Thanks for the update Gary. I've updated my trends sheet I derive from your data.
Looks like July ruled for last week, with even August receiving 8 approvals.
I know I'm one of these, but I don't feel it's right. I know if I was a petitioner from March, April, May or June I'd be really upset.
What do you mean in your sig?
I presume you're referring to the Chinese Characters.

This is the translation from the lame sites that offer this service. "I love me the baby, I thought of I the baby, I kisses me the baby, hurries the California service center to be supposed to die."

If I remember correctly what I wanted translated was;
I Love My Baby, I Miss My Baby, I Kiss My Baby. (I really don't remember what I was saying referring to the CSC) But it boiled down to Hurry up CSC.

I guess I could change it now simce I've got my NOA2 now.

I'd convey to Mr. Porter that petitioners from CSC need someone of prominence and power to kick some but and get them rolling. If they need more help, by all means get it for them. Mention how their approving petitions out of order. They need to start following a systematic practice of approving the older NOA1 dates first.

K-1 Fiance(e) Visa Process & ProceduresK-1 and Joint Sponsors question about unemployment

Your joint sponsor has to understand that by agreeing to be the sponsor, they accept responsibility for your fiancee for a period of 10 years. This is the length of time it was explained to me that a sponsor is responsible for the immigrant applicant. This is of course assuming that he/she marries and stays in this country with the K-1 visa and later AOS. So, your sponsor needs to be aware of this huge potential commitment.

As to being unemployed, that is not likely to have a bearing as long as the other sponsor has the ability to pay. But, it is normal that they would ask how you plan to support your spouse and you. Often times the applicant is still in school or between jobs. This is one reason for the need of an additional sponsor.

Discuss with your sponsor first, then proceed, if everything is clear to all parties.

Yeah my joint sponsor is my brother. He very well knows he is obligated to support my fiance no matter what. Thanks for your help it's really appreciated.

K-1 Fiance(e) Visa Process & ProceduresK-1 and Joint Sponsors question about unemployment
Me and my Fiance were orginally going to file for a K-3 visa through DCF. With the new law that came into effect K-1 seems like a better option for us. Information about joint sponsors is really sketchy for k-1 visa's. So here is my question that I hope someone can answer.

I am currently unemployed and have been unemployed for 2 years due to personal reasons. I have a joint sponser that makes very well over the poverty line. If I am unemployed but have a joint sponser. Will me being unemployed affect the decision for apporval? I know it doesn't matter for the K-3 visa, but like I said K-1 seems a little more sketchy. Thanks so much!

K-1 Fiance(e) Visa Process & ProceduresWelfare question
I am not on welfare nor have I been past the age of 18. But my mom was on welfare and listed me as her dependent under the age of 18 where I recieved a medical card and such. This doesn't count as me being on welfare correct or have been on welfare? Like i said I have never been on welfare on my own. Anyone know?

K-1 Fiance(e) Visa Process & ProceduresTax forms and bank accounts

I am not really sure about this. Me and my fiance' will be filing for the k1 visa and I know the tax papers don't come until down the road but I want to be prepared.

I am currently unemployed and have been for 2 years. Although I will have a job in 3 months when I return from Denmark from visiting my fiance'. Since I don't have proof of 3 tax years what do I do? Also my bank account will be positively abysmal!

I have enlisted a joint sponsor (which I obviously need) but he doesn't have a bank account. But he makes enough to support 5 people if he wanted. Any suggestions on that? And also what tax forms does he need? It's a tad bit ambiguous to me. There are different tax transcripts you can request.

Any help would be wonderful! Thanks so much!

You definitely need someone to sponsor you and the beneficiary. The sponsor will probably be required to show the most recent years tax return, possibly the most recent 3 years tax returns & W-2s. The different Tax transcripts are based on what the sponser filed. If he filed 1040EZ or 1040 or 1040A, he should know and that's what he'd request. It's hard to believe that a person earning $24,130 (poverty level for 5) has no bank account.

Make sure your Fiancee knows and understands your financial situation before she moves to the US. A problem with finances can often take the life out of a relationship by the stress it creates. She will already be trying to adapt to life in the US. You add in no money to do anything or to go anywhere and all of a sudden, life in the US is not a pretty picture. Talk to her.

2007 Poverty Guidelines

Wow I was off on how my much my sponsor can support. My sponsor is my brother he earns 34k a year he has no problem whatsoever sponsoring my fiance'. He doesn't believe in havinga bank account for some unknown reasoning. But it's his choice and it is what it is. Thank you for your advice it was much needed and very kind. I am very thankfu you took the time to answer me.

