your married name... make sure you have TWO NBI certificate. One with your maiden name, the other with your married name (with alias of your maiden name). Not exactly an SOP but you never know... in case you meet a very ####### CO.

If you are below 21 (or 25 not really sure; check with CFO), bring an affidavit/parental consent to your CFO appointment too. There was one in our group who had to go all the way back to province and back to Manila to get her CFO just because she forgot or didn't know that they need it.

IMO don't worry about it. It can be difficult to get extra information matched up with your petition if you send it to USCIS unsolicited. If they have a problwm with it they will let you know but my guess is it will not come up. Let us know how things go. Good luck!

But in the meantime, I am trying to find out if I need to worry and try to correct the G-325a (if it is wrong...even my sister thought he was born in the state I listed :( ).

If the birth certificate turns out to be incorrect, then I will get that corrected, but should I try to send a corrected one to USCIS since they have a copy of the incorrect one? If so, how do I accomplish either, correcting the G-325a or sending a corrected birth cert?

He put NA in the adjustment of status thing too because Im not living there so there is no adjustment needed. I wish when they sent the package back they would carify WHICH question instead of just saying "section C Address"



That is a good idea, that way you will know for sure what they want. If you could please post their answer, if you get one, that would be nice as I wonder out of curiousity what the answer is, especially if they are referring to the consular post question.

Could it be they are referring to Question #22, "If your relative is not eligible for adjustment of status, he or she will apply for a visa abroad at the American consular post in"??

This was confusing to me because the question above states, "Your relative is in the United States and will apply for adjustment of status to that of a lawful permanent resident at the USCIS office in". For us this would be N/A. But according to the sample guide, the question below that had the consular post name typed in.

I was with my husband for two weeks, but the last address we lived together would be N/A or None...IMO two weeks is not living together.

Perhaps someone else with more knowledge can respond, or maybe call USCIS and ask?

Sorry, this is sometimes a trick question. Even if they are not your "blood" they are your husbands true children, you must include them on form.

In reading the various posts, on how people filled out the Form I-130, and what items are missing or what should have been answered; and comparing to my form, I realized on the above question, I (USC citizen)answered with my name but left off my children, which would be my husband's (beneficiary) stepchildren. :bonk: :angry: :blush:

My question is...should I worry about this, try to fix it (if possible), will this cause a RFE once I have to fill out the I-864? Any suggestions?

Thanks Skynaut...but I believe there are already threads for May and one for June (I'm in this one), and in my opinion it's best to keep the different filings separate (for CR-1/IR-1 & K-1) since they are different and it might confuse people since different forms, etc. have to be filed for each.

Maybe someone more experienced can comment...If not, well I be posting updates here :whistle:

Unless VJ want's to restrict everyone from offering advice unless we meet some sort of prequalification, we just have to expect that some responses will be bad advise... However, people can and do benefit from VJ in a HUGE way.. I won't be the only once who'll say this, but for me, there is no possible way I would have gotten as far as I've gotten without the help of all of you.. I am extremely grateful for this forum... Everybody's case is unique. We sent only the copies of everything including Affidavits from third parties while submitting I-130. We didn't have any RFE. However, at NVC stage, we provided all the originals (except beneficiary's passport) and got everything back after the Consulate interview. NVC will forward ALL originals to the Consulate. But I don't think USCIS will forward originals to NVC after I-130 approval. In their instructions, it says USCIS may keep the originals in their record, if you send the originals. It will be pain to contact them to collect the originals back. But, I think there is an option to request the originals back if you contact them.

Again, copies are enough. But if you have more than one originals of the same event (eg: marriage), you may send one of them.

Yep, I used the biggest I could find because like you the logs were really thick, and I also didn't like the idea of 2 hole punching for the ACCO fastners. Sometimes, in my experience anyway, when you 2 hole punch it punches through whatever writing is at the top of the document.

I really need to chill about putting this package together...however, couple of trivial (or maybe not) questions.

1) Do I have to include original witness affidavits attesting to the relationship or can I send copies? I'm afraid USCIS will lose them or something and then I'll just be left with copies. But if they need the originals, that's what I'll send.

2) How did you experienced folks organizing your I-130 package? I've got several sections of evidence compiled, but it seems I should staple them together in separate sections so it doesn't get all scattered when USCIS starts ruffling through it. Did you I-130 veterans use staples or paper clips to hold related stuff together? Or did you just stack it all up and put it in the big envelope loose?

Sorry, if these seem like dumb questions. I've gone over this stuff 200 times and I still keep thinking of things and finding things to fix. This stuff puts filing taxes to shame.



1. Unfortunately I sent my original affidavits, thinking that the notary seal had to be original :angry: , but I believe supporting evidence only have to be copies. See the Guide for CR-1/IR-1 here: CR-1/IR-1 Guide

2. No staples. Use binder clips or ACCO fastners. I also put tabs at the BOTTOM and labeled each section (tabs of course were on blank page separators).

I am sure more experienced members can give you more information.

I suggest that you look for more advice, because even if most of the help you have gotten here says otherwise, I would tread carefully here. During my interview the IO asked if I had children abroad, by other women, in "any part of the world" (quote). If you get the same question, and you happen to say yes, without it being in the application, it may sound fishy to the IO (not to mention you are under oath when interviewed). My IO went over each single form with me and my wife, one question after another.

Remember that as a resident, you are expected to comply with certain morale obligations, like child support, regardless of his/her location. Also, this should also be on your family budget, raising the bar on your obligations as far as income is concerned.

Not saying to omit your child, nor document him/her, instead look further into this before you make the call.

PS - I am the beneficiary.

Okay, if I am understanding everything correctly myself, fellow VJers please correct me if I am wrong...The only person(s) you need to list on the form are the Petitioner (you-because you are now the beneficiary's relative) and any children of the Beneficiary (your current wife) and/or children you may have had together.

Even though your child lives with your Ex in Russia, he/she would still be considered your current wife's stepchild, but that child would not be listed on the form since the natural mother is someone else (your Ex).