But it's for lack of doing so that I don't have a job. It's because my parents on their own a very well off and I didn't need a job they supported me. So there won't be a financial situation when he comes here. I just need to make sure I can get him here with what I have to prove. Thank you respectively. But you aswered something that didn't pertain to my questioning and kinda made me feel bad.

K-1 Fiance(e) Visa Process & ProceduresAny go through the WHOLE k-1 visa process without a job?

Dont have any advice, just empathy! I've got to do the same thing. Med school = no job :-D Thank God for Co-sponsors!!! Good luck to you in the K-1 and job hunt!

Thanks so much! It seems like a lot of people have really busy schedules when they start this process and it's just hard to do both at once which is why I am waiting to start school. Lol I just get stressed so easy. Good luck to you as well!

Neither of us are employed, both students, and upon a successful petition, will move back to the states when I graduate (after July 07). Obviously we do not have an income and have a 2 willing co-sponsors in the US (her parents) who are willing to suply us with as much info as needed. As one parent is self imployed we are getting tax returns/reciepts and W2's for the last 3 years etc.

As long as you have a co-sponsor you will be fine. As long as he can supply W2's and tax returns for the past 3 years I believe....

I am glad I am not alone in my situation ( I knew I wans't) but it's nice to hear it from someone else. Thanks for the help!

K-1 Fiance(e) Visa Process & ProceduresAny go through the WHOLE k-1 visa process without a job?

okspider,

All you need is a co-sponser to satisify the Financial support part of this process and you have that. As long as you can show to the consulate that the beneficiary will not become a "Public charge", you are OK. So start putting together some recent photos together and proof that you have met in person in the past 24 months and get that K-1 subimtted!

Thank so you so much! You are so helpful.

K-1 Fiance(e) Visa Process & ProceduresAny go through the WHOLE k-1 visa process without a job?
I am unemployed. I have been for 2 years. I worked at a video store for 2 years prior to my unemployment. I unfortunately started getting such bad stress I quit my job (well jobs) because I had 2 at the time. My mom said she would take care of me and get me destressed and I didn't have to work. Well I didn't know 2 years would go by without me having a job. I tried to get a job for like 6 months but noone wants to hire someone who didn't finish school. But my mom could support that wasn't a problem.

I met Thomas when I was 15 almost 8 years ago. We have talked almost everyday for 8 years. And within the past 2 years fell in love, met eachother, got engaged. (still I have no job) We were going to do DCF but since that law changed everything we can't. I had my plane ticket and everything to Denmark.
So we found out we couldn't do DCF in Denmark we decided to go to the next plan. Which was a k-1 visa. So my worry comes down to what a lot of people seem to worry about the I134. I can't get a refund on the ticket nor do I want to so I am going to Denmark march 28th. which stops me from trying to get a job sooner and that's fine.

So back to my worry on the I134. I obviously need a co-sponsor (I KNOW THIS) and I have one it's my brother and he makes 34k a year as a construction site manager. He has no bank account for some reason but he can get everything he needs other than that. I know there is a commitment he is making and he knows that. He knows the left the rights the ups downs and sideways. My fiance is ALSO aware that I have no job and isn't concerned because he will be working with my brother and when he gets here I will be starting school.

So there is my story from then till now. And here are my questions.

1.) Has anyone gone through the k-1 visa unemployed or extremely small income and can offer me advice? ( I already have a joint sponsor who makes 34k)

Any advice would be wonderful from anyone who has gone through the no employment thing with the k-1. This is the most helpful forum there is! Thanks so so much for even looking.

K-1 Fiance(e) Visa Process & ProceduresI-129F questions

My other question is about the G-325A forms. Many of the fields were not large enough (I filled them out on the computer) and for the Country on some fields (I put "United States of America") would not fit, and there is a tiny "+" sign at the end...
Also, when I enter "N/A" for the "year" fields, "0000" shows up instead. The computer does this automatically. Will this be a problem when I submit my forms? They appear on my fiance's forms also, and it will be difficult to have new forms completed and signed by her.

Thanks!

Mine did the exact same thing!! So I just filled in what I could with typing (completely avoiding those number slots) and filled in the rest with black ink. Yes it's more tedious and annoying. But that's what I did.

K-1 Fiance(e) Visa Process & ProceduresEvidence of Support and interview

Hi Folks,

My fiance' and I finally have our interview scheduled for Feb. 28 2007. We have all our our information ready to go after reading these forums over the last few months. Thank you for all the good advise during our journey. I have a question regarding evidence of support. I have been a US Postal employee for 19 years. I can not find any W-2's or tax returns. I have moved several times and seemed to have placed them where I cant find them or threw them out in error. Anyway, I do have several Social Security earning statements, a letter from my employer, as well as all my pay stub's. Do you think this is sufficient as "evidence of my income" or will they reject us simply it isnt on a W-2?? Thank you for the replies in advance.))

You can get transcripts of your income taxes and w2's from the IRS. The FAQ guide says last year but you can get them for the past 3 years just go here: http://www.irs.gov/faqs/faq1-6.html

K-1 Fiance(e) Visa Process & ProceduresI-134 Questions
ok I have posted a similar question about this but I want to try it again.

I have no job right now. I should have a job when we have our k1 interview. I have a co sponsor.

I contacted the Embassy in Copenhagen and asked them if I needed to file the 1-134 as well and they said I do. SO here are questions.

When I compile my 1-134 documentation, should I include my bank account statement for the past year and transcripts for income tax and w2's eventhough I haven't had a job for almost 2 years? I am thinking I should include everything eventhough I can't prove I have sufficent income.

And lastly my Co sponsor DOES NOT have a bank account or any assets. But he makes 34k a year and can provide the letter from his employer and his copies of his income tax and w2's for 3 years. Will this be enough?

Thanks!

K-1 Fiance(e) Visa Process & ProceduresI-129 F Question
I have read a lot of peoples checklists on here. One I came across was this one

http://www.visajourn...129f checklist

she seemed to have a good grasp on the whole process. I did notice that there wasn't proof of an ongoing relationship. So my questions are:

1.) At this point in filing do I need to send proof of an ongoing relationship (like letters, e-mails blah blah)or is that saved for the interview part.

2.) And is her checklist a good one to follow?

K-1 Fiance(e) Visa Process & ProceduresCan middle names mess up the FBI name check?

Hey guys, a question, when I filed my K1 I wrote down that my Fiancée’s middle name was Yurievna, which in Russian is the equivalent of putting her dad's name, Yuri, with the last part to make her middle name, which isn't really her given middle name at birth, just a Russian/Belarusian tradition, and everyone there has one of these middle names. Do you think that this type of middle name would screw with the process?
Thanks

A piece of advice - relax and TRY to stop thinking of what can/might go wrong. If something is not right, they will let you know. Unless they have already informed you that your petition is in an FBI name check (rather unlikely at the phase in the process) there is zero reason to even go down this path in your head!!!!!! Really, you are gonna make yourself completely crazy if you keep coming up with what ifs . . .

Great answer. This process can make you crazy at times

K-1 Fiance(e) Visa Process & ProceduresAnother slow week to come

Right on, I just called the USCIS phone # and they stress that they process forms in the order they were received...HAHA! I know that all of the petitions are different from each other, but still I don't understand how mine can be that different that they just leave me behind! Man, all i see is other people with later dates then mine getting approved, and it is pure torture!! Iam so tired of that! But of course I will continue stress over the unknown and wait some more.

Don't let this process drive you crazy if you can. You have just begun to wait. Don't worry things will pick up and then they will slow down and pick up again. It's one of those things that is out of your conrol however as with anything with life if you show some patience this too will pass. Cheer up and hang in there :star:

K-1 Fiance(e) Visa Process & ProceduresFiance's visit

On the topic of being able to show evidence of "strong ties" to the home country... What if I have none? I've read what sort of proof is required and can't seem to find something I could show. Here's why:
Most of the time, people (like in this topic, but pretty much everywhere else) will suggest to bring proof of having a mortgage, a rent, a job, or studies. So, in that order:
- I live with my dad, meaning I do not have a place of my own (= no mortgage, no rent, etc.)
- I don't have a job, meaning no employer who can vouch for me.
- By the time I'd like to go visit my fiancée (I am the foreign fiancé), I will have graduated from college, meaning my school could not vouch for me either.
So what's left for me?
Here's what I've thought of:
- Recent bills from my cell phone operator
- Recent bank statements
- Recent credit card statements
- A return ticket, if I can even get one! In the era of online reservations and electronic tickets, all I have on me until I check in at the airport is a stupid email with my flight plan... I haven't held a plane ticket in years, except when handing it to the lady at the boarding gate.
- Letters from family and friends stating that... they exist?
- A statement (written? is verbal enough? should I bring a copy of the NOA1 or 2 if I already have those?) that I'm currently going through the process of obtaining a K-1 visa, that I know about it and that I know I must return to my country for my interview at the US embassy, and that's just what the plan is?
So, yeah...

Anyway, I have to ask: isn't this whole stress over the POE blown a bit out of proportion? I went to the US several times before and never had anything remotely close to a problem. I often went with my parents in the past and I doubt they ever brought any evidence of strong ties to the home country with them. Last time I went (alone), I even told the officer that I was visiting my girlfriend when asked about the purpose of my visit, and he didn't say anything and just let me through without a hitch. Maybe I got lucky all those times? My POE was (and always will be) Philadelphia, if that makes a difference, and I travel with a Swiss passport.

The difference is that you're Swiss....we haven't had a whole lot of problems with the Swiss trying to pour into the U.S. - illegally or otherwise. It is different when it comes to the MENA countries as well as others like Mexico and Latin America. Due to the surge in illegal immigration from these countries it is difficult to obtain a tourist Visa to the U.S. But Europeans, at least as far as I know, are still able to qualify for tourist visas without much difficulty.

K-1 Fiance(e) Visa Process & ProceduresFiance's visit

I have already applied for the I-129F. Now I am wondering if it is possible to bring my fiance to the US as a tourist to stay here until our visa comes through...can he transfer and do the interview in the US without going back?
Thanks.

Not in a million years....they will laugh you out of the embassy (I know because my fiance and I tried the same thing.) It's the curse of being Iraqi in this day and age....they will barely allow my fiance into Jordan anymore. I went to Jordan for a few months so that we could be together but then came back to the U.S. and we are waiting out the rest of our Visa processing time apart. Going on 6 months since I saw him :(

K-1 Fiance(e) Visa Process & Proceduresfrustrating situation...can anyone help?

Well, hopefully the fact that he worked for the US government will at least help him to get approved without them thinking he's just a terrorist. My fear is they will think Robin (my fiance) is a terrorist and not allow him in. My goodness, he's as far from a terrorist as you could possibly be.

And what's this incompetency thing?! That's an odd question. Why do they want you to say you are incompetent? Maybe they think you will be brainwashed more easily--ha.

It would seem it would be more difficult for someone from Iraq to enter the country than someone from Pakistan. With that said, I got a response saying the Pakistani embassy is difficult and that I should go the marriage route. What are the disadvantages of going the marriage route rather than the fiance route?

It's also comforting to hear from an American that it's not as bad as we make it out to be over there. Robin tries telling me that I'd be safe, too. I suppose I should trust his judgement because it's not like he wants something to happen to me. How do I go about getting a tourist visa to Pakistan?

I really do appreciate all your help. I'd love to hear your results for your fiance. Keep me updated!

Try not to worry about them thinking he's a terrorist.....Mid-Eastern males are approved for Visas all the time.....the number one reason for denial is lack of proof of a significant and lasting relationship. I've heard bad things about the Pakistan embassy as well :( I read about a girl who's fiance's visa was in administrative processing for 10 months.

I'm not sure, but you probably do not need to aquire a tourist visa before you go. Most places allow Americans to enter with their American passport or, like Jordan, you simply purchase a visa at the airport when you arrive for about $20. Check the U.S. embassy website in Pakistan, it will probably tell you what you need to enter Pakistan.

K-1 Fiance(e) Visa Process & Proceduresfrustrating situation...can anyone help?

Oh my. Thanks for the information. I appreciate such a thorough response. I can imagine how you feel. Although I understand why such care is taken when deciding who should and shouldn't come, I wish prejudices didn't go along with that. Although I wish this stress on nobody, it's nice to have someone else understand where I am coming from. How did you meet your fiance?

I have thought about going to Pakistan for a visit. However, I am a bit fearful. My sister did say she would go with me, though. Now it's just a matter of saving money for the trip. :) I suppose we could establish paternity that way.

When you began the application process, what forms did you turn in? I have the I-129 application and I understand the paperwork I need to turn in with it. But, are there other forms I need to turn in with it?

Thanks again for such a prompt response.
I hope all goes well for you!

You're welcome......It is sad that prejudice is part of the game today, but I am doing my best to be understanding. I met my fiance while I was stationed in Iraq with the military. I worked directly with Iraqi civilians and he was my personal translator. He has been working with the U.S. military/government as a translator ever since the war started. He's done everything from go out with the Marines on raids to translating for government officials in meetings. Since he has done so much to help the U.S. cause in Iraq I of course feel he should have at least a LITTLE bit of preferential treatment when it comes to getting his Visa but the U.S. government obviously doesn't see it that way....LOL. We are waiting as long as everyone else.

I've never been to Pakistan but I flew to Jordan on my own to see my fiance last summer. The entire Middle East isn't the backward barbaric place that the U.S. media has it made out to be, but if your sister is willing to go with you it would definately ease some of the tension.

As far as forms are concerned, I just downloaded the I-129F packet from USCIS.gov and filled out all of the forms. You can actually get the fillable PDF forms so you can type in the info - I did this because it just looks more professional. Just get all the form numbers and do an internet search such as "fillable PDF I-129F" etc... Also be sure to include as much proof of a relationship as possible. I sent plance ticket stubs, hotel receipts, printouts of emails and IMs sent between my fiance and me, phone records and photos. Just give them so darn much proof they CAN'T say no! I put everything in a three ring binder with page covers. It actually looked like a nice scrapbook and I was almost sad to have to mail it off and never see it again. Be sure to keep copies of EVERYTHING you put into the packet in case it gets lost in the mail or the service center loses it - God knows they don't all have the brightest of individuals working for them. Having worked for the government, I know that one of the first questions asked of government civilian employee candidates at the job interview is "Are you incompetent?" and the answer they're looking for is "yes".

Good Luck

K-1 Fiance(e) Visa Process & Proceduresfrustrating situation...can anyone help?
I feel for you Sherry and I know what you are going through. I am 7 months pregnant and anxiously awaiting the arrival of my fiance - if you think Pakistan is difficult, my fiance is Iraqi. We have been going through the Visa process for over a year now but are in the final stages. There is typically not much difference between the fiance (K-1) or Spouse (K-3) as far as waiting times are concerned - but I have noticed the I-129F (the fiance petition) being approved through the service centers here int he U.S. more quickly then the I-130 (spouse petition). My petition was approved here in the U.S. and the case was sent to the U.S. embassy in Amman, Jordan in less than two months. It's waiting for the Visa interview and then the administrative processing after the interview that is the time consuming part of the process.

The fact that he has a daughter here will most likely do nothing to expedite the process. I am pregnant and due March 16th and the powers that be seem to care less whether or not my fiance makes it before his daughter is born. The fact that he has a daughter here though will help when it comes to approval of the petition. It is obvious that you two have a real relationship and are not marrying solely for immigration purposes - so be sure to provide as much proof as possible that he is the father of your daughter - I'm sure you haven't had a paternity test but do the best you can. Even pictures of the three of you together will be beneficial. Maybe go over for a visit, keep all records (plane tickets, hotel receipts, photos, etc...) then file the petition when you return.

Hope I was able to answer at least some of your quandries...keep your chin up....lots of people here have been through it or are going through what you are dealing with now - so remember you are not alone.

Good Luck!

K-1 Fiance(e) Visa Process & ProceduresAnyone one else hear this?

I refuse to buy that BS. I am more convinced now, that they know not what they are doing there. Pitiful!

They, just like any incompetent employee, will only give excuses why the job is not finished yet.

K-1 Fiance(e) Visa Process & ProceduresFINALLY NOA1....now what?

I will tell you now what...since you have filed with the CSC, you can now sit on your thumbs and get frustrated like the rest of us while VSC customers get their petitions approved in less than 30 days.

Amen to that, I get frustrated seeing all the petitions filed through Vermont, moving at light speed, but the ones in Cali. are stagnant, in fact they have moved their processing dates back. #######? Do they just have a back-log from an unrealistic workload, or what?

K-1 Fiance(e) Visa Process & ProceduresSetting a Date?

I guess everyone going through a K1 process goes through the problem of setting a date, as nobody knows when visa'll be approved or *if* it will.

Having a wedding ceremony that is *not* legally binding before getting the visa shouldn't pose as a problem. If you're having any kind of minister involved to perform the ceremony when exchanging vows, you would have to check whether that wouldn't be considered as legally binding as per the laws in the country where such ceremony will be held.

Also, you'd have to be extra careful for the interview. If the consular officer has any reason whatsoever to believe that you guys have gotten married before the visa was approved, it would be grounds for denial. In that sense, the petitioner and the beneficiary, for example, should avoid referring to each other as husband and wife and should not provide the consular office with any evidence that would slightly give them the impression that such a ceremony resembles a wedding.

This makes me a little worried too. My fiancee and I had a traditional Thai wedding ceremony in the morning, and then later that day, in the evening, had a wedding party. Although no documents were signed at that time, I wonder if that is considered a legal marriage in her country. Will the U.S. consider it a legally binding marriage or not? Did I apply for the correct visa? K-1 or K-3? Oiy!! Can someone help to enlighten me? Please & thank you
